As required by O.C.G.A. 43-45-8 (3), the Georgia Structural Pest Control Commission submits the following annual rep011.

The Georgia Structural Pest Control Commission met monthly during Fiscal Year 2015 on the following dates:

All meetings began at 9:30am in Room 201 of the Agriculture Building with the exception of the November 12th meeting held in Room 146 of the Tifton Lab Complex Building in Tifton, the January 13 th meeting which began at 10am and was hosted by the Department of Entomology in the Fireside Room of Rooker Hall on the University of Georgia Campus in Athens, and the February 10th meeting held in Room 300B of the Agriculture Building.

Expenditures for the Commission and records of attendance for each member are included.

STRUCTURAL PEST CONTROL COMMISSION MEETING

July 8, 2014

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the

Agriculture Building on July 8, 2014. The following commission members were present:

Chris Gorecki, Chair, Derrick Lastinger, Vice-chair, Laurie Padgett, Dr. Brian Forschler (via

teleconference), Bodine Sinyard, Christy Kuriatnyk, and Greg Holley.

B. Also in attendance were Josh Wiley with the Georgia Department of Agriculture, registrants,

and other members of the pest management industry.

C. Motion was made by Mr. Sinyard to approve the minutes of the June meeting. Mr. Holley

seconded the motion and motion passed.

D. The Commission elected chairman and vice chairman positions for FY 2015. Mr. Sinyard

recommended a motion for Mr. Gorecki to be chairman and Mr. Lastinger to be vice

chairman. Mr: Holley seconded the moti.on, the Commission agreed and the motion was approved.

J.. E. The Commission approved company license applications (see Attachment 2).

F. Dr. Forschler provided the UGA program update. He stated the plans of posting the draft

employ~e registration manual on the Commission we~page for public comment. In keeping

,

up with the new rule compliance timeline, the registration manual will need to be

.completed before the end of the year. The draft manual will be posted on the website for 30 days.

G. Mr. Lastinger provided the Department update. He noted the recent success of the recent farmer's market showcases held in Macon, Atlanta, and Savannah. The next showcase will be in Moultrie. Lastly, he mentioned that the Structural Pest Section had a consumer outreach booth that provided information on licensing and pest man~gement.
H. Mr. Lastinger provided a program update. He discussed a recent GDA email notification sent to all licensees announcing the recently issued new rule guidance. The documents include the WDO Con_tract fact sheet, Pesticide Use Record Compliance fact sheet, Official Waiver form fact sheet, Official Georgia Wood Destroying Organism Infestation Inspection Report and Under-floor Space Ventilation fact sheet. He noted that the posting of the draft registration manual will also be sent out in an email notification. These notifications are sent to Certified Operators and Licensees that have an email address on file with their license. He noted that the new rule. implementation steps are currently on schedule with the new rule compliance timeline. Mr. Lastinger recommended the removal of two guidance documents from the website. He made a motion to remove notice 03-01 non-soil exposed crawl spaces and new construction and the old guidance instructions for completing a wood infestation report. Mr. Sinyard seconded the motion and the motion was approved.

I. Mr. Rick Bell reported on a two day workshop he attended with representatives from

NPMA, EPA, and ASPCRO. Such topics discussed were termite management and pollinators.

Mr. Lastinger also reported on the workshop and mentioned EPA's current reregistration review of Sulfuryl Fluoride process. Discussion of future workshops included a proposal to ( focus the next one on structural fumigation. He recognized the workshops as being great for building relationships and providing information to EPA that is necessary when making decisions. J. Meeting adjourned at 10:19 AM.

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the

C. Motion was made by Mr. Holley to approve the minutes of the July meeting. Mrs. Padgett

D. The Commission approved company license applications (see Attachment 2}.

E. . The Commission discussed a request from a certification exam applicant who requested to

be exempt from having to meet the one year of experience in the last five years. The

Commission reviewed the applicant's experience and did not approve the request for an

exemption to the minimum experience requirement.

F. Mr. Skin Edge provided the legislative update.

G. Mr. Rick Bell reported on a meeting he attended with th e Georgia Associations of Realtors

(GAR} involving termite inspection and termite damage repair language on the GAR

contract. Those attending the meeting agreed to work together on improving the contract

language.

H. Mr. Holley recognized Mrs. Lara Fink for her years of service to the Georgia Pest Control

Industry and Commission.

I. Mr. Go_recki welcom.ed and introduced Ms. Glenda Lehmberg as the new executive director

of CPCO of Georgia.

J. ": Dr< Fors~hler provided the UGA update. He noted that classes will begin shortly for the fall

semester. He recognized and appreciated the positive feedback from the comments

received on the Employee Registration Manual draft. He also suggested keeping the draft

on the website for another week for additional public comments. The test questions are

currently being revised and new questions will be added to the test bank. Lastly, he

mentioned an article from an entomology journal by the name of American Entomologist.

The article discussed the Structural Pest Control Section and cited several topics that were

misleading on various topics such as enforcements efforts, mandated laws, and practices.

Dr. Forschler suggested that the Commission consider responding through an editorial

rebuttal.

I<. Mr. Lastinger provided the Department update. He welcomed and introduced Mr. Adam

Dye who works in the Department's policy office. He also provided an update on the

Biowatch exercise and appreciated the commission members for their time and

participation.

L. Mr. Lastinger requested the Commission review a GDA case involving a consumer compliant ( and termite treatment failure and make a recommendation for corrective action under rule 620-6-.07(5}. Mr. Wesley Burton provided details regarding the case. After discussion, the Commission made a motion requiring a complete comprehensive soil applied termite treatment and refresh termite bait products in all of the termite bait stations.
M. Mr. Lastinger provided the program update. He discussed the upcoming Annual Conference of the Association of Structural Pest Control Regulatory Officials beginning this month in Montana. A discussion of Pollinator Protection and label language requirements for neonicotinoids will be on the agenda.
N. Mr. Gorecki congratulated Mrs. Connie Rogers with GPCA for her recent promotion to the executive director for GPCA.
0. Mr. Rick Bell provided the NPMA update. There is possible news that EPA has decided .not to issue a PR notice on the pollinator protection label language. Mr. Bell's hopes are that the ASPCRO language interpretations will be accepted by all states.
P. Lastly, the Commission discussed several locations to have the meetings for the year of 2015. Plans for October or November of this year will be to hold a meeting at the GDA Tifton Lab Campus.

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the

E. Mr. Skin Edge provided the legislative update. He introduced the newest representative of

Georgia Link, Ms. Lauren Fraulick.

F. Dr. Forschler provided the UGA update. He thanked those that contributed to the

comments received on the draft Employee Registration Manual. He explained that most of

(

the comments will be included into the manual. The projected goal is to have a final revised

draft to the Commission by the October meeting. The rebuttal draft letter to the American

Entomologist article on regulating pesticides in schools is also in the process of being

reviewed by the Commission members. Lastly, he discussed a group of UGA faculty that

convened to write a position statement on protecting pollinators. Dr. Forschler distributed

the statement draft among the Commission members. He suggested the Commission get

involved to work together on a mission statement that will represent the pest control

industry's perspective. Mr. Lastinger added that there was also a GDA Georgia Pollinator

Protection planning meeting that recently took place at the GOA Tifton Lab which was

hosted by GDA Plant Protection Director Mike Evans. The meeting's initiative was to

develop a plan for agriculture groups and in the near future incorporating urban pest

control and the general public. Commercial beekeepers were included in the first meeting.

Mr. Lastinger will get more information regarding the recent Tifton meeting and report back

to the Commission at the next meeting.

G. Mr. Lastinger reported on the success of the Annual ASPCRO Conference. He mentioned the

discussion of pollinator protection and EPA's plan include additional pollinator protection

language on pesticide labels. The label language is expected to be similar to that of

neonicotinoid label language.

,

H. Mr. Lastinger provided a Department update. He introduced members of the Structural Pest

Team that attended the meeting. He also updated the Commission on the Biotech case

which was referred to US EPA Region 4 for pesticides misuse in nursing homes in several

(

southern states. The operator was sentenced two weeks ago in Federal court in Macon

with a $7,500 fine. The corporation was sentenced to three years probation and a $50,000

fine. Mr. Lastinger discussed a request from the August Commission meeting where the

Commission requested representatives from Athens Technical College (ATC) to attend the

Commission meeting to provide a program update. ATC administers the GA Pest Exam

program. Dr. Tidings, president of ATC is planning to attend the Commission meeting for

January. Recently ATC requested funding to update the firewall software and hardware that

supports the program. GDA was able to secure funding and purchase the equipment for

ATC.

I. The location of the November Commission meeting is scheduled to take place at the Tifton

Lab on November 1ith.

J. The Official Waiver Compliance Fact Sheet that the Commission issued in June 2014 has

been revised to correct a typo in section number 4. Motion was made by Mr. Holley to

accept the revised fact sheet. Mr. Sinyard seconded the motion and motion passed.

I<. Mr. Gorecki welcomed and thanked Commissioner Black for his attendance to the meeting.

L. Mr. Lastinger updated the Commission on the New Rule Timeline. He noted that

implementation is on schedule including exam revisions.

M. Lastly, Mr. Rick Bell provided an NPMA update. He announced plans for the House to pass a

bill by the first of next week to disapprove EPA's request for waters of the US, which would

have allowed them to govern drainage ditches, moist spots in yards, and areas that are wet

for thirty days during the year.

N. Meeting adjourned at 10:26 AM.

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the

Agriculture Building on October 14, 2014. The following Commission members were

present: Chris Gorecki, Chair, Derrick Lastinger, Vice-chair, Laurie Padgett, Dr. Brian

B. Also in attendance were representatives of the Georgia Department of Agriculture, GPCA

and CPCO representatives, registrants and other members of the pest management

industry. C. Motion was made by Dr. Forschler to approve the minutes of the September meeting. Mrs.

Padgett seconded the motion and motion passed.

D. The Commission approved company license applications (see Attachment 2).

E. Mr. Skin Edge provided the legislative update. He mentioned a committee that is studying

tax reform in order to reduce income tax by adding sales tax on services such as pest

control. F. Dr. Forschler provided the UGA update. He reported that all comments received on the

employee registration manual were considered and incorporated as appropriate. Motion

was made by Mr. Lastinger to accept the revised employee registration manual. Mr.

Gorecki seconded the motion and motion passed. Dr. Forschler thanked the industry and

GDA for submitting detailed comments on the draft. Mr. Gorecki and Lastinger recognized

Dr. Forschler for his work on coordinating the revisions to the manual. Dr. Forschler

updated the Commission on the SPCC article that will highlight Georgia's common sense

approach to regulating SIPM to the American Entomologis t on the recent school IPM article.

Suggestions from the Commission will be incorporated into the final draft that will be

submitted to the American Entomologist. Lastly, he mentioned that he will report on the

pollinator protection mission statement that UGA's Entomology Department is drafting at

the next Commission meeting.
G. Mr. Lastinger provided the Department update. He announced an upcoming Georgia Clean Day scheduled for October 30th for Cook, Thomas, Brooks and Lowndes counties. Pre-

registration is required for anyone that plans to participate. The Clean Day will be hosted by

the Brook's County Ag Extension office in Quitman. Lastly, he discussed a recent visit by the

Department to the Port of Savannah by Commissioner Black and other GDA directors.

During the visit, the Plant Industry Division conducted a workshop at the port in partnership

with U.S. Department of Hom ~land Security Customs and Border Protection, Georgia Port

Authority, U.S. Department of Agriculture, University of Georgia and U.S. Environmental

Protection Agency.



H. Mr. Evans, Director of Plant Protection discussed the drafting of a pollinator protection

(

management plan for Georgia. He discussed a recent meeting in Tifton of beekeepers and

commercial pesticide applicators in Tifton that discussed a voluntary plan. He discussed

future activity with initial focus on pollinator protection in agriculture and then urban. The

plan will include fact sheets for the various focus groups that will provide

recommendations. Mr. Holley mentioned that some pest control companies have

beekeepers that they use as consultants to determine whether a bee hive can be captured

and relocated or need to be exterminated.

I. Mr. Burton discussed several cases requiring a complete termite retreatment . One case

involved a retreatment warranty contract issued on a structure that did not receive an

initial treatment. Mr. Gorecki clarified the difference between a no treatment warranty

contract for termite control and a warranty contract takeover. Mr. Lastinger further

indicated that a warranty contract takeover is not permitted under the WDO contract rule.

J. Mr. Lastinger reported on the progress of the New Rule timeline. He noted that

implementation activities continue to be on schedule. The revised Employee Registration

Manual should be published within the next two weeks and exams are currently being revised for implementation after January 15\ K. Mr. Gorecki discussed modifying the ventilation fact sheet to reflect a new interpretation

from the Department of Community Affairs. The change will be incorporated into the fact

sheet along with improved formatting to provide clarity on the four options for ventilation

standards. Motion was made by Mr. Holley to accept the revised fact sheet 14-08. Mrs.

Padgett seconded the motion and motion was passed.

L. Mr. Gorecki mentioned that new fact sheets are being drafted to be presented and

discussed at the next meeting. Mr. Lastinger added that further clarification on the

(

meaning of "conditioned air" language that is included in the ventilation option 4 of the

ventilation fact sheet 14-08 is also being researched and he plans to report on this at the

next meeting. M. Mr. Rick Bell provided the NPMA update. He discussed an upcoming USDA stakeholder's

meeting regarding pollinat~r protection on Monday in Washington, DC. The national

meeting will include manufacturers, growers, commercial applicators and beekeepers. He

also noted that the comment period on "Waters of the US" has been extended until November 14th. N. Mr. Lastinger discussed a letter that ASPCRO sent to EPA on September 24th- The letter
requests an amendment to rodenticide labeling of second generation products to include

and allow use for specific non-commensal rodents.
0. Mr. Lastinger provided details for November Commission meeting. The meeting will be on Wednesday, November 12th at 9:30 AM in room 146 at the Tifton Lab Complex. The address

is 3150 US Highway 41 South in Tifton. After the meeting, there will be an optional tour of

the lab facility. P. Mr. Taylor reported on a recent issue of Designated Certified Operators (DCO) refusing to

sign applications for individuals wanting to take the certification exam. According to rule

620-3-.02(1)(i), DCO's are required to sign the application verifying experience for the

applicants.

MINUTES OF THE GEORGIA

STRUCTURAL PEST CONTROL COMMISSION MEETING

November 12, 2014

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 146 of the

Tifton Lab Complex Building on November 12, 2014. The following commission members

were present: Chris Gorecki, Chair, Derrick Lastinger, Vice-chair, Laurie Padgett, Dr. Brian

Forschler and Bodine Sinyard.

B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA

and CPCO representatives, registrants, WSBTV reporters and other members of the pest

management industry.

C. Motion was made by Bodine Sinyard to approve the minutes of the October meeting. Laurie

Padgett seconded the motion and motion passed.

D. The Commission approved company license applications {see Attachment 2).

E. Dr. Beverly, Laboratory Division Director greeted and welcomed everyone to the GOA

Laboratory Tifton Campus.

F. Mr. Lastinger provided the Department update; he discussed the Georgia Clean Day

currently taking place in Quitman. He .also announced the 2015 meeting schedule including

Public Notice 14-16 which is now posted on the Commission website. G. Dr. Forschler provided the UGA update. He noted details for the January Commission

meeting hosted by the UGA Entomology Department. He discussed the recent research

conducted by his students on the residential mosquito treatment which fi_nished their first

season. He also provided an update on the Formosan termite infestation suppression

project in Hinesville.

H. Dr. Forschler mentioned that a rebuttal was submitted to the editor of the American

Entomologist in response to their article regarding regulation of pesticides. The editor

acknowledged receiving the Commission's rebuttal and agreed to start a review and

response process. Dr. Forschler proposed issuing a model contract for Georgia schools to

utilize when contracting 1PM services. Mr. Lastinger added that this would be a great

resource for schools and PMP's since GDA often receives requests for this information. He

also mentioned that there might be an opportunity to work with the Georgia Grown farm to

school program to start a dialog with schools that are interested in School 1PM programs

and resources.

I. Mr. Lastinger and Dr. Forschler discussed the revised Employee Registration Manual and exam. The revised exam should be completed for the t esting center by December 15\ In

preparation of finalizing the exam, the program W!'.:>Uld like to provide a practice exam. This practice exam will be available on December 15th, 16th and December 1ih. GOA will monitor

the exam results and make modifications as needed. Revised registration and certification

exams are expected to be in place for all exams starting in January 2015.

J. Dr. Phillip Roberts, University of Georgia extension entomologist, provided information on

the UGA pollinator mission statement. UGA plans to meet next week with Mr. Mike Evans,

Director of the Plant Protection Section, to discuss a pollinator protection plan for t_he State

of Georgia. Dr. Roberts stressed the importance of communication and education to the

public and the industry surrounding pollinator protection. In the document/statement that

the University of Georgia is putting together, there are discussions on maintaining healthy

bee colonies and ways to reduce the exposure of pollinators to pesticides.

I<. Mr. Lastinger provided the 2014 new rules timeline update. He noted the progress

continues to move further along on implementation of the new exam questions. In addition

to the exams, notices have been sent out to all licensees regarding the publication of the

new Employee Registration manual including the new guidance documents that were

approved by the Commission last month. The documents have been posted on the website.

Implementation continues to be on schedule with the compliance date of January 1, 2015. Accordingly another important date to note is March l 5t 2015, which is the deadline for all registered employee training for renewal of registrations. Registered Employees who have

taken the exam after September 30, 2014 are exempt from getting the required training

hours for renewal. L. Mr. Gorecki discussed the recently drafted Wood Destroying Fungus and Wood Boring

Beetle guidance documents. The documents continue to state what the minimum

treatment requirements are in addition to the ventilation standard changes. Motion was

made by Mr. Sinyard to accept the two documents. Dr. Forschler seconded the motion and

motion passed. The new guidance will be posted on the website and the pest control

associations were asked to assist with outreach on getting this information to their

membership. GDA was asked to look at the website statistics for the Commission webpage

and report back.

M . Mr. Lastinger reported on further clarification of the interpretation of "conditioned air" in

Section R408.3 of the IRC building code for unvented crawl spaces. After reaching out to

the Department of Community Affairs and Southface technical services, GDA learned that

the most common practice for providing conditioned air in new construction is with HVAC

ductwork with 2 cfm/100 s.f. A variation to providing cond itioned air is with a dedicated

dehumidifier supplying at least 2 cfm/100 s.f. The dehumidifier must be plumbed to

automatically drain the captured condensate away either by gravity, to a sump pump, or to

the air conditioner's condensate pump. N. Mr. Gorecki provided the update regarding NPMA's efforts on rodenticides. He noted that

there was a petition in New York wanting to change second generation rodenticides to

restricted use pesticides. However, there is a mandate in New York's regulation listed by the

Commissioner that does not allow restricted use pesticides to be used if there is a viable

alternative. Local associations and NPPMA were heavily involved in providing input on the

issue. O. In an effort to raise awareness, Mr. Lastinger discussed the GDA Self-reporting Enforcement

Response Policy for the pest control industry. The goal of the policy is to enhance

compliance with regulations by encouraging the industry to self-aud it and self-discove r

violations by self-reporting this information to the Department. According to Mr. Burton,

there is a decline in the number of reports.

There are three steps to self-reporting:

1. Discovery: self-audit by reviewing records such as service records,

inspection records, pesticide labels and contracts.

2. Correction Prevention: take immediate corrective action and

prevention action.

3. Report: Contact GDA and schedule a self-reporting compliance

meeting.

STRUCTURAL PEST CONTROL COMMISSION MEETING

December 9, 2014

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the

Agriculture Building on December 9, 2014. The following commission members were

present: Chris Gorecki, Chair, Derrick Lastinger, Vice-chair, Laurie Padgett, Dr. Brian

Forschler (Teleconference), Bodine Sinyard, Christy Kuriatnyk, and Greg Holley.

B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA

and CPCO representatives, registrants and other members of the pest management

industry.

C. Dr. Forschler provided the UGA update. He mentioned that the Commission letter will be

published by the American Entomologist magazine in spring 2015. He also noted the details

for the January Commission meeting which will be at the University of Georgia in Athens,

h_osted by the Entomology Department. Lastly, Dr. Forschler mentioned that the revised

and new questions for the employee registration exam question bank were completed and

submitted to GOA for final review.

D. Mr. Taylor announced an opportunity to take the new employee registration sample exam.

The exam will be available to take on December 15th, 16th and the 1ih. Pre-registration is required to take the exam. The sample exam is available through Georgia Pest Exam and

registration of the sample exam should be made under the "Mouse Club Exam". All exam

proctoring rules will apply to keep the exam questions secure. GOA will do further review

of the exam questions and results and make needed revisions. Dr. Forschler further

explained the breakdown of new questions and revised questions including the new manual

sections on 1PM and pesticide mode of action.

E. Motion was made by Mr. Sinyard to approve the minutes of the December meeting Mr.

Holley seconded the motion and motion passed.

F. The Commission approved company license applications (see Attachment 2).

G. Mrs. Lauren Fraulick provided the legislative update. She noted a recent legislative training

that took place in Athens to discuss topics such as the budgeting process, economic

development and transportation. All topics were discussed in preparation for the upcoming

session starting on January 1ih with the inauguration event taking place at the new Liberty

Plaza.

H. Mr. Lastinger provided an update on the new rule compliance timeline and final
implementation. He reminded the Commission of the compliance date of January 151. As

requested last month, Mr. Lastinger provided a report of the Commission website activity.

The report indicated that website hits doubled for the same reporting period in 2014

compared to 2013.

I. Mr. Lastinger mentioned that GOA received several inquiries from PMP's regarding the

issuance of the NPMA-33 form. He noted that the rule requires the use of the state

mandated Official Georgia Wood _Infestation Inspection Report form to be issued

exclusively. He referenced several documents referencing HUD and VA specifically

accepting state forms in place of the NPMA-33 form . Mr. Lastinger will forward the

referenced documents to the Commission to further consider posting on the website. Mr.

Holley suggested reaching out to the Board of Realtors to assist with outreach on the

Georgia requirement. J. Mr. Taylor discussed recertification course renewals and notices for 2015; the notices were

distributed last week. Currently there have been 800 courses submitted for renewal, 750 of

those were submitted online and 50 were submitted through email. Course approval

notifications are planned to be sent out throughout the upcoming weeks.
I<. Mr. Lastinger discussed the pollinator protection update. He mentioned a recent meeting

with UGA and GDA representatives that are drafting a state pollinator protection plan. Once

the draft is complete, it will be distributed to stakeholders. There is a public meeting scheduled at the Farm Bureau in Macon on January 27th
L. In regards to national activity, Mr. Lastinger reported that SFIREG is currently meeting to

discuss pollinator protection plan guidance for states. ASPCRO is providing comments on

the guidance regarding urban pest management.

A. The Georgia Structural Pest Control Commission convened at 10:00 a.m. in the Catherine

Rooker Fireside Lounge, on the University of Georgia campus on January 13, 2015. The

following commission members were present: Chris Gorecki, Chair, Derrick Lastinger, Vice-

chair, Laurie Padgett, Dr. Brian Forschler, Bodine Sinyard, Greg Holley, and Christy

Kuriatnyk.

B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA

and CPCO, UGA, Athens Technical College, registrants and other members of the pest

management industry.

C. Dr. Ray Noblet, Head of UGA's Entomology department welcomed everyone to the

University of Georgia campus.

D. Motion was made by Mr. Sinyard to approve the minutes of the December meeting. Mrs.

F. Dr. Keith Delaplane, UGA Professor and Honey Bee Program Director, discussed the draft

Pollinator Protection Plan for Georgia. He discussed an upcoming public meeting to be held

at the Farm Bureau Building in Macon to discuss the draft plan. The document advises the

best practices on protecting honey bees, pollinator conservation and urban considerations

for homeowners. Dr. Forschler noted that most of the draft plan addresses agriculture and

that it would be helpful to educate PMP's on pollinator protection practices around

structures.

G. Dr. Forschler provided the UGA Urban Entomology research update and report including

details of several projects focusing on carpenter bees, mosquito sampling techniques,

mosquito treatments around homes, plastic termite barriers, termite bait field trials and

treated lumber trial for carpenter bee protection. His students will provide research

updates at 5:00 P.M. today at the GPCA Winter Conference. (see attachment 3 for the

report)

H. Dr. Dan Suiter, University of Georgia's Professor of Entomology, provided an extension

update. He noted upcoming workshops including several new workshops (Bed bug, School

1PM, Commercial 1PM and residential 1PM) webinars to be hosted by UGA Extension Griffin

Campus.

I. Mr. Tommy Gray provided the Department update. He noted November's re-election of

Commissioner Black and thanked him for being very supportive of the Plant Industry .

Programs. He also discussed th e opportunity to fill several vacancies including two

inspectors to the Structural Pest Section. He introduced and recognized Dr. James Sutton

with the Department's Leadership team for attending the meeting.

J. Mr. Lastinger provided the program update. He highlighted the revision of several

documents including the Recertification Attendance Verification Requirements and Specific

Areas Treated. He also noted new documents including the New Company Guidance Fact Sheet, Pesticide Use Record Keeping Requirement Fact Sheet, WOO Contracts Fact Sheet,

Under-Floor Ventilation Fact Sheet, Official Waiver Fact Sheet and Official Georgia Wood

Infestation Report Fact Sheet. The new and revised documents are all posted on the

Commission website. He also mentioned the compliance assistance webpage that hosts a

library of new rule guidance for industry members to reference. The program will receive

US EPA funding to support several new projects and activities in 2015 and 2016. These

projects include School 1PM, Pollinator Protection and Bed Bug Outreach. Lastly he

mentioned that GOA wil) host an ASPCRO/NPMA Structural Fumigation Workshop for US

EPA Registration staff in March 2015 at the Rollins Learning Center in Atlanta.

I<. Mr. Taylor provided the licensing update. He reminded the industry of this year's upcoming renewal and stated that all license payments are due by June 30th. Industry members should

expect to see license renewal packets in the mail this spring. He recommended everyone to

go online to ensure accuracy of all licensing mailing address and contact information. The training deadline for Registered Employees renewal is coming up on February 28th.

L. Dr. Flora Tydings and Mr. Dennis Ashworth with Athens Technical College provided an

update on the pest exam project. The examination process has drastically improved since it

came online in 2006. Today, exams are administered at 33 Technical College testing centers

around Georgia. It is estimated that the pesticide and pest control industries has saved over

3 m illion dollars a year with the current pest exam program. To date over 16,382 individuals

have tested through the centers. Mr. Ashworth thanked the Department for all of the

testing program's support from GOA and the pest control industry. He updated attendees

on many additional services the program provides, such as fast and efficient help desk

support, system hardware and software updates, and professional proctor training. Last

year there were roughly 4,100 exams administered with a little over 32,000 exams

administered since over the past 9 years. GOA was recognized for providing funding for the

recent software and hardware update that was needed.

M. Mr. Rick Bell provided a NPMA update. He discussed a proposal in Montgomery, Maryland

from a county commission to ban the use of neonicotinoids in turf use and structural use in

private and public buildings. He also shared concerns with US EPA redefining the definition

of waters of the US under the Clean Water Act.

PROGRESS REPORT: The past year included efforts that resulted in arevision ofthe GDA Employee Registration Manual, as well as, a book chapter on biology and control ofdrywood termites. Theeducational program celebrated the graduation ofthe 9th and 10th Masters of Sciencein Entomologystudents. The research programcontinues to investigate insect pests common in the urban habitat in the quest to develop realistic pest management recollllllendations. Graduate student research on mosquito and termite pests are =mining questions that include comparison ofsamplingmethods for mosquitos as well as efficacy ofp~ticide interventions for their control, collective decision making in termite colonies, and the ecological role ofsubterraneantennites. Afield trial was established to test 4 types oflumber treatments for managementofcaipenter bees where after onefield season no new nests were observed in any ofthe boards, including the controls, which indicates a slow rate ofnew nest establishment Fieldwork on d!ywood and subterranean tennites continues with deu1onstration projects on University property. The research program also donated a collection ofover 180 samples oflermite alates collected over the past 20 years that includes all 5 species ofsubterranean termites found in Georgia. The species-specific flight times fromthose samples shows that theeastern subterranean termite, Reticuliten11esjlmipes, bas the longestflight period - from November to April. R. nelsonae the shortest flight period from February through March, and that R. virigi11c11s andR.malletei overlap during April through June with R. llageni swarmsfrom August through October. 1llis infonnation is useful in identifying the species oftermites involved in a stmctural infestationand our data from the can1pus demonstration projectshows that 92% ofall infestations are caused by R.jlmripes with 4%R. virgi11ic11.s while 2% are R. /Jageni and the last 2%, R. malletel, (R. ne/sonae is not found inthe Athens area).
EXPENDITURES:
Graduatestudent stipendsfscholarships cost approximately$64,000 in addition to $12,000, for supplies and equipment. Funds, from the State Stmctural Pest Control Commission research fees ($45,000 annually) were used for partofthe aforementioned graduate student stipends and the remaining expenditures were paid by eJt.1ranmral fonds.
PLANNED RESEARCH:
We plan to address the following research areas over the nei.1 year: (1) dlywood termite. management (2) collective decision-making in subterranean termites (3) efficacyof residential mosquito treatments in GA and (4) subterranean termite imolvement in soil nutrient cycles.

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 300B of the

Agriculture Building on February 10, 2015. The following commission members were

present: Chris Gorecki, Chair, Derrick Lastinger, Vice-chair, Laurie Padgett, Dr. Brian

Forschler, Bodine Sinyard, Christy Kuriatnyk, and Greg Holley.

B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA

and CPCO representatives, registrants and other members of the pest management

industry.

C. Motion was made by Mr. Sinyard to approve the minutes of the January meeting. Mr.

Holley seconded the motion and motion passed.

D. The Commission approved company license applkations (see Attachment 2).

E. After discussing several issues concerning similar company names, the Commission

discussed adding license issuance dates to the list ofsimilar names when considering new

company license applications. Mr. Holley suggested that the Commission adopt a policy on

company name approvals. The Commission agreed to review the rules regarding company

(

name requirements and consider the need for new policy. Mrs. Padgett added that when

I

the Commission reviews the rule to also discuss what is considered "substantially similar".

F. Dr. Forschler provided the UGA update. He discussed an issue with the brown marmorated

stink bug found on vehicles that were exported out of the Port of Savannah to New Zealand

and Australia. Accordingly, an embargo was issued this month that initiated port officials to

find ways to fumigate or heat treat the vehicles prior to export. Mr. Las.tinger added that

GOA was contacted regarding the use of ProFume to treat for the brown marmorated stink

bug and licensing requirements. Since the Georgia Structural Pest Control Act defines

structural pest control to include the fumigation of railroad cars, trucks, ships and airplanes

and agriculture commodity fumigation is limited to agricultural commodities, it was

determined that a structural fumigation license is required to fumigate vehicles. This issue

went throu&h legal review since it involved several laws. Dr. Forschler also mentioned that

the rebuttal to the American Entomologist article on school pesticide regulations was finally

submitted. Lastly, he discussed the comments that he prepared on behalf of the

Commission in response to the UGA draft pollinator protection plan for Georgia. The

comments included helpful practices for property owners, as well as pest management

considerations which were based ori the current NPMA best management practices

document. The document will be posted on the Commission website.

G. Mr. Lastinger also discussed a draft memo regarding HUD & VA acceptance of the Official

Georgia Wood Infestation Inspection Report. The memo provides the clarification that

He announced Ms. Jennifer Wren as the new enforcement and compliance manager for the Plant Industry Division. He also discussed Commissioner Black's most recent State of the Department address noting the Department's progression over the years including recognition of work accomplished by the Strudural Pest Section. I. Mr. Lastinger provided the Program update. He mentioned the recent departure of Market Bulletin's editor; therefore, program staff will assist with writing articles for the bulletin. There are plans to submit articles regarding pollinator protection and the development of the state plan, GOA activities at the Port of Savannah and consumer awareness on bed bugs. He discussed a recent division meeting involving all of the Plant Industry Division's ffeld staff. The meeting highlighted Inspection Standard Operation Procedures which is part of a Department effort to enhance consistency across divisions. J. The Commission received a letter from Mr. Charles Guy with Good Guy's Pest Control. His letter addressed requested the Commission to review Rule 620-4-.01 on advertising and consider amending the rule to .further ~estrict licensee advertising on websites and social media and from using any part of another licensee name. Mr. Guy addressed his letter and concerns. The Commission acknowledged his concerns and requested the GOA legal team to review his letter. K. Mr. Bell provided the NPMA update. He mentioned the NPMA Best Management Practices for pollinator protection was still under review. Also, due to a recent decision at US EPA, ( there is now an opportunity for rodenticide registrants to include certain non-commensal rodents on the label for structural uses. Registrants will need to go through the process of submitting label amendments for US EPA approval. L. Mrs. Lauren Fraulick invited Commission members to attend the GPCA Legislative Luncheon at the Capitol following the meeting. M. March 10, 2015

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the Agriculture Building on March 10th, 20i5. The following commission members were present: Chris Gorecki, Chair, Derrick Lastinger, Vice-chair, Laurie Padgett, Bodine Sinyard, Christy Kuriatnyk, and Greg Holley.
B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA and CPCO representatives, registrants and other members of the pest management industry.
C. Motion was made by Mr. Holley to approve the minutes of the March meeting. Mrs. Padgett seconded the motion and motion passed.
D. The Commission approved company license applications (see Attachment 2). E. Mr. Lastinger provided a letter and request from Mr. Guy with Good Guy's Pest Control's
letter requesting the Commission to review the advertising Rule 620-4-01 and consider an amendment regarding advertising on websites and social media. The Commission discussed the concerns from the letter and reviewed guidance from the GDA legal team. Since the Department does n_ot have the authority to enforce such requirements as proposed, the Commission does .not plan to amend the advertising rule. A letter will be drafted for Chairman Gorecki to ~espond on behalf of the Commission. F. Mr. Lastinger reviewed the current rule on the consideration of similar company names for new company license applications and company name change requests. G. The Commission discussed a name change request received from FPM Services requesting Focus Pest Management, LLC. Currently there is a licensed company under the name Focus Pest Control. FPM Services recently applied for the Focus Pest Management federal trademark. Motion was made by Mr. Sinyard to turn down the request for the name change. Mr. Lastinger seconded and motion passed. The -Commission requested that the GDA legal team review the similar name rule and determine if the Federal Trade Commission's registration of a company name trademark take precedence over the rule. H. Mr. Lastinger mentioned that GDA recently transferred approximately $90,000 to the University of Georgia as required by the Georgia Structural Pest Control Act. These funds are to continue tlie support of Dr. Brian Forschler's research in Household and Structural Entomology. The Commission briefly discussed the latest draft of the State Pollinator Protection Plan. The Commission agreed to review the draft plan and share comments at the next meeting. I. Mr. Lastinger provided the Department update. He introduced Ms. Jennifer Wren as the new Plant Industry Division Enforcement Manager. Mr. Tim Taylor made a few announcements regarding the 2015 licensing renewal. He noted that renewal notices will be mailed out by the end of April. Notices will also be sent to the email address on file for
each license.

J. Mr. Burton requested the Commission review a GDA case involving a consumer complaint
J and termite treatment failure and make a recommendation for corrective action under rule \ 620-6-.07(5). Mr. Burton provided details regarding the case. Motion was made by Mr. Sinyard to require a full .comprehensive soil treatment and to refresh the termite bait in all stations in compliance with the label. Mr. Gorecki seconded and motion passed.
I<. Mr. Rick Bell provided the NPMA update. He noted the upcoming legislative day held in Washington D.C. to discuss pollinators.
L. Mr. Lastinger discussed an upcoming meeting that he plans to attend with AAPCO and ASPCRO that will focus on pollinator protection plans.

C. Motion was made by Mr. Sinyard to approve the minutes of the March meeting. Mr. Holley

seconded the motion and motion passed.

D. The Commission approved company license applications (see Attachment 2).

E. Mr. Lastinger discussed a draft letter that will be sent in response to Mr. Charles Guy of

Good Guys Pest Control's request for a rule review of administrative rule 620-4-.01. At the

March meeting, the Commission considered the request and found that it would not have

the authority to implement such a rule. The letter was finalized and will be mailed to Mr.

Guy.

F. Mr. Lastinger discussed the pending application from FPM Services requesting a name

change to Focus Pest Management. Since the company applied for a Federal Trademark

after the initial application for a company license, the Commission requested a legal opinion

from the Georgia Attorney General's Office regarding the similar name rule and how it may

apply in this situation. G. Dr. Forschler provided the UGA update noting that the final publication of the American

Entomologist article concerning Georgia pesticide use regulations in schools. He noted that

the article notes information that could be useful for state lead agencies and individuals I
interested in school !PM regulation.

H. Mr. Gorecki discussed the current draft Georgia Pollinator Stewardship Plan. The

Commission discussed their support of the draft document. Motion was made by Mr. Holley

to approve the draft Georgia Pollinator Stewardship Plan. Mrs. Padgett seconded the

motion and motion passed.

I. Mr. Gray provided the Departmen~ : :update. He mentioned that the pesticide programs

received final U.S. EPA cooperative grant funding for FV15. Mr. Gray also noted changes

with the Department's Chief Financial Officer. Lastly, the Marketing Division will host the

annual Georgia Grown Symposium at the Georgia National Fair Grounds in Perry on April

30th.

J. Mr. Lastinger provided the program update. He discussed a recent U.S. EPA Structural

Fumigation workshop held in Atlanta at the Rollins Center. NPMA and ASPCRO partnered on

the workshop which demonstrated structural, commodity, chamber, tape and seal, and tarp

fumigations. He noted the success of the workshop which focused on U.S. EPA pesticide risk

assessment and registration staff. Lastly, Mr. Lastinger introduced and welcomed the new Georgia Farmer's Market Bulletin editor Ms. Amy Carter to the Commission meeting.

K. Mr. Taylor provided the licensing renewal update. He noted that certified operators will first

receive an email notification followed by a renewal statement in the mail to renew certified operator licenses by April 15th. The company and registered employee renewal

Registered Employees who have

not met the training requirement will have a status of "not eligible" on ,the company

renewal statement..The due date for all payments will be on June 30, 2015 with a late fee

accessed to any payments posted on or after July 1, 2015. All training records received by

the Department have been processed and training summaries are current online. Training

taken by registered employees on or after March 1, 2015 will not show on training

summaries until renewal period closes. L. Jim Wright with BASF shared concerns with Georgia's registration and Commission

acceptance of Termidor . HE under the Georgia Subterranean Termite Defined Treatment

Rule. He requested the Commission to consider amending the regulations to approve a

request of an alternate application technique when such application technique will result in

an efficacious use of the termiticide. The Commission discussed th_e possibility of starting

the rule making process in the future that may focus on the Wood Destroying Organisms

Chapter. The Commission asked Mr. Lastinger to draft a notice to the pest management

industry that will clarify the current acceptance of Termidor HE under the Georgia Defined

Treatment Rule.
M. Mr. Burton requested the Commission review a GOA case involving a consumer complaint (_
and termite treatment failure and make a recommendation for corrective action under rule

620-6-.07(5). Mr. Burton provided details regarding the case. Motion was made by Mr.

Sinyard to require a full comprehensive soil treatment and to install termite bait in all

stations in compliance with the label. Mr. Holley seconded and motion passed. Mr. Burton

discussed a second case for review involving a borate treatment failure and requested a

recommendation for corrective action under rule 620-6-.07(5). Motion was made by Dr.

Forschler to require a full comprehensive soil treatment. Mrs. Padgett seconded motion

and motion passed. N. Mrs. Lauren Fraulick provided the legislative update recognizing that the end to this year's

legislative session. She discussed an upcoming Governor's Proclamation signing recognizing

April as pest control month. 0 . Mr. Rick Bell discussed the Methyl Bromide incident in the U.S. Virgin Islands and NPMA's

effort to develop talking points. He also shared his appreciation for the Commission in their

continued support of the draft Georgia pollinator stewardship plan.

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the

Agriculture Building on May 12, 2015. The following commission members were present:

Chris Gorecki, Chair, Derrick Lastinger, Vice-chair, Laurie Padgett, Dr. Brian Forschler, Bodine

Sinyard, Christy Kuriatnyk, and Greg Holley.

B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA

industry. C. Motion was made by Mr. Sinyard to approve the minutes of the April meeting. Mr. Holley

seconded the motion and motion passed.

D. The Commission approved company license applications (see Attachment 2). During the

review the Commission discussed a new company license application from BugMan LLC.

The Commission discussed the name being similar to other currently licensed companies.

Motion was made by Dr. Forschler to approve the application pending submission of

another name. Mr. Lastinger seconded the motion and motion passed. Mr. Lastinger

mentioned that the legal department is considering the Commission's request to have the Attorney General's office review the similar name rule and company names that have a

Federal Trademark. E. Dr. Forschler provided the UGA report. Graduation took place last week. Summer field

research has started and students are working on several projects including drywood

termites, subterranean termites, mosquitos, and carpenter bee pollination. He also

discussed an upcoming engagement where he will be teaching an 1PM course at the

National Taiwan University. Lastly, he discussed the latest draft of the Georgia Pollinator

Stewardship Plan. Mr. Lastinger mentioned an additional stakeholder meeting had been

hosted by the Georgia Agribusiness council. Comments from this meeting were considered

by the committee and the draft document was revised. The revised draft will be sent to

members after the meeting. F. Mr. Lastinger provided the Department update. He discussed several pest control related

articles published in the Georgia Farmer's Market Bulletin including bed bug outreach,

reporting brown marmorated stink bugs and GPCA President Jeff Dunn's guest column.

G. Mr. Lastinger discussed a concern received from a Georgia consumer, Mr. Robbie Baron.

Mr. Barron wanted to express his concerns to the Commission that termite contracts do not

state boldly that termite damage .found when t ermite infestations are inactive will not

covered for damage repairs. The Commission discussed the difficulties i~ deiterniiningwh~n

reviewing the WDO rules in the next rule change.

H. Mr. Taylor provided the licensing renewal update. He noted that certified operator renewal

notices have been distributed by email and regular mail. If a renewal notice has not been

received, contact the licensing division. Company and registered employee renewal notices (
will be distributed later today.

I. Mr. Gorecki discussed the background on the Commission reviewing termite retreatment

cases. He highlighted a Commission decision to review all cases that fall under the

complete retreatment rule with termite baiting or wood treatment preventive treatment

types in response to a proposed rule change. Mr. Lastinger discussed Rule 620-6-.07(5) that

states, "Any structure under contract with a licensee found by either the licensee or the

Enforcement Agency to have three or more separate areas of active infestation from

subterranean termites .within a 5 year period shall receive a complete retreatment in

accordance with the minimum treatment standards". When these cases are discussed, the

Commission makes a recommendation to the Department. The recommendation is then

issued by the Department as a corrective action to the licensee.

J. Mr. Burton requested the Commission review a case involving a consumer complaint

regarding a termite treatment failure. He provided details regarding treatments and

inspections. Motion was made by Mr. Gorecki to require a comprehensive soil treatment.

Mr. Sinyard seconded and motion passed.



I<. Mr. Mel l<yle representing Polyguard presented details regarding a TERM Particle Barrier

System which is a new device installed around a structure for protection against

subterranean termites. The product is a termite exclusion product consisting of naturally

occurring stone particles which acts a physical barrier against subterranean termites.

L. Mrs. Lauren Fraulick provided the legislation update.

M . Mr. Lastinger announced the recently published Public Notice 15-02. The notice provides (

information regarding the July Commission meeting. The meeting will start at 10:00 AM in

The Barn at Jaemor Farms located at 5340 Cornelia Highway Alto, Georgia 30510. The public

notice has been published on the Commission website.

N. Mr. Lastinger discussed draft notice 15-03 regarding the Georgia Registration status and

Commission acceptance of Termidor HE for professional use in Georgia for the control and

prevention of subterranean termites. Motion was made by Dr. Forschler to accept and

publish the notice on the website. Mr. Sinyard seconded and motion passed.

A. The Georgia Structural Pest Control Co mmission convened at 9:30 a.m. in Room 201 of the

Agriculture Building on June 9, 2015. The following commission members were present:

C. Motion was made by Mr. Sinyard to approve the minutes of the May meeting. Mrs. Padgett

seconded the motion and motion passed.

D. Th e Commission approved company license applications (see Attachment 2).

E. Mr. Lastinger provided the Department update. He discussed the closing of the state fiscal

year 2015 and the current.transition into the state fiscal year 2016. The st ate pollinator

protection plan went out for comment and has now been fina lized. He also discussed an

upcoming Georgia Clean Day event scheduled for July 22, 2015. The event will be located at

(

the Gwinnett County Fair Grounds. Pre- registration is required to participate. The event is

'

open to commercial pesticide applicators, pest control operators and agriculture

applicators. Mr. Lastinger asked the pest control associations to distribute event

information to their members.

F. Mr. Lastinger addressed an inquiry regarding t he electronic communication

acknowledgement statement/ form for pesticide use records and if it could be accepted

electronically as well. The department did review the rule and found that this was

acceptable and would need to have the ability to provide a copy of the record if req uested.

G. Mr. Lastinger provided the licensing renewal update. He included a reminder that all licenses will expire on June 30, 2015. Accordingly, beginning July 1st all licensing fees will

double during the late renewal period.

H. Mr. Burton discussed the current enforcement response for issuing ..the Official Georgia

Wood Infestation Inspection Report on the old version and not as required by the April 1,

2014 rule change. Since th e compliance assistance period ended on January 1, 2015, the

Department is issuing a mon etary penalty for non-compliant reports.

I. Mr. Lastinger discuss!j!d the recently issued federal strategy for pollinator protection. The

federal strategy includes pollinator _research, expanding education and outreach for public

and private partnerships and improving pollinator habitat. US EPA strategy also relea sed a

draft strategy that is open for public c9rnment. The strategy includes restrictions on

pesticides that are considered highly toxic to pollin ators and promotes communication

between growers and honey bee keepers. J. Mr. Lastinger provided details for the July 14th Commission meeting. He noted that the

meeting will be held in the barn at Jaemor Farms located 5340 Cornelia Highway in Alto,

Georgia. The meeting will begin at 10:00 AM. There will be an optional tour of the farm beginning at 9:00 AM for anyone that is interested. K. Mrs. Fraulick provided the legislative update. She noted tax reform will likely be a focus in the 2016 legislative session. L. Mr. Lastinger announced that the 2016 ASPCRO conference will be in Ft. Lauderdale and hosted by the Florida Department of Agriculture and Consumer Services. Registration is now open for the conference and the agenda has been posted. M. Mr. Gorecki provided the NPMA update. He noted that the NPMA policy update has been distributed. N. Commissioner Black greeted the Commission and expressed his gratitude for Mrs. Laurie Padgett's service as the consumer affairs representative since 2011. He recognized Mrs. Padgett for her service with a proclamation. Mrs. Padgett expressed her app_reciation for the opportunity to serve on the Commission. 0. Meeting adjourned at 10:55 AM.
