Whereas, By an act of the thirty-third Congress of the United States, Second Session, chapter two hundred and four, Section third, the sum of forty two thousand two hundred and ninety dollars and Sixty nine cents is appropriated for the use and benefit of the Cherokee Indians residing in the State of North Carolina, and embraced in the role of John C. Mullay, the payment of which is dependant on the consent of the State of North Carolina that such Indians may remain permanently in the State.
Sec. 1. Be it enacted by the General Assembly of the State of North Carolina, and it is hereby enacted by the authority of the Same, That the Cherokee Indians, who are now residents of the State of North Carolina

shall have the authority and permission to remain in the several counties of this State where they now reside; and shall be permitted to remain permanently therein so long as they may see proper to do so, anything in the treaty of eighteen hundred and thirty-five to the contrary notwithstanding.
Sec 2. Be it further enacted, That this act shall be in force from and after its ratification.
