- Petition dated April 1799 from sundry inhabitants of Jackson County (Georgia) to Governor of Georgia James Jackson (1798-1801) respecting the case of William Hodge, indicted for horse stealing. The petitioners request that the Governor pardon Hodge since the horse(s) in question belonged to an Indian. The petitioners reason that since the complainant was not white, the thief should not be punished. Among a number of signatures is that of Augustus Christian George Elholm, former Adjutant General of Georgia. Horse stealing
To his Excellency James Jackson Governor etc. in and over the State aforesaid
The petition of your subscribers respectfully sheweth That whereas the exemplification taken from the records of the aforesaid Court and which [added text: will ] be accompanied herewith will exhibit to your Excellency that the Defendent [Defendant] in the above case on the sixt [sixth] instant had a verdict found against him to be guilty of the charge alledged [alleged] ; but with the recommendation of Mercy; and happy to know that we are sheltered under a constitution that gives power [added text: to ] the Executive to sanction reliefs to unfortunate Individuals; and that the quality of pardoning is wisely placed with you; that Mercy blesses twice it blesseth him [added text: that ] gives, and him that takes, and that Earthly [added text: power ] is most like the power of heavn [heaven] "when Mercy Seasons justice" we are confidently induced to hope your Excellency will feel with us; and sanction the mercy recommended by his [unclear text: triars ] of the Fact; for the relief of an unfortunate man a most affectionate Wife, and distracted Mother of a sucking Babe through the disorder of the Perant [Parent] become nearly Motherless to the hightened [heightened] griefe [grief] of a [added text: sentenced ] Father unfortunately prosecuted by an Indian in the above case. consider the novelty of the case, and reflect how often the [unclear text: red ] crual [cruel] murderors [murderers] has stained [deleted text: Stained ] their hands with the blood of Our Feabler [Feebler] Sexes. Sanction mercy and your Petitioners as in duty bound will ever pray.
