This indenture made this the Eighth
day of April in the year eighteen
hundred and fifty eight between Clement A. Evans
and Robert W. Walton duly constituted administrators
upon the Estate of James H. Walton deceased
of the one part, and Peyton D. Hill Trustee of
Mrs. Mary A. Evans of the other part, all of said
State and County, Witnesseth, that whereas by virtue
of an order granted by the Ordinary of said County
previous notice of application having been given
arguably [?] to the Statute in such cases [?] made and
provided to the said Clement A. Evans & Robert W. Walton
administrators as aforesaid to sell the negroes belong-
ing to the Estate of said James H Walton deceased, and
the same were advertised in Conformity to law there
being among said negroes one negro boy by the name
Levi of dark complexion and about nineteen years
of age, and a negro girl, by the name of Harriet
and about Twelve years of age, the said two
negroes were put up and exposed to sale, separately
at the Court house door, at Lumpkin in said
County, between the legal hours of Sale on the first
Tuesday of this present month of April by the said
Administrators, when the said Two negroes were knocked
off to the said Mary A. Evans, through her Trustee the said
Peyton D. Hill, at the sum of Eighteen hundred and
forty dollars, that being the highest bid. Now for
and in Consideration of the said sum
of Eighteen Hundred and forty dollars
paid to the said Clement A Evans & Robert W.
Walton administrators aforesaid at and before the
Sealing and delivery of these presents
the receipt whereof is hereby acknowledged

the said Clement A. Evans and Robert W
Watton administrators as aforesaid hath
granted, bargained and sold, and by these presents
do grant, bargain and Sell, unto the said Peyton
D. Hill, for the sale and separate use, benefit and
advantage, in trust for the said Mary A. Evans
feme covert and wife of the said Clement A. Evans, The
Children she now has, and those she may hereafter
have by her present husband, the said two negroes
Levi, a boy of dark complexion aged about nineteen
years, and Hannah a girl of yellow Complexion
aged about twelve years, To have and to hold the
said Two negroes unto the said Peyton D Hill, in
trust for the sole and seperate use, benefit and behoof
and in trust for the said Mary A Evans wife of said
Clement A. Evans and the Children she now has or
Those she may hereafter have by her present
husband (free from the debts, liabilities and control
of her present or any future husband) forever in
fee simple.

Robert W Walton hath hereunto set their hand
and affixed their seals this day and year above
