The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the Agriculture Building on July 8, 2014. The following commission members were present: Chris Gorecki, Chair, Derrick Lastinger, Vice-chair, Laurie Padgett, Dr. Brian Forschler (via teleconference), Bodine Sinyard, Christy Kuriatnyk, and Greg Holley. B. Also in attendance were Josh Wiley with the Georgia Department of Agriculture, registrants, and other members of the pest management industry. C. Motion was made by Mr. Sinyard to approve the minutes of the June meeting. Mr. Holley seconded the motion and motion passed. D. The Commission elected chairman and vice chairman positions for FY 2015. Mr. Sinyard recommended a motion for Mr. Gorecki to be chairman and Mr. Lastinger to be vice chairman. Mr: Holley seconded the moti.on, the Commission agreed and the motion was approved. J.. E. The Commission approved company license applications (see Attachment 2). F. Dr. Forschler provided the UGA program update. He stated the plans of posting the draft employ~e registration manual on the Commission we~page for public comment. In keeping , up with the new rule compliance timeline, the registration manual will need to be .completed before the end of the year. The draft manual will be posted on the website for 30 days. G. Mr. Lastinger provided the Department update. He noted the recent success of the recent farmer's market showcases held in Macon, Atlanta, and Savannah. The next showcase will be in Moultrie. Lastly, he mentioned that the Structural Pest Section had a consumer outreach booth that provided information on licensing and pest man~gement. H. Mr. Lastinger provided a program update. He discussed a recent GDA email notification sent to all licensees announcing the recently issued new rule guidance. The documents include the WDO Con_tract fact sheet, Pesticide Use Record Compliance fact sheet, Official Waiver form fact sheet, Official Georgia Wood Destroying Organism Infestation Inspection Report and Under-floor Space Ventilation fact sheet. He noted that the posting of the draft registration manual will also be sent out in an email notification. These notifications are sent to Certified Operators and Licensees that have an email address on file with their license. He noted that the new rule. implementation steps are currently on schedule with the new rule compliance timeline. Mr. Lastinger recommended the removal of two guidance documents from the website. He made a motion to remove notice 03-01 non-soil exposed crawl spaces and new construction and the old guidance instructions for completing a wood infestation report. Mr. Sinyard seconded the motion and the motion was approved. I. Mr. Rick Bell reported on a two day workshop he attended with representatives from ( NPMA, EPA, and ASPCRO. Such topics discussed were termite management and pollinators. Discussion of future workshops included a proposal to ( focus the next one on structural fumigation. Mr. Rick Bell reported on a meeting he attended with th e Georgia Associations of Realtors (GAR} involving termite inspection and termite damage repair language on the GAR contract. Those attending the meeting agreed to work together on improving the contract language. H. Mr. Holley recognized Mrs. Lara Fink for her years of service to the Georgia Pest Control Industry and Commission. I. Mr. Go_recki welcom.ed and introduced Ms. Glenda Lehmberg as the new executive director of CPCO of Georgia. . . J. ": Dr< Fors~hler provided the UGA update. He noted that classes will begin shortly for the fall semester. He recognized and appreciated the positive feedback from the comments received on the Employee Registration Manual draft. He also suggested keeping the draft on the website for another week for additional public comments. The test questions are currently being revised and new questions will be added to the test bank. Lastly, he mentioned an article from an entomology journal by the name of American Entomologist. The article discussed the Structural Pest Control Section and cited several topics that were misleading on various topics such as enforcements efforts, mandated laws, and practices. Dr. Forschler suggested that the Commission consider responding through an editorial rebuttal. I<. Mr. Lastinger provided the Department update. He welcomed and introduced Mr. Adam Dye who works in the Department's policy office. He also provided an update on the Biowatch exercise and appreciated the commission members for their time and ( participation. Commission Minutes August 2014 Page 1 of 4 L. Mr. Lastinger requested the Commission review a GDA case involving a consumer compliant ( and termite treatment failure and make a recommendation for corrective action under rule 620-6-.07(5}. Mr. Wesley Burton provided details regarding the case. After discussion, the Commission made a motion requiring a complete comprehensive soil applied termite treatment and refresh termite bait products in all of the termite bait stations. M. Mr. Lastinger provided the program update. He discussed the upcoming Annual Conference of the Association of Structural Pest Control Regulatory Officials beginning this month in Montana. A discussion of Pollinator Protection and label language requirements for neonicotinoids will be on the agenda. N. Mr. Gorecki congratulated Mrs. Connie Rogers with GPCA for her recent promotion to the executive director for GPCA. 0. Mr. Rick Bell provided the NPMA update. There is possible news that EPA has decided .not to issue a PR notice on the pollinator protection label language. Mr. Bell's hopes are that the ASPCRO language interpretations will be accepted by all states. P. Lastly, the Commission discussed several locations to have the meetings for the year of 2015. He introduced the newest representative of Georgia Link, Ms. Lauren Fraulick. F. Dr. Forschler provided the UGA update. He thanked those that contributed to the comments received on the draft Employee Registration Manual. He explained that most of ( the comments will be included into the manual. The projected goal is to have a final revised draft to the Commission by the October meeting. The rebuttal draft letter to the American Entomologist article on regulating pesticides in schools is also in the process of being reviewed by the Commission members. Lastly, he discussed a group of UGA faculty that convened to write a position statement on protecting pollinators. Dr. Forschler distributed the statement draft among the Commission members. He suggested the Commission get involved to work together on a mission statement that will represent the pest control industry's perspective. Mr. Lastinger added that there was also a GDA Georgia Pollinator Protection planning meeting that recently took place at the GOA Tifton Lab which was hosted by GDA Plant Protection Director Mike Evans. The meeting's initiative was to develop a plan for agriculture groups and in the near future incorporating urban pest control and the general public. Commercial beekeepers were included in the first meeting. Mr. Lastinger will get more information regarding the recent Tifton meeting and report back to the Commission at the next meeting. G. Mr. Lastinger reported on the success of the Annual ASPCRO Conference. He mentioned the discussion of pollinator protection and EPA's plan include additional pollinator protection language on pesticide labels. The label language is expected to be similar to that of neonicotinoid label language. , H. Mr. Lastinger provided a Department update. He introduced members of the Structural Pest Team that attended the meeting. He also updated the Commission on the Biotech case which was referred to US EPA Region 4 for pesticides misuse in nursing homes in several ( southern states. The operator was sentenced two weeks ago in Federal court in Macon with a $7,500 fine. The corporation was sentenced to three years probation and a $50,000 Commission Minutes September 2014 Page 1 of 4 ( fine. Mr. Lastinger discussed a request from the August Commission meeting where the Commission requested representatives from Athens Technical College (ATC) to attend the Commission meeting to provide a program update. ATC administers the GA Pest Exam program. Dr. Tidings, president of ATC is planning to attend the Commission meeting for January. Recently ATC requested funding to update the firewall software and hardware that supports the program. GDA was able to secure funding and purchase the equipment for ATC. I. The location of the November Commission meeting is scheduled to take place at the Tifton Lab on November 1ith. J. The Official Waiver Compliance Fact Sheet that the Commission issued in June 2014 has been revised to correct a typo in section number 4. He announced plans for the House to pass a bill by the first of next week to disapprove EPA's request for waters of the US, which would have allowed them to govern drainage ditches, moist spots in yards, and areas that are wet for thirty days during the year. This practice exam will be available on December 15th, 16th and December 1ih. GOA will monitor the exam results and make modifications as needed. Revised registration and certification exams are expected to be in place for all exams starting in January 2015. J. Dr. Phillip Roberts, University of Georgia extension entomologist, provided information on ( the UGA pollinator mission statement. UGA plans to meet next week with Mr. Mike Evans, Commission Minutes November 2014 Page 1 of 5 Director of the Plant Protection Section, to discuss a pollinator protection plan for t_he State of Georgia. Dr. Roberts stressed the importance of communication and education to the public and the industry surrounding pollinator protection. In the document/statement that the University of Georgia is putting together, there are discussions on maintaining healthy bee colonies and ways to reduce the exposure of pollinators to pesticides. I<. Mr. Lastinger provided the 2014 new rules timeline update. He noted the progress continues to move further along on implementation of the new exam questions. In addition to the exams, notices have been sent out to all licensees regarding the publication of the new Employee Registration manual including the new guidance documents that were approved by the Commission last month. The documents have been posted on the website. Implementation continues to be on schedule with the compliance date of January 1, 2015. Accordingly another important date to note is March l 5t 2015, which is the deadline for all registered employee training for renewal of registrations. Registered Employees who have taken the exam after September 30, 2014 are exempt from getting the required training hours for renewal. L. Mr. Gorecki discussed the recently drafted Wood Destroying Fungus and Wood Boring Beetle guidance documents. The documents continue to state what the minimum treatment requirements are in addition to the ventilation standard changes. Motion was made by Mr. Sinyard to accept the two documents. Dr. Forschler seconded the motion and motion passed. The new guidance will be posted on the website and the pest control associations were asked to assist with outreach on getting this information to their E- membership. GDA was asked to look at the website statistics for the Commission webpage and report back. M . Mr. Lastinger reported on further clarification of the interpretation of "conditioned air" in Section R408.3 of the IRC building code for unvented crawl spaces. After reaching out to the Department of Community Affairs and Southface technical services, GDA learned that the most common practice for providing conditioned air in new construction is with HVAC ductwork with 2 cfm/100 s.f. A variation to providing cond itioned air is with a dedicated dehumidifier supplying at least 2 cfm/100 s.f. The dehumidifier must be plumbed to automatically drain the captured condensate away either by gravity, to a sump pump, or to the air conditioner's condensate pump. N. Mr. Gorecki provided the update regarding NPMA's efforts on rodenticides. He noted that there was a petition in New York wanting to change second generation rodenticides to restricted use pesticides. However, there is a mandate in New York's regulation listed by the Commissioner that does not allow restricted use pesticides to be used if there is a viable alternative. Local associations and NPPMA were heavily involved in providing input on the issue. O. In an effort to raise awareness, Mr. Lastinger discussed the GDA Self-reporting Enforcement Response Policy for the pest control industry. The goal of the policy is to enhance compliance with regulations by encouraging the industry to self-aud it and self-discove r violations by self-reporting this information to the Department. According to Mr. Burton, there is a decline in the number of reports. There are three steps to self-reporting: Commission Minutes November 2014 Page 2 of 5 ( 1. Dr. Forschler provided the UGA update. He mentioned that the Commission letter will be published by the American Entomologist magazine in spring 2015. He also noted the details for the January Commission meeting which will be at the University of Georgia in Athens, h_osted by the Entomology Department. Lastly, Dr. Forschler mentioned that the revised and new questions for the employee registration exam question bank were completed and submitted to GOA for final review. D. Mr. Taylor announced an opportunity to take the new employee registration sample exam. ( The exam will be available to take on December 15th, 16th and the 1ih. Pre-registration is required to take the exam. The sample exam is available through Georgia Pest Exam and registration of the sample exam should be made under the "Mouse Club Exam". All exam proctoring rules will apply to keep the exam questions secure. GOA will do further review of the exam questions and results and make needed revisions. Dr. Forschler further explained the breakdown of new questions and revised questions including the new manual sections on 1PM and pesticide mode of action. E. Motion was made by Mr. Sinyard to approve the minutes of the December meeting Mr. Holley seconded the motion and motion passed. F. The Commission approved company license applications (see Attachment 2). G. Mrs. Lauren Fraulick provided the legislative update. She noted a recent legislative training that took place in Athens to discuss topics such as the budgeting process, economic development and transportation. All topics were discussed in preparation for the upcoming session starting on January 1ih with the inauguration event taking place at the new Liberty Plaza. H. Mr. Lastinger provided an update on the new rule compliance timeline and final implementation. He reminded the Commission of the compliance date of January 151. As requested last month, Mr. Lastinger provided a report of the Commission website activity. The report indicated that website hits doubled for the same reporting period in 2014 compared to 2013. I. Mr. Lastinger mentioned that GOA received several inquiries from PMP's regarding the issuance of the NPMA-33 form. He noted that the rule requires the use of the state l mandated Official Georgia Wood _Infestation Inspection Report form to be issued Commission Minutes December 2014 Page 1 of4 exclusively. Mr. Holley suggested reaching out to the Board of Realtors to assist with outreach on the Georgia requirement. J. Mr. Taylor discussed recertification course renewals and notices for 2015; the notices were distributed last week. Currently there have been 800 courses submitted for renewal, 750 of those were submitted online and 50 were submitted through email. Course approval notifications are planned to be sent out throughout the upcoming weeks. I<. Mr. Lastinger discussed the pollinator protection update. He mentioned a recent meeting with UGA and GDA representatives that are drafting a state pollinator protection plan. Once the draft is complete, it will be distributed to stakeholders. Dr. Keith Delaplane, UGA Professor and Honey Bee Program Director, discussed the draft I Pollinator Protection Plan for Georgia. He discussed an upcoming public meeting to be held at the Farm Bureau Building in Macon to discuss the draft plan. The document advises the best practices on protecting honey bees, pollinator conservation and urban considerations for homeowners. Dr. Forschler noted that most of the draft plan addresses agriculture and that it would be helpful to educate PMP's on pollinator protection practices around structures. G. Dr. Forschler provided the UGA Urban Entomology research update and report including details of several projects focusing on carpenter bees, mosquito sampling techniques, mosquito treatments around homes, plastic termite barriers, termite bait field trials and treated lumber trial for carpenter bee protection. His students will provide research updates at 5:00 P.M. today at the GPCA Winter Conference. (see attachment 3 for the report) H. Dr. Dan Suiter, University of Georgia's Professor of Entomology, provided an extension update. He noted upcoming workshops including several new workshops (Bed bug, School 1PM, Commercial 1PM and residential 1PM) webinars to be hosted by UGA Extension Griffin Campus. I. Mr. Tommy Gray provided the Department update. He noted November's re-election of Commissioner Black and thanked him for being very supportive of the Plant Industry . Programs. He also discussed th e opportunity to fill several vacancies including two inspectors to the Structural Pest Section. He introduced and recognized Dr. James Sutton with the Department's Leadership team for attending the meeting. J. Mr. Lastinger provided the program update. The new and revised documents are all posted on the Commission website. He also mentioned the compliance assistance webpage that hosts a library of new rule guidance for industry members to reference. The program will receive US EPA funding to support several new projects and activities in 2015 and 2016. These projects include School 1PM, Pollinator Protection and Bed Bug Outreach. Lastly he mentioned that GOA wil) host an ASPCRO/NPMA Structural Fumigation Workshop for US EPA Registration staff in March 2015 at the Rollins Learning Center in Atlanta. I<. Mr. Taylor provided the licensing update. He reminded the industry of this year's upcoming renewal and stated that all license payments are due by June 30th. Industry members should expect to see license renewal packets in the mail this spring. He recommended everyone to go online to ensure accuracy of all licensing mailing address and contact information. The training deadline for Registered Employees renewal is coming up on February 28th. L. Dr. Flora Tydings and Mr. Dennis Ashworth with Athens Technical College provided an update on the pest exam project. The examination process has drastically improved since it came online in 2006. Today, exams are administered at 33 Technical College testing centers around Georgia. It is estimated that the pesticide and pest control industries has saved over 3 m illion dollars a year with the current pest exam program. To date over 16,382 individuals have tested through the centers. Mr. Ashworth thanked the Department for all of the ( testing program's support from GOA and the pest control industry. He updated attendees on many additional services the program provides, such as fast and efficient help desk support, system hardware and software updates, and professional proctor training. Last year there were roughly 4,100 exams administered with a little over 32,000 exams administered since over the past 9 years. GOA was recognized for providing funding for the recent software and hardware update that was needed. M. Mr. Rick Bell provided a NPMA update. He discussed a proposal in Montgomery, Maryland from a county commission to ban the use of neonicotinoids in turf use and structural use in private and public buildings. The research programcontinues to investigate insect pests common in the urban habitat in the quest to develop realistic pest management recollllllendations. Graduate student research on mosquito and termite pests are =mining questions that include comparison ofsamplingmethods for mosquitos as well as efficacy ofp~ticide interventions for their control, collective decision making in termite colonies, and the ecological role ofsubterraneantennites. Afield trial was established to test 4 types oflumber treatments for managementofcaipenter bees where after onefield season no new nests were observed in any ofthe boards, including the controls, which indicates a slow rate ofnew nest establishment Fieldwork on d!ywood and subterranean tennites continues with deu1onstration projects on University property. The research program also donated a collection ofover 180 samples oflermite alates collected over the past 20 years that includes all 5 species ofsubterranean termites found in Georgia. The species-specific flight times fromthose samples shows that theeastern subterranean termite, Reticuliten11esjlmipes, bas the longestflight period - from November to April. R. nelsonae the shortest flight period from February through March, and that R. virigi11c11s andR.malletei overlap during April through June with R. llageni swarmsfrom August through October. 1llis infonnation is useful in identifying the species oftermites involved in a stmctural infestationand our data from the can1pus demonstration projectshows that 92% ofall infestations are caused by R.jlmripes with 4%R. virgi11ic11.s while 2% are R. /Jageni and the last 2%, R. malletel, (R. ne/sonae is not found inthe Athens area). EXPENDITURES: Graduatestudent stipendsfscholarships cost approximately$64,000 in addition to $12,000, for supplies and equipment. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 300B of the Agriculture Building on February 10, 2015. The following commission members were present: Chris Gorecki, Chair, Derrick Lastinger, Vice-chair, Laurie Padgett, Dr. Brian Forschler, Bodine Sinyard, Christy Kuriatnyk, and Greg Holley. B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA and CPCO representatives, registrants and other members of the pest management industry. C. Motion was made by Mr. Sinyard to approve the minutes of the January meeting. Mr. Holley seconded the motion and motion passed. D. The Commission approved company license applkations (see Attachment 2). E. After discussing several issues concerning similar company names, the Commission discussed adding license issuance dates to the list ofsimilar names when considering new company license applications. Mr. Holley suggested that the Commission adopt a policy on company name approvals. The Commission agreed to review the rules regarding company ( name requirements and consider the need for new policy. Mrs. Padgett added that when I the Commission reviews the rule to also discuss what is considered "substantially similar". F. Dr. Forschler provided the UGA update. He discussed an issue with the brown marmorated stink bug found on vehicles that were exported out of the Port of Savannah to New Zealand and Australia. Accordingly, an embargo was issued this month that initiated port officials to find ways to fumigate or heat treat the vehicles prior to export. Mr. Las.tinger added that GOA was contacted regarding the use of ProFume to treat for the brown marmorated stink bug and licensing requirements. Since the Georgia Structural Pest Control Act defines structural pest control to include the fumigation of railroad cars, trucks, ships and airplanes and agriculture commodity fumigation is limited to agricultural commodities, it was determined that a structural fumigation license is required to fumigate vehicles. This issue went throu&h legal review since it involved several laws. Dr. Forschler also mentioned that the rebuttal to the American Entomologist article on school pesticide regulations was finally submitted. Lastly, he discussed the comments that he prepared on behalf of the Commission in response to the UGA draft pollinator protection plan for Georgia. The comments included helpful practices for property owners, as well as pest management considerations which were based ori the current NPMA best management practices document. The document will be posted on the Commission website. G. Mr. Lastinger also discussed a draft memo regarding HUD & VA acceptance of the Official Georgia Wood Infestation Inspection Report. The memo provides the clarification that according to the rules for the Georgia Pest Control Act, only the Official Georgia Wood ( Infestation Inspection Report may be issued for the transfer of real property and no other Commission Minutes February 2015 Page 1 of4 forms may be issued. He announced Ms. Jennifer Wren as the new enforcement and compliance manager for the Plant Industry Division. He also discussed Commissioner Black's most recent State of the Department address noting the Department's progression over the years including recognition of work accomplished by the Strudural Pest Section. I. Mr. Lastinger provided the Program update. He mentioned the recent departure of Market Bulletin's editor; therefore, program staff will assist with writing articles for the bulletin. There are plans to submit articles regarding pollinator protection and the development of the state plan, GOA activities at the Port of Savannah and consumer awareness on bed bugs. He discussed a recent division meeting involving all of the Plant Industry Division's ffeld staff. The meeting highlighted Inspection Standard Operation Procedures which is part of a Department effort to enhance consistency across divisions. J. The Commission received a letter from Mr. Charles Guy with Good Guy's Pest Control. His letter addressed requested the Commission to review Rule 620-4-.01 on advertising and consider amending the rule to .further ~estrict licensee advertising on websites and social media and from using any part of another licensee name. Mr. Guy addressed his letter and concerns. The Commission acknowledged his concerns and requested the GOA legal team to review his letter. K. Mr. Bell provided the NPMA update. He mentioned the NPMA Best Management Practices for pollinator protection was still under review. Also, due to a recent decision at US EPA, ( there is now an opportunity for rodenticide registrants to include certain non-commensal rodents on the label for structural uses. Registrants will need to go through the process of submitting label amendments for US EPA approval. L. Summer field research has started and students are working on several projects including drywood termites, subterranean termites, mosquitos, and carpenter bee pollination. He also discussed an upcoming engagement where he will be teaching an 1PM course at the National Taiwan University. Lastly, he discussed the latest draft of the Georgia Pollinator Stewardship Plan. Mr. Lastinger mentioned an additional stakeholder meeting had been hosted by the Georgia Agribusiness council. Comments from this meeting were considered by the committee and the draft document was revised. The revised draft will be sent to members after the meeting. F. Mr. Lastinger provided the Department update. He discussed several pest control related articles published in the Georgia Farmer's Market Bulletin including bed bug outreach, reporting brown marmorated stink bugs and GPCA President Jeff Dunn's guest column. G. Mr. Lastinger discussed a concern received from a Georgia consumer, Mr. Robbie Baron. Mr. Barron wanted to express his concerns to the Commission that termite contracts do not state boldly that termite damage .found when t ermite infestations are inactive will not covered for damage repairs. I. Mr. Gorecki discussed the background on the Commission reviewing termite retreatment cases. He highlighted a Commission decision to review all cases that fall under the complete retreatment rule with termite baiting or wood treatment preventive treatment types in response to a proposed rule change. Mr. Lastinger discussed Rule 620-6-.07(5) that states, "Any structure under contract with a licensee found by either the licensee or the Enforcement Agency to have three or more separate areas of active infestation from subterranean termites .within a 5 year period shall receive a complete retreatment in accordance with the minimum treatment standards". When these cases are discussed, the Commission makes a recommendation to the Department. The recommendation is then issued by the Department as a corrective action to the licensee. J. Mr. Burton requested the Commission review a case involving a consumer complaint regarding a termite treatment failure. He provided details regarding treatments and inspections.
