- This is a letter to Elbert Herring, Commissioner of Indian Affairs, from John F. Schermerhorn, dated July 4, 1836. Schermerhorn says that after the Treaty of New Echota (1835) was concluded, he asked local merchants to supply the destitute Cherokees with provisions because they were on the verge of starvation. Schermerhorn requests that the U.S. reimburse these men for their supplies as stipulated by the 18th article of the treaty.

Sir
Before I left the Cherokee Country; and after the Cherokee treaty was Concluded. Knowing the very destitute Condition of the Cherokees and their suffering need of provisions I requested some persons Whom I knew were able to do it, to supply the poor and destitute with provisions to keep them from starvation I requested particularly Col A. R. S. Hunter of Huntington NC, Mr. Rogers the farther [father] of Wm [William] Rogers, One of the Cherokee delegation from the Chattahoochee in georgia; and Mr. Wm [William] H Thomas, of Haywood NC to render the Indians in their vicinity every necessary [added text: aid & ] assistance; and I [deleted text: presumed ] [added text: assured them ] they would be paid by the government a fare [fair] price for the same Out of the money provided for this purpose by the 18th article of the treaty. I trust therefore that the government will give the necssary [necessary] directions and instructions to their agent entrusted with this business, to allow and pay the accounts of those gentle men [gentlemen] for the provisions they have furnished according to my request, and at such a price as the Other Contracts are made for Corn.
