To the Kings most Excellent Majesty in Council
The Humble Petition of John Whiteside and Thomas LaBreton of Sun Court Comhill London Gentlemen Agents for & on the Behalf of Isaac Levy formerly of Broad Street London Esqr. [Esquire] but now Resident at Philadelphia in America.
Sheweth

That the Revd. [Reverend] Thomas Bosomworth and Mary his Wife otherwise called Cousaponakeesa the Princess and Natural and Lawful Heiress of the Upper & lower Creek Indian Countrys [Countries] in America being in England in the year
1754 Entered into a Treaty with said Isaac Levy for the Sale of one moiety of the Islands St. Catherine Usseba & Sappola which had been duly Conveyed and Granted by Opiya Mico Emperor of the Upper & Lower Creek Nations in behalf of himself his Subjects & Vassals unto the said Thoms. [Thomas] Bosomworth and Mary [document damaged: his wife ] otherwise the Princess Cousaponakeesa and which Grant had been duely [duly] Ratified by the Seven Kings of the Creek Nations in their General Assembly, And the Original Treaties Entered into by Lieutent. [Lieutenant] General Oglethorpe by virtue of your Majestys Authority on behalf of the Trustees for Establishing your Majestys Colony of Georgia in America having been produced together with such Grants & Conveyances with other Authentick [Authentic] Evidence of the said Thomas Bosomworth & Mary his Wife the the said Isaac Levy agreed to their proposals & Advanced them [unclear text: Secd. ] Sum of Money thereupon
That by Articles of Agreement of the
14th. October 1754 the said Thos. [Thomas] Bosomworth and Mary his Wife [unclear text: Covenanted ] & Agreed to Convey a moiety of the said Islands to the said Isaac Levy his Heirs & Assigns [unclear text: for Ever [forever] ] on or before the
10th of the same October
That in pursuance of such Articles of Agreement the sd. [said] Thomas Bosomworth and his Wife by [illegible text] of Leave & Release of the
17th. &
18th. days of October 1754 & Bargain & Sale [illegible text] Conveyd. [Conveyed] a moiety of the sd. [said] Islands to the sd. [said] Isaac Levy his Heirs & Assn. [Assigns] for Ever

That the said Isaac Levy on obtaining this Conveyance settled all his affairs in England & went to Live & Reside in America and hath been at great Expences [Expenses] in improving his aforesaid Acquisition
That the said Isaac Levy hath lately Discovered that the said Thos. [Thomas] Bosomworth sometime since unknown to the said Isaac Levy entd. [entered] into a Treaty for the surrendring [surrendering] up the said two Islands of Usseba & Sappola to your Majesty and laid proposals for that Purpose before his Excellency the Govr. [Governor] of [deleted text: his ] [added text: your ] Native Colony of Georgia in which he Claimed to be Indempnified [Indemnified] and Saved Harmless against the said Isaac Levy with Respect to the Articles of Agreement Entd. [Entered] into between them on the said
14th. of October 1754 & [illegible text] a Copy of such Articles to his proposals & also Claimed to have the Sum of £3000 ster. [sterling] paid him & the said Island of St. Catherine Ratified & Confirmed to him and his Heirs upon the Terms that other Lands are held in the province which proposals he executed [document damaged] his Hand & Seal and Delivered to the Secretary of the said Province [document damaged]
That without any notice given to the said Isaac Levy or any [document damaged] from him an agreemt. [agreement] was made with the said Thos. [Thomas] Bosomworth & an advertisement published in the
South Carolina Gazette
giving notice that on the
10th. Decr. [December] would be exposed to Sale agreable [agreeable] to your Majestys Order in Council in the Town of Savannah the Valuable Islands of Osseba & Sappelo laying on the Sea Coast of that Province
This Advertisement very much Surprized [Surprised] the said Isaac Levy and he immediately thereupon procured an Advertisement to be printed and put up in all the publick [public] Places in Georgia & in the
South Carolina Gazette
Reciting the Advertisement for the Sales of Ossaba & Sapelo and that he had a Valid & legal Title to a moiety of the same Islands by virtue of a good & Sufficient Deed of Bargain & Sale from Thomas Bosomworth & Mary his Wife who were the Original Purchasers under Mico the Prince & Chief of all the Assembled States of the Lower Creek Indians to whom the same formerly of Right belonged which said Purchase had been Ratifyed [Ratified] and Confirmed in publick [public] Treaty with the said Indians and Reciting that he was determined immediately in all humble manner to present a Petition to yr. [your] Majesty

Setting [document damaged] Right and Title to the same Moyety [Moiety] of the said Islands in humble Hopes & assuran [document damaged] ing the same Restored & Secured to him agreable [agreeable] to his Right & the Rules of Law [document damaged] Therefore he did thereby give notice and advertize [advertise] the publick [public] and all such [document damaged] become Purchasers of the same Islands of his said Claim Right & Pretention [Pretension] [document damaged] this Intention & Resolution of making such application to your Majesty That such [document damaged] might purchase under the [document damaged] of his Title and might not Take the A [document damaged] ager usually allowed to Bona Fide Purchasers without Notice And at the [document damaged] Time the said Isaac Levy wrote to his Excellency the Govr. [Governor] of Georgia in treating [document damaged] put off the Sale to a further Time till your Majestys Pleasure might be kno [document damaged] thereupon for that he would Petition your Majesty to be Restored to his moiety of [document damaged] said Islands and the said Isaac Levy hath accordingly transmitted the Petition [illegible text] [document damaged] and herewith laid before your Majesty
That [document damaged] Isaac Levy is ready & willing to Submit to any Thing which your Majesty will [document damaged] to order for [document damaged] Service & is willing if the same shall be Required to Surrender up his Title to the said 3 Islands to the Govr. [Governor] of Georgia or any other pson [person] to be appointed by your Majesty & to Release the said Thos. [Thomas] Bosomworth & his wife from the said Articles of the
14th October 1754 for which the sd. [said] Thos. [Thomas] Bosomworth is to be Indemnified upon the sd. [said] Isaac Levys Receiving a proper Recompence [Recompense] for the same either by Grant of Lands Equivalent with those he shall give up or by a satisfaction in Money.
Yr. Petrs. [Your Petitioners] therefore most humbly pray yr. [your] Majesty That yr. [your] [unclear text: Matie [Majesty] ] will please to take the Case of the said Isaac Levy in to yr. [your] [unclear text: Maties [Majesty's] ] Consideration & give yr. [your] [unclear text: Maties [Majesty's] ] Instructions to the sd. Govr. [said] Isaac Levy for the Recompence [Recompense] to be made him in Lieu of his moiety of the sd. [said] Islands And that in Case any Part of the sd. [said] Islands or any other Lands shall be agreed to be Granted to him in Discharge of his Claim That proper Direction may be given by yr.
