Sir,
We are informed that Nathaniel Peak, one of the No [North] Carolina Cherokees, entitled to the benefits of the 4 section of the Act of Congress of
25 July 1848, has made application for the payment to him of the [unclear text: amount ], allowed by said fourth section, with [deleted text: the view ] [added text: a purpose ] of defrauding the [added text: undersigned ] and William H Thomas Esq [Esquire], of No [North] Carolina, of the commission due them [deleted text: & said Thomas ] for their services in prosecuting the claim allowed and ordered to be paid by said act.
Mr Thomas holds a power of attorney from said Peak [added text: & other beneficiaries of said act ] to receive and receipt for the money, for which he, Peak, now makes application; which power of attorney was given in, or before, the year 1841, and was intended by the parties as a security; in the nature of a [unclear text: lien ] to the said Thomas, for his commissions & expenses in prosecuting said claim, and for advances of money previously and since made by Thomas [unclear text: W ] Peak, and was, by express terms therein contained, made and declared to be irrevocable.
We have therefore to request that you will place on file this, our protest, against the payment of

the arrears of interest, allowed by said [deleted text: act of ] fourth section of the Act of
25 July 1848, to said Peak or to any other person than the said William H Thomas: and also to request that you will forward to the Hon Secretary of the Treasury the enclosed communication, and meanwhile suspend all action in the premises until the decision of the Secretary [unclear text: thereon ] shall be first made known to us.
