- This is a letter to Robert P. Dick, a U.S. District Court Judge in western North Carolina, from James W. Terrell and Thomas D. Johnston, dated November 15, 1879. The letter contains a report relative to a law suit brought against William H. Thomas and others by the Eastern Cherokees. The report concerns expenditures claimed to have been made by Thomas and his associates while in the employ of the Eastern Cherokees. The suit was filed by the Cherokees in order to gain money and land that Thomas had secured for them but was lost to Thomas' creditors after the Civil War.

We have again to express our regrets at the tardiness, of the Indian Department, of the General Government, in not sending an Inspector, some person duly authorized to recieve [receive] lands for the Indians, to supply the deficiency, which the survey of
1878 showed, in the deed made by us,
Oct 9th 1876 A letter received in
September last, from the Commissioner of Indian Affairs, in reply to one from us, informed us, that an Inspector would be sent to this Country, against the
15th of the past month, but he failed to come, and since the reception of that letter, we have heard nothing further from the Department.
We have, all the time, been prepared to

consummate our part of the agreement, by transferring such lands, as might be selected, to discharge in full the judgement against Thomas, but this neglect on the part of the Commissioner of Indian Affairs has [unclear text: presented ], much to the damage of said Thomas estate, and to the great annoyance, of the undersigned, who are anxious to close up this business, and have been urging the Department at Washington to do so.
