1757, Governor Ellis Procured [added text: from ] some of the Indians a Cession of the Islands in questn. [question] and that notwithstanding [unclear text: those Matters before ] stated were [unclear text: remaining of Record agt. [against] it ] and about [unclear text: the same time ] Mr. Bosomworth [unclear text: delivered ] Proposals for [unclear text: surrendering ] up Usaba & Sappola to his Majesty on being paid a Sum of 3000, & having the Island of Saint Catherine confirmed to him and at the same time he annexed to his Proposals a Copy of the Articles between him & Mr. Levy of the
14th. Octo. [October] 1754 and prayed to be [unclear text: indemnified agt. [against] ] the same
This Treaty was Carried on for about a year & an half before any actual agreement was entered into but Mr. Levy who then was at Philadelphia at the distance of 900 miles from Georgia was in no way acquainted what was going on between Mr. Bosomworth and Mr. Ellis on behalf of the Crown, and the first notice Mr. Levy reced [received] thereof was by a Publick [Public] Notice in the
South Carolina Gazette
for the Sale of the Two Islands of Ussuba & Sappola when he took the steps mentioned in his second Petition to his -- Majesty for the Preventing thereof And he -- and [document damaged] Titles to register their Claims within 3 Years of which notice was given in the
London Gazette
and Mr. Levy in pursuance thereof caused his -- claims to be entered in Georgia in pursuance thereof in due time, of which having by his Agent demanded a Certificate he could not obtain the same But no Doubt but what the same has been Certified

[should] possess those Lands -- without the authority of the King, They answered That they gave them to Mrs. Bosomworth as an Indian and one of themselves, and further answered that she might give them or sell or dispose of them as she pleased. --
The Minutes of those Conferences we have obtained from the Lords of Trade upon our Petn. [Petition] to them for that Purpose. --
We were in Hopes to have also obtained Copies of the Letters of Govr. [Governor] Ellis relative to this affair which would have flung a Clear Light upon the whole Transactions and showed, That he did look upon the Title of Bosomworth to be such as that they could not get rid of but by Treating with him in an amicable manner for which reason Govr. [Governor] Ellis by directions from above Entered into a Treaty with Bosomworth for the Surrendering and Conveying his Title to Govr. [Governor] -- Ellis in behalf of the Crown -- His first step was to obtain an Act of Assembly in Georgia which passed in
February 1750, forbidding the Purchasing of Lands of the Indians adjoining to the [document damaged: Province ] entered into articles with Govr. [Governor] Ellis and his -- Council on the
14th. July 1759, reciting demands for certain Services Performed by his wife for the Crown and also his Claims with respect to the said Lands & Islands and that it had been Proposed to pay the sd [said] Thos. [Thomas] Bosomworth the Sum of 2100, in Satisfn. [Satisfaction] of his sd. [said] Claims and demands and a Grant of the Island of Saint Catherine

which he had agreed to accept and to -- convey all right to the sd. [said] Lands & other Islands and releases the Crown [added text: from all Claims ] for Services or otherwise It was by the said articles agreed that the said Bosomworth and wife shod. [should] Execute such Conveyance when Tendered and that thereupon he should pay the sd. [said] £2100 if the said Islands Produced so much
Upon Mr. Levy's advertisement the Sale of the Islands was Postponed until Govr. [Governor] Ellis reced [received] further Instructions from home. In the meanwhile Mr. Levy Presented his Petns. [Petitions] to his Majesty in Council on the
20th. Decr. [December] 1759 which were referred unto the -- Lords of Trade and Plantation. -- [document damaged] appears by an authentick [authentic] Copy from the said [document damaged] Conveyance [document damaged] said Two Islands of Ussaba and Sappalo was not Executed to Govr. Ellis for the Use of his -- Majesty until the
19th. April 1760, long after the Crown had full notice of our Claims. --
With respect to the Pretended Demands of Mrs. Bosomworth (and which are made the -- Ostensible Considn. [Consideration] of this Deed [unclear text: Logd. ] with the Giving up his [illegible text] to Ussaba & Sappola [document damaged] the Council [document damaged] and the laying over to Mr. Bosomworth of the very Sum of Money the Islands were sold for shews manifestly that they believed his Title thereto to be good and in Effect no Purchaser would taken them but as deriving under the authority of a Conveyance from Bosomworth

This affr. [affair] was called on before their Lordships in
Janry [January] 1760, but was not then fully Entered into for want of the necessary Papers & vouchers both on the Part of Mr. Levy & also on the Part of those acting under their Lordships Intructns. [Instructions] abroad -- and in
Janry [January] 1761, their Lordships -- having reced [received] an account of the Proceedings [document damaged] abroad appointed a further day for hearing the same on the
14th. January 1761, But Mr. Levy's agents not being then Prepared for him Prayed a further Time which has never since been appointed.
NB [Nota Bene] : The account of Services Mrs. Bosomworth made out Consisted Principally of a Salary of 200 a yr. [year] which she Pretended [document damaged] than of her own authority. --
Upon the whole State of this Case you will Please to advise Mr.Levy what are his Proper Steps to obtain Redress -- Wher. [Whether] to Proceed -- before their Lordships and insist upon their -- Report in pursuance of a memorial Presented by him 6 weeks ago in which after recapitulating his Two former Petns. [Petitions] he has taken up these facts [document damaged] his Presenting [document damaged] heard by his Councils and what is your Opinn. [Opinion] upon the General Complexion of this -- Case
