This indenture made concluded and agreed upon
November the thirteenth one thousand eight hundred and forty between George Mingus of the county of Haywood and state of North Carolina of the first part and William H. Thomas and Allen Fisher partners in trade of the same county and state of the second part witnesseth that the said George Mingus for and in consideration of the sum of two hundred and sixty dollars to him in hand paid by said Thomas and Fisher before the sealing and delivery of these presents the recipt [receipt] and payment whereof is hereby acknowledged have bargained sold aliened enfeoffed conveyed and confirmed and by these presents do bargain sell alien enfeoffe [enfeoff] Convey and Confirm to said Thomas and Fisher the following pice [piece] or parcel of land situated in said County bounded as follows, part of the lands acquired by treaty of the Cherokee Indians Concluded in the year
1819, in the District no 3, Tract no 9 Beginning at a red Oak On the north East [northeast] Corner of no 8 running thence fifteen East one hundred and five poles to a sower wood [sourwood] thence south eighty four East seventy poles to a Hickory thence south twenty six East sixty three poles to a post oak crossing Broadaways Mill creek at the distance of eight poles thence South forty five west One hundred and twelve poles to a spanish Oak the corner of no 8 thence north forty seven west sixty three poles to the beginning sixty five and One fourth acres be the same more or less with all the woods ways, waters, Mines, Minerals or appurtenances thereunto belonging or appertaining to have and to hold to the said Thomas and Fisher their heirs and assigns from said George Mingus his heirs and assigns forever. And the said George Mingus for himself his heirs and assigns do warrant the title of the said bargained premises to the said Thomas and Fisher their heirs or assigns against all lawful Claims whatsoever.
