We are pleased to transmit to you the "Summary of General Statutes Enacted at the 1983 Regular Session of the General Assembly of Georgia." This represents one of the services which the Legislative Services Committee and the Office of Legislative Counsel perform for the legislative branch of government. Other services include bill drafting, research, statutory and Code revision, rendering of opinions, counseling, legislative reference, interim committee staffing, and preparation of reports. 
The Office of Legislative Counsel drafted a total of 3,781 bills, resolutions, and amendments for the 1983 session. Of this number, 757 had been prepared by the convening date of the session, leaving a total of 3,024 which were drafted during the session. 
The other members of the committee and the Office of Legislative Counsel join me in the sincere hope that this booklet will be of benefit to those who use it. If we may be of service, please feel free to call upon us.

This booklet contains a summary of the general statutes of statewide application which were enacted at the 1983 regular session of the General Assembly of Georgia. No resolutions, "population" Acts, or Acts with special application have been included. 
 
It would be impractical to minutely 
 
analyze each statute because to do so would defeat 
 
the main purpose which it is hoped that this 
 
booklet accomplishes. It is intended that it be 
 
used as a convenient reference for persons 
 
desiring to know which laws were enacted or 
 
desiring to ascertain the main features of each 
 
Act without the necessity of reading it in its 
 
entirety. It should be pointed out that for 
 
specific, detailed information on any particular 
 
law, the Act itself should be examined.

Revises the laws relating to bonding and regulation of livestock dealers, brokers, packers, and market operators. Provides that the custodial account of each operator of a livestock sales establishment must be maintained in a bank which is located in this state and within 100 miles of the sales establishment. Changes the formulas for calculating the bonds of livestock sales establishments and livestock dealers and brokers and requires licensees and applicants for licensure to submit current financial statements.

Enacts O.C.G.A. Section 7-1-237, so as to provide for reimbursement to financial institutions for responding to garnishments, attachments, subpoenas, and other processes involving their customers. 
Amends O.C.G.A. Section 7-1-261, so as to restate the incidental powers of banks and trust companies. 
Amends O.C.G.A. Sections 7-1-284 and 7-1-285, so as to change the amount of acceptances or obligations of any one person which a bank may hold. 
Amends O.C.G.A. Section 7-1-288, so as to authorize banks to own shares in nonsubsidiary safe-deposit and real estate corporations and corporations promoting international trade. 
Amends O.C.G.A. Section 7-1-290, so as to provide that an irrevocable letter of credit issued by a domestic bank may serve in place of any legally required bond, surety, or pledge of assets.

Amends O.C.G.A. Section 7-1-293, so as to provide for applicability to savings and loan associations of certain statutes relating to management and corporate affairs of banks and trust companies. 
Enacts 0.C.G.A. Section 7-1-234, so as to authorize financial institutions acting as fiduciaries to make otherwise prudent investments in securities underwritten by themselves or their affiliates. 
Amends 0.C.G.A. Section 7-1-394, so as to clarify the authority of the Department of Banking and Finance to approve special purpose banking and trust companies conducting limited banking business in the area of trade. 
Amends O.C.G.A. Section 7-1-491, so as to increase to $25,000.00 the maximum amount which a bank or trust company may lend to one of its directors or officers. 
Amends O.C.G.A. Section 7-1-512, so as to change the required contents of articles of amendment of banks and trust companies. 
Amends 0.C.G.A. Section 7-1-602, so as to change provisions relative to authorization of bank offices and bank facilities. 
Amends 0.C.G.A. Section 7-1-608, so as to authorize bank holding companies to acquire a bank or trust company organized solely for the purpose of facilitating acquisition of the trust department of a bank in existence for five years. 
Enacts 0.C.G.A. Section 7-1-612, so as to authorize banks which do not exercise trust powers to contract with another bank for such other bank to furnish trust services through the facilities of the bank not exercising trust powers. 
Amends O.C.G.A. Section 7-1-632, so as to provide that department approval of the articles of a credit union shall indicate any change made to the articles. 
Amends O.C.G.A. Section 7-1-634, so as to direct the department to file with the Secretary of State any amendment to the bylaws of a credit union which affects its field of membership. 
Amends 0.C.G.A. Section 7-1-670, so as to delete the requirement that a credit union have total assets in excess of $1 million in order to offer third-party payment services. 
Amends O.C.G.A. Section 7-1-845, so as to provide that it shall be a felony to willfully engage in the business of a

credit union without proper authority. Amends O.C.G.A. Section 7-1-862, so as 
to increase to $10.00 the fee for filing articles of amendment of a credit union.

deceased depositor to his next of kin.

 TITLE 9 CIVIL PRACTICE

Section 9-10-91, so as to provide that the courts of this state may exercise jurisdiction over a nonresident in a case involving child support, alimony, or division of marital property if the nonresident maintains a matrimonial domicile in this state or resided in this state prior to the commencement of the action.

TITLE 10 COMMERCE AND TRADE

Amends 0.C.G.A. Section 10-1-7, so as to provide that retail installment contracts and revolving accounts may authorize the creditor to impose a bad check fee not to exceed $12.00. 
Effective March 31, 1983.

Amends O.C.G.A. Section 10-1-310, so as to increase from $1.00 to $2.00 the amount of service charge on sales of tickets to athletic events which may be charged by authorized ticket agents. 
Repeals O.C.G.A. Section 20-3-81, relating to prohibited sales in excess of face price of tickets to athletic events of colleges of the University System of Georgia. 
Effective July 1, 1983.

Amends the "Fair Business Practices Act of 1975," so as to provide that it shall be an unfair or deceptive practice for a hospital or long-term care facility to fail to deliver an itemized statement of charges within six business days after an inpatient is discharged.

Section 10-4-10, so as to require applicants for state warehouse licenses and license renewals to furnish current financial statements with their applications. Amends 0.C.G.A.
