We are pleased to transmit to you the "Summary of General Statutes Enacted at the 1980 Session of the General Assembly of Georgia." This represents one of the services which the Legislative Services Committee and the Office of Legislative Counsel perform for the legislative branch of government. other services include bill drafting, research, statutory and code revision, rendering of opinions, counselinq, legislative reference, interim committee staffing, and preparation of reports.
The Office of Legislative Counsel drafted a total of 3,762 bills, resolutions, and amendments for the 1980 session. Of this number, 824 had been prepared by the convening date of the session, leaving a total of 2,938 which were drafted during the session.
The other members of the committee and the Office of Legislative Counsel join me in the sincere hope that this booklet will be of benefit to those who use it. If we may be of service, please feel free to call upon us.

This booklet contains a summary Jf the general statutes of statewide ~pplication which were enacted at the 1980 regular session of the General Assembly of }eorgia. No resolutions, "population" Acts, Jr Acts with special application have been included.
It would be impractical to ninutely analyze each statute because to do po would defeat the main purpose which it ls hoped that this booklet accomplishes. It is intended that it be used as a convenient reference for persons desiring to know which laws were enacted or desiring to ascertain the main features of each Act without the ~ecessity of reading it in its entirety. It should be pointed out that for specific, ietailed information on any particular law, the Act itself should be examined. A notation Jf the effective date is listed after each

Provides that no agricultural or farming operation which has been in operation for one year or more shall become a public or private nuisance as a result of changed conditions in or around the locality of the agricultural or farming operation.

Removes the 8 percent annual

limitation on dividends on preferred

stock

of cooperative marketing

associations.

Comprehensively and

provides for regulation of the sale,

inspection,

importation,

and

distribution of milk and dairy products

by the Commissioner of Agriculture.

Enacts the "Georgia Dairy Act of

1980. 11 Repeals the following laws: Code

Chapter 42-5; Code Sections 42-9912 and

9913; Ga. Laws 1951, p. 444 (Ga. Code

Ann. 42-506.1, 506.2, 506.3, and 9929);

Changes the nature of labeling which must be affixed by egg dealers to cases of eggs at the time of packing and candling.
Amends Ga. Laws 1935, p. 364 (Ga. Code Ann. 42-912).

Raises from $15.00 to $30.00 the maximum amount of compensation per colony which may be paid for bees, hives, and other beekeeping equipment ordered destroyed by the Commissioner of Agriculture.

Changes the procedure under which the Commissioner of Agriculture enforces laws and rules relating to farmers markets so as to allow orders of the Commissioner to become effective prior to hearing.

Removes the Governor from the membership of the Georgia Seed Development Commission.

Removes the Attorney General and the

state auditor from ex_officio membership

on

the

agricultural commodity

commissions and replaces them with

members appointed by the agriculture

committees of the Georgia Senate and

House of Representatives.

Amends the "Georgia Agricultural

Commodities Promotion Act," Ga. Laws

1969, p. 763 (Ga. Code Ann. 5-2909).

Effective for purposes of selection of

members March 20, 1980, and effective

for all other purposes July 1, 1980.

Repeals Ga. Laws 1937, p. 716 (Ga.

Code

Ann.

Ch. 62-13) which

regulated the buying and selling of

livestock and provided for licensing of

livestock dealers by probate courts.

ALCOHOLIC BEVERAGES

Act 1394; HB 1330; p. 1573
Exhaustively and completely codifies, revises, and modernizes laws relating to the regulation and taxation of alcoholic beverages in a new Code Title SA and repeals existing laws relating to alcoholic beverages.
Effective July 1, 1981.

Act 1206; SB 68; p. 1206
Provides that it shall be unlawful for any person to furnish alcoholic beverages to any other person under 19 years of age or for any person under 19 years of age to purchase or possess alcoholic beverages. Exempts possession and consumption of alcoholic beverages by persons under 19 for medical purposes, at religious ceremonies, or in the home with parental consent. Allows purchase, consumption, and possession of alcoholic beverages by military personnel 18 years of age or older. Conforms related provisions of law.

Act 1160; HB 1445; p. 1174
Requires that each retail business establishment authorized to sell alcoholic beverages of any kind post a notice furnished by the Department of Revenue which contains the provisions of law relating to unlawful sale of alcoholic beverages to underage persons.
Effective July 1, 1980.

Act 1390; HB 1165; p. 1561
Authorizes the sale of wine at retail on the premises of wineries which produce less than 10,000 gallons of wine per year wholly from Georgia grown agricultural products.
Enacts Code Section 58-806.1. Effective April 8, 1980.

Act 918; HB 717; p. 501

Provides

that

counties

and

municipalities shall have the power to

regulate and tax the sale, storage, and

distribution of wines at airports owned

by the county or municipality as if the

airport boundaries were located entirely

within the boundaries of the county or

municipality which operates the airport.

Amends Code Section 58-828.

Effective March 20, 1980.

Act 1136; SB 491; p. 1126
Provides that the prohibition against sale of alcoholic beverages on election days shall not apply to properties owned by local governments for airport purposes if no person resides thereon.

Gives to Georgia Bureau of Investigation agents enforcement power over criminal provisions relating to

1981, the effective date of the Act

providing for the comprehensive

treatment

AUTHORITIES

Act 1372; HB 1485; p. 1466

Creates an authority to develop

residential care facilities for the

elderly in each county and municipal

corporation in the state but provides

that such authorities shall be activated

only upon resolution of the local

governing authority. Provides for

issuance of revenue bonds by such

authorities and for other related

matters.

Enacts

the "Residential Care

Facilities for the Elderly Authorities

Act."

Effective April 2, 1980.

Act 1124; SB 388; p. 1094
Removes the 8 percent annual interest rate ceiling on bonds issued by housing authorities. Authorizes private sale of such bonds to institutions insured by agencies of the federal government.
Amends the "Housing Authorities Law," Ga. Laws 1937, p. 210 (Ga. Code Ann. Ch. 99-11).
Effective March 25, 1980.

Act 1313; HB 1260; p. 1332
Provides that, for purposes of the "Development Authorities Law," the word "project" shall include skilled nursing home and intermediate care home facilities and provides that such homes leased by a development authority shall

Act 1142; HB 813; p. 1140

Provides that hospital authorities may

lease projects if such leases will lower

the cost of health care iri the

community.

Authorizes

hospital

authorities to carry out refinancing

plans for debts of their lessees

incurred in connection with acquisition

or construction of facilities of the

lessee and to issue revenue anticipation

certificates for purposes of paying off

or refinancing such debts. Authorizes

hospital authorities to set aside from

the proceeds of certificate issues

amounts not exceeding 15 percent of the

issue for the purpose of establishing a

debt service reserve.

Amends Code Sections 88-1805 and 1807.

Effective March 25, 1980.

Act 734; HB 1679; p. 328 Creates The Great Park Authority to develop a plan for the creation of a great park within the City of Atlanta. Enacts "The Great Park Authority Act." Effective March 25, 1980.

Act 741; HB 1082; p. 351 Raises to $300 million the amount of bonds which the Georgia Residential Finance Authority may have outstanding at any one time. Amends Ga. Laws 1974, p. 975 (Ga. Code Ann. 99-3609). Effective March 18, 1980.

Act 1302; SB 544; p. 1269

Changes the membership of the Georgia

Residential

Finance

Authority.

Authorizes the authority to engage in

financing of family farms for qualified

individuals and to issue revenue bonds

in connection with such financing.

Changes the membership and procedures of the Lake Lanier Islands Development Authority. Authorizes the authority to exercise its police powers up to within 300 yards of the shoreline of the islands.

Act 919; HB 748; p. 503
Grants to investigators employed by the Georgia Ports Authority the same arrest and law enforcement powers granted to members of the Uniform Division of the Department of Public Safety and to the sheriff and the chief of police of the jurisdiction in which they are performing their duties. Makes those investigators subject to the requirements of the "Georgia Peace Officer Standards and Training Act."

Authorizes the Geo. L. Smith II Georgia World Congress Center Authority to employ security guards and provides for their duties and training.

Act 1162; HB 1460; p. 1176
Changes the membership of the Geo. L. Smith II Georgia World Congress Center Authority and provides that the members of the authority shall receive actual travel expenses and the same per diem

BANKING AND FINANCE

Act 928; HB 906; p. 523
Raises the amount of motor vehicle sales finance charges to the following: class 1, $10.00 per $100.00 per year; class 2, $13.00 per $100.00 per year; class 3, $15.00 per $100.00 per year; class 4, $17.00 per $100.00 per year. Authorizes computation of finance charges on an actuarial basis equivalent to charges computed on a monthly basis. Provides that where finance charges are computed on an actuarial basis the provision for credit upon anticipation of payments shall not apply and deletes the provision for deduction of a $25.00 acquisition cost from computation of the credit.
Amends the "Motor Vehicle Sales Finance Act," Ga. Laws 1967, p. 674 (Ga. Code Ann. 96-1004 and 1005).
Effective March 20, 1980.

Act 923; SB 389; p. 511
Authorizes financial institutions which accept governmentally insured deposits to charge 16 percent per annum simple interest or a fee of $25.00, whichever is greater, on single-payment, balloon payment, and certain demand notes. Provides that the maximum interest rate on loans secured by secondary security deeds shall be the same as the maximum rate of interest now or hereafter fixed for installment loans under Code Section 57-116.

Act 924; HB 708; p. 514
Defines "commercial accounts" to be obligations for the payment of money arising out of the sale of goods or services other than "retail installment transactions" and provides that such accounts may bear interest at a rate not in excess of 1 1/2 percent per month beginning 30 days after they are due. Increases from 7 percent to 9 percent the maximum permissible add-on interest rate for loans repayable in weekly, monthly, quarterly, semiannual, or yearly installments.
Amends Code Sections 57-111 and 116. Effective March 20, 1980.
Act 922; SB 355; p. 509
Changes the maximum rate of interest on industrial loans from 8 percent to 10 percent. Increases from $100.00 to $200.00 the maximum loan balance as to which additional charges may be made for refinancing if the original loan was made more than two months prior to the refinancing.

Changes the penalties for making of loans in violation of the "Georgia Industrial Loan Act" and provides a one-year period of limitation for actions to enforce the previous penalty provision of invalidity of the contract.

Act 920; HB 772; p. 505
Provides penalties for unlicensed persons acting as insurance premium financers. Provides procedures for hearings and examination of records of insurance premium finance companies.

Act 1149; HB 1209; p. 1159
Extends the legal authority for recovery of damages and attorney's fees for bad faith refusal to remedy default by a corporate surety to allow such recovery in situations where the surety refuses to make payment to an obligee after demand for payment. Provides that the term "obligee" shall include any beneficiary under the contract ofsuretyship.
Amends Ga. Laws 1973, p. 825 (Ga. Code Ann. 103-210).
Effective March 25, 1980.

Act 1084; SB 382; p. 972

Redefines the term "trust company" to

include corporations exercising certain

incidental trust powers. Authorizes the

Department of Banking and Finance to

waive requirements for publication of

notices in order to facilitate a merger,

consolidation, or sale of assets

pursuant to Code Section 13-203(c)(3).

Provides additional procedures for

dissolution of financial institutions

and for receiverships. Authorizes the

department to determine the extent to

which corporations may exercise

incidental test powers under former Code

Section 41A-1103(a)(3).

Includes

federal credit unions within the

provisions of Code Section 41A-3118.

Authorizes investments of trust funds

and public funds in institutions insured

by the Georgia Credit Union Deposit

Insurance

Corporation.

Changes

requirements for obtaining deposit

insurance by building and loan

associations.

Amends Code Sections 41A-102, 108,

Provides that whenever a bank holding

company would be eligible to cause a

bank to become a subsidiary of a bank

holding company it may be permitted to

elect to acquire, merge with, or operate

such a bank as a branch of another of

the holding

company's

banking

Amends Code Section 13-203.l(e),

relating to the operation of bank

offices

after

mergers

and

consolidations, so as to provide that

the merger and consolidation provisions

of Code Chapters 41A-24 and 41A-25,

rather than those of Code Chapter 13-14,

shall apply.

Act 1121; SB 383; p. 1081
Provides that the prohibition against acquisition by a bank holding company of a bank which has been in existence for less than five years shall not apply to the acquisition of a bank organized solely for the purpose of acquisition of a bank which has been in existence for a period of five years or more.
Amends Code Section 13-207.3. Effective March 25, 1980.

Provides that it shall be unlawful to acquire control of a financial institution through a purchase, assignment, pledge, or other disposition of voting stock of the institution except with the approval of the Department of Banking and Finance after specified disclosure has been made.
Enacts Code Chapter 41A-10. Effective March 25, 1980.

Extends

prohibitions on

transactions by officers of the

Department of Banking and Finance to

include transactions with subsidiaries

of regulated financial institutions and

modifies the reporting requirements as

to financial transactions by said

Directs the Georgia State Financing and Investment Commission to invest proceeds other than bond proceeds in the same manner as bond proceeds. Directs the commission to use income from sources other than investments in the same manner as income earned from investments.
Amends the "Georgia State Financing and Investment Commission Act," Ga. Laws 1973, p. 750 (Ga. Code Ann. 87-106a).

Act 1009; HB 1340; p. 763
Authorizes the State Depository Board to appoint as a state depository any building and loan association or federal or state savings and loan association whose deposits are insured by the Federal Savings and Loan Insurance Corporation or the Georgia Credit Union Deposit Corporation.
Amends Code Section 100-101. Effective March 20, 1980.

Act 1083; SB 381; p. 969
Authorizes all state and local officers holding public funds to determine depositories for such funds. Provides conditions under which depositories holding public funds must furnish a bond, deposit insurance, or pledge of securities.
Enacts Code Sections 89-810.1 and 810.2.
Effective March 24, 1980.

Act 720; HB 1532; p. 303

Clarifies the authority of agencies,

authorities,

boards,

public

corporations, and other divisions of

state government to sell and purchase

direct obligations of the United States

government

and

obligations

unconditionally guaranteed by the United

States government under agreements to

resell or repurchase such obligations at

a future date certain at a specific

price which reflects a premium

equivalent to a stated rate of interest.

Effective March 4, 1980.

Provides a new procedure of continuing garnishment on employers under which all debts accruing from the garnishee employer to the defendant employee for 179 days after the date of service shall be subject to garnishment and provides procedures and forms in connection therewith.
