March 15 1839

In the name of God Amen!

I Eli Rushing being of
sound mind and perfect memory, thanks
be to Almighty God for the Same, and calling to
mind the uncertain estate of this life and that it
is appointed once for all flesh to die, I do therefore
make ordain & constitute this my last will and
Testament in manner and form following first
I Will that all the debts that I owe in right
or conscience to any person or persons whatsoever
to be well & truly satisfied by my Executor & Executrix
hereinafter named
Imprimis - I Give & bequeath to my wife
Elizabeth Rushing, all and every part or parts
Of my estate both real & personal that I have never
given away and all that I may hereafter hold
& possess to the day of my death. And after the
death or intermarriage of my wife Elizabeth Rushing
if she should intermarry the property shall then
both real & personal be equally divided amongst
my Lawful heirs. And moreover I do hereby
appoint my trusty friends John Rushing & David
Avera Executors & Elizabeth Rushing my wife Executive
to manage and carry into effect this my last
Will & Testament till it be published after my death
