We are pleased to transmit to you the "Summary of General Statutes Enacted at the 1979 Session of the General Assembly of Georgia." This represents one of the services which the Legislative Services Committee and the Office of Legislative Counsel perform for the legislative branch of government. Other services include bill drafting, research, statutory and code revision, rendering of opinions, counseling, legislative reference, interim committee statfing, and preparation of reports.

The Office of Legislative Counsel drafted a total of 3,666 bills, resolutions, and amendments for the 1979 session. Of this number, 802 had been prepared by the convening date of the session, leaving a total of 2,864 which were drafted during the session.

The other members of the committee and the Office of Legislative Counsel join me in the sincere hope that this booklet will be of benefit to those who use it. If we may be of service, please feel free to call upon us.

FOREWORD
This booklet contains a summary of the general statutes of statewide application which were enacted at the regular 1979 session of the General Assembly of Georgia. No resolutions, "population" Acts, or Acts with special application have been included.
It would be impractical to minutely analyze each statute because to do so would defeat the main purpose which it is hoped this booklet accomplishes. It is intended that it be used as a convenient reference for persons desiring to know which laws were enacted or desiring to ascertain the main features of an Act without the necessity of reading it in its entirety. It should be pointed out that for specific, detailed information on any particular law, the Act itself should be examined. A notation of the effective date is listed after each Act.
I would like to give special credit to Sewell Brumby, Assistant Legislative Counsel, for the preparation of this booklet. The many long hours involved in this project are evidence of his outstanding work and his meticulous attention to detail.
This summary is not to be deemed in any manner as an opinion from the Office of Legislative Counsel, and the question of constitutionality has not been considered in any respect. It is hoped that this booklet will benefit all who have occasion to use it and comment and suggestions for improvement are invited.

Act 471; S. B. 166; p. 756
Amends Code Section 109A-2-316, so as to provide that there shall be no implied warranty of freedom from disease with respect to the sale of cattle, hogs, and sheep by licensed auction companies or agents; exempts brucellosis reactor cattle detected at an official state laboratory within 30 days after sale.
Effective April 12, 1979.

Prohibits the slaughter of horses except upon compliance with certain record-keeping requirements; provides for rule making and investigations by the Georgia Department of Agriculture; provides penalties.

The "Georgia Swine Mycobacteriosis

Indemnification Act" authorizes the

Commissioner of Agriculture to pay

indemnities to owners of swine condemned

by reason of infection with swine

mycobacteriosis

certain

conditions; authorizes the Commissioner

of Agriculture to promulgate necessary

rules and regulations.

Amends the "Georgia Meat Inspection Act" (Ga. Laws 1969, p. 1028), so as to provid~ for the imposition of administrative penalties by the Commissioner of Agriculture for violations.

Amends the 1953 Act relating to eradication and control of infectious diseases in livestock (Ga. Laws 1953, Jan.-Feb. Sess., p. 480), so as to provide for the imposition of administrative penalties by the Commissioner of Agriculture for violations.

Amends Code Chapter 58-8, known as the "Wine Tax Law," so as to redefine the terms "broker" and "importer."

Amends the "Georgia Residential Finance Authority Act" (Ga. Laws 1974, p. 975), so as to increase to $200 million the maximum amount of bonds and notes which the authority may have outstanding at any one time.

Amends the "Private Colleges and Universities Facilities Authority Act" (Ga. Laws 1978, p. 1765), so as to include within the definition of the word "project" certain medical and hospital facilities.

Amends Code Section 69-1507a, so as to prohibit resource recovery development authorities from bidding or paying compensation for solid wastes being privately processed or reused.
Effective July 1, 1979.

Amends the "Development Authorities Law" (Ga. Laws 1969, p. 137), so as to include within the definition of the word "project" the acquisition, construction, leasing, or financing of certain office buildings; provides that property leased for the purposes of a project which is an office building shall not be exempt from ad valorem taxation.
Effective March 15, 1979.
Act 608; H. B. 544; p. 1091
Creates a new Code Section 95A-1244.l which authorizes state agencies and

political subdivisions of the state to lease, lend, grant, or convey to the Georgia Tollway Authority real or personal property upon such terms as may be agreed upon without advertisement, court order, or other formality other than the regular execution of an appropriate instrument; amends Code Section 95A-1245 and creates a new Code Section 95A-1245.l, so as to authorize the Georgia Tollway Authority to acquire and operate tollway projects which were toll facilities at the time of acquisition or at some earlier time.
Effective April 16, 1979.
Act 623; H. B. 515; p. 4634
Amends "The Metropolitan Atlanta Rapid Transit Authority Act of 1965" (Ga. Laws 1965, p. 2243), so as to require that the charges for charter services rendered by the authority shall be no lower than the charges of motor common carriers and motor contract carriers in the metropolitan area; extends the 1 percent sales tax rate under the Act to June 30, 1997; limits the percentage of said sales tax which may be used to subsidize operating costs; provides use priorities for revenue raised by the authority.
Effective July 1, 1979, except a provision as to use priorities which is effective April 1, 1982.
BANKING AND FINANCE
Act 36; S. B. 133; p. 355
Amends Code Section 57-101, so as to change the maximum legal rate of interest to 10 1/2 percent per annum; amends Code Section 57-118, so as to provide that any corporation or person may agree to pay any rate of interest upon any loan for nonconsumer purposes where the principal balance exceeds the sum of $3,000.00 and prohibits any claim or defense of usury as to such transactions.
Effective March 9, 1979.
Act 37; S. B. 134; p. 357
Amends Code Section 57-101.1, so as to establish a flexible maximum rate of interest for real estate loans; bases this rate on the return of United States government bond yields; provides for computation of said rate by the commissioner of banking and finance.

Prohibits certain practices in

connection

with

real

estate

transactions; prohibits acceleration of

indebtedness secured by real estate on

account of the sale or transfer of the

real estate to be used as a residence;

allows lenders to raise the interest

rate upon transfer of property by up to

1 percent per annum if the original

borrower is relieved of liability;

regulates the amount of loan transfer

fees charged by lenders; requires

approval or disapproval of loan

assumptions by lenders within 45 days

and prohibits disapproval for any reason

other than the credit worthiness of the

person seeking to assume the

indebtedness;

provides

certain

exemptions.

Effective March 1, 1979.

Act 642; H. B. 673; p. 1281
Amends the 1966 Act regulating charges and interest on loans secured by secondary security deeds on residential property (Ga. Laws 1966, p. 574), so as to provide that the legal rate of interest shall be at the same rate as and computed in accordance with the provisions of Code Section 57-116; changes the amount of permissible finance charges on loans up to $1,500.00 from $150.00 to $50.00.
Effective July 1, 1979.

Act 588; H. B. 385; p. 1051
Amends Code Section 20-1204, so as to provide that acceptance by a creditor of a check, draft, or money order marked "payment in full" or with equivalent language in an amount less than the total indebtedness shall not constitute an accord and satisfaction unless there is a bona fide dispute as to the amount due or there is an independent agreement that such payment shall satisfy the debt.
Effective July 1, 1979.

Act 64; H. B. 414; p. 417
Amends Code Section 41A-3101 and creates Code Section 41A-3121, so as to provide that the Department of Banking and Finance may authorize credit unions which have total assets in excess of $1 million to offer third party payment

services; provides for standards and regulation of credit unions which offer
third party payment services. Effective July 1, 1979.

Act 545; H.B. 203; p. 951
creates a new Code Section 41A-411 which designates the Department of Banking and Finance as the appropriate agency to receive and investigate certain complaints regarding interest and usury violations; provides that the Department of Banking and Finance in consultation with the Department of Law may render advisory opinions; provides that good faith reliance upon such opinions shall constitute prima facie evidence of good faith.
Effective April 13, 1979.

Act 546; H. B. 204; p. 953
Amends Code Section 41A-1309(b)(3), so as to exclude obligations representing the sale of federal or correspondent funds to another financial institution from computation of the loan limitation as to the stock or capital securities of any corporation.
Effective April 13, 1979.

Act 544; H.B. 202; p. 950
Creates a new Code Section 41A-318, which provides that rules and regulations issued by any state or federal official or agency, which rules or regulations are intended to apply to any financial or other institution under the jurisdiction of the commissioner of banking and finance, shall become effective as to such institution only upon written approval by the commissioner.
Effective July 1, 1979.

Act 57; H. B. 106; p. 399

Amends Code Section 100-108, so as to

provide that debt obligations issued by

certain federal agencies shall be

accepted as collateral to secure state

funds in state depositories; amends Code

Section 100-117, so as to provide for

the nature and type of investments

allowed to be made by the director,

Fiscal

Division, Department of

Administrative Services, and to provide

that interest earned on the investment

of motor fuel tax revenues shall be

defined as motor fuel tax revenues

Act 652; H.B. 783; p. 1296

Amends the "Georgia Securities Act of

1973 11 (Ga. Laws 1973, p. 1202), so as to

provide for measuring the value of

securities by reference to book value

under

certain circumstances in

connection with registration of

securities by notification; provides for

continuing

the registration of

predecessor dealers for their successors

under certain circumstances; creates

certain additional exemptions to

provisions of the Act; makes other

technical changes relating to securities

regulation.

Effective April 17, 1979.

CIVIL PROCEDURE
Act 438; S. B. 59; p. 619
Amends the 1965 Act comprehensively revising appellate and other posttrial procedures (Ga. Laws 1965, p. 18), so as to require appeal by petition in cases of divorce, alimony, child custody, contempt arising from alimony or child custody judgments, superior court decisions reviewing administrative agencies' decisions, and superior court decisions reviewing lower courts' decisions; exempts decisions of the Public Service Commission and probate courts and cases involving ad valorem taxes and condemnations; prescribes procedure for filing and contents of petitions for appeal in such cases; provides for orders by the Supreme Court or the Court of Appeals granting or denying such petitions and procedure thereafter; exempts procedure in certain habeas corpus cases provided for by Code Section 50-127(11).
Effective July 1, 1979, and applicable to orders and judgments rendered after that date.
Act 583; H. B. 368; p. 1041
Amends the "Georgia Civil Practice Act" (Ga. Laws 1966, p. 609), so as to require notice to all parties of record of discovery against persons, firms, or corporations who are not parties.
Effective April 16, 1979.

Act 503; H.B. 43; p. 831
Authorizes counties which provide dumpsters to designate all or any of such dumpsters as suitable for household garbage only; makes it unlawful to dump nonhousehold garbage into any dumpster which is so marked; makes it unlawful to set fire to, scatter the contents of, or otherwise vandalize any county-provided dumpster.
Effective July 1, 1979.
Act 665; S. B. 63; p. 1400
Creates a new Code Chapter 24-27A providing for the Office of the Receiver of Child Support; provides that such office may be, but is not required to be, created by the governing authority or authorities within each county or within all the counties of a judicial circuit; provides for the duties of said office to collect, account for, and pay over child support and to take action in cases of nonpayment.
Effective July 1, 1979.
Act 40; H.B. 185; p. 367
"The Georgia Indigent Defense Act" creates the Georgia Indigent Defense Council and an optional system of state-funded local indigent defense programs; provides for adoption of guidelines by the Supreme Court upon recommendation by the council; provides that each county or all the counties within a judicial circuit may establish a local program to be governed by a local tripartite committee representing the county governing authority or authorities, the local bar association or associations, and the superior court judge or judges; provides for recovery of costs from ineligible defendants; provides that existing or future local programs which do not receive state funds need not be affected.
Effective July 1, 1979, for a period of four years.
Act 111; S. B. 178; p. 504
The "Capital Felony Expense Act" provides for state reimbursement to counties for extraordinary expenses incurred above a certain percentage of county revenue as a result of the trial of capital felony cases; provides for administration and adoption of rules and regulations at a state level by the commissioner of the Department of Community Affairs; provides that the clerks of the superior courts shall be local administrators.

Creates a new Code Section 24-3804 which provides that the Supreme Court may hear oral argument in places other than the seat of government.
Effective April 16, 1979.

Repeals Code Section 24-1803 which required posting of a $1,000.00 bond by probate court clerks.
Effective July 1, 1979.

Act 430; S. B. 22; p. 601

Amends Code Section 59-120, so as to

change the amount of compensation of

Act 201; H. B. 462; p. 518 Fixes the terms of court for the Tallapoosa Judicial circuit in Douglas, Polk, Haralson, and Paulding counties. Effective July 1, 1979.

Act 515; H.B. 100; p. 876
Provides for an additional judge of the Eastern Judicial Circuit; provides for adoption of local rules by the judges of said circuit; provides for a presiding judge of said circuit; directs Chatham County to furnish certain office space and clerical help to said judicial circuit.
Effective April 13, 1979.

Act 419; H.B. 1013; p. 578 Amends the 1949 Act creating the Mountain Judicial Circuit (Ga. Laws

1949, p. 266), so as to change the terms of court and times for convening grand juries for Habersham, Rabun, Stephens, Towns, and Union counties.

Act 479; S. B. 204; p. 769
Provides for an additional judge of the Ocmulgee Judicial Circuit; provides for adoption of local rules by the judges of said circuit; provides for a chief judge of said circuit; authorizes an additional court reporter for such circuit.
Effective April 12, 1979.
Act 95; H. B. 729; p. 503
Fixes an additional term of court for the Ocmulgee Judicial Circuit in Jasper County.
Effective April 5, 1979.

CRIMINAL LAW

Act 8; H. B. 481; p. 131
Creates a new Code Section 26-2023 which provides that nothing contained in Code Chapter 26-20 shall prevent any county or municipality from adopting ordinances which proscribe loitering, or related activities, in public for the purpose of procuring others to engage in sexual acts for hire.
Effective February 19, 1979.

Act 596; H.B. 460; p. 1068

Amends Code Section 26-2408, so as to

make knowing and willful false

statements and fraud of any matter

within

the

jurisdiction of the

government of any political subdivision

of the state a felony.

Effective July 1, 1979.

Act 538; H. B. 190; p. 935
Amends Code Sections 26-1401, 1402, and 1403, so as to change the definition of and penalties for arson in the first, second, and third degree.
Effective April 13, 1979.

Act 437; S. B. 45; p. 618
Creates a new Code Section 26-1508 defining the misdemeanor of injuring, tearing down, or destruction of mail

Act 478; S. B. 197; p. 768
Creates a new Code Section 68A-903.l which provides that whoever, without malice, by reason of violation of Code Section 68A-902, relating to drivers with ability impaired by alcohol or drugs, causes bodily harm to another by depriving him of an arm, leg, or eye shall be guilty of the felony of serious injury by vehicle.
Effective July 1, 1979.

Act 475; S. B. 176; p. 764

Amends code Section 26-1503, so as to

provide that the notice to a trespasser

which is an element of criminal trespass

may

be

given,

upon proper

identification, by an authorized

representative of the owner or rightful

occupant of the premises.

Effective July 1, 1979.

Act 516; H.B. 101; p. 879

Amends Code Section 79A-828, so as to

provide for forfeiture under the

"Georgia Controlled Substances Act" of

money seized in connection with

controlled

substance

violations;

provides for payment of such money into

the county treasury as county funds;

provides that the superior court upon

application of the district attorney or

sheriff may pay to informers up to

one-fourth of the proceeds of the sale

of forfeited property.

Effective July 1, 1979.

Act 631; H. B. 187; p. 1258
Amends Code Section 79A-811, so as to change penalties for crimes involving 100 pounds or more of marijuana.
Effective April 17, 1979.

Act 572; H.B. 295; p. 1019
Amends Code Section 26-2907, so as to add authorized employees under the State Board of Pardons and Paroles and the Attorney General to the list of officers exempted in the performance of their duties from Code Sections 26-2901, relating to concealed weapons; 26-2902, relating to deadly weapons at public gatherings; 26-2903, relating to pistol

CRIMINAL PROCEDURE

Amends

the "Uniform Criminal

Extradition Act" (Ga. Laws 1951, p.

726), so as to provide that habeas

corpus actions brought under said Act

shall be defended by district attorneys

unless the Governor shall direct the

Attorney General to defend.

Effective March 15, 1979.

Act 615; S. B. 195; p. 1173
Amends Code Sections 27-101 et seq., so as to change the amount of the reward which the Governor may offer to an amount "not to exceed the sum of $1,000.00 in felonies not capital, including arson, and not to exceed the sum of $10,000.00 in capital felonies and arson"; deletes the provisions for a specific reward for the burning of gin houses; makes specific provision for rewards for theft of horses and swine; changes the definition of "conviction" for purposes of determination of when the Governor is authorized to pay over rewards.
Effective April 16, 1979.

Act 472; S. B. 174; p. 759
Amends the 1973 Act permitting drivers' licenses to be deposited as bail for traffic offenses (Ga. Laws 1973, p. 435), so as to provide for use of drivers' licenses as bail to be deposited with the judicial officer or other officer authorized to accept cash bonds where the arresting officer has not accepted the driver's license as bail.
Effective April 12, 1979.

Act 499; H.B. 15; p. 824
Amends Code Section 26-3004, so as to include arson within the class of crimes for which superior courts may issue investigatio,, warrants permitting the use of electronic surveillance devices.
Effective April 13, 1979.

Amends provisions of Code Chapter 95A-9, relating to oversized vehicles and loads, including the following: Code Section 95A-957, so as to authorize operation of buses which do not exceed a width of 102 inches upon all roads except interstate highways where traffic

lanes are less than 12 feet wide; Code Section 95A-958, so as to provide that loads of poles and similar items may exceed the length of 55 feet without requiring a permit when such items are single length pieces and no pieces are
loaded end to end; Code Section 95A-961, so as to provide that permits may be immediately declared null and void when the conditions of such permits are violated; and Code Section 95A-961, so as to provide that certain oversized vehicles may return unloaded to their point of origin and so as to provide for
certain permit fees. The 1977 Act authorizing extra wide motor vehicles on highways (Ga. Laws 1977, p. 321) and the
1978 Act providing for permits for transporting mobile homes (Ga. Laws 1978, p. 1565) are repealed in their
entirety. Effective April 1, 1979, except a
provision for single trip permit fees for certain double wide trailers with a roof overhang which is effective July 1, 1979.

Amends the "Uniform Act Regulating Traffic on Highways" (Ga. Laws 1953, Nov.-Dec. Sess., p. 556), so as to exempt from safety requirements for school buses any motor vehicles operated by a local transit system which transports school children along with regular fare-paying passengers.

Creates a new Code Section 113-1001.1

which provides that any husband who

becomes a widower after the effective

date of the Act shall be entitled to

year's support pursuant to the same

provisions under which a widow is

entitled to year's support; amends Code

Section 113-1202, so as to provide that

beneficiaries under a will shall be

entitled, in lieu of other rules, to

name an administrator with the will

annexed; amends Code Section 113-1502,

so as to provide that an administrator

with the will annexed shall have all the

powers and immunities of an executor,

except such as manifestly arise from

personal trust in the named executor;

amends Code Section 113-1217, so as to

reenact

the

requirement

that

administrators shall post bond in an

amount equal to double the value of the

estate, except administrators with the

will annexed whose bond shall be

governed by the rules of law governing

the bond of an executor.

Section 3A of the Act provides that

the Act shall become effective July 1,

1979, except the provisions relating to

year's support which shall become

effective upon approval by the Governor,

April 18, 1979. Section 4 of the Act

provides that the entire Act shall

become effective upon approval by the

Governor, April 18, 1979.
