This represents one of the services which the Legislative Services Committee and the Office of Legislative Counsel perform for the legislative branch of government. other services include bill drafting, research, statutory and code revision, rendering of opinions, counselinq, legislative reference, interim committee staffing, and preparation of reports. The Office of Legislative Counsel drafted a total of 3,762 bills, resolutions, and amendments for the 1980 session. Of this number, 824 had been prepared by the convening date of the session, leaving a total of 2,938 which were drafted during the session. The other members of the committee and the Office of Legislative Counsel join me in the sincere hope that this booklet will be of benefit to those who use it. No resolutions, "population" Acts, Jr Acts with special application have been included. It would be impractical to ninutely analyze each statute because to do po would defeat the main purpose which it ls hoped that this booklet accomplishes. It is intended that it be used as a convenient reference for persons desiring to know which laws were enacted or desiring to ascertain the main features of each Act without the ~ecessity of reading it in its entirety. Sent to the Governor foe signature appro r AGRICULTURE Act 1297; SB 348; p. 1253 Provides that no agricultural or farming operation which has been in operation for one year or more shall become a public or private nuisance as a result of changed conditions in or around the locality of the agricultural or farming operation. Effective March 31, 1980. Act 1070; HB 1801; p. 924 Removes the 8 percent annual limitation on dividends on preferred stock of cooperative marketing associations. Amends Code Section 65-215. Effective March 24, 1980. Act 1087; SB 415; p. 981 Comprehensively and extensively provides for regulation of the sale, inspection, importation, and distribution of milk and dairy products by the Commissioner of Agriculture. Enacts the "Georgia Dairy Act of 1980. 11 Repeals the following laws: Code Chapter 42-5; Code Sections 42-9912 and 9913; Ga. Laws 1951, p. 444 (Ga. Code Ann. 42-506.1, 506.2, 506.3, and 9929); Ga. Laws 1961, p. 501 (Ga. Code Ann. Ch. 42-6). Effective July 1, 1980. Act 982; HB 1166; p. 690 Changes the nature of labeling which must be affixed by egg dealers to cases of eggs at the time of packing and candling. Amends Ga. Laws 1935, p. 364 (Ga. Code Ann. 42-912). Effective March 20, 1980. Act 991; HB 1205; p. 713 Raises from $15.00 to $30.00 the maximum amount of compensation per colony which may be paid for bees, hives, and other beekeeping equipment ordered destroyed by the Commissioner of Agriculture. Amends Code Section 5-908. Effective March 20, 1980. - 1- AGRICULTURE (continued) Act 1146; HB 1142; p. 1150 Changes provisions relating to required registration and license fees of companies guaranteeing commercial fertilizer marketed in Georgia. Changes the formula for computation of penalties for deficient fertilizer. Amends the "Georgia Plant Food Act of 1970," Ga. Laws 1970, p. 609 (Ga. Code Ann. Ch. 5-10). Effective March 25, 1980. Act 1002; HB 1287; p. 749 Changes provisions relative to licensing and license fees of commercial pesticide applicators and the enforcement authority of the Commissioner of Agriculture under the "Georgia Pesticide Use and Application Act of 1976." Amends Ga. Laws 1976, p. 369 (Ga. Code Ann. Ch. 5-15A). Effective March 20, 1980. Act 1001; HB 1286; p. 747 Changes provisions relative to the enforcement authority of the Commissioner of Agriculture under the "Georgia Pesticide Control Act of 1976," Ga. Laws 1976, p. 282 (Ga. Code Ann. Ch. 5-15). Effective March 20, 1980. Act 948; HB 1554; p. 572 Changes the procedure under which the Commissioner of Agriculture enforces laws and rules relating to farmers markets so as to allow orders of the Commissioner to become effective prior to hearing. Amends Ga. Laws 1935, p. 369 (Ga. Code Ann. 5-225). Effective March 20, 1980. Act 739; HB 1080; p. 348 Removes the Governor from the membership of the Georgia Seed Development Commission. Amends the "Georgia Seed Development Act," Ga. Laws 1959, p. 83 (Ga. Code Ann. 5-2703). Effective March 18, 1980. - 2- AGRICULTURE (continued) Act 946; HB 1509; p. 568 Removes the Attorney General and the state auditor from ex_officio membership on the agricultural commodity commissions and replaces them with members appointed by the agriculture committees of the Georgia Senate and House of Representatives. Amends the "Georgia Agricultural Commodities Promotion Act," Ga. Laws 1969, p. 763 (Ga. Code Ann. 5-2909). Effective for purposes of selection of members March 20, 1980, and effective for all other purposes July 1, 1980. Act 1128; SB 430; p. 1107 Repeals Ga. Laws 1937, p. 716 (Ga. Code Ann. Ch. 62-13) which regulated the buying and selling of livestock and provided for licensing of livestock dealers by probate courts. Effective March 25, 1980. ALCOHOLIC BEVERAGES Act 1394; HB 1330; p. 1573 Exhaustively and completely codifies, revises, and modernizes laws relating to the regulation and taxation of alcoholic beverages in a new Code Title SA and repeals existing laws relating to alcoholic beverages. Effective July 1, 1981. Act 1206; SB 68; p. 1206 Provides that it shall be unlawful for any person to furnish alcoholic beverages to any other person under 19 years of age or for any person under 19 years of age to purchase or possess alcoholic beverages. Exempts possession and consumption of alcoholic beverages by persons under 19 for medical purposes, at religious ceremonies, or in the home with parental consent. Allows purchase, consumption, and possession of alcoholic beverages by military personnel 18 years of age or older. Conforms related provisions of law. - 3- ALCOHOLIC BEVERAGES (continued) Amends Code Section 58-612. Enacts Code Section 58-612.1. Repeals Ga. Laws 1967, p. 797 (Ga. Code Ann. 58-614 to 617). Amends Ga. Laws 1937-38, Ex. Sess., p. 103 (Ga. Code Ann. 58-1061). Effective September 1, 1980. Act 1160; HB 1445; p. 1174 Requires that each retail business establishment authorized to sell alcoholic beverages of any kind post a notice furnished by the Department of Revenue which contains the provisions of law relating to unlawful sale of alcoholic beverages to underage persons. Effective July 1, 1980. Act 1390; HB 1165; p. 1561 Authorizes the sale of wine at retail on the premises of wineries which produce less than 10,000 gallons of wine per year wholly from Georgia grown agricultural products. Enacts Code Section 58-806.1. Effective April 8, 1980. Act 918; HB 717; p. 501 Provides that counties and municipalities shall have the power to regulate and tax the sale, storage, and distribution of wines at airports owned by the county or municipality as if the airport boundaries were located entirely within the boundaries of the county or municipality which operates the airport. Amends Code Section 58-828. Effective March 20, 1980. Act 1136; SB 491; p. 1126 Provides that the prohibition against sale of alcoholic beverages on election days shall not apply to properties owned by local governments for airport purposes if no person resides thereon. Amends Ga. Laws 1972, p. 721 (Ga. Code Ann. 58-1085). Effective March 25, 1980. Act 883; HB 1148; p. 420 Gives to Georgia Bureau of Investigation agents enforcement power over criminal provisions relating to - 4- ALCOHOLIC BEVERAGES (continued) alcoholic beverages and tobacco products concurrent with the authority of agents and enforcement officers appointed by the state revenue commissioner. Amends Ga. Laws 1937, p. 322 (Ga. Code Ann. Ch. 92A-3). Effective March 20, 1980. Act 945; HB 1508; p. 566 Changes from July 1, 1980, to July 1, 1981, the effective date of the Act providing for the comprehensive treatment of alcoholism and intoxication, Ga. Laws 1974, p. 200 (Ga. Code Ann. Ch. 99-39). Effective March 20, 1980. AUTHORITIES Act 1372; HB 1485; p. 1466 Creates an authority to develop residential care facilities for the elderly in each county and municipal corporation in the state but provides that such authorities shall be activated only upon resolution of the local governing authority. Provides for issuance of revenue bonds by such authorities and for other related matters. Enacts the "Residential Care Facilities for the Elderly Authorities Act." Effective April 2, 1980. Act 1124; SB 388; p. 1094 Removes the 8 percent annual interest rate ceiling on bonds issued by housing authorities. Authorizes private sale of such bonds to institutions insured by agencies of the federal government. Amends the "Housing Authorities Law," Ga. Laws 1937, p. 210 (Ga. Code Ann. Ch. 99-11). Effective March 25, 1980. Act 1313; HB 1260; p. 1332 Provides that, for purposes of the "Development Authorities Law," the word "project" shall include skilled nursing home and intermediate care home facilities and provides that such homes leased by a development authority shall - 5- AUTHORITIES (continued) be taxable. Amends Ga. Laws 1969, p. 137 (Ga. Code Ann. Ch. 69-15). Effective March 31, 1980. Act 1142; HB 813; p. 1140 Provides that hospital authorities may lease projects if such leases will lower the cost of health care iri the community. Authorizes hospital authorities to carry out refinancing plans for debts of their lessees incurred in connection with acquisition or construction of facilities of the lessee and to issue revenue anticipation certificates for purposes of paying off or refinancing such debts. Authorizes hospital authorities to set aside from the proceeds of certificate issues amounts not exceeding 15 percent of the issue for the purpose of establishing a debt service reserve. Amends Code Sections 88-1805 and 1807. Effective March 25, 1980. Act 734; HB 1679; p. 328 Creates The Great Park Authority to develop a plan for the creation of a great park within the City of Atlanta. Enacts "The Great Park Authority Act." Effective March 25, 1980. Act 741; HB 1082; p. 351 Raises to $300 million the amount of bonds which the Georgia Residential Finance Authority may have outstanding at any one time. Amends Ga. Laws 1974, p. 975 (Ga. Code Ann. 99-3609). Effective March 18, 1980. Act 1302; SB 544; p. 1269 Changes the membership of the Georgia Residential Finance Authority. Authorizes the authority to engage in financing of family farms for qualified individuals and to issue revenue bonds in connection with such financing. Amends Ga. Laws 1974, p. 975 (Ga. Code Ann. Ch. 99-36). Effective March 31, 1980. - 6- AUTHORITIES (continued) Act 1138; HB 109; p. 1128 Requires the Municipal Electric Authority of Georgia to make payments in lieu of ad valorem taxes on property hereafter acquired by the authority and on property previously acquired by the authority after the bonds previously issued have been fully redeemed. Amends Ga. Laws 1975, p. 107 (Ga. Code Ann. 34B-406) . Effective March 25, 1980. Act 1010; HB 1349; p. 765 Changes the membership and procedures of the Lake Lanier Islands Development Authority. Authorizes the authority to exercise its police powers up to within 300 yards of the shoreline of the islands. Amends Ga. Laws 1962, p. 736. Effective March 20, 1980. Act 919; HB 748; p. 503 Grants to investigators employed by the Georgia Ports Authority the same arrest and law enforcement powers granted to members of the Uniform Division of the Department of Public Safety and to the sheriff and the chief of police of the jurisdiction in which they are performing their duties. Makes those investigators subject to the requirements of the "Georgia Peace Officer Standards and Training Act." Amends Ga. Laws 1945, p. 464 (Ga. Code Ann. 98-205.1). Effective March 20, 1980. Act 1099; SB 553; p. 1043 Authorizes the Geo. L. Smith II Georgia World Congress Center Authority to employ security guards and provides for their duties and training. Amends Ga. Laws 1972, p. 245 (Ga. Code Ann. Ch. 40-36). Effective March 24, 1980. Act 1162; HB 1460; p. 1176 Changes the membership of the Geo. L. Smith II Georgia World Congress Center Authority and provides that the members of the authority shall receive actual travel expenses and the same per diem - 7- AUTHORITIES (continued) received by members of the General Assembly. Amends Ga. Laws 1972, p. 245 (Ga. Code Ann. 40-3602). Effective as to membership of the authority July 1, 1980, and as to compensation March 24, 1980. Act 960; HB 1091; p. 598 Changes the membership of the Georgia Agrirama Development Authority. Amends Ga. Laws 1972, p. 1161 (Ga. Code Ann. 5-3303). Effective March 20, 1980. BANKING AND FINANCE Act 928; HB 906; p. 523 Raises the amount of motor vehicle sales finance charges to the following: class 1, $10.00 per $100.00 per year; class 2, $13.00 per $100.00 per year; class 3, $15.00 per $100.00 per year; class 4, $17.00 per $100.00 per year. Authorizes computation of finance charges on an actuarial basis equivalent to charges computed on a monthly basis. Provides that where finance charges are computed on an actuarial basis the provision for credit upon anticipation of payments shall not apply and deletes the provision for deduction of a $25.00 acquisition cost from computation of the credit. Amends the "Motor Vehicle Sales Finance Act," Ga. Laws 1967, p. 674 (Ga. Code Ann. 96-1004 and 1005). Effective March 20, 1980. Act 923; SB 389; p. 511 Authorizes financial institutions which accept governmentally insured deposits to charge 16 percent per annum simple interest or a fee of $25.00, whichever is greater, on single-payment, balloon payment, and certain demand notes. Provides that the maximum interest rate on loans secured by secondary security deeds shall be the same as the maximum rate of interest now or hereafter fixed for installment loans under Code Section 57-116. - 8- BANKING AND FINANCE (continued) Enacts Code Section 57-101.2. Amends Code Section 57-116 and Ga. Laws 1966, p. 574 (Ga. Code Ann. 57-202). Effective March 20, 1980. Act 924; HB 708; p. 514 Defines "commercial accounts" to be obligations for the payment of money arising out of the sale of goods or services other than "retail installment transactions" and provides that such accounts may bear interest at a rate not in excess of 1 1/2 percent per month beginning 30 days after they are due. Increases from 7 percent to 9 percent the maximum permissible add-on interest rate for loans repayable in weekly, monthly, quarterly, semiannual, or yearly installments. Amends Code Sections 57-111 and 116. Effective March 20, 1980. Act 922; SB 355; p. 509 Changes the maximum rate of interest on industrial loans from 8 percent to 10 percent. Increases from $100.00 to $200.00 the maximum loan balance as to which additional charges may be made for refinancing if the original loan was made more than two months prior to the refinancing. Amends Ga. Laws 1955, p. 431 (Ga. Code Ann. 25-315). Effective March 20, 1980. Act 1415; HB 1339; p. 1784 Changes the penalties for making of loans in violation of the "Georgia Industrial Loan Act" and provides a one-year period of limitation for actions to enforce the previous penalty provision of invalidity of the contract. Amends Ga. Laws 1955, p. 431 (Ga. Code Ann. Ch. 25-3). Effective April 9, 1980. Act 920; HB 772; p. 505 Provides penalties for unlicensed persons acting as insurance premium financers. Provides procedures for hearings and examination of records of insurance premium finance companies. - 9- BANKING AND FINANCE (continued) Amends Ga. Laws 1969, p. 561 (Ga. Code Ann. 84-5306 and 5307). Effective July 1, 1980. Act 1149; HB 1209; p. 1159 Extends the legal authority for recovery of damages and attorney's fees for bad faith refusal to remedy default by a corporate surety to allow such recovery in situations where the surety refuses to make payment to an obligee after demand for payment. Provides that the term "obligee" shall include any beneficiary under the contract ofsuretyship. Amends Ga. Laws 1973, p. 825 (Ga. Code Ann. 103-210). Effective March 25, 1980. Act 1084; SB 382; p. 972 Redefines the term "trust company" to include corporations exercising certain incidental trust powers. Authorizes the Department of Banking and Finance to waive requirements for publication of notices in order to facilitate a merger, consolidation, or sale of assets pursuant to Code Section 13-203(c)(3). Provides additional procedures for dissolution of financial institutions and for receiverships. Authorizes the department to determine the extent to which corporations may exercise incidental test powers under former Code Section 41A-1103(a)(3). Includes federal credit unions within the provisions of Code Section 41A-3118. Authorizes investments of trust funds and public funds in institutions insured by the Georgia Credit Union Deposit Insurance Corporation. Changes requirements for obtaining deposit insurance by building and loan associations. Amends Code Sections 41A-102, 108, 507, 811, 1103, 3118, 3525, and 3529. Effective March 24, 1980. Act 935; HB 1455; p. 542 Provides that whenever a bank holding company would be eligible to cause a bank to become a subsidiary of a bank holding company it may be permitted to elect to acquire, merge with, or operate such a bank as a branch of another of the holding company's banking - 10 - BANKING AND FINANCE (continued) subsidiaries. Amends Code Section 13-207.1. Effective July 1, 1980. Act 1122; SB 384; p. 1082 Amends Code Section 13-203.l(e), relating to the operation of bank offices after mergers and consolidations, so as to provide that the merger and consolidation provisions of Code Chapters 41A-24 and 41A-25, rather than those of Code Chapter 13-14, shall apply. Effective March 25, 1980. Act 1121; SB 383; p. 1081 Provides that the prohibition against acquisition by a bank holding company of a bank which has been in existence for less than five years shall not apply to the acquisition of a bank organized solely for the purpose of acquisition of a bank which has been in existence for a period of five years or more. Amends Code Section 13-207.3. Effective March 25, 1980. Act 1120; SB 380; p. 1076 Provides that it shall be unlawful to acquire control of a financial institution through a purchase, assignment, pledge, or other disposition of voting stock of the institution except with the approval of the Department of Banking and Finance after specified disclosure has been made. Enacts Code Chapter 41A-10. Effective March 25, 1980. Act 1067; HB 1561; p. 919 Extends the prohibitions on transactions by officers of the Department of Banking and Finance to include transactions with subsidiaries of regulated financial institutions and modifies the reporting requirements as to financial transactions by said officials. Amends Code Section 41A-207. Effective March 24, 1980. - 11 - BANKING AND FINANCE (continued) Act 941; HB 1479; p. 555 Directs the Georgia State Financing and Investment Commission to invest proceeds other than bond proceeds in the same manner as bond proceeds. Directs the commission to use income from sources other than investments in the same manner as income earned from investments. Amends the "Georgia State Financing and Investment Commission Act," Ga. Laws 1973, p. 750 (Ga. Code Ann. 87-106a). Effective March 20, 1980. Act 1009; HB 1340; p. 763 Authorizes the State Depository Board to appoint as a state depository any building and loan association or federal or state savings and loan association whose deposits are insured by the Federal Savings and Loan Insurance Corporation or the Georgia Credit Union Deposit Corporation. Amends Code Section 100-101. Effective March 20, 1980. Act 1083; SB 381; p. 969 Authorizes all state and local officers holding public funds to determine depositories for such funds. Provides conditions under which depositories holding public funds must furnish a bond, deposit insurance, or pledge of securities. Enacts Code Sections 89-810.1 and 810.2. Effective March 24, 1980. Act 720; HB 1532; p. 303 Clarifies the authority of agencies, authorities, boards, public corporations, and other divisions of state government to sell and purchase direct obligations of the United States government and obligations unconditionally guaranteed by the United States government under agreements to resell or repurchase such obligations at a future date certain at a specific price which reflects a premium equivalent to a stated rate of interest. Effective March 4, 1980. - 12 - CIVIL PROCEDURE Act 1073; SB 60; p. 938 Limits the number of interrogatories which any party to a civil action may serve on any other party to 50 interrogatories, including subparts, except by leave of court. Amends the "Georgia Civil Practice Act," Ga. Laws 1966, p. 609 (Ga. Code Ann. 81A-133). Effective July 1, 1980. Act 1135; SB 486; p. 1124 Authorizes a form of tack and mail service in civil cases involving less than $200.00 after reasonable efforts have been made to obtain personal service. Amends the "Georgia civil Practice Act," Ga. Laws 1966, p. 609 (Ga. Code Ann. 81A-104). Effective March 25, 1980. Act 1063; HB 1229; p. 833 Amends Code Section 110-401 so as to provide that the amount of damages in actions ex delicto after default judgment may be established before the court without a jury. Effective January 1, 1981, only if an appropriate constitutional amendment is ratified at the November, 1980, general election. Effective March 20, 1980. - 13 - CORPORATIONS (continued) Act 992; HB 1218; p. 715 Authorizes corporations to establish and vary the number of shares in series of preferred or special stock under certain conditions and provides a $10.00 filing fee for filing of statements. changing the number of shares included in a series. Amends Code Sections 22-502 and 1602. Effective March 20, 1980. Act 968; HB 1110; p. 623 Authorizes redemption of preferred stock at the option of the holder under certain circumstances. Requires that a consent to appointment as registered agent be filed with articles of incorporation of domestic corporations and with applications for certificate of authority by foreign corporations. Increases from $15.00 to $16.00 the superior court clerk's fee required for amendment of articles, restatement of articles, mergers or consolidations, and dissolutions. Provides that notice to corporations to be involuntarily dissolved may be given by regular rather than certified mail. Provides procedures for reinstatement of dissolved corporations. Provides for involuntary dissolution of corporations which failed to file annual reports for the years 1969 through 1978. Provides for reinstatement of foreign corporations whose certificates of authority have been revoked. Provides for involuntary dissolution of nonprofit corporations by the Secretary of State rather than the Attorney General. Provides that where the office of Secretary of State becomes vaca~t, his authority as corporation commissioner shall immediately vest in the assistant corporation commissioner. Act 963; HB 1104; p. 603 Deletes the authorization for corporations to change their registered agents as a part of their annual reports. Provides that upon the resignation of a registered agent - 14 - CORPORATIONS (continued) becoming effective the address of the registered agent shall no longer be that of the registered office of the corporation. Requires written consent of all registered agents to their appointment. Provides that domestic and foreign profit and nonprofit corporations may serve as registered agents of foreign nonprofit corporations. Act 1189; HB 1800; p. 1188 Provides a procedure for the revival of a corporation which has failed to revive its corporate existence within ten years after its period of duration has expired. Provides that under certain conditions such revival may be made during the period from ten to 20 years after the date of expiration. Enacts Code Section 22-1327. Effective March 25, 1980. Act 708; HB 1211; p. 72 Provides for incorporation of electric membership corporations and related procedures under Secretary of State rather than the superior courts. Provides that electric membership corporations shall have perpetual duration unless otherwise specified. Amends the "Electric Membership Corporation Act," Ga. Laws 1937, p. 644 (Ga. Code Ann. Ch. 34B-l). Effective February 19, 1980. Act 969; HB 1111; p. 635 Provides for incorporation of cooperative marketing associations and related procedures under the Secretary of State rather than the superior courts. COUNTIES AND MUNICIPALITIES Act 1405; HB 776; p. 1738 Provides minimum required budget procedures to be followed by local governments other than local school districts and boards of education. Requires audits of local government finances at specified periods according to specified standards. Effective July 1, 1980. Act 1400; SB 470; p. 1715 Authorizes municipalities, counties, school districts, and other political subdivisions to make specified investments of funds subject to their control and jurisdiction. Authorizes the State Depository Board to assist local governments in developing cash management policies and in investing funds. Creates a local government investment pool to be administered by the Fiscal Division of the Department of Administrative Services under policies established by the state Depository Board. Enacts the "Local Government Investment Pool Act." Effective January 1, 1981. Act 1402; HB 457; p. 1723 Establishes a uniform procedure for use by counties and municipalities in enacting historic preservation ordinances which are designed to prohibit changes in the exterior architectural features of historic properties and historic districts except after issuance of a certificate of appropriateness by the local governing authority. Exempts cities or counties which as of March 31, 1980, have adopted ordinances relating to planning and zoning for historic purposes. Enacts the "Georgia Historic Preservation Act." Effective April 8, 1980. - 16 - COUNTIES AND MUNICIPALITIES (continued) Act 1336; HB 1277; p. 1395 States the po~ers and authority which may be exercised by county, municipal, and other fire departments. Authorizes counties, municipalities, and other political subdivisions to enact ordinances, regulations, and safety codes necessary to exercise those powers. Effective July 1, 1980. Act 988; HB 1193; p. 709 Defines the term "revenue" as used in the "Revenue Bond Law" to include moneys received as grants from the United States or the State of Georgia or any agency of either if so stated in the resolution authorizing the issuance of obligations. Amends Ga. Laws 1937, p. 761 (Ga. Code Ann. 87-802). Effective March 20, 1980. Act 933; HB 1447; p. 534 Raises from $1,500.00 to $5,000.00 the minimum amount of county contracts required to be bonded. Act 1061; HB 1138; p. 830 Authorizes counties to supplement from county funds the salary of the district attorney of the circuit in which the county lies for child support recovery services. Act 905; HB 488; p. 470 Deletes the requirement that a county use funds paid for state prisoners assigned to the county correctional institution only for the operation and maintenance of the county correctional institution and authorizes use of such funds to supplant county funds or previous levels of county funding for the county correctional institution. - 17 - COUNTIES AND MUNICIPALITIES (continued) Amends Ga. Act 1163; HB 1478; p. 1178 Amends Code Section 23-406 so as to provide that, when a county boundary line dispute has been settled under Code Chapter 23-4, such boundary line may thereafter be changed only in accordance with the provisions of Code Chapter 23-3. Act 1322; SB 515; p. 1352 Removes the 8 percent annual interest rate ceiling from bonds issued by municipalities under the "Urban Redevelopment Law" and authorizes the private sale of such bonds to institutions insured by agencies of the federal government. COURTS Act 1100; SB 569; p. 1045 Increases from $20.00 to $35.00 the fee of the clerk of superior court for each day of service in attendance upon the courts in civil and criminal cases. Act 899; HB 274; p. 455 Authorizes the chief judge of superior court of each judicial circuit to employ one law clerk for the circuit and authorizes such clerks to participate in the employees' health insurance plan. Amends Ga. Laws 1957, p. 273 (Ga. Code Ann. Ch. 24-26) and Ga. Laws 1961, p. 147 (Ga. Code Ann. 89-1201). Effective July 1, 1980. Act 931; HB 1020; p. 528 Provides that a temporary employment permit issued to a court reporter by a judge may be limited by the Board of Court Reporting only with the concurrence of the issuing judge. Amends "The Georgia Court Reporting Act," Ga. Laws 1974, p. 345 (Ga. Code Ann. 24-3115b). Effective July 1, 1980. - 19 - COURTS (continued) Act 900; HB 275; p. 458 Provides that any senior judge of the supertor courts (formerly judge of the superior courts emeritus) who is 65 years of age or older and who becomes disabled from continuing his official duties may become a nonresident of the state and retain his office and continue to receive his retirement salary. Amends Ga. Laws 1945, p. 362 (Ga. Code Ann. Ch. 24-26A). Effective July 1, 1980. Act 959; HB 1090; p. 596 Authorizes judges of the superior courts to receive reimbursement for the actual expenses of judicial education within and without the state in the same manner as members of the General Assembly in attendance at conferences and meetings. Requires approval of such expenses by the Institute of Continuing Judicial Education and limits such reimbursement to $3,500.00 for each judge every four years. Amends Code Section 24-2606.3. Effective July 1, 1980. Act 961; HB 1100; p. 600 Authorizes state court judges to serve as judge of any other state court but only upon the call of the judge of such other state court. Authorizes a retired judge or judge emeritus of any state court to serve as judge of any other state court upon the call of the judge of such other court. Amends Ga. Laws 1970, p. 679 (Ga. Code Ann. Act 970; HB 1113; p. 638 Provides that small claims court judges who are not practicing attorneys must take the same training required for justices of the peace. Act 1123; SB 386; p. 1083 Extensively revises and restates the law relating to criminal offenses involving credit cards and extends such law to apply to financial transaction cards other than credit cards. Act 1096; SB 523; p. 1034 Provides that it shall be prima facie evidence that a defendant knew that a particular check would not be honored by the drawee if notice of dishonor sent by certified or registered mail to the defendant is returned undelivered to the sender if mailed within a reasonable time after dishonor to the address printed on the check or given by the defendant at the time of issuance of the check. Provides that a check for state taxes which are past due or presently due or for payments to the Georgia Employment Security Agency is given for present consideration for purposes of the bad check law. CRIMINAL PROCEDURE Act 898; HB 273; p. 452 Provides for trial on accusations in all felony cases, other than capital felonies, where the defendant waives indictment after he has been bound over or confined in jail or released on bond. Provides for trial of all misdemeanor cases in all courts upon accusation and for trial of traffic cases upon the uniform traffic citation. Sets out a form for accusations. Amends Code Section 27-704 and enacts Code Section 27-705. Effective March 20, 1980. Act 1333; HB 672; p. 1388 Provides a procedure for discovery by criminal defendants of statements made by them while in police custody and of scientific reports to be used at trial. Act 885; HB 1150; p. 426 Authorizes the taking of depositions to preserve testimony in criminal cases where the witness is in imminent danger of death or has been threatened with death or great bodily harm because of his status as a potential witness in the criminal trial. Effective July 1, 1980. - 25 - CRIMINAL PROCEDURE (continued) Act 872; SB 406; p. 390 Directs the supreme Court of Georgia to establish by rule a unified review procedure for presenting to the sentencing court and the Supreme court all possible challenges in cases in which the death penalty is sought. Requires ratification of such rules by the 1981 General Assembly. Enacts Code Section 27-2538. Effective March 20, 1980. Act 1327; SB 588; p. 1359 Provides that appeal bonds shall terminate when the right of appeal terminates and shall not be effective as to petitions or applications for certiorari unless the court where the petition or application is filed so specifies. Act 732; HB 1156; p. 326 Authorizes the issuance of investigation or surveillance warrants when there is probable cause to believe that a person is committing or has committed a crime involving the importation or sale of marijuana. Act 954; HB 1612; p. 589 Provides that no fees, court costs, or other charges of any nature shall be charged for any warrant obtained by the prosecutor for the unlawful conversion of military property. Amends the "Georgia Military Forces Reorganization Act of 1955," Ga. Laws 1955, p. 10 (Ga. code Ann. 86-1105). Effective March 20, 1980. Act 977; HB 1131; p. 678 Provides that, in the case of a habeas corpus petition filed under Code Section 88-402.14, 502.14, or 2503.14 to challenge the detention of a person detained pursuant to court order under Code Section 27-1502 or 1503, a copy of the petition shall be served upon the court which ordered the detention in the - 26 - CRIMINAL PROCEDURE (continued) criminal proceeding. Effective March 20, 1980. 88-402.14, Act 881; HB 1146; p. 415 Provides that only superior courts and state courts may try violations of Code section 26-2901, relative to carrying concealed weapons, and Code Section 26-2903, relative to carrying a pistol without a license, and related violations. Provides that other courts, regardless of their jurisdiction, may exercise only the jurisdiction of a court of inquiry as to said crimes. Amends Code Section 27-407. Effective July 1, 1980. Act 1396; HB 1494; p. 1683 Authorizes any municipal court judge to seal the record of an individual when upon the call of the case for trial the charges are dismissed upon motion of the arresting officer or are dismissed for lack of prosecution. Authorizes records to be sealed when the charges are the subject of a pretrial disposition by the municipal prosecutor. Effective April 8, 1980. DEBTOR AND CREDITOR Act 1076; SB 249; p. 952 Establishes property which may be exempted by the debtor in bankruptcy proceedings and provides that the exemptions set out in the federal law shall not apply to an individual whose domicile is in Georgia. Enacts Code Sections 51-1301.1 and 51-1601. Effective March 24, 1980. Act 1131; SB 439; p. 1118 Provides that all judgments shall bear interest at 12 percent per year. Amends Code Section 57-108. Provides for judicial supervision, notice to defendants, and prompt hearings in attachment proceedings. Effective March 25, 1980. Act 1057; HB 476; p. 822 Completely revises the procedure for foreclosure of liens on personal property. Provides for notice to defendants and prompt hearings. Amends Code Section 67-2401. Effective July 1, 1980. Act 1413; HB 701; p. 1769 Authorizes issuance of garnishment writs on judgments of federal courts sitting in this state. Provides that, for purposes of determining what is subject to garnishment, the term "earnings" shall include compensation paid for personal services and periodic payments pursuant to pension or retirement programs. Limits the amount of an individual's disposable earnings subject to garnishment in an alimony or child support case to 50 percent. Provides that benefits from a pension or retirement program shall not be exempt from garnishment after they have been paid or transferred to the beneficiary. Requires that courts which issue garnishment on the salary of public employees be located in the county in which the warrant or check for the salary is issued or drawn. Changes the amount to which a default judgment against a garnishee may be reduced to $50.00 plus the amount by which the garnishee was indebted to the defendant. Provides a new procedure of continuing garnishment on employers under which all debts accruing from the garnishee employer to the defendant employee for 179 days after the date of service shall be subject to garnishment and provides procedures and forms in connection therewith. DOMESTIC RELATIONS Act 1343; HB 1570; p. 1432 Restates and changes rules of inheritance by, from, and through illegitimate children so as to provide for inheritance by and from maternal kin in all cases and by and from paternal kin if the child has been legitimated by court order. Amends Code Sections 113-904 and 905. Effective April 1, 1980. Act 1331; HB 390; p. 1374 Establishes a new civil procedure for judicial determination of paternity and support of children. Changes the provisions relating to blood tests in criminal child abandonment actions. Enacts Code Chapter 74-3 and amends Code Section 74-9902. Effective July 1, 1980. Act 1141; HB 711; p. 1136 Provides special rules for service of suspended sentences in child abandonment cases and authorizes modification of the amount of child support a defendant is required to pay as a condition of suspended sentence. Amends the "Statewide Probation Act," Ga. Laws 1956, p. 27 (Ga. Code Ann. 27-2709). Effective March 25, 1980. Act 1004; HB 1294; p. 755 Provides that in cases of collection of arrearages by child support receivers the fee of the receiver shall be assessed as if the past due payments had been paid individually when due. Effective July 1, 1980. - 29 - DOMESTIC RELATIONS (continued) Act 1072; SB 43; p. 936 Authorizes grandparents to file original actions for visitation rights with their grandchildren whenever one parent of the grandchild dies, remarries after the death of his or her spouse, or has his or her parental rights terminated. Amends Ga. Laws 1976, p. 247 (Ga. Code Ann. 74-112). Effective March 24, 1980. Act 1145; HB 1062; p. 1149 Authorizes the court, in any action involving the determination of child custody between the parents, to order investigations and reports by family and children services agencies or other entities on motion of a party, which motion alleges child abuse, neglect, or other acts which have adversely affected the child. Effective July 1, 1980. Act 891; HB 112; p. 438 Requires the judge of the probate court to notify the parents of any person 17 years of age or younger who applies for a marriage license and whose parents' consent is not required for issuance of the license. Provides for an additional $1.00 fee to be charged in such cases. Enacts Code Section 53-207. Effective July 1, 1980. Act 1395; HB 1406; p. 1661 Completely revises Code Chapter 49-6, relating to guardians of incapacitated adults, changing both procedural and substantive law applicable to such guardianships. EDUCATION Act 1211; HB 835; p. 1214 Creates a Professional Practices Commission for teaching as a successor - 30 - EDUCATION (continued) to and continuation of the existing Professional Practices Commission. Directs the commission to adopt standards of performance and a code of ethics for educators and to investigate violations by educators. Repeals the "Professional Teaching Practices Act," Ga. Laws 1967, p. 840 (Ga. Code Ann. 32-838 et seq.) and enacts a new "Professional Teaching Practices Act." Effective March 26, 1980. Act 1065; HB 1428; p. 835 Comprehensively and exhaustively revises laws relating to state scholarship and higher education assistance programs. Enacts Code Chapters 32-31, 32-33, and 32-37. Repeals Code Chapters 35-7 and 35-8 and parts of Ga. Laws 1937, p. 355 (Ga. Code Ann. Ch. 32-28). Effective July 1, 1980. Act 896; HB 195; p. 450 Provides that the 180 day school year for public schools may be reduced by not more than two days where the 178th or any subsequent day falls on the last day of the last week otherwise provided for and such two or fewer days were missed for emergency reasons. Act 1092; SB 458; p. 1010 Provides that local school systems may continue to receive state funds allocated for instructional personnel who are participating in personnel exchange programs. Act 984; HB 1184; p. 698 Directs the State Board of Education to establish policies and procedures providing for partial allocations to local units of administration of special education leadership positions. Amends the "Adequate Program for Education in Georgia Act," Ga. Laws 1974, p. 1045 (Ga. Code Ann. 32-62la). Effective July 1, 1980. Act 1339; HB 1416; p. 1413 Changes the formulae for allotment of state funds to local school systems for instructional media and maintenance and operation to include kindergarten instructional units. Changes certain provisions relating to local school systems' facilities surveys and the - 32 - EDUCATION (continued) allotment of funds for capital facilities. Amends the "Adequate Program for Education in Georgia Act," Ga. Laws 1974, p. 1045 (Ga. Code Ann. 32-613a, 615a, and 648a). Effective April 1, 1980. Act 895; HB 184; p. 448 Changes the amount of state funds to be withheld from local school systems because of each day of employment of an unqualified substitute teacher from 1/180 to 1/190 of the state funds otherwise payable on behalf of the regular teacher who is absent. Amends the "Adequate Program for Education in Georgia Act," Ga. Laws 1974, p. 1045 (Ga. Code Ann. 32-655a.1). Effective March 20, 1980. Act 1417; HB 1372; p. 1789 Changes the distribution formula for state grants to local school systems for purposes of ad valorem tax relief so that, where pupils residing in one school district attend schools within another district, those pupils shall be counted in the district in which they reside. Act 904; HB 393; p. 465 Makes the provisions of law governing sick leave of school teachers applicable to student services support personnel and administrative and supervisory personnel. Amends Ga. Effective July 1, 1980. - 33 - EDUCATION (continued) Act 1382; SB 145; p. 1538 Authorizes the State Personnel Board to establish a self-insurance plan of health insurance for public school employees. Removes the 3 percent limitation on employer contributions to the public school employees health insurance fund. Authorizes coverage of employees who have previously rejected coverage. Provides for investment of the funds of the plan. Repeals a provision for payment of state funds to school systems maintaining their own health insurance plan for employees. Amends Ga. Laws 1975, p. 1194 (Ga. Code Ann. Ch. 32-44). Effective July 1, 1980. Act 1383; SB 329; p. 1541 Authorizes the State Personnel Board to provide dental and v1s1on care benefits as part of the health insurance plan for public school teachers. Amends Ga. Laws 1975, p. 37 (Ga. Code Ann. 32-4302). Effective April 8, 1980. Act 1079; SB 330; p. 963 Provides for coordinated benefits where both a husband and wife are covered by the public school teachers health insurance plan. Provides for investment of the funds of said health insurance plan by the fiscal division of the Department of Administrative Services. Authorizes the State Personnel Board to contract with health maintenance organizations with regard to said insurance plan. Amends Ga. Laws 1975, p. 37 (Ga. Code Ann. Ch. 32-43). ELECTIONS Act 995; HB 1249; p. 724 Provides for applicability of the "Campaign and Financial Disclosure Act" to persons seeking to bring about the approval or rejection by the voters of any proposed question on the ballot in any county or municipal election. - 34 - ELECTIONS (continued) Changes the time of filing of reports concerning recall elections. Amends Ga. Laws 1974, p. 155 (Ga. Code Ann. Ch. 40-38). Effective March 20, 1980. Act 1346; HB 1640; p. 1436 Changes certain procedures for application for recall elections. Provides for determination of the legal sufficiency of applications for recall petitions. Amends the "Public Officers Recall Act," Ga. Laws 1979, p. 1612 (Ga. Code Ann. Ch. 89-19). Effective April 1, 1980. Act 890; HB 51; p. 437 Requires that, when voting machines are used on which the titles of offices are arranged horizontally, the names of all candidates for the same office appear within the same vertical lines. Amends Code Section 34-1208. Effective March 20, 1980. Act 1299; SB 434; p. 1256 Changes provisions relating to required training of local election officers. Prohibits the use after July 1, 1984, of any polling place which is not appropriately accessible to handicapped voters. Provides that, when the general primary would otherwise occur during the same week as the national convention of a major political party, then the general primary shall be conducted on the first rather than the second Tuesday in August. Provides that, if two or more candidates for the same position have the same or similar names, then the residence of each shall be printed on the ballot below his name if deemed appropriate by the qualifying official. Provides that delivery of absentee ballots of disabled electors may be made by certain named relatives of the elector. Changes the required hours for registrars' offices to remain open on election days. Requires fixed hours of operation and security measures for the operation of additional voter registration places. Requires that municipal voters given notice of disqualification because of failure to vote request continuance of their registration in writing within 20 days. Provides that municipal elections shall not be held within an election district when there are no questions to be submitted to the electorate within that district and changes related procedures. Provides that, if two or more candidates for the same position have the same or similar names, the residence of each shall be printed on the ballot under his name if determined to be appropriate by the qualified official. Act 674; HB 1092; p. 5 Provides that the name of a potential presidential candidate will not be placed on the primary ballot or published if he would be ineligible for office if elected. Act 722; HB 1407; p. 312 Provides for challenges to the qualifications of candidates to be determined by the Secretary of State in the case of federal and state elections and by the superintendent in the case of county elections. Act 980; HB 1144; p. 685 Provides that, whenever any person elected to public office fails to take office validly, then a special election shall be called to fill the vacancy. Act 979; HB 1143; p. 684 Provides that, whenever a person elected at a municipal election fails to take office validly, then a special election shall be called to fill the office. Amends Code Section 34A-1409. Effective March 20, 1980. EVIDENCE Act 706; HB 1180; p. 70 Raises witness fees from $4.00 to $10.00 per day. Raises the amount tendered to out-of-county witnesses from 8 to 20 per mile. Provides that subpoenas requiring the attendance of witnesses may be served at any place within the state. Amends Ga. HEALTH Act 985; HB 1189; p. 699 Directs the Office of Telecommunications of the Department of Administrative Services to develop a "911" emblem to be displayed on all marked vehicles used for enforcement of traffic laws by public safety agencies participating in the "911" emergency telephone number system except vehicles of the Department of Public Safety and vehicles used for investigative purposes. Amends the "Georgia Emergency Telephone Number '911' Service Act of 1977," Ga. Laws 1977, p. 1040 (Ga. Code Ann. Ch. 92A-33). Effective March 20, 1980. Act 1407; HB 1250; p. 1758 Authorizes emergency medical technicians who work for county or municipal police departments, fire departments, and rescue units to obtain from hospital pharmacies those drugs which they are authorized to administer by virtue of their certification. Enacts Code Section 81-3112.13. Effective July 1, 1980. Act 1158; HB 1376; p. 1170 Authorizes the Composite State Board of Medical Examiners to conduct investigations and subpoena documents relating to the fitness of advanced emergency medical technicians and cardiac technicians. Requires that each ambulance service have a licensed physician medical advisor except in counties having a population under 12,000. Amends Code Section 88-3112.7 and enacts Code Section 88-3118. Effective March 25, 1980. - 38 - HEALTH (continued) Act 1305; HB 553; p. 1282 Provides civil and criminal immunity under certain circumstances to individuals who furnish information to review organizations established by health care professional societies or associations. Provides for confidentiality of records of such review organizations. Enacts Code Chapter 84-76. Effective March 31, 1980. Act 1418; HB 1391; p. 1790 Provides for licensing by the Department of Human Resources of home health agencies which provide home health services. Provides that regulation by the department shall be no less stringent than that required for participation of home health agencies in the Title XVIII Medicare Program. Effective July 1, 1980. Act 1139; HB 284; p. 1131 Extends to deaf persons the same rights to public transportation and housing accommodations, including the right to be accompanied by a guide dog, which are presently provided to blind persons. Amends Ga. Laws 1975, p. 1639 (Ga. Code Ann. 79-601 and 76-9901). Effective July 1, 1980. Act 1293; SB 11; p. 1245 Requires registration by social agencies and physicians of persons identified as being spinal-cord-disabled for purposes of making rehabilitative services available to such persons. Enacts Code Chapter 88-34. Effective March 31, 1980. Act 1300; SB 450; p. 1261 Requires reports of abuse or exploitation of residents of long-term health care facilities to be made by any of the following persons who have knowledge thereof: any administrator, manager, physician, nurse, nurse's aid, orderly, or other employee in a hospital or facility; any medical examiner, dentist, osteopath, optometrist, - 39 - HEALTH (continued) chiropractor, podiatrist, social worker, coroner, clergyman, police officer, psychologist, pharmacist, physical therapist, or employee of a public or private agency engaged in services to or responsible for inspection of facilities. Provides for investigations and other related matters. Enacts Code Chapter 88-19C. Effective March 31, 1980. Act 1098; SB 541; p. 1040 Provides for grants of state funds to hospital authorities which operate teaching hospitals. Requires physicians, nurses, and other persons employed by medical facilities to report through the person in charge of the medical facility to the appropriate police authorities cases of injuries to patients inflicted by other than accidental means. Enacts Code Sections 88-1825 and 88-1913. Effective as to state grants to hospital authorities July 1, 1980. Effective as to required reports by medical personnel March 24, 1980. Act 1409; HB 1512; p. 1761 Requires that notice of and an opportunity to enroll in third-party prescription programs be given to all pharmacies in the state. Defines "third-party prescription programs" to mean systems of reimbursement of pharmaceutical services by contractual agreement between providers of pharmaceutical services and other parties who are not the consumers of those services, including employee benefit plans. Specifies required contractual provisions and prohibited practices. Enacts Code Chapter 79A-12. Effective April 8, 1980. Act 1351; HB 1771; p. 1451 Requires that certain notification and consultation rights concerning changes in treatment of hospitalized alcohol or drug dependent persons and mentally ill persons be given to the patient's representative or guardian. - 40 - HEALTH (continued) Enacts Code Sections 88-402.24 and 502.24. Effective July 1, 1980. Act 1151; HB 1280; p. 1160 Authorizes admission of mentally retarded persons to facilities for purposes of temporary respite care in cases where the person or persons with whom the person to be admitted usually lives is unavailable. Enacts Code Section 88-2504.3. Effective July 1, 1980. Act 1312; HB 1186; p. 1328 Provides that corneal tissue for purposes of transplants or research may be removed from decedents under the jurisdiction of a coroner or medical examiner unless an objection on the part of the decedent or a relative has been made known. Provides that eye tissue may be removed only after express written consent given by the next of kin. Amends Code Section 80-2010. Effective March 31, 1980. Act 710; HB 1077; p. 82 Provides a system of permits for and regulation of the medicinal use of marijuana in treating glaucoma and chemotherapy side effects. Act 1017; HB 1435; p. 784 Repeals in its entirety Code Chapter 88-22, relating to the Advisory Council for Construction and Licensure of Hospitals. Effective March 20, 1980. INSURANCE Act 1296; SB 217; p. 1251 Requires that accident and sickness insurance policies and contracts which provide coverage for medical or surgical - 41 - INSURANCE (continued) procedures on an inpatient basis also provide coverage when certain medical or surgical procedures are performed on an outpatient basis. Authorizes the Insurance Commissioner to promulgate a listing of medical or surgical procedures which may be so performed on an outpatient basis. Amends Code Section 56-3016. Effective September 1, 1980. Act 1295; SB 169; p. 1249 Requires that accident and sickness insurance policies and contracts provide coverage for services whether rendered by a medical doctor or by a licensed applied psychologist. Enacts Code Section 56-2445. Effective July 1, 1980. Act 1303; HB 228; p. 1279 Requires that accident and sickness insurance policies and contracts provide coverage for services rendered by chiropractors which are within the lawful scope of practice of chiropractors. Enacts Code Section 56-2445. Effective July 1, 1980. Act 1335; HB 1251; p. 1393 Prohibits accident and sickness insurance policies and contracts which cover both an insured and his or her spouse from containing provisions for termination of coverage of the spouse because of a break in the marital relationship other than a divorce. Requires that policies which provide for termination of coverage of the spouse upon divorce also provide for the right of such spouse to purchase similar insurance upon application made within 31 days after divorce. Enacts Code Sections 56-3004.1 and 3102.1. Effective July 1, 1980. Act 1093; SB 468; p. 1011 Provides that it shall be an unfair and deceptive act to cancel, modify, or refuse to issue any property or casualty insurance policy or contract solely because the applicant or the insured or - 42 - INSURANCE (continued) any employee of either is mentally or physically impaired. Prohibits basing vehicle insurance ratings upon physical handicaps which do not impair the ability to drive. Amends Code Sections 56-712 and 507. Effective July 1, 1980. Act 1008; HB 1317; p. 760 States terms required to be included in any vehicle or residential building extended warranty or service contract which is included within the definition of property insurance. Amends Code Section 56-405. Effective March 20, 1980. Act 1342; HB 1542; p. 1428 Provides that for purposes of uninsured motorists insurance coverage a motor vehicle shall be considered "uninsured" to the extent that the liability coverage carried on such vehicle is less than the limits of the insured's uninsured motorist coverage. Authorizes municipalities by ordinance to adopt by reference the provisions of state law making it unlawful to operate motor vehicles without adequate insurance thereon. Amends Code Section 56-407A and the "Georgia Motor Vehicle Accident Reparations Act," Ga. Laws 1974, p. 113 (Ga. Code Ann. Ch. 56-34B and 56-99). Effective July 1, 1980, as to uninsured motorist coverage and effective April 1, 1980, as to the authority of municipalities to enact ordinances. Act 1340; HB 1439; p. 1418 Defines and authorizes the regulation of medicare supplement insurance. Enacts Code Section 56-2446. Effective April 1, 1980. Act 1301; SB 451; p. 1266 Defines the term "medicare supplement insurance policy" and requires that such insurance provide reasonable benefits in relation to premiums paid. Prescribes what shall be unfair or deceptive practices with regard to medicare supplement health insurance. - 43 - INSURANCE (continued) Amends Code Sections 56-704 and 2411 and enacts Code Section 56-3019. Effective March 31, 1980. Act 1129; SB 432; p. 1108 Changes provisions relating to insurers' credit for reinsurance placed with foreign and alien insurers. Authorizes investment of insurers' assets with savings and loan associations and building and loan associations. Changes other provisions relating to authorized investments by insurers and branch offices of insurers outside the state. Amends Code Sections 56-413, 901, 908, 1005, 1006, 1021, 1522, and 1533. Effective March 25, 1980. Act 1155; HB 1315; p. 1163 Changes provisions relating to the expiration date of and application date for licensure as an insurance agent or counselor. Act 925; HB 791; p. 516 Exempts from examination requirements applicants for licensure as insurance counselors who have successfully been examined by the society of Certified Insurance Counselors. Authorizes registration of foreign insurance representatives of domestic life insurers who represent the insurer exclusively at a United States military installation located in a foreign country. Amends Code Section 56-806b and enacts Code Section 56-820a. Effective July 1, 1980. JUVENILES Act 882; HB 1147; p. 416 Requires juvenile courts to notify the district attorney within 48 hours after the court learns of the taking into custody of a juvenile who has committed - 44 - JUVENILES (continued) an act which would be a felony if committed by an adult. Requires district attorneys upon request of the court to conduct delinquency proceedings in which the delinquent act would constitute a felony if committed by an adult. Amends Code Sections 24A-1301 and 1801. Effective July 1, 1980. Act 1094; SB 489; 1013 Provides special rules for the disposition of juveniles who commit certain specified acts which if done by an adult would be felonies. Mandates a finding as to whether restrictive custody is required and specifies types and periods of restrictive custody to be imposed if found to be required. Enacts Code Chapter 24-23A. Redesignates Code Chapter 24A-34, relating to protective orders, as Code Chapter 24A-34A. Effective July 1, 1980. Act 1068; HB 1676; p. 921 Authorizes the taking of nonidentifying photographs of injuries to abused children for use as documentation in supporting allegations by hospital staff, physicians, law enforcement personnel, school officials, or staff of child protective agencies. Amends Code Section 74-111. Effective March 24, 1980. Act 1101; SB 580; p. 1046 Provides for transfer of county juvenile detention facilities to the Department of Human Resources effective July 1, 1981. Authorizes full or partial state funding of county facilities untl that date. Amends Ga. Laws 1963, p. 81 (Ga. Code Ann. 99-213) and Code Section 24A-603. Effective March 24, 1980. - 45 - LABOR Act 1143; HB 831; p. 1145 Redefines the term "employer" for purposes of workers' compensation to include both public and private corporations and also persons who by agreement with an employer provide workers' compensation benefits to employees. Provides that employees receiving benefits shall not be entitled to bring tort actions against such "employers." Amends Code Sections 114-101 and 103. Effective March 25, 1980. Act 1114; SB 595; p. 1063 Requires workers' compensation insurers to file copies of the rates or rating systems used or proposed to be used by the insurer. Authorizes the Insurance Commissioner to require rate filings by insurers without compliance with insurance rule-making or "Administrative Procedure Act" procedures. Amends Code Section 56-522.1. Effective March 25, 1980. Act 1398; SB 250; p. 1686 Authorizes group self-insurance for workers' compensation purposes by groups of trade associations, professional associations, municipalities, counties, school boards, and hospital authorities. Provides for regulation of such group self-insurance funds by the Secretary of State. Enacts Code Chapter 114-6a. Effective July 1, 1981, provided that no such funds shall commence operations prior to January 1, 1982. Act 1393; HB 1213; p. 1565 Provides that unemployment compensation benefits shall not be charged to the account of a part-time employer who continues to provide part-time employment. Changes provisions for computation of maximum employment security contributions charged to employers delinquent in filing reports. Increases the interest rate on delinquent contributions to 1 percent per month. Provides for forfeiture of benefits to persons making false statements to begin at the time of the false statement. - 46 - LABOR (continued) Amends the "Employment Security Law," Ga. Laws 1937, p. 806 (Ga. Code Ann. Ch. 54-6). Effective April 8, 1980, except as to the interest rate on delinquent taxes. Effective July 1, 1980, as to the interest rate on delinquent taxes. Act 1392; HB 1212; p. 1563 Provides that unemployment compensation benefits payable after March 31, 1980, shall be reduced by the amount of governmental or other pension or retirement pay, annuity benefits, or other payments reasonably attributable to the week for which unemployment benefits are due. Provides for administration in conformity with federal law. Amends the Employment Security Law, Ga. Laws 1937, p. 806 (Ga. Code Ann. Ch. 54-6). An effective date of March 31, 1980, is provided in the Act, but it was signed by the Governor on April 8, 1980. Act 1388; HB 698; p. 1553 Provides that, for purposes of unemployment compensation coverage, employees of county and district health agencies established by general law, local law, or local constitutional amendment shall be consideted employees of the State of Georgia. Amends the "Employment Security Law," Ga. Laws 1937, p. 806 (Ga. Code Ann. 54-657(h)(8)(B)). Effective on the first day of the month following the month in which funds for implementation are appropriated. NATURAL RESOURCES Act 1075; SB 137; p. 942 Extensively amends the "Erosion and Sedimentation Act of 1975." Provides for certification of local governments as permit-issuing authorities and for certain of such local governments to approve or disapprove land-disturbing activity plans without further review. Exempts from coverage activities of water or sewerage authorities, airport authorities, electric membership corporations, municipal electric - 47 - NATURAL RESOURCES (continued) systems, and public utilities regulated by the Public Service Commission. Provides procedures for enforcement outside the jurisdiction of certified local governments. Provides for other related matters. Amends Ga. Laws 1975, p. 994 (Ga. Code Ann. Ch. 5-23A). Effective March 24, 1980. Act 943; HB 1499; p. 561 Authorizes the State Forestry Commission to contract for the production, purchase, and resale of seedlings. Amends Ga. Laws 1955, p. 309 (Ga. Code Ann. 43-206.1). Effective March 20, 1980. Act 957; HB 1764; p. 593 Abolishes the Franklin D. Roosevelt Warm Springs Memorial Commission and transfers its functions to the Department of Natural Resources. Provides that the members of said commission shall serve until the expiration of their terms as a Franklin D. Roosevelt Warm Springs Memorial Advisory Committee. Amends Ga. Laws 1972, p. 1015 (Ga. Requires that before granting any such relief the courts, the Department of Offender Rehabilitation, and the State Board of Pardons and Paroles must make a written finding as to whether restitution will be required. Act 1291; HB 407; p. 1233 Requires that specified disclosures be made to purchasers of certain business opportunities or franchises and filed with the Administrator of the "Fair Business Practices Act." Requires that sellers of such business opportunities post a surety bond or establish a trust account in favor of the state of Georgia for the benefit of persons damaged. Otherwise regulates the sale of business opportunities or franchises. Provides for administration by the Administrator of the "Fair Business Practices Act" and provides remedies. Provides for allocation of the property of railroad companies to municipalities as well as to counties for taxing purposes. Lists retirement systems whose benefits are exempt from income taxation and provides that benefits from all other retirement systems shall not be exempt. Increases from $1,000.00 to $5,000.00 the minimum amount of distributions per year as to which information at the source income tax reports must be made. Changes from January 31 to February 28 the date on which annual withholding tax returns must be made. Requires purchasers of sales tax exempt air and water pollution equipment to furnish a certificate from the commissioner of revenue in order to receive the tax exemption. Places conditions on extensions of time for filing sales tax returns. Extends for - 76 - REVENUE (continued) six months the sales tax assessment period in cases where a refund is applied for during the last six months of the period. Increases from $75,000.00 to $150,000.00 the maximum amount of a motor fuel dealer's required surety bond. Authorizes quarterly or annual rather than monthly motor fuel tax reports by distributors having $150.00 or less to report per quarter or year. Repeals prohibitions on sales of cigars and cigarettes below cost price. Repeals the requirement that local governments offer an opportunity to work the streets before collecting street tax. Provides that references in the rules and regulations of the Department of Revenue to laws other than Code Title 91A shall be deemed until revision of the rules to refer to the appropriate prov1s1ons of Code Title 91A. Makes other editorial changes. Clarifies that intangible tax revenues distributed to municipalities having independent school systems shall be divided between the municipality and the school system according to the ratio of nonschool property taxes to all property taxes levied by the municipality. Requires that intangible taxes be entered on a separate intangible property tax digest and mandates confidentiality of intangible tax records. Act 712; SB 418; p. 90 Authorizes the Department of Administrative services to make transfers of title of personal property of the state in connection with lease purchase agreements. Changes competitive bidding procedures applicable to purchases in excess of $5,000.00 by the state. Act 1294; SB 52; p. 1247 Creates a state fund for the purpose making grants to local civil defense organizations for purposes of obtaining equipment needed for disaster preparedness. Effective March 25, 1980. - 86 - TORTS (continued) Act 1102; SB 584; p. 1048 Relieves from civil liability any person who provides equipment to the state or any political subdivision at no cost during an emergency or disaster situation. Act 705; HB 1074; p. 69 Grants immunity from civil damages and criminal penalties arising from the condition of donated food to persons who in good faith donate food for use or distribution by nonprofit organizations. Directs the Department of Agriculture to maintain a referral service concerning food donations. Enacts Code Section 105-1106. Effective July 1, 1980. Act 1058; HB 873; p. 824 Extends civil and criminal immunity to members and commanders of the militia in performance of their duties. Amends the "Georgia Military Forces Reorganization Act of 1955," Ga. Laws 1955, p. 10 (Ga. Code Ann. 86-1101). Effective March 24, 1980. Act 1159; HB 1436; p. 1173 Provides that the officers, members, agents, or employees of any fire department established by any county, municipality, fire district, or authority shall not be liable for acts done while fighting a fire or at the scene of an emergency except for willful negligence or malfeasance. Act 915; HB 656; p. 495 Limits the conditions under which a cause of action shall exist on a sheriff's bond to situations where the sheriff derives financial benefit from the act complained of, had actual knowledge of and caused or failed to prevent the act complained of, or failed to exercise ordinary care to prevent the act or condition complained of. Amends Code Section 24-2805. Effective July 1, 1980. - 87 - TORTS (continued) Act 914; HB 655; p. 493 Limits the liability of a sheriff for misconduct of a jailer to situations where the sheriff personally benefits financially from the act complained of, had actual knowledge of and caused or failed to prevent the act complained of, or failed to exercise ordinary care to prevent the act or condition complained of. Amends Code Section 24-2812. Effective July 1, 1980. TRANSPORTATION Act 1314; HB 1302; p. 1334 Provides for issuance by the Department of Public Safety of temporary and permanent handicapped parking permits. Makes unlawful the use of public or private handicapped parking places by any person other than one displaying a handicapped parking permit and actually using the space for a handicapped person. Enacts Code Sections 68A-1020 to 1024. Effective July 1, 1980. Act 1088; SB 416; p. 995 Provides procedures for removal and sale of abandoned motor vehicles. Amends Ga. Laws 1961, p. 68 (Ga. Act 926; HB 815; p. 518 Exempts homemade trailers from the requirements of the "Motor Vehicle Certificate of Title Act." Amends Ga. Laws 1961, p. 68 (Ga. Code Ann. 68-402a and 404a). Act 1000; HB 1283; p. 746 Provides that persons renting, leasing, or loaning motor vehicles shall be responsible for failure to display a current license tag on any such vehicle and fixes penalties. - 88 - TRANSPORTATION (continued) Amends Code Section 68-9901. Effective July 1, 1980. Act 1097; SB 533; p. 1038 Requires that county motor vehicle tag agents submit title applications and related sums of money on a daily basis. Provides penalties for failure to submit such applications and sums of money within seven calendar days from the date of collection unless an extension is granted. Amends the "Motor Vehicle certificate of Title Act," Ga. Laws 1961, p. 68 (Ga. Code Ann. Ch. 68-4A). Effective March 24, 1980. Act 1105; SB 532; p. 1050 Authorizes the state revenue commissioner to allow issuance of license plates for motor vehicles in excess of 24,000 pounds by county tag agents. Provides deadlines within which county tag agents must submit reports of tag applications and moneys and provides penalties for late remittance. Amends Ga. Laws 1955, p. 659 (Ga. Code Ann. 68-245 and 246). Effective July 1, 1980. Act 757; SB 403; p. 357 Requires that license plates issued for publicly owned motor vehicles indicate whether the vehicle is operated by the state, a city, a county, an authority, or a board. Amends Code Section 68-260. Effective January 1, 1983. Act 983; HB 1177; p. 691 Provides that for purposes of suspending drivers' licenses, moving traffic violations other than those specifically listed shall assess three points against the driver. Provides for a system of probationary drivers' licenses to be issued to habitual violators under certain conditions. Amends Code Sections 68B-307 and 308. Effective July 1, 1980. - 89 - TRANSPORTATION (continued) Act 1108; SB 538; p. 1059 Provides that any driver who fails to notify the operator or owner of an unattended motor vehicle which he strikes shall be guilty of a misdemeanor. Amends the "Uniform Act Regulating Traffic on Highways," Ga. Laws 1953, Nov.-Dec. Sess., p. 556 (Ga. Code Ann. 68-1621). Effective July 1, 1980. Act 1066; HB 1463; p. 917 Provides that the driver's operating record kept by the Department of Public Safety shall list only those accidents in which the individual was convicted of a moving traffic violation. Act 1086; SB 391; p. 979 Requires that persons operating radar speed detection devices after December 31, 1980, be trained in the use thereof and certified by the Georgia Peace Officer Standards and Training Council. Act 949; HB 1563; p. 576 Changes certain vehicle size and weight limits, including an increase from 55 to 60 feet in the general length limitation for vehicles. Authorizes the Department of Transportation as a last resort to provide replacement housing when a federal-aid or state-aid project cannot proceed to construction because no comparable replacement sale or rental housing is available. Authorizes the Department of Transportation to pay relocation assistance for persons displaced by state-aid highway projects. Provides that counties and municipalities shall be required to pay relocation assistance only on federal-aid highway projects. Amends Code Sections 95A-401, 503, and 622.
