We are pleased to transmit to you the "Summary of General Statutes Enacted at the 1983 Regular Session of the General Assembly of Georgia." This represents one of the services which the Legislative Services Committee and the Office of Legislative Counsel perform for the legislative branch of government. Other services include bill drafting, research, statutory and Code revision, rendering of opinions, counseling, legislative reference, interim committee staffing, and preparation of reports.
The Office of Legislative Counsel drafted a total of 3,781 bills, resolutions, and amendments for the 1983 session. Of this number, 757 had been prepared by the convening date of the session, leaving a total of 3,024 which were drafted during the session.
The other members of the committee and the Office of Legislative Counsel join me in the sincere hope that this booklet will be of benefit to those who use it. If we may be of service, please feel free to call upon us.

FOREWORD

This booklet contains a summary of the general statutes of statewide application which were enacted at the 1983 regular session of the General Assembly of Georgia. No resolutions, "population" Acts, or Acts with special application have been included.

It would be impractical to minutely

analyze each statute because to do so would defeat

the main purpose which it is hoped that this

booklet accomplishes. It is intended that it be

used as a convenient reference for persons

desiring to know which laws were enacted or

desiring to ascertain the main features of each

Act without the necessity of reading it in its

entirety. It should be pointed out that for

specific, detailed information on any particular

law, the Act itself should be examined.

TITLE 1 GENERAL PROVISIONS

Makes extensive editorial amendments

to the Official Code of Georgia

Annotated,

so

as

to

correct

typographical, stylistic, and other

errors and omissions and so as to change

citations and language in conformity

with the Constitution of 1982. Provides

that the Official Code of Georgia

Annotated may be cited or referred to as

"O.C.G.A." Reenacts the

statutory

portion of the Code as so amended.

Effective January 25, 1983.

Act 293; HB 21; p. 685
Provides that no local Act may abolish or shorten the term of an elected office during a term of office unless the Act is approved in a referendum by the affected voters.
Enacts O.C.G.A. Section 1-3-11. Effective July 1, 1983.

TITLE 2 AGRICULTURE

Act 418; HB 90; p. 831

Requires each applicant for a new or

renewal grain dealer's license to

furnish with the application a current

financial statement.

Increases the

minimum amount of a grain dealer's bond

from $10,000.00 to $20,000.00 and

increases the maximum amount of the bond

from

$100,000.00

to $150,000.00.

Provides that the exemption from

licensure and bonding for persons who

buy grain for cash shall apply only in

cases where payment is made at the time

of purchase by U.S. currency, certified

check, or cashier's check.

Amends O.C.G.A. Sections 2-9-32,

2-9-34, and 2-9-44.

Effective July l, 1983.

TITLE 3 ALCOHOLIC BEVERAGES

Act 411; HB 625; p. 806
Extensively revises the procedures for the calling and conducting of special elections as to the manufacture, sale, and distribution of distilled spirits and the sale of distilled spirits by the

drink. Amends 0.C.G.A. Sections 3-4-41,
3-4-43 through 3-4-45, 3-4-91, and 3-4-92.
Effective March 18, 1983.

Act 504; SB l; p. 1214

Requires

persons

shipping malt

beverages into the state to designate

sales territories in the state and to

name one licensed wholesaler in each

territory for each brand of beer.

Prohibits owners and employees of malt

beverage brewers, brokers, and importers

from owning any interest in a wholesaler

or retailer.

Prohibits brewers,

brokers, and importers from imposing

certain conditions on wholesalers.

Repeals 0.C.G.A. Section 3-5-22 and

enacts 0.C.G.A. Sections 3-5-29 through

3-5-34.

Effective July 1, 1983.

Act 453; HB 171; p. 1116

Authorizes farm wineries to sell wine

at retail on their premises and in

tasting rooms. Authorizes farm wineries

to sell their wine at wholesale if their

annual production does not exceed 24,000

gallons and a wholesaler has declined to

purchase the wine.

Exempts from

taxation wine sold to persons outside

the state for resale or consumption

outside the state.

Amends 0.C.G.A. Sections 3-6-21.1 and

3-6-70.

Effective March 29, 1983.

Act 363; HB 627; p. 759
Amends 0.C.G.A. Section 3-8-1, so as to provide that alcoholic beverage sales at county and municipal airports shall be taxed as in other cases according to the place of the sale but shall be licensed by the county or municipality which owns or operates the airport.
Effective March 16, 1983.

TITLE 4 ANIMALS

Act 492; HB 401; p. 1161
Revises the laws relating to bonding and regulation of livestock dealers, brokers, packers, and market operators. Provides that the custodial account of each operator of a livestock sales establishment must be maintained in a bank which is located in this state and within 100 miles of the sales establishment. Changes the formulas for calculating the bonds of livestock sales establishments and livestock dealers and brokers and requires licensees and applicants for licensure to submit current financial statements.
Amends O.C.G.A. Chapter 4-6. Effective July 1, 1983.

TITLE 5 APPEAL AND ERROR

Act 304; SB 69; p. 702

Amends O.C.G.A. Section 5-5-42, so as

to specify a form for motion for new

trial in criminal cases and so as to

correspondingly

modify

the

form

previously used for motion for new trial

in both civil and criminal cases.

Effective July 1, 1983.

TITLE 6 AVIATION

Act 271; HB 492; p. 647
Provides that the interests of private persons in facilities located on public property used for airport purposes, which facilities are leased to, controlled by, or occupied by the private persons, are declared not to be used for public purposes. Provides that such interests of private parties, whether an estate in land or merely possessory, are subject to ad valorem taxation.
Amends 0.C.G.A. Section 6-3-21. Effective March 16, 1983.

TITLE 7 BANKING AND FINANCE

Act 216; HB 15; p. 493

Amends O.C.G.A.

Section

7-1-4,

relating

to definitions involving

financial institutions, so as to delete

from the definition of the term "bank"

an

obsolete

reference

to

the

Constitution of 1976.

Effective July 1, 1983.

Act 240; SB 161; p. 532

Revises the restrictions on financial

transactions between officers

and

employees of the Department of Banking

and Finance and regulated financial

institutions.

Authorizes employees

other than the commissioner and deputy

commissioner to borrow from nonstate

regulated institutions owned by state

regulated institutions and exempts

lender credit card obligations.

Amends O.C.G.A. Section 7-1-37.

Effective March 15, 1983.

Act 255; SB 162; p. 602
Amends O.C.G.A. Section 7-1-71, so as to provide for removal of directors, officers, or employees of financial institutions who have been indicted for crimes involving moral turpitude or who have filed for bankruptcy.
Amends O.C.G.A. Section 7-1-110, so as to authorize the board of directors of any financial institution to provide that Saturday shall not be a business day of the institution.
Enacts O.C.G.A. Section 7-1-237, so as to provide for reimbursement to financial institutions for responding to garnishments, attachments, subpoenas, and other processes involving their customers.
Amends O.C.G.A. Section 7-1-261, so as to restate the incidental powers of banks and trust companies.
Amends O.C.G.A. Sections 7-1-284 and 7-1-285, so as to change the amount of acceptances or obligations of any one person which a bank may hold.
Amends O.C.G.A. Section 7-1-288, so as to authorize banks to own shares in nonsubsidiary safe-deposit and real estate corporations and corporations promoting international trade.
Amends O.C.G.A. Section 7-1-290, so as to provide that an irrevocable letter of credit issued by a domestic bank may serve in place of any legally required bond, surety, or pledge of assets.

Amends O.C.G.A. Section 7-1-293, so as to provide for applicability to savings and loan associations of certain statutes relating to management and corporate affairs of banks and trust companies.
Enacts 0.C.G.A. Section 7-1-234, so as to authorize financial institutions acting as fiduciaries to make otherwise prudent investments in securities underwritten by themselves or their affiliates.
Amends 0.C.G.A. Section 7-1-394, so as to clarify the authority of the Department of Banking and Finance to approve special purpose banking and trust companies conducting limited banking business in the area of trade.
Amends O.C.G.A. Section 7-1-491, so as to increase to $25,000.00 the maximum amount which a bank or trust company may lend to one of its directors or officers.
Amends O.C.G.A. Section 7-1-512, so as to change the required contents of articles of amendment of banks and trust companies.
Amends 0.C.G.A. Section 7-1-602, so as to change provisions relative to authorization of bank offices and bank facilities.
Amends 0.C.G.A. Section 7-1-608, so as to authorize bank holding companies to acquire a bank or trust company organized solely for the purpose of facilitating acquisition of the trust department of a bank in existence for five years.
Enacts 0.C.G.A. Section 7-1-612, so as to authorize banks which do not exercise trust powers to contract with another bank for such other bank to furnish trust services through the facilities of the bank not exercising trust powers.
Amends O.C.G.A. Section 7-1-632, so as to provide that department approval of the articles of a credit union shall indicate any change made to the articles.
Amends O.C.G.A. Section 7-1-634, so as to direct the department to file with the Secretary of State any amendment to the bylaws of a credit union which affects its field of membership.
Amends 0.C.G.A. Section 7-1-670, so as to delete the requirement that a credit union have total assets in excess of $1 million in order to offer third-party payment services.
Amends O.C.G.A. Section 7-1-845, so as to provide that it shall be a felony to willfully engage in the business of a

credit union without proper authority. Amends O.C.G.A. Section 7-1-862, so as
to increase to $10.00 the fee for filing articles of amendment of a credit union.
Effective March 16, 1983.

Act 277; HB 221; p. 661

Authorizes financial institutions to

pay up to $2,500.00 of the funds of a

deceased depositor to his next of kin.

Provides that if no application for such

funds is made by the next of kin then

such amount may be applied by the

financial institution to the funeral

expenses and expenses of last illness of

the deceased depositor. Authorizes

nursing homes to deposit up to $2,500.00

of the funds of a deceased resident to a

savings account in the name of the

decedent

and

provides that the

depository financial institution may

apply the funds as discussed above.

Enacts O.C.G.A. Section 7-1-239,

repeals O.C.G.A. Sections 7-1-357 and

7-1-664, and amends O.C.G.A. Section

7-1-791.

Effective July l, 1983.

Act 209; SB 270; p. 479
Changes procedures for denial of applications for licensure under the "Georgia Industrial Loan Act."
Amends O.C.G.A. Section 7-3-9. Effective March 15, 1983.

Act 489; HB 128; p. 1146

Provides that the parties to any loan

agreement involving more than $3,000.00

may agree to any rate of interest.

Provides that the parties to any loan

agreement involving $3,000.00 or less

may agree to any rate of interest which

does not exceed 16 percent per annum

simple interest. Provides that the

foregoing provisions do not modify the

rates on industrial loans, retail

installment and home solicitation sales,

credit cards,

insurance premium

financing, and pawnbrokers' loans.

Provides that the parties may agree to

any rate of interest on financing of

manufactured homes costing more than

$3,000.00 or motor vehicles costing

$25,000.00 or more.

Deletes former provisions relating to

floating maximum interest on real estate

loans; maximum interest on installment loans; maximum interest on loans secured by deposits; maximum interest on loans
by insured financial institutions; and maximum interest on loans secured by secondary security deeds.
Amends 0.C.G.A. Chapter 7-4. Effective March 29, 1983.

Act 518; SB 283; p. 1316
Enacts O.C.G.A. Section 7-4-21, so as to provide that a claim of usury with respect to a loan secured by real estate may not be the subject of a class action law suit.
Effective March 29, 1983.

TITLE 8 BUILDINGS AND HOUSING

Act 193; HB 287; p. 456

Amends O.C.G.A. Section 8-2-135, so as

to change the amount of fees charged for

state

inspections of manufactured

housing.

Effective July 1, 1983.

Act 507; HB 428; p. 1228

Extensively amends O.C.G.A. Sections

8-3-170 et

seq.,

the "Georgia

Residential Finance Authority Act," so

as to change the membership of the

authority, enable the authority to

engage in projects to attract manpower

resources to certain areas, increase the

maximum bonding capability for the

authority's single-family residential

housing program to $465 million. Makes

numerous other changes relative to the

authority.

Repeals

the

"Georgia

Secondary Market Corporation Act" and

creates in its place a new secondary

market mortgage program for home

mortgages to be administered by the

authority.

Effective March 29, 1983.

TITLE 9 CIVIL PRACTICE
Act 513; SB 239; p. 1304
Amends 0.C.G.A. Section 9-10-91, so as to provide that the courts of this state may exercise jurisdiction over a nonresident in a case involving child support, alimony, or division of marital property if the nonresident maintains a matrimonial domicile in this state or resided in this state prior to the commencement of the action.
Effective March 29, 1983.
TITLE 10 COMMERCE AND TRADE
Act 532; HB 645; p. 1430
Amends 0.C.G.A. Section 10-1-7, so as to provide that retail installment contracts and revolving accounts may authorize the creditor to impose a bad check fee not to exceed $12.00.
Effective March 31, 1983.
Act 543; HB 249; p. 1468
Amends O.C.G.A. Section 10-1-310, so as to increase from $1.00 to $2.00 the amount of service charge on sales of tickets to athletic events which may be charged by authorized ticket agents.
Repeals O.C.G.A. Section 20-3-81, relating to prohibited sales in excess of face price of tickets to athletic events of colleges of the University System of Georgia.
Effective July 1, 1983.
Act 509; HB 545; p. 1298
Amends the "Fair Business Practices Act of 1975," so as to provide that it shall be an unfair or deceptive practice for a hospital or long-term care facility to fail to deliver an itemized statement of charges within six business days after an inpatient is discharged.
Amends 0.C.G.A. Section 10-1-393. Effective July 1, 1983.

Amends 0.C.G.A. Section 10-1-395, so as to change the membership of the Consumer Advisory Board.

Amends O.C.G.A. Section 10-1-442, so as to eliminate the requirement that an application for registration of a trademark or service mark contain a statement that no other person has a federal registration of the same trademark or service mark.
Amends O.C.G.A. Sections 10-1-445, 10-1-446, and 10-1-448, so as to increase to $15.00 the fee charged by the Secretary of State for filing renewals, assignments, and voluntary cancellations of trademarks and service marks.
Effective July 1, 1983.

Act 551; SB 199; p. 1548

Enacts O.C.G.A. Sections 10-1-620

through 10-1-663, the "Georgia Motor

Vehicle Franchise Practices Act," so as

to regulate agreements and conduct of

business

between motor vehicle

manufacturers,

distributors,

and

franchisors and motor vehicle dealers.

Effective July 1, 1983.

Act 438; HB 89; p. 946
Amends O.C.G.A. Section 10-4-4, so as to change the conditions under which federally licensed warehouses shall be exempt from state licensure and bonding requirements. Amends O.C.G.A. Section 10-4-10, so as to require applicants for state warehouse licenses and license renewals to furnish current financial statements with their applications. Amends 0.C.G.A. Section 10-4-12, so as to increase the minimum warehouse bond to $20,000.00 and the maximum bond to $150,000.00 and so as to provide that the required bond of a warehouseman who is also a grain dealer shall be the higher of the warehouse bond or the grain dealer's bond.
Effective July 1, 1983.

Act 404; HB 427; p. 781

Provides that no securities dealer's

bond shall be required of a dealer who

is a member of the Securities Investor

Protection Corporation and who has a

minimum capital of not less than

$250,000.00.

Provides that

no

securities salesman's bond shall be

Amends O.C.G.A. Section 10-5-3. Effective March 18, 1983.
TITLE 11 COMMERCIAL CODE
Act 226; HB 44; p. 509
Amends O.C.G.A. Section 11-3-603, so as to provide that, when there has been an assignment of a note which is a negotiable instrument and which is to be paid off in more than one payment, the maker or drawer of the note is authorized to make payments to the assignor of the note until such time as the maker or drawer has been sent by the assignee a registered or certified letter notifying the maker or drawer that payment is to be made to the assignee. Further provides that, if requested by the drawer or maker, the assignee must furnish reasonable proof of assignment.
Effective July 1, 1983.
TITLE 12 CONSERVATION AND NATURAL RESOURCES
Act 196; HB 353; p. 460
Extends to July l, 1988, the sunset or termination date of the Heritage Trust Commission.
Amends O.C.G.A. Section 12-3-73. Effective March 15, 1983.

Authorizes the Jekyll Island State Park Authority to operate a fire department with the powers of a county or municipal fire department and to charge fire protection fees to benefited land owners.
Amends O.C.G.A. Section 12-3-235. Effective March 16, 1983.

Amends O.C.G.A. Section 12-3-235, so as to authorize the Jekyll Island State Park Authority to be licensed to sell

the

Amends O.C.G.A. Section 12-4-20, so as to provide that the determination as to whether an oil well within Georgia is producing 100 barrels per day so as to be eligible for a reward from state funds shall be made by the commissioner of natural resources rather than by the Board of Natural Resources.
Effective July 1, 1983.

Amends O.C.G.A. Section 12-5-134, so as to extend to April 11, 1985, the sunset or termination date of the State Water Well Standards Advisory Council.

Extensively revises O.C.G.A. Sections

annually appropriated to fund training

law enforcement officers and

prosecutors.

period of limitation for tax executions.

to require that an entry of satisfaction

be made on the execution docket as soon

as reasonably possible after a tax

48-8-46, so as to change provisions

relating to successor tax liability of

purchasers of businesses for withholding

tax and sales and use tax.
