Sir
By a resolve of the legislature passed in
February Commissionor [Commissioner] were appointed to explore, & treat for, a Tract of country Situated in the [unclear text: northwestern ] most extremity of the State; now held by the Cherokee Indians. The Treaty is not [unclear text: expressed ] in the resolution from

which the persons nominated derive their powers; Yet is it their opinion strongly implied; as no compulsive means were [unclear text: placed ] in their hands to enforce any measure however desirable or necessary it might appear.
[unclear text: Impressed ] with their perswasion [persuasion] they had taken Steps to carry into effect what to them seem the intention of the resolve, and agreeable to Stipulation made with the Gentlemen named from No [North] Carolina when they were informed that Genl. [General] Rutherford was killd [killed] by the [unclear text: chigemogies ] the Tribe with whom they were to have treated. of the authenticity of this information there is no room to Doubt not only from report & a publication extant; but also from the [unclear text: concurrence ] of a Mr. [unclear text: Young ] a Citizen of this place, and lately from

St. Augustine who assures us the same intelligence is current there & generally beleivd [believed] this act of hostility [illegible text] of the idea of negotiations and establishes with them a perswasion [persuasion] the end intended cannot be answered should they proceed. as this is an occurrence not foreseen or provided against by the Legislative, they are at a loss how far it may be [unclear text: eligible ] to postpone their [unclear text: procedures ] to the next meeting of the House, altho [although] the commissioners from the [unclear text: tenure ] of the appointment is ameneable [amenable] [unclear text: but ] to the assembly [unclear text: yet ] where an extra occasion happens, which was not anticipated or provided for; tis presum'd [presumed] they can apply for directions only to the executive
