This represents one of the services which the Legislative Services Committee and the Office of Legislative Counsel perform for the legislative branch of government. Other services include bill drafting, research, statutory and code revision, rendering of opinions, counseling, legislative reference, interim committee statfing, and preparation of reports. The Office of Legislative Counsel drafted a total of 3,666 bills, resolutions, and amendments for the 1979 session. Of this number, 802 had been prepared by the convening date of the session, leaving a total of 2,864 which were drafted during the session. The other members of the committee and the Office of Legislative Counsel join me in the sincere hope that this booklet will be of benefit to those who use it. No resolutions, "population" Acts, or Acts with special application have been included. It would be impractical to minutely analyze each statute because to do so would defeat the main purpose which it is hoped this booklet accomplishes. It is intended that it be used as a convenient reference for persons desiring to know which laws were enacted or desiring to ascertain the main features of an Act without the necessity of reading it in its entirety. It should be pointed out that for specific, detailed information on any particular law, the Act itself should be examined. A notation of the effective date is listed after each Act. I would like to give special credit to Sewell Brumby, Assistant Legislative Counsel, for the preparation of this booklet. The many long hours involved in this project are evidence of his outstanding work and his meticulous attention to detail. This summary is not to be deemed in any manner as an opinion from the Office of Legislative Counsel, and the question of constitutionality has not been considered in any respect. B. 166; p. 756 Amends Code Section 109A-2-316, so as to provide that there shall be no implied warranty of freedom from disease with respect to the sale of cattle, hogs, and sheep by licensed auction companies or agents; exempts brucellosis reactor cattle detected at an official state laboratory within 30 days after sale. Effective April 12, 1979. Act 507; H. B. 60; p. 846 Prohibits the slaughter of horses except upon compliance with certain record-keeping requirements; provides for rule making and investigations by the Georgia Department of Agriculture; provides penalties. Effective April 13, 1979. Act 579; H.B. 349; p. 1032 The "Georgia Swine Mycobacteriosis Indemnification Act" authorizes the Commissioner of Agriculture to pay indemnities to owners of swine condemned by reason of infection with swine mycobacteriosis under certain conditions; authorizes the Commissioner of Agriculture to promulgate necessary rules and regulations. Effective April 16, 1979. Act 581; H.B. 351; p. 1037 Amends the "Georgia Meat Inspection Act" (Ga. Laws 1969, p. 1028), so as to provid~ for the imposition of administrative penalties by the Commissioner of Agriculture for violations. Effective April 16, 1979. Act 580; H. B. 350; p. 1035 Amends the 1953 Act relating to eradication and control of infectious diseases in livestock (Ga. Laws 1953, Jan.-Feb. Sess., p. 480), so as to provide for the imposition of administrative penalties by the Commissioner of Agriculture for violations. Effective April 16, 1979. ALCOHOLIC BEVERAGES Act 531; H. B. 161; p. 923 Amends the "Revenue Tax Act to Legalize and Control Alcoholic Beverages - 5- ALCOHOLIC BEVERAGES (continued) and Liquors" (Ga. Laws 1937-38, Ex. Sess., p. 103), so as to define the terms "broker" and "importer." Effective April 13, 1979. Act 530; H.B. 155; p. 922 Amends Code Chapter 58-8, known as the "Wine Tax Law," so as to redefine the terms "broker" and "importer." Effective April 13, 1979. AUTHORITIES Act 636; H.B. 582; p. 1266 Amends the "Georgia Residential Finance Authority Act" (Ga. Laws 1974, p. 975), so as to increase to $200 million the maximum amount of bonds and notes which the authority may have outstanding at any one time. Effective April 17, 1979. Act 597; H. B. 471; p. 1069 Amends the "Private Colleges and Universities Facilities Authority Act" (Ga. Laws 1978, p. 1765), so as to include within the definition of the word "project" certain medical and hospital facilities. Effective April 16, 1979. Act 564; H. B. 255; p. 1006 Amends Code Section 69-1507a, so as to prohibit resource recovery development authorities from bidding or paying compensation for solid wastes being privately processed or reused. Effective July 1, 1979. Act 62; H. B. 108; p. 413 Amends the "Development Authorities Law" (Ga. Laws 1969, p. 137), so as to include within the definition of the word "project" the acquisition, construction, leasing, or financing of certain office buildings; provides that property leased for the purposes of a project which is an office building shall not be exempt from ad valorem taxation. Effective March 15, 1979. Act 608; H. B. 544; p. 1091 Creates a new Code Section 95A-1244.l which authorizes state agencies and - 6- AUTHORITIES (continued) political subdivisions of the state to lease, lend, grant, or convey to the Georgia Tollway Authority real or personal property upon such terms as may be agreed upon without advertisement, court order, or other formality other than the regular execution of an appropriate instrument; amends Code Section 95A-1245 and creates a new Code Section 95A-1245.l, so as to authorize the Georgia Tollway Authority to acquire and operate tollway projects which were toll facilities at the time of acquisition or at some earlier time. Effective April 16, 1979. Act 623; H. B. 515; p. 4634 Amends "The Metropolitan Atlanta Rapid Transit Authority Act of 1965" (Ga. Laws 1965, p. 2243), so as to require that the charges for charter services rendered by the authority shall be no lower than the charges of motor common carriers and motor contract carriers in the metropolitan area; extends the 1 percent sales tax rate under the Act to June 30, 1997; limits the percentage of said sales tax which may be used to subsidize operating costs; provides use priorities for revenue raised by the authority. Effective July 1, 1979, except a provision as to use priorities which is effective April 1, 1982. BANKING AND FINANCE Act 36; S. B. 133; p. 355 Amends Code Section 57-101, so as to change the maximum legal rate of interest to 10 1/2 percent per annum; amends Code Section 57-118, so as to provide that any corporation or person may agree to pay any rate of interest upon any loan for nonconsumer purposes where the principal balance exceeds the sum of $3,000.00 and prohibits any claim or defense of usury as to such transactions. Effective March 9, 1979. Act 37; S. B. 134; p. 357 Amends Code Section 57-101.1, so as to establish a flexible maximum rate of interest for real estate loans; bases this rate on the return of United States government bond yields; provides for computation of said rate by the commissioner of banking and finance. - 7- BANKING AND FINANCE (continued) Effective March 9, 1979, and applicable to real estate loans made on or after April 1, 1979. Act 25; S. B. l; p. 345 Prohibits certain practices in connection with real estate transactions; prohibits acceleration of indebtedness secured by real estate on account of the sale or transfer of the real estate to be used as a residence; allows lenders to raise the interest rate upon transfer of property by up to 1 percent per annum if the original borrower is relieved of liability; regulates the amount of loan transfer fees charged by lenders; requires approval or disapproval of loan assumptions by lenders within 45 days and prohibits disapproval for any reason other than the credit worthiness of the person seeking to assume the indebtedness; provides certain exemptions. Effective March 1, 1979. Act 642; H. B. 673; p. 1281 Amends the 1966 Act regulating charges and interest on loans secured by secondary security deeds on residential property (Ga. Laws 1966, p. 574), so as to provide that the legal rate of interest shall be at the same rate as and computed in accordance with the provisions of Code Section 57-116; changes the amount of permissible finance charges on loans up to $1,500.00 from $150.00 to $50.00. Effective July 1, 1979. Act 588; H. B. 385; p. 1051 Amends Code Section 20-1204, so as to provide that acceptance by a creditor of a check, draft, or money order marked "payment in full" or with equivalent language in an amount less than the total indebtedness shall not constitute an accord and satisfaction unless there is a bona fide dispute as to the amount due or there is an independent agreement that such payment shall satisfy the debt. Effective July 1, 1979. Act 64; H. B. 414; p. 417 Amends Code Section 41A-3101 and creates Code Section 41A-3121, so as to provide that the Department of Banking and Finance may authorize credit unions which have total assets in excess of $1 million to offer third party payment - 8- BANKING AND FINANCE (continued) services; provides for standards and regulation of credit unions which offer third party payment services. Effective July 1, 1979. Act 545; H.B. 203; p. 951 creates a new Code Section 41A-411 which designates the Department of Banking and Finance as the appropriate agency to receive and investigate certain complaints regarding interest and usury violations; provides that the Department of Banking and Finance in consultation with the Department of Law may render advisory opinions; provides that good faith reliance upon such opinions shall constitute prima facie evidence of good faith. Effective April 13, 1979. Act 546; H. B. 204; p. 953 Amends Code Section 41A-1309(b)(3), so as to exclude obligations representing the sale of federal or correspondent funds to another financial institution from computation of the loan limitation as to the stock or capital securities of any corporation. Effective April 13, 1979. Act 544; H.B. 202; p. 950 Creates a new Code Section 41A-318, which provides that rules and regulations issued by any state or federal official or agency, which rules or regulations are intended to apply to any financial or other institution under the jurisdiction of the commissioner of banking and finance, shall become effective as to such institution only upon written approval by the commissioner. Effective July 1, 1979. Act 57; H. B. 106; p. 399 Amends Code Section 100-108, so as to provide that debt obligations issued by certain federal agencies shall be accepted as collateral to secure state funds in state depositories; amends Code Section 100-117, so as to provide for the nature and type of investments allowed to be made by the director, Fiscal Division, Department of Administrative Services, and to provide that interest earned on the investment of motor fuel tax revenues shall be defined as motor fuel tax revenues - 9- BANKING AND FINANCE (cdntinued) and appropriated in conformity with Article III, section X, Paragraph VII, subsection (b) of the Constitution. Effective March 13, 1979. Act 652; H.B. 783; p. 1296 Amends the "Georgia Securities Act of 1973 11 (Ga. Laws 1973, p. 1202), so as to provide for measuring the value of securities by reference to book value under certain circumstances in connection with registration of securities by notification; provides for continuing the registration of predecessor dealers for their successors under certain circumstances; creates certain additional exemptions to provisions of the Act; makes other technical changes relating to securities regulation. Effective April 17, 1979. CIVIL PROCEDURE Act 438; S. B. 59; p. 619 Amends the 1965 Act comprehensively revising appellate and other posttrial procedures (Ga. Laws 1965, p. 18), so as to require appeal by petition in cases of divorce, alimony, child custody, contempt arising from alimony or child custody judgments, superior court decisions reviewing administrative agencies' decisions, and superior court decisions reviewing lower courts' decisions; exempts decisions of the Public Service Commission and probate courts and cases involving ad valorem taxes and condemnations; prescribes procedure for filing and contents of petitions for appeal in such cases; provides for orders by the Supreme Court or the Court of Appeals granting or denying such petitions and procedure thereafter; exempts procedure in certain habeas corpus cases provided for by Code Section 50-127(11). Effective July 1, 1979, and applicable to orders and judgments rendered after that date. Act 583; H. B. 368; p. 1041 Amends the "Georgia Civil Practice Act" (Ga. Laws 1966, p. 609), so as to require notice to all parties of record of discovery against persons, firms, or corporations who are not parties. Effective April 16, 1979. - 10 - COUNTIES Act 503; H.B. 43; p. 831 Authorizes counties which provide dumpsters to designate all or any of such dumpsters as suitable for household garbage only; makes it unlawful to dump nonhousehold garbage into any dumpster which is so marked; makes it unlawful to set fire to, scatter the contents of, or otherwise vandalize any county-provided dumpster. Effective July 1, 1979. Act 665; S. B. 63; p. 1400 Creates a new Code Chapter 24-27A providing for the Office of the Receiver of Child Support; provides that such office may be, but is not required to be, created by the governing authority or authorities within each county or within all the counties of a judicial circuit; provides for the duties of said office to collect, account for, and pay over child support and to take action in cases of nonpayment. Effective July 1, 1979. Act 40; H.B. 185; p. 367 "The Georgia Indigent Defense Act" creates the Georgia Indigent Defense Council and an optional system of state-funded local indigent defense programs; provides for adoption of guidelines by the Supreme Court upon recommendation by the council; provides that each county or all the counties within a judicial circuit may establish a local program to be governed by a local tripartite committee representing the county governing authority or authorities, the local bar association or associations, and the superior court judge or judges; provides for recovery of costs from ineligible defendants; provides that existing or future local programs which do not receive state funds need not be affected. Effective July 1, 1979, for a period of four years. Act 111; S. B. 178; p. 504 The "Capital Felony Expense Act" provides for state reimbursement to counties for extraordinary expenses incurred above a certain percentage of county revenue as a result of the trial of capital felony cases; provides for administration and adoption of rules and regulations at a state level by the commissioner of the Department of Community Affairs; provides that the clerks of the superior courts shall be local administrators. - 11 - COUNTIES (continued) Effective for administrative purposes April 11, 1979, and for all other purposes July 1, 1979. Act 559; a. B. 244; p. 988 Amends Code Section 24-2823, so as to change the amount of sheriffs' fees in both civil and criminal cases. Effective July 1, 1979. COURTS Act 610; H.B. 560; p. 1107 Creates a new Code Section 24-3804 which provides that the Supreme Court may hear oral argument in places other than the seat of government. Effective April 16, 1979. Act 514; H. B. 81; p. 875 Repeals Code Section 24-1803 which required posting of a $1,000.00 bond by probate court clerks. Effective July 1, 1979. Act 430; S. B. 22; p. 601 Amends Code Section 59-120, so as to change the amount of compensation of superior and state court bailiffs from $5.00 - $30.00 to $5.00 $35.00 per diem. Effective April 12, 1979. Act 201; H. B. 462; p. 518 Fixes the terms of court for the Tallapoosa Judicial circuit in Douglas, Polk, Haralson, and Paulding counties. Effective July 1, 1979. Act 515; H.B. 100; p. 876 Provides for an additional judge of the Eastern Judicial Circuit; provides for adoption of local rules by the judges of said circuit; provides for a presiding judge of said circuit; directs Chatham County to furnish certain office space and clerical help to said judicial circuit. Effective April 13, 1979. Act 419; H.B. 1013; p. 578 Amends the 1949 Act creating the Mountain Judicial Circuit (Ga. Laws - 12 - COURTS (continued) 1949, p. 266), so as to change the terms of court and times for convening grand juries for Habersham, Rabun, Stephens, Towns, and Union counties. Effective April 11, 1979. Act 479; S. B. 204; p. 769 Provides for an additional judge of the Ocmulgee Judicial Circuit; provides for adoption of local rules by the judges of said circuit; provides for a chief judge of said circuit; authorizes an additional court reporter for such circuit. Effective April 12, 1979. Act 95; H. B. 729; p. 503 Fixes an additional term of court for the Ocmulgee Judicial Circuit in Jasper County. Effective April 5, 1979. CRIMINAL LAW Act 8; H. B. 481; p. 131 Creates a new Code Section 26-2023 which provides that nothing contained in Code Chapter 26-20 shall prevent any county or municipality from adopting ordinances which proscribe loitering, or related activities, in public for the purpose of procuring others to engage in sexual acts for hire. Effective February 19, 1979. Act 596; H.B. 460; p. 1068 Amends Code Section 26-2408, so as to make knowing and willful false statements and fraud of any matter within the jurisdiction of the government of any political subdivision of the state a felony. Effective July 1, 1979. Act 538; H. B. 190; p. 935 Amends Code Sections 26-1401, 1402, and 1403, so as to change the definition of and penalties for arson in the first, second, and third degree. Effective April 13, 1979. Act 437; S. B. 45; p. 618 Creates a new Code Section 26-1508 defining the misdemeanor of injuring, tearing down, or destruction of mail - 13 - CRIMINAL LAW (continued) boxes or injuring, defacing, or destruction of mail therein. Effective July 1, 1979. Act 478; S. B. 197; p. 768 Creates a new Code Section 68A-903.l which provides that whoever, without malice, by reason of violation of Code Section 68A-902, relating to drivers with ability impaired by alcohol or drugs, causes bodily harm to another by depriving him of an arm, leg, or eye shall be guilty of the felony of serious injury by vehicle. Effective July 1, 1979. Act 475; S. B. 176; p. 764 Amends code Section 26-1503, so as to provide that the notice to a trespasser which is an element of criminal trespass may be given, upon proper identification, by an authorized representative of the owner or rightful occupant of the premises. Effective July 1, 1979. Act 516; H.B. 101; p. 879 Amends Code Section 79A-828, so as to provide for forfeiture under the "Georgia Controlled Substances Act" of money seized in connection with controlled substance violations; provides for payment of such money into the county treasury as county funds; provides that the superior court upon application of the district attorney or sheriff may pay to informers up to one-fourth of the proceeds of the sale of forfeited property. Effective July 1, 1979. Act 631; H. B. 187; p. 1258 Amends Code Section 79A-811, so as to change penalties for crimes involving 100 pounds or more of marijuana. Effective April 17, 1979. Act 572; H.B. 295; p. 1019 Amends Code Section 26-2907, so as to add authorized employees under the State Board of Pardons and Paroles and the Attorney General to the list of officers exempted in the performance of their duties from Code Sections 26-2901, relating to concealed weapons; 26-2902, relating to deadly weapons at public gatherings; 26-2903, relating to pistol - 14 - CRIMINAL LAW (continued) licenses; and 26-2906, relating to machine guns. Effective April 16, 1979. CRIMINAL PROCEDURE Act 61; H. B. 107; p. 412 Amends the "Uniform Criminal Extradition Act" (Ga. Laws 1951, p. 726), so as to provide that habeas corpus actions brought under said Act shall be defended by district attorneys unless the Governor shall direct the Attorney General to defend. Effective March 15, 1979. Act 615; S. B. 195; p. 1173 Amends Code Sections 27-101 et seq., so as to change the amount of the reward which the Governor may offer to an amount "not to exceed the sum of $1,000.00 in felonies not capital, including arson, and not to exceed the sum of $10,000.00 in capital felonies and arson"; deletes the provisions for a specific reward for the burning of gin houses; makes specific provision for rewards for theft of horses and swine; changes the definition of "conviction" for purposes of determination of when the Governor is authorized to pay over rewards. Effective April 16, 1979. Act 472; S. B. 174; p. 759 Amends the 1973 Act permitting drivers' licenses to be deposited as bail for traffic offenses (Ga. Laws 1973, p. 435), so as to provide for use of drivers' licenses as bail to be deposited with the judicial officer or other officer authorized to accept cash bonds where the arresting officer has not accepted the driver's license as bail. Effective April 12, 1979. Act 499; H.B. 15; p. 824 Amends Code Section 26-3004, so as to include arson within the class of crimes for which superior courts may issue investigatio,, warrants permitting the use of electronic surveillance devices. Effective April 13, 1979. - 15 - CRIMINAL PROCEDURE (continued) Act 508; H.B. 65; p. 848 Creates a new Code Section 27-2529 which authorizes imposition of a fine not to exceed $10,000.00 or the amount of the maximum fine for an offense, whichever is greater, as a condition precedent to probation in felony cases; repeals the 1957 Act relating to fines in certain felony cases (Ga. Laws 1957, p. 477). Effective July 1, 1979. Act 660; H.B. 173; p. 1321 Amends the "Georgia Post Mortem Examination Act" (Ga. Laws 1953, Jan.-Feb. Sess., p. 602), so as to change the fees to be paid to medical examiners to $50.00 where dissection is not required, to $175.00 for cases where a partial post mortem examination and autopsy are required, and to $250.00 for a complete post mortem examination and autopsy. Effective July 1, 1979. EDUCATION Act 562; H.B. 95; p. 1001 Provides for grants of state funds to local school systems based on average daily attendance; requires school tax bills to reflect the effect of such grants on the tax mill rate. Effective April 16, 1979. Act 458; S. Laws 1974, p. 1045), so as to change the effective date of certain provisions relating to the allotment of funds for capital facilities. Effective July 1, 1979. Act 460; S. B. 141; p. 663 The "Public School Disciplinary Tribunal Act" provides that local boards of education may establish disciplinary hearing officers, panels, or tribunals - 16 - EDUCATION (continued) to deal with suspension or expulsion of students. Effective July 1, 1979. Act 661; H.B. 183; p. 1323 Amends the 1977 Act granting certain law enforcement powers to campus policemen (Ga. Laws 1977, p. 1160), so as to provide that said Act shall apply to campus policemen employed by a school or training facility operated by or pursuant to the authority of the State Board of Education. Effective July 1, 1979. Act 595; H. B. 450; p. 1065 Amends the "Georgia Professional Standards Act" (Ga. Laws 1976, p. 966), so as to change the term of office of the members of the Professional Standards Commission; changes the provisions for appointment by the Governor of members; changes the limit on actual and necessary expenses of the members to $44.00 per day; changes the provisions for compensation of the commission's administrative assistant; provides for membership of commission employees in the Employees' Retirement system of Georgia; changes the termination or sunset date of the 1976 Act to June 30, 1982. Effective April 16, 1979. Act 447; S. B. 82; p. 636 Amends the 1935 Act providing for the establishment and maintenance of public libraries (Ga. Laws 1935, p. 409), so as to provide that members of regional and county library boards may be entitled to receive reimbursement from local funds for actual travel expenses incurred in the course of their duties. Effective April 12, 1979. Act 590; H.B. 412; p. 1055 Amends the "Adequate Program for Education in Georgia Act" (Ga: Laws 1974, p. 1045), so as to raise the minimum monthly salary of school bus drivers to $250.00 per month. Effective July 1, 1979. Act 641; H.B. 671; p. 1279 Amends the "Adequate Program for Education in Georgia Act" (Ga. Laws 1974, p. 1045), so as to change certain provisions relating to allocation of funds for instructional units, - 17 - EDUCATION (continued) instructional media, and sick and personal leave expenses. Effective July 1, 1979. Act 602; H.B. 509; p. 1077 Amends the "Adequate Program for Education in Georgia Act" (Ga. Laws 1974, p. 1045), so as to direct the State Board of Education to establish policies, procedures, and regulations to provide for partial allocation to local units of school psychologists and school psychometrists. Effective July 1, 1979. Act 461; S. B. 143; p. 665 Amends the "Adequate Program for Education in Georgia Act" (Ga. Laws 1974, p. 1045), so as to provide that the State Board of Education shall allot special education instructional units to local units of administration; provides criteria and procedures for such allotment. Effective April 12, 1979. Act 453; S. B. 128; p. 649 Amends the "Adequate Program for Education in Georgia Act" (Ga. Laws 1974, p. 1045), so as to change certain provisions relating to the midterm adjustment of allotments of personnel and state funds to local units based on changes in average daily attendance. Effective July 1, 1979. ELECTIONS Act 670; H. B. 239; p. 1612 The "Public Officers Recall Act" establishes uniform and exclusive procedures for the recall of persons holding elective state or local offices; provides for application of the "Campaign Financing Disclosure Act" (Ga. Laws 1974, p. 155). Effective April 25, 1979. Act 431; S. B. 24; p. 602 Amends the "Campaign Financing Disclosure Act" (Ga. Laws 1974, p. 155), so as to provide for applicability of the Act to persons seeking the recall of public officers holding elective offices or seeking to influence voter approval - 18 - ELECTIONS (continued) or rejection of proposed constitutional amendments or statewide referenda. Effective July 1, 1979. Act 550; H.B. 214; p. 962 Amends Code Sections 34-631 and 34-1316, so as to provide that any elector who moves to a new residence in the same election district and fails to notify the board of registrars of such move 30 days prior to an election or primary shall vote in the election district of his former residence; directs the election superintendent to make change of address forms available at each polling place; provides for revision of electors' lists. Effective July 1, 1979. Act 445; S. B. 77; p. 633 Amends Code Section 34-1402, so as to provide that certain persons related to an absentee elector may apply for an absentee ballot on behalf of such absentee elector when such elector is residing temporarily (whether within or without the state) out of the county in which he permanently resides. Effective July 1, 1979. Act 548; H.B. 212; p. 955 Amends Code sections 34-301 and 34-605, so as to provide that the Secretary of State shall in each even-numbered year conduct training sessions for the board of registrars and the superintendent of elections in each county or their designated representatives; amends Code Section 34-807, so as to change the conditions under which a special primary or election may be held at the time of or on the same ballot as a general primary or election; amends Code Section 34-1002, so as to require filing of notice of candidacy at least 25 days prior to the date of a special election; amends Code Section 34-1223, so as to require that ballot cards for vote recorders be printed in black ink on clear white or colored material; amends Code Section 34-1310, so as to provide for submission of poll watchers by candidates and designation of poll watchers by parties in run-off primaries and elections; amends Code Section 34-1401, so as to provide that a person who will be unable to be present at the polls because an election date falls upon a religious holiday observed by such person shall be entitled to vote as an absentee elector; amends Code Section 34-1705, so as to require that the State - 19 - ELECTIONS (continued) Election Board be served with a copy of petitions for election contests. Effective July 1, 1979. Act 604; H.B. 516; p. 1080 Amends Code Section 34-623, so as to require registrars to certify the number of electors by race in each election district in their county. Effective July 1, 1979. Act 551; H.B. 215; p. 963 Amends Code Section 34-1017, so as to require notice of intent of write-in candidacy in special elections and delete a reference to municipal elections. Effective July 1, 1979. Act 526; H.B. 138; p. 904 Amends Code Section 34-1513, so as to change the time at which a runoff shall be held in the case of a special primary or special election to a date no sooner than the fourteenth day and no later than the twenty-first day after the holding of such special primary or special election; provides for determination of said date by the Secretary of State for federal and state offices, and by the superintendent for county offices. Effective April 13, 1979. Act 443; S. B. 75; p. 629 Amends Code Sections 34-1407 and 34-1507, so as to provide that absentee ballots shall be counted and returned on a countywide basis rather than on an election district basis except at elections in which any question affecting a political subdivision of less than the entire county will be voted on. Effective July 1, 1979. Act 440; S. B. 65; p. 624 Amends code Sections 34-1102 and 34-1208, so as to delete the provision that the names of unopposed candidates for party nomination should be placed on the ballot or ballot labels so as to follow the names of all other candidates who have opposition. B. 41; p. 617 Amends Code Section 34-1010, so as to change the requirements for nomination petitions relating to the required number of signatures and method of computing that number. Effective July 1, 1979. Act 656; H.B. 821; p. 1316 Repeals Code Section 34-l0l0A and amends Code Section 34-1005A, so as to provide for establishment by political parties of procedures for selection of delegates to presidential nominating conventions. Effective April 17, 1979. Act 549; H.B. 213; p. 960 Amends Code Sections 34A-522 and 34A-1214, so as to provide that any municipal elector who moves to a different address within the municipality but fails to notify the board of registrars of such fact prior to the election or primary shall vote in the district of his former residence; requires the election superintendent to make change of address forms available to such persons at each polling place; provides for revision of electors' lists. Act 552; H.B. 217; p. 964 Amends Code Section 34A-103, so as to define the term "call"; amends Code Section 34A-506, so as to require advertisement of additional municipal voting registration places and to require that all municipal voting registration places be open to and frequented by the general public; amends Code Section 34A-1209, so as to provide that no candidate shall be eligible to serve as a municipal poll watcher; amends Code Section 34A-1225, so as to provide that municipal voting machines which become inoperative must be locked - 21 - ELECTIONS (continued) and sealed immediately only if they cannot be readily repaired without exposing the count on the candidates' counters; amends Code Section 34A-1307, so as to provide that if the absentee ballots have been printed at the time a municipal elector applies for an absentee ballot, then such elector shall then and there vote the absentee ballot. Effective July 1, 1979. Act 553; H.B. 218; p. 967 Creates a new Code Section 34A-915 which requires notice of intent of write-in candidates 20 or more days prior to municipal elections. B. 221; p. 970 Amends Code Section 34A-1004, so as to provide that, when a municipal election is not held because there are no opposed candidates, each elector eligible to have voted in such election if held shall be deemed to have voted for the purposes of determining when electors shall be purged from the voters' list. Effective July 1, 1979. EVIDENCE Act 633; H. B. 367; p. 1261 Amends Code Section 38-1603, so as to delete the eight exceptions to the competency of witnesses relating to transactions of deceased or insane parties; provides that no person offered as a witness shall be excluded by reason of incapacity, for crime or interest, or from being a party, from giving - 22 - EVIDENCE (continued) evidence. Effective July 1, 1979, and applicable to transactions or occurrences which take place on or after said date. Act 569; H.B. 288; p. 1014 Amends the "Georgia Administrative Procedure Act" (Ga. Laws 1964, p. 338), so as to provide for admissibility into evidence of medical reports or psychiatric or psychological evaluations of a type routinely relied upon by an agency in the normal course of its business; requires filing of emergency rules with the office of Secretary of State within four workdays after adoption. Effective April 13, 1979. Act 473; S. B. 175; p. 761 Amends the 1966 Act providing search and seizure procedure (Ga. Laws 1966, p. 567), so as to provide for admissibility into evidence of video tapes of articles not constituting contraband which have been returned to the rightful owners. Effective July 1, 1979. HEALTH Act 612; S. B. 40; p. 1109 Amends Code Chapter 88-33, so as to require issuance by the State Health Planning and Development Agency of a "certificate of need" before new institutional health services or facilities are developed; defines terms; provides for administration, rules, and review of said state agency; provides sanctions and penalties; provides exemptions; repeals the "Long-Term Health Care Facility Act" (Ga. Laws 1974, p. 621). Effective July 1, 1979. Act 505; H. B. 55; p. 834 "The Patient Cost of Care Act" provides for the payment of the cost of care of patients receiving services from state hospitals under the control of the Division of Mental Health and Mental Retardation of the Department of Human Resources; provides for assessment by the department of all or a part of the cost of care against the patient, the patient's estate, the patient's spouse, the parent or parents of a minor patient, or any person holding assets for the patient; provides that - 23 - HEALTH (continued) assessment shall be based on the cost of care and available assets and income; provides for administrative procedure and actions at law or equity; provides for rules and regulations; repeals the 1960 Act relating to payment of the cost of care of persons in state institutions (Ga. Laws 1960, p. 1138). Effective for administrative purposes April 13, 1979, and for all other purposes on July l, 1979. Act 626; H.B. 753; p. 1240 Creates a new Code Chapter 88-19A, so as to provide an ombudsman program for long-term health care facilities pursuant to the federal Older Americans Act of 1965; provides for statewide administration by the State Office of Aging of the Department of Human Resources; provides for a state ombudsman and for community ombudsmen; provides for investigative authority and procedures. Effective April 16, 1979. Act 625; H.B. 691; p. 1234 Creates a new Code Chapter 88-23A providing for a nonresident indigent health care fund; states legislative intent to equalize the burden of the cost of noncounty resident indigent health care; provides for statewide administration by the Department of Human Resources; requires each county to designate a health care advisory officer for the county who shall determine indigency for the residents of the county and perform other duties; creates a nonresident indigent health care fund and provides procedures for payment to hospitals from such fund. Effective April 16, 1979. Act 650; H.B. 774; p. 1293 Amends the "Georgia Medical Assistance Act of 1977" (Ga. Laws 1977, p. 384), so as to provide that recipients of medical assistance shall be deemed under certain circumstances to have made an assignment to the Department of Human Resources of any rights which such persons may have to receive payments for such medical care from third parties. Effective April 17, 1979. Act 638; H.B. 626; p. 1272 Creates a new Code Section 88-1004.1 which requires food service establishments to post notices supplied by the Department of Human Resources - 24 - HEALTH {continued) explaining procedures to aid persons who are . choking; provides immunity from civil liability for owners, employees, or guests who render aid to persons who are choking. Effective July 1, 1979. Act 568; H.B. 287; p. 1012 Amends Code Section 49-604, so as to provide that the director of the Department of Family and Children Services of the county of residence of a mentally ill, mentally retarded, or mentally incompetent person may be appointed as guardian of the person of such person; deletes the former provision for appointment of the commissioner of human resources as such guardian of the person; provides that the director of the county department of family and children services may delegate his duties as guardian to responsible employees of the department; provides that, where it would not be appropriate for the director of the county department of family and children services to serve, a guardian may be appointed under Code Section 49-109. Effective April 13, 1979. Act 644; H.B. 705; p. 1284 Amends Code Section 32-911, so as to provide that a county school superintendent or school principal may issue to the parent or guardian of any child a provisional certificate of immunization from contagious diseases; provides that provisional certificates shall be issued for justifiable reasons and shall be valid for 30 days. Effective July 1, 1979. Act 571; H. B. 292; p. 1017 Creates a new Code Section 88-3112.11 which authorizes the rendering of certain services by cardiac technicians and advanced emergency medical technicians in hospitals under the direction of a physician or nurse under certain conditions. Effective April 16, 1979. Act 537; H. B. 188; p. 933 Amends the 1974 Act providing for the comprehensive treatment of alcoholism and intoxication (Ga. B. 196; p. 766 Amends the 1972 Act creating the Council on Maternal and Infant Health (Ga. Laws 1972, p. 635), so as to change the membership of the council. Effective July 1, 1979. Act 468; S. B. 163; p. 723 Extensively revises Code Chapter 88-5, relating to hospitalization and treatment of the mentally ill; redefines the term "facility"; changes provisions relating to appointment of a replacement for the probate judge; changes provisions for appointment of counsel for indigents; changes provisions relating to confidentiality of records; changes provisions relating to transfer from involuntary to voluntary status of patients; changes procedures for orders for continued hospitalization; provides for apprehension of escaped involuntary patients. B. 375; p. 1042 Amends Code Sections 88-407.2, 88-507.2, and 88-2509.2, so as to clarify provisions relating to court costs, attorneys' fees, and hearing officer expenses in hospitalization and habilitation proceedings for alcohol or drug dependent, mentally ill, and mentally retarded persons; provides that hearing expenses shall be paid by the county only if the hearing officer makes a written finding that the assets of the patient, his estate, or persons legally obligated to support him are insufficient to defray such expenses; further defines costs, the amount thereof, and assessments therefor. Effective April 16, 1979. HUMAN RELATIONS Act 86; S. B. 18; p. 466 Extensively revises sexually biased laws relating to intrafamilial duties and rights, including Title 30, relating to divorce, alimony, and support of minors; Title 53, relating to husband and wife; Title 74, relating to parent and child; "Uniform Reciprocal Enforcement of Support Act; and related matters, so as to comply with the United States Supreme Court decision in Orr v. Orr; repeals tort actions for adultery, alienation of affections, and criminal conversation; changes provisions for rights of action for wrongful death of children. Effective April 4, 1979. Act 513; H. B. 80; p. 872 Amends Code Sections 53-102 and 53-206, so as to change provisions relating to proof of age of applicants for marriage licenses and proof of pregnancy of or parentage by underage applicants. Effective July l, 1979. Act 540; H. B. 193; p. 941 Amends the "Uniform Reciprocal Enforcement of Support Act" (Ga. Laws 1958, p. 34), so as to provide for the applicability of said Act to arrearages due under any existing court order or - 27 - HUMAN RELATIONS (continued) reimbursement for reasonable expenses actually incurred in the absence of a court order. Effective April 13, 1979. Act 539; H.B. 192; p. 938 Amends the "Uniform Reciprocal Enforcement of Support Act" (Ga. Laws 1958, p. 34), so as to provide a procedure whereby foreign support orders may be registered in the superior courts of this state; directs the clerk of superior court to maintain a registry of foreign support orders; provides for practice, procedure, and hearings whereby a foreign support order may through registration acquire the effect of an order of a court of this state. Effective April 13, 1979. Act 619; H. B. 208; p. 1182 Extensively revises provisions of Code Chapter 74-4, including the following: Code section 74-402, relating to who may adopt; Code Section 74-404, relating to surrender of parental rights; Code Section 74-405, relating to when surrender or termination of parental rights is not required; Code Section 74-406, relating to notice to putative fathers; Code Section 74-407, relating to the adoption petition and its contents; Code Section 74-412, relating to the hearing and decree of adoption; Code Section 74-417, relating to keeping and examination of records; and creates a new Code Section 74-419, relating to the effect of prior written consent to adopt. B. 200; p. 948 Repeals the following: Code Chapter 53-3, relating to registration as to race; Code Section 53-106, relating to miscegenation; Code Section 53-212, relating to colored marriages; Code Sections 53-9902 through 9908, providing penalties; Code Section 79-103, relating to defining persons of color. Effective July 1, 1979. INSURANCE Act 428; S. B. 5; p. 594 Amends the "Georgia Motor Vehicle Accident Reparations Act" (Ga. Laws 1974, p. 113), so as to provide for certain correlation of benefits between - 28 - INSURANCE (continued) said Act and workers' compensation laws; provides that, where benefits under both laws have been provided at the expense of one employer, the aggregate medical expense and lost income benefits allowable shall be limited. Effective April 12, 1979. Act 647; H.B. 746; p. 1289 Creates a new Code Section 56-2444 which provides that group disability income policies which integrate benefits may not reduce benefits due to certain changes in the level of social security benefits. Effective July l, 1979, and applicable to all group disability income policies delivered or issued for delivery after said date. Act 493; S. B. 276; p. 804 Amends Code Section 56-405, so as to redefine the term "property insurance" to include certain motor vehicle service agreements or extended warranty agreements and certain residential real estate warranties. Effective July l, 1979. Act 601; H. B. 508; p. 1076 Amends the "Insurance Premium Finance Company Act" (Ga. Laws 1969, p. 561), so as to increase the maximum service charge permitted to be charged by a premium finance company to $9.50 per $100.00 per annum. Effective April 16, 1979. Act 510; H. B. 70; p. 850 Amends Code Sections 56-1303 and 56-1312, so as to gradually exempt annuity considerations from the tax imposed on gross direct premiums received by insurance companies. Effective January l, 1980, and applicable to tax years beginning on or after January l, 1980. Act 486; S. B. 233; p. 786 Amends Code Title 56, so as to require filing and public disclosure of records by any person designated by a local government to assist in the collection of tax on the transacting of insurance; provides that certain life insurance certificates, policies, contracts, and annuity plans shall be returnable - 29 - INSURANCE (continued) by the purchaser within ten days after receipt; requires notice of said right of return. Effective July 1, 1979. Act 517; H.B. 102; p. 882 Amends Code Sections 56-808a and 56-816b, so as to provide for the licensing of nonresident insurance counselors. Effective July l, 1979. Act 614; S. B. 162; p. 1148 Creates a new Code Chapter 56-36 which provides a comprehensive system for the licensing, regulation, and control of health maintenance organizations which arrange for and provide prepaid health care services. Effective January 1, 1980. Act 667; H. B. 790; p. 1407 Amends Code Section 56-912, known as the "Standard Valuation Law," so as to change procedures for computing minimum reserves for life insurance and annuity contracts and so as to increase the permissible age setback for females; amends Code Section 56-2504, so as to change provisions relating to nonforfeiture provisions and computation of premiums; creates a new Code Section 56-2602A to be known as the "Standard Nonforfeiture Law for Individual Deferred Annuities." Effective July 1, 1979. Act 462; S. B. 146; p. 667 Amends the 1961 Act relating to state employees' health insurance (Ga. Laws 1961, p. 147), so as to redefine the term "employee"; provides that claims must be filed within two years and that benefit checks shall be valid for only six months; increases the maximum amount of employer contributions; provides that employees may waive health insurance coverage. Effective April 12, 1979. Act 463; S. B. 147; p. 672 Amends the 1975 Act providing a health insurance plan for public school teachers (Ga. Laws 1975, p. 37), so as to provide that claims must be filed within two years and that benefit checks shall be valid for only six months; increases the maximum amount of the contribution by the State Department of - 30 - INSURANCE (continued) Education; increases the maximum assessment for the local employer's share of the contribution; provides that public school teachers may waive health insurance coverage. Effective April 12, 1979. Act 648; H. B. 751; p. 1290 Amends the 1975 Act relating to health insurance for public school teachers (Ga. Laws 1975, p. 37), so as to provide that the terms "public school teacher," "teacher," and "employee" shall include certain retired teachers; provides for insurance coverage to certain surviving spouses of teachers and to teachers with 20 or more years of creditable service who are not presently eligible to receive retirement benefits. Effective July 1, 1979. Act 464; S. B. 148; p. 674 Amends the 1977 Act relating to the provision of liability insurance for state officers and employees (Ga. Laws 1977, p. 1051), so as to include employees and officials of county departments of health and county departments of family and children services and board members of said departments as state employees for purposes of the Act. Effective April 12, 1979. JURIES Act l; H. B. l; p. 3 Amends Code Section 59-106, so as to eliminate the requirement that the jury list contain at least 50 percent of the intelligent and upright citizens from the voters' list. Effective January 23, 1979. Act 586; H. B. 379; p. 1048 Creates a new Code Section 59-704.1 which requires the trial judge to administer to each jury panel prior to commencing voir dire the following oath: "You shall give true answers to all questions as may be asked by the court or its authority, including all questions asked by the parties or their attorneys, concerning your qualifications as jurors in the case of (herein state the case). So help you God." Effective July 1, 1979. - 31 - JURIES (continued) Act 585; H.B. 378; p. 1047 Amends Code Section 59-806, so as to change the form of the first question on voir dire in felony trials to the following: "Have you, for any reason, formed and expressed any opinion in regard to the guilt or innocence of the accused?" Effective April 16, 1979. Act 465; S. B. 149; p. 676 Amends Code Section 59-202, so as to provide that the foreman or clerk of a grand jury may be requested to appear before and report to the immediately succeeding grand jury; provides for compensation for such appearances. Effective July 1, 1979. JUVENILES Act 666; S. B. 83; p. 1404 Amends Code Section 24A-30l(a), so as to change provisions relating to exclusive jurisdiction of the juvenile court; provides for continuing exclusive jurisdiction of the juvenile court for the sole purpose of completing and enforcing supervision of a probation begun prior to the seventeenth birthday of an individual who has subsequently reached 17 years of age. Effective July 1, 1979. Act 618; H.B. 207; p. 1179 Amends Code Section 24A-301, so as to provide that the superior court and the juvenile court shall have concurrent jurisdiction over a petition for termination of parental rights of the putative father in cases where the rights of the parent(s) or guardian(s) of the child have been surrendered or terminated pursuant to the provisions of Code Section 74-403(a)(l). B. 212; p. 774 Amends Code Section 24A-1403, so as to provide for detention of children who are alleged to be unruly and who come within the purview of the "Interstate Compact on Juveniles" (Ga. B. 126; p. 645 Amends the 1962 Act granting certain basic powers to municipalities (Ga. Laws 1962, p. 140) and the "Municipal Home Rule Act of 1965" (Ga. Laws 1965, p. 298), so as to change provisions relating to members of municipal governing authorities increasing their own compensation; defines terms. Effective April 12, 1979. NATURAL RESOURCES Act 659; H. B. 165; p. 1320 Amends Code Section 45-302, so as to provide that any person not a resident of Georgia who owns at least 50 acres of land in Georgia and the immediate family of such person may hunt on that land without purchasing a hunting license if the landowner has filed with the Department of Natural Resources an affidavit on a form provided by the department. Effective July 1, 1979. Act 578; H.B. 343; p. 1028 Amends Code Section 91-ll0a, so as to authorize the State Properties Commission to grant and convey leases authorizing the dredging of state-owned waterways and the retention of products of such dredging. B. 376; p. 1636 The "Shore Assistance Act of 1979" states legislative findings; defines terms; requires permits for any engineering activity, structure, or land alteration which alters the natural topography or vegetation of certain shore areas; provides for administration by the Department of Natural Resources or any local unit of government which the board has certified as a permit-issuing authority; provides for rules, regulations, administrative and judicial review, and enforcement. Effective April 25, 1979. Act 592; H. Laws 1978, p. 245), so as to redefine the term "approved program"; provides for implementation of the provisions of the federal "Coastal Zone Management Act of 1972"; authorizes the Coastal Management Board to enter into agreements with other agencies and local governments to carry out the approved program; provides a termination or sunset date of July 1, 1984. Effective April 17, 1979. - 36 - NATURAL RESOURCES (continued) Act 561; H.B. 249; p. 997 Creates the Franklin D. Roosevelt Warm Springs Pools and Springs Site Commission as an agency to develop and maintain the thermal springs area and to memorialize Franklin D. Roosevelt and the history of Warm Springs, Georgia. Effective July 1, 1979. Act 613; S. B. 71; p. 1127 The "Georgia Hazardous Waste Management Act" provides for administration by the Environmental Protection Division of the Department of Natural Resources of a comprehensive statewide program for the management of hazardous wastes; exempts radioactive wastes, emissions to the air, discharges to waters, and nonhazardous solid waste regulated under federal law and other named state laws; provides for rule making by the Board of Natural Resources; specifies duties of the department; provides criminal and civil penalties; requires permits for hazardous waste facilities and manifests for hazardous waste transportation; requires proof of financial responsibility or posting of a bond; prescribes administrative procedure; provides for emergency powers. Effective April 16, 1979. Act 523; S. B. 206; p. 893 Amends Code Section 45-102, so as to define or redefine "commercial crab trap," "commercial quantities," and "soft-shell crab dealer"; amends provisions in Code Section 45-810, relating to shipment of live fish or fish eggs; amends Code Section 45-815, relating to commercial eel fishing; amends Code Section 45-901, relating to taking of crabs, peelers, and soft-shell crabs; amends Code Section 45-909, relating to legal areas for use of crab traps and identification of crab traps and crab boats. Effective April 13, 1979. Act 616; S. B. 234; p. 1177 Amends Code Section 45-302.1, so as to exempt from the requirement of completion of a hunter education course youths under the age of 15 years until May 1, 1980, and youths under the age of 12 thereafter. Effective April 16, 1979. - 37 - NATURAL RESOURCES (continued) Act 491; S. B. 256; p. 800 Amends the 1977 Act regulating trappers and fur dealers (Ga. Laws 1977, p. 1270), so as to define "rats and mice"; makes it unlawful to sell undressed furs or hides without a valid license; changes penalty provisions; makes it lawful to trap rats and mice at any time during the year; changes licensing and license fee provisions; authorizes issuance of emergency regulations. Effective April 12, 1979. Act 630; H.B. 31; p. 1255 Amends Code Section 45-301, so as to allow local license agents to sell and receive fees for nonresident big game licenses; repeals Code Section 45-301.1 which limited nonresident big game licenses to 100 per county and provided for central sale of such licenses by the Department of Natural Resources; amends Code Section 45-302, so as to make it unlawful for any nonresident, regardless of age, to hunt or possess big game without a nonresident big game license. Effective April 17, 1979. Act 501; H.B. 24; p. 828 Amends Code Section 45-503, so as to provide that certain listed types of handguns may be used for hunting deer; makes it unlawful for any group of five or more people hunting deer with dogs to use either handguns or rifles; provides that for hunting deer shotguns shall be plugged to limit capacity to not more than five shells; provides that for hunting all other game shotguns shall be plugged to limit capacity to not more than three shells. Effective July 1, 1979. Act 529; H.B. 151; p. 919 The "Ginseng Protection Act of 1979" provides for regulation of harvesting of and dealing in ginseng by the Department of Natural Resources; provides penalties; repeals the 1868 Act relating to the unlawful digging of noncultivated ginseng (Ga. Laws 1868, p. 194). Effective July 1, 1979. Act 532; H.B. 164; p. 924 Amends Code Section 45-301, so as to require hunting and fishing license agents to require persons purchasing licenses to display a driver's license or other equally reliable - 38 - NATURAL RESOURCES (continued) identification; amends Code Section 45-302, so as to require any person who is required to have with him a hunting or fishing license to furnish, upon demand by a ranger, a driver's license or other equally reliable identification, together with such hunting or fishing license. Effective April 13, 1979. Act 56; H.B. 467; p. 394 Amends Code Section 45-513, so as to provide a maximum open season for bear hunting from September 15 to January 15; adds Taliaferro County to those counties in which there is a closed season for raccoon. Effective July 1, 1979. Act 509; H.B. 67; p. 849 Creates a new Code Section 45-105.1 which authorizes the Department of Natural Resources to provide technical assistance to local governments relating to the control or elimination of wild dogs. Effective July 1, 1979. PENAL MATTERS Act 490; S. B. 253; p. 798 Amends the 1943 Act creating the State Board of Pardons and Paroles (Ga. Laws 1943, p. 185), so as to provide that, upon receipt of proper documentation from a county, said board shall reimburse the county for the cost of incarceration of any person arrested pursuant to a warrant issued by the board; authorizes the board to adopt rules and regulations. Effective July 1, 1979. Act 42; H. B. 243; p. 376 Amends the 1956 Act revising laws relating to prisons, public works camps, and prisoners (Ga. Laws 1956, p. 161), so as to provide that after receipt of proper documentation from the clerk of court the Department of Offender Rehabilitation shall reimburse counties for the cost of incarceration of felony prisoners beyond 30 days after the time at which there exists no further right of appeal; provides for adoption of rules and regulations by the Board of - 39 - PENAL MATTERS (continued) Offender Rehabilitation; exceptions. Effective July 1, 1979. provides Act 573; H.B. 296; p. 1020 Amends the 1943 Act creating the State Board of Pardons and Paroles (Ga. Laws 1943, p. 185), so as to provide that authorized employees of the State Board of Pardons and Paroles shall be empowered to execute warrants issued by the board. Effective April 16, 1979. Act 455; S. B. 132; p. 652 Amends the 1972 Act making Georgia a party to the Interstate Agreement on Detainers (Ga. Laws 1972, p. 938), so as to provide that the director of the Department of Offender Rehabilitation shall appoint a central administrator of and information agent for the agreement on detainers pursuant to Article VII of the agreement. Effective April 12, 1979. Act 634; H. B. 409; p. 1262 Provides that any person who contracts with a person accused or convicted of a crime in this state for any movie, book, or other dramatization or record of such crime shall submit a copy of the contract to the Board of Offender Rehabilitation and shall pay over to the board any money which would otherwise be payable to the person accused or convicted of the crime; provides for deposit of such money in an escrow account for the benefit of any victim of such crime; provides procedure for payment of such escrow funds. Effective April 17, 1979. PROFESSIONS, BUSINESSES, AND TRADES Act 73; S. B. 46; p. 427 The "Georgia Motion Picture Fair competition Act" prohibits the practice of blind bidding whereby motion picture exhibitors are required to bid for exhibition or distribution rights before having seen a movie; provides for civil enforcement by penalties and injunction for successful civil actions. Effective March 21, 1979. - 40 - PROFESSIONS, BUSINESSES, AND TRADES (continued) Act 635; H.B. 580; p. 1265 Amends the 1977 Act relating to nonprofit bingo games (Ga. Laws 1977, p. 1164), so as to change the provisions limiting the amount of prizes which may be awarded during any day or week. Effective July 1, 1979. Act 567; H.B. 276; p. 1011 Amends "The Retail Installment and Home Solicitation Sales Act" (Ga. Laws 1967, p. 659), so as to provide a four-year statute of limitations for actions brought under the Act arising out of violations which occur after July 1, 1979. Effective July 1, 1979. Act 87; S. B. 184; p. 502 Amends Code Section 9-105, so as to provide that the Supreme Court, upon recommendation by the Board of Bar Examiners, shall set by rule the amount of the state bar examination fee at a reasonable amount not to exceed $90.00. Effective April 4, 1979. Act 671; H. B. 600; p. 1625 Amends Code C~apter 84-66, known as the "Motor Vehicle, Farm Machinery, and Construction Equipment Franchise Practices Act," so as to define or redefine the terms "construction equipment," "farm machinery," "relevant market area," "dealer," "licensee," and "franchisor"; amends Code Section 84-6609, so as to change provisions relating to license applications and fees; amends Code Section 84-6610, so as to change provisions relating to disciplinary licensing sanctions and prohibited practices; creates a new Code Section 84-6612.1, so as to exempt from Code Chapter 84-66 any farm machinery dealer who has a gross annual revenue of $250,000.00 or less unless such dealer elects in writing to come under the chapter; provides for preservation of existing causes of action. Effective April 25, 1979. Act 654; H.B. 795; p. 1305 Amends the 1969 Act relating to registration and regulation of cemeteries (Ga. Laws 1969, p. 242), so as to provide for applicability of certain provisions to mausoleums; - 41 - PROFESSIONS, BUSINESSES, AND TRADES (continued) provides for procedure and fees for applications for certificates of registration; changes provisions relating to annual registration of perpetual and nonperpetual care cemeteries; requires filing of certain information as to perpetual care trust funds; requires escrow accounts for payments on certain merchandise which is not delivered to the purchaser at the time of sale; provides for civil and criminal penalties and other related matters. Effective April 17, 1979. Act 646; H. B. 744; p. 1286 Amends "The Uniform Standards Code for Mobile Homes Act" (Ga. Laws 1973, p. 4), so as to provide for both a manufacturing fee and a monitoring inspection fee on each mobile home manufactured in Georgia; provides for required record keeping and reporting by manufacturers, distributors, and dealers of mobile homes; provides for enforcement and sanctions by civil and criminal penalties. Effective July 1, 1979. Act 511; H. B. 73; p. 853 Amends Code Section 84-707, so as to change the duties of the Georgia Board of Dentistry relating to licensing of dentists; amends Code Section 84-724, so as to change the grounds for revocation or suspension of a license and change the board's authority as to disciplinary actions; provides for civil and criminal immunity for persons providing information to the board. Effective April 13, 1979. Act 512; H. B. 112; p. 643 Amends the "Buying Services Act of 1975" (Ga. Laws 1975, p. 529), so as to provide for the imposition of administrative penalties for violations; requires bonding of each location for services or clubs operating a multilocation business; redefines terms. B. 8; p. 389 "The Georgia Cogeneration Act of 1979" exempts from regulation by the Georgia Public Service Commission certain energy-producing facilities, the output of which is not sold or the output of which does not exceed 30 megawatts electric. Effective March 13, 1979. Act 624; H. B. 531; p. 1233 Amends the "Georgia State Occupational Therapy Licensing Act" (Ga. Laws 1976, p. 993), so as to exempt recreational therapists from the operation of the Act. Effective July 1, 1979. Act 506; H.B. 58; p. 843 Amends the 1951 Act relating to licensing of applied psychologists (Ga. - 44 - PROFESSIONS, BUSINESSES, AND TRADES (continued) Laws 1951, p. 408), so as to delete the requirement that licensees be United States citizens; changes hearing and appeal procedure as to such licensing; provides for license fees to be set by rule; changes provisions relative to renewal of licenses. Effective July 1, 1979. Act 637; H.B. 622; p. 1268 Amends Code Section 84-303A, so as to exempt from licensing requirements for auctioneers any person who acts as an auctioneer in the auction of farm equipment, farm lands, or both not more than three times a year and so as to exempt sales through licensed and bonded livestock auctions; amends Code Section 84-311A, so as to change requirements for auctioneers' and apprentice auctioneers' licenses; amends Code Section 84-314A, so as to provide for licensing of nonresidents who are residents of a state without a license law. Effective July 1, 1979. Act 442; S. B. 69; p. 628 Amends the 1958 Act regulating advertising (Ga. Laws 1958, p. 411), so as to clarify certain provisions relating to the use of the term "Doctor" or "Dr." in letters, business cards, advertisements, or other notices; creates an exemption from said requirements for use of said terms in the name of a professional association or professional corporation legally organized in this state. Effective April 12, 1979. Act 664; H.B. 565; p. 1327 Amends the 1963 Act regulating the occupation of cosmetology (Ga. Laws 1963, p. 45), so as to add a citizen member to and change other provisions relating to the Georgia State Board of Cosmetology; changes certain references so as to conform to executive reorganization; provides for travel expenses of board members; provides for certain fees to be set by the board; changes requirements for operation of beauty schools or schools of cosmetology; provides for investigations and disciplinary sanctions by the board. Effective July 1, 1979. - 45 - PROFESSIONS, BUSINESSES, AND TRADES (continued) Act 50; S. B. 35; p. 385 Amends the 1968 Act creating the State Board of Nursing Homes (Ga. Laws 1968, p. 1143), so as to add a third citizen member to the board; provides for selection procedure for said three citizen members. Effective July 1, 1979. Act 450; S. B. 107; p. 642 Amends the 1976 Act creating the Joint Advisory Board of Family Practice (Ga. Laws 1976, p. 1096), so as to provide for an additional member of the board who shall be a doctor of osteopathy and family physician; requires that all board members be licensed physicians. B. 26; p. 610 Amends Code Section 84-304, so as to provide for the appointment of an additional citizen member to the State Board for Examination, Qualification, and Registration of Architects; provides that said citizen member may vote only on administration and policy matters which do not directly relate to the practical and scientific examination of architects. Effective July 1, 1979. Act 441; S. B. 67; p. 626 Amends Code Section 109A-9-313, so as to provide for priority of purchase money security interests in removable carpeting or padding. Effective July 1, 1979. Act 75; H.B. 545; p. 435 Creates a new Code Section 22-1009, so as to authorize and provide procedures for the merger or consolidation of a domestic corporation with a joint-stock or other unincorporated association or trust. Effective March 26, 1979. Act 55; H.B. 32; p. 393 Amends Code Section 7-302, so as to provide for applicability of Code Chapter 7-3, known as the Georgia Arbitration Code for Construction Contracts, to arbitration of contracts for architectural or engineering design of any building or alterations or additions thereto. Effective March 13, 1979. Act 483; S. B. 228; p. 776 Amends the 1978 Act prohibiting the construction of buildings using certain - 48 - PROPERTY (continued) plumbing facilities which exceed a certain water rate (Ga. Laws 1978, p. 914), so as to direct counties and municipalities to provide by ordinance an exemption relative to new construction under certain circumstances. Effective July 1, 1979. Act 448; S. B. 98; p. 637 Amends the "Facade and Conservation Easements Act of 1976" (Ga. Laws 1976, p. 1181), so as to further define the term "conservation easement" and to interreference the subsections of Section 2 correctly. Effective April 12, 1979. Act 474; S. B. 177; p. 762 Amends the 1958 Act relating to actions of false arrest and false imprisonment and providing a defense thereto for reasonable detention in mercantile establishments when shoplifting is suspected (Ga. Laws 1958, p. 693), so as to provide that the activation of an antishoplifting or inventory control device shall constitute a reasonable cause for detention where the premises have been posted as to use of such devices. Effective July 1, 1979. Act 576; H.B. 325; p. 1025 Amends Code Section 72-301, so as to include places used for the purpose of sodomy, the solicitation of sodomy, or masturbation for hire within those houses of prostitution declared to be nuisances; creates a new Code Section 72-313 which provides that, as an additional remedy, state courts and the municipal courts of municipalities having a population of 15,000 or more shall have jurisdiction to determine the existence of and order the abatement of nuisances defined by Code Section 72-301. Effective July 1, 1979. PUBLIC OFFICERS AND EMPLOYEES Act 627; S B. 14; p. 1248 Amends the 1971 Act providing minimum salaries for sheriffs (Ga. Laws 1971, p. 380), so as to change the amount of minimum salaries and provide for longevity increases. Effective July 1, 1979. - 49 - PUBLIC OFFICERS AND EMPLOYEES (continued) Act 628; S. B. 15; p. 1250 Amends the 1976 Act providing minimum salaries for certain tax collectors and tax commissioners (Ga. Laws 1976, p. 988), so as to change the amount of minimum salaries; provides for longevity increases; makes special provisions for tax collectors or tax commissioners who receive income from the sale of motor vehicle license plates or fees and commissions upon collection of taxes in excess of a certain percentage of the tax digest; amends Code Title 91A (effective January 1, 1980) to conform said Code Title to the above changes. Effective July 1, 1979. Act 449; S. B. 102; p. 639 Amends Code Section 24-2919 et seq., so as to change the compensation of certain assistant district attorneys; provides that, upon the death or resignation of a district attorney, the chief assistant district attorney or the most senior assistant district attorney shall perform the duties of the district attorney until a successor is qualified. Effective July 1, 1979. Act 599; H.B. 503; p. 1072 Amends the 1937 Act creating the Department of Public Safety (Ga. Laws 1937, p. 322), so as to authorize payment of a clothing allowance to members of the Georgia State Patrol who are permanently assigned to personal security or special duty assignments which necessitate the wearing of nonuniform clothing; changes certain technical references. Effective April 16, 1979. Act 54; H. B. 13; p. 392 Requires 30 days' notice to the public and to the Governor before making any change in the compensation of the following officers: the commissioner of the Department of community Affairs, the director of the Employees' Retirement System of Georgia, the director of the State Forestry Commission, the director of investigation of the Georgia Bureau of Investigation, the executive director of the Georgia Franchise Practices Commission, the commissioner of human resources, the commissioner of the Department of Industry and Trade, the commissioner of natural resources, the commissioner of Public Safety, the - 50 - PUBLIC OFFICERS AND EMPLOYEES (continued) chancellor of the University System of Georgia, the executive director of the state Scholarship Commission, the executive director of the Soil and Water conservation Committee, the executive secretary-treasurer of the Teachers' Retirement System of Georgia, the commissioner of transportation, and the executive director of the State Campaign and Financial Disclosure Commission. Effective March 13, 1979. Act 519; H.B. 120; p. 886 Amends the "Georgia Military Forces Reorganization Act of 1955" (Ga. Laws 1955, p. 10), so as to change the minimum base pay for members of the militia to $30.00 per day. Effective April 13, 1979. Act 439; S. B. 61; p. 623 Amends the "Georgia Military Forces Reorganization Act of 1955" (Ga. Laws 1955, p. 10), so as to reduce the period for which compensation is paid to public officers and employees while on military duty from 30 to 15 days; further provides a 30 day period during which public officers and employees may be paid while on military duty if such duty is emergency duty. Effective July 1, 1979. Act 427; S. B. 3; p. 592 Amends the 1974 Act authorizing the state or any political subdivision to defer an employee's compensation (Ga. Laws 1974, p. 198), so as to repeal the requirement that a favorable letter or ruling be obtained from the Internal Revenue Service prior to the effective date of the deferred compensation program. Effective April 12, 1979. Act 485; S. B. 231; p. 780 Amends the 1975 Act exhaustively revising laws relating to the State Personnel Board and the State Merit System of Personnel Administration (Ga. Laws 1975, p. 79), so as to change the provisions relating to adoption of rules by the State Personnel Board; provides that provisions prohibiting age discrimination apply only to ages between 40 and 70 years; creates certain executive officers; changes procedure - 51 - PUBLIC OFFICERS AND EMPLOYEES (continued) for dismissals from employment and other adverse actions. Effective April 12, 1979. RETIREMENT Act 63; H.B. 222; p. 415 Amends the 1949 Act establishing the Employees' Retirement System of Georgia (Ga. Laws 1949, p. 138), so as to change provisions relating to time of application for and effective date of retirement. Effective March 15, 1979. Act 632; H.B. 278; p. 1259 Amends the 1949 Act establishing the Employees' Retirement System of Georgia (Ga. Laws 1949, p. 138) so as to change the conditions under which group term life insurance coverage may be continued by certain members after separation from employment or retirement. Effective April 17, 1979. Act 574; H. B. 298; p. 1022 Amends the 1949 Act establishing the Employees' Retirement System of Georgia (Ga. Laws 1949, p. 138), so as to provide that the board of trustees of the retirement system may establish rules and regulations to provide for creditable service for forfeited annual and sick leave for full-time member employees or officials for whom there is no established practice or policy with regard to annual and sick leave accumulations. Effective April 16, 1979. Act 620; H. B. 303; p. 1196 Amends the 1943 Act establishing the Teachers' Retirement System of Georgia (Ga. Laws 1943, p. 640), so as to provide that teachers employed by an independent school system after July 1, 1979, shall become members of the Teachers' Retirement System; provides for transfer of teachers from local retirement funds to membership in the Teachers' Retirement System; provides for contributions by such teachers, local retirement funds, and the state. Effective April 16, 1979. - 52 - l ~ RETIREMENT (continued) Act 563; H.B. 251; p. 1004 Amends the 1943 Act establishing the Teachers' Retirement System of Georgia (Ga. Laws 1943, p. 640), so as to increase the amount of minimum retirement allowances to $10.00 per month for each year of service not to exceed 40 years; provides for applicability to retirees under local funds. Effective when funds are appropriated by the General Assembly to carry out the provisions of the Act. Act 565; H.B. 265; p. 1007 Amends the 1943 Act creating the Teachers' Retirement System of Georgia (Ga. Laws 1943, p. 640), so as to change from five to three years the .time of membership service required for certain reestablishment of membership service, for certain reestablishment of previous credits, and for certain reestablishment of creditable service under the Employees' Retirement System. Effective July 1, 1979. Act 535; H.B. 175; p. 930 Amends the 1943 Act establishing the Teachers' Retirement System of Georgia (Ga. Laws 1943, p. 640), so as to provide that members who rendered service which would currently be covered by the Employees' Retirement System but which was rendered prior to the establishment of the Employees' Retirement System may under certain conditions establish Teachers' Retirement System service credit for such service. Effective July 1, 1979. Act 528; H. B. 145; p. 918 Amends the 1943 Act establishing the Teachers' Retirement System of Georgia (Ga. Laws 1943, p. 640), so as to provide that no beneficiary who causes the death of a member or retiree by murder or voluntary manslaughter shall receive any benefits. Effective April 13, 1979. Act 518; H. B. 105; p. 884 Amends "The Act Creating the Public School Employees Retirement System" (Ga. Laws 1969, p. 998), so as to eliminate a provision for termination of membership due to failure to carry out certain - 53 - RETIREMENT (continued) services; provides for reestablishment of certain terminated members. Effective July 1, 1979. Act 536; H.B. 182; p. 931 Amends the 1967 Act establishing the Georgia Legislative Retirement System (Ga. Laws 1967, p. 259), so as to change the amount of benefits and contributions; provides for certain required election between membership in the Georgia Legislative Retirement System and the Employees' Retirement System. Effective April 13, 1979. Act 74; H.B. 247; p. 430 Amends the 1950 Act creating the Peace Officers' Annuity and Benefit Fund (Ga. Laws 1950, p. 50), so as to change the amount of members' contributions; increases benefits; changes provisions relating to eligibility for certain retirement options; provides for recomputation of benefits; changes provisions relating to eligibility for and amount of disability benefits. Effective May 1, 1979. Act 560; H. B. 246; p. 994 Amends the 1963 Act creating the Sheriffs' Retirement Fund of Georgia (Ga. Laws 1963, p. 630), so as to increase certain retirement benefits. Effective May 1, 1979. Act 556; H.B. 231; p. 971 Amends the 1949 Act creating the office of district attorney emeritus (formerly solicitor general emeritus) (Ga. Laws 1949, p. 780), so as to provide that any district attorney emeritus may resign and be reappointed up to three times under certain conditions. Effective April 13, 1979. Act 429; S. B. 7; p. 596 Amends the 1958 Act providing for retirement benefits for the judges of the probate courts (Ga. Laws 1958, p. 185), so as to increase the maximum amount of compensation upon which contributions and benefits are computed; provides for increased retirement benefits; provides for refunds of dues paid and interest thereon to the estates - 54 - RETIREMENT (continued) of probate judges who die prior to retirement. Effective July l, 1979. Act 39; H.B. 124; p. 364 Amends the 1955 Act creating the Firemen's Retirement System (Ga. Laws 1955, p. 339), so as to change the requirements for reinstatement to membership; changes provisions relating to required time of application for membership; changes provisions relating to the amount of retirement benefits and optional payment plans. Effective March 9, 1979. REVENUE Act 2; H. B. 3; p. 5 Extensively revises Code Title 91A (effective January 1, 1980), the Public Revenue Code, so as to incorporate three basic types of changes: inclusion of laws passed by the 1978 regular session of the General Assembly; correction of errors contained in the new Public Revenue Code, as enacted; and further deletions of obsolete and duplicate provisions. Cross-reference indices between Title 91A and the current Title 92, Ga. Code Ann., are available upon request from the Office of Legislative Counsel. Effective January 1, 1980. Act 600; H.B. SOS; p. 1075 Amends the 1978 Act exhaustively revising and codifying revenue laws (Ga. Laws 1978, p. 309; effective January 1, 1980), so as to delete from the repealer section of said Act a provision for repeal of the 1977 Act relating to regulation and licensing of nonprofit bingo games (Ga. Laws 1977, p. 1164). Effective April 16, 1979. Act 524; H. B. 128; p. 901 Amends Code Section 92-3108, so as to redefine the "Internal Revenue Code of 1954" to include provisions in effect on January 1, 1979. Effective April 13, 1979, and applicable to all taxable years beginning on or after January l, 1979; repealed effective January 1, 1980. - 55 - REVENUE (continued) Act 603; H.B. 512; p. 1078 Amends the 1938 Act making comprehensive provision for an integrated tax administration (Ga. Laws 1937-38, Ex. Sess., p. 77) and Code Section 91A-245 (effective January 1, 1980), so as to authorize the Department of Revenue to set off against any taxpayer's claim for refund any other state taxes due from the taxpayer. Effective as to the 1938 Act April 16, 1979; effective as to Code Section 91A-245 January 1, 1980. Act 521; H.B. 125; p. 888 Amends Code Chapters 92-31 and 91A-36 (effective January 1, 1980), so as to provide that, where a corporation or individual has taken a federal jobs tax credit which required the elimination for federal tax purposes of salary and wage deductions, for purposes of Georgia income taxation taxable income shall be adjusted by the amount of such salary and wage expenses. all Effective April 13, 1979, as to Code Chapter 92-31 and applicable to taxable years beginning on or after January 1, 1979; effective January 1, 1980, as to Code Chapter 91A-36. Act 533; H.B. 168; p. 926 Amends the "Current Income Tax Payment Act of 1960" (Ga. Laws 1960, p. 7), and Code Section 91A-3902 (effective January 1, 1980), so as to provide that an employer is not required to withhold any taxes on wages paid to an employee who has furnished to the employer a withholding exemption certificate in proper form stating that such employee incurred no income tax liability in the preceding tax year and does not expect to incur any income tax liability in the current tax year. Effective as to the 1960 Act on April 13, 1979; effective as to Code Section 91A-3902 on January 1, 1980. Act 617; H. B. 170; p. 1178 Amends Code Section 91A-3904, so as to require monthly payment of withholding taxes for any month in which the amount of such withholding taxes exceeds $200.00; provides that such monthly payments shall be due on the fifteenth day of the following month except for payments due in April, July, October, and January which shall be due on the last day of the month. Effective January 1, 1980. - 56 - REVENUE (continued) Act 85; H.B. 281; p. 446 Amends the "Georgia Retailers' and Consumers' Sales and Use Tax Act" (Ga. Laws 1951, p. 360) and Code Chapter 91A-46 (effective January 1, 1980), so as to delete provisions pertaining to a local option sales and use tax; creates 159 special tax districts conterminous with the boundaries of Georgia's counties; provides the procedures and circumstances whereby a joint county and municipal sales and use tax may be imposed within such districts; provides for repeal of Code Chapter 91A-46 effective July 1, 1981. Effective as to the "Georgia Retailers' and Consumers' Sales and Use Tax Act" April 1, 1979; effective as to Code Chapter 91A-46 January 1, 1980, except that resolutions imposing a joint county and municipal tax under said Code chapter may be adopted effective April 1, 1979. Act 639; H.B. 633; p. 1274 Amends Code Chapter 92-14 and Code Chapter 91A-50 (effective January l, 1980), so as to provide a second motor fuel tax of 3 percent, to be administered and collected in the same manner as the sales and use tax. Act 640; H.B. 634; p. 1278 Amends the "Georgia Retailers' and Consumers' Sales and Use Tax Act" (Ga. Act 605; H.B. 518; p. 1081 Provides supplemental appropriations to the Department of Labor pursuant to Section 903 of the federal Social Security Act and the Employment Security Law. Effective April 16, 1979. Act 459; S. B. 139; p. 659 Amends the 1937 Act relating to state purchasing and the Department of Administrative Services (Ga. Laws 1937, p. 503), so as to declare purposes and policies of the department; provides for duties of the department in connection with competitive bidding and purchasing; provides for negotiated contracts in certain cases; provides for exceptions from the requirement of purchase through the department. Effective April 12, 1979. Act 34; H.B. 455; p. 352 Amends the 1937 Act relating to state purchasing and the Department of Administrative Services (Ga. Laws 1937, p. 503), so as to authorize the department to execute, on behalf of all state agencies subject to said Act, multiyear lease, purchase, or lease purchase contracts subject to certain conditions. Effective March 6, 1979. Act 496; S. B. 299; p. 816 Amends Code Section 91-105a, so as to define lease amendments and prescribe procedure for lease amendments by the - 58 - STATE GOVERNMENT (continued) State Properties Commission; amends Code Section 91-112a, so as to authorize the Department of Natural Resources to convey to local governments property acquired by the department for boat ramps without the prior approval of the State Properties Commission and without appraisal, plat, or public bidding. Effective April 12, 1979. Act 598; H.B. 477; p. 1071 Amends the 1968 Act providing procedures for disposal of surplus state-owned property (Ga. Laws 1968, p. 1148), so as to authorize the sale of surplus property by negotiated contract to private nonprofit health and educational institutions and public corporations under certain conditions. Effective July 1, 1979. Act 651; H.B. 779; p. 1295 Amends Code Section 91-802A, so as to increase from $50.00 to $100.00 the minimum value of articles of movable personal property which are required to be included in the annual central inventory of personal property belonging to the state. Effective July 1, 1979. Act 658; H.B. 362; p. 1318 Amends the 1937 Act changing certain provisions relating to state purchasing (Ga. Laws 1937, p. 503), so as to provide for the purchase by the state and its political subdivisions of goods available from sheltered workshops and training centers operated by or in contract with the Department of Human Resources where the Department of Administrative Services has certified the price of such goods as competitive; provides that goods not available from sheltered workshops and training centers shall be obtained from other agencies of the state which are legally authorized to engage in the provision of such goods and have certified the availability thereof with the advice and consent of the Department of Administrative Services. Effective July l, 1980. Act 60; H. B. 14; p. 411 Provides that the Governor may authorize the use and display of the great seal or a facsimile of the state emblem under conditions where such use is appropriate and not contrary to the state's interest in preserving the - 59 - STATE GOVERNMENT (continued) dignity of said seal and emblem and where such use does not otherwise violate the provisions of an Act relating to prohibited use of state symbols (Ga. Laws 1960, p. 985). Effective March 15, 1979. Act 655; H. B. 812; p. 1312 Creates a new Code Section 93-307.2 which prohibits any utility regulated by the Public Service Commission from automatically increasing billing by reason of application of a fuel adjustment tariff after July 1, 1979; prescribes a new procedure for changes in the rates of utilities based on changes in fuel costs. Effective April 17, 1979. Act 606; H.B. 536; p. 1084 Amends Code Section 93-508, so as to expand the provisions for discovery by the employees and agents of the Public Service Commission; provides for discovery of any relevant nonprivileged matter in the same manner prescribed by law for discovery in civil actions; provides for orders, injunctions, and subpoenas necessary to compel discovery to be issued upon petition to the Superior Court of Fulton County. Effective April 16, 1979. Act 20; H. B. 12; p. 143 Amends the 1937 Act creating the Department of Public Safety (Ga. Laws 1937, p. 322), so as to authorize the Security Guard Division of the Department of Public Safety to provide security services for the protection of the immediate family of the Governor and such other individuals as may be directed by the Governor; authorizes the transportation at state expense of members of the Governor's family for whom protection is provided when traveling with the Governor on state-related business at the request of the Governor. Effective February 23, 1979. Act 498; H.B. 9; p. 823 Amends Code Section 88-108, so as to authorize the Department of Human Resources to establish by rule a schedule of fees for laboratory services not to exceed the cost of such services; provides that no person shall be denied services because of inability to pay. Effective April 13, 1979. - 60 - STATE GOVERNMENT (continued) Act 593; H. B. 429; p. 1062 Amends the 1976 Act creating a State Office of Housing Section within the Department of Community Affairs (Ga. Laws 1976, p. 651), so as to authorize the state Office of Housing Section to apply for, receive, and administer federal funds under any federal housing program; prohibits the department from establishing a state housing authority or operating any local housing authority. Effective April 16, 1979. Act 577; H. B. 342; p. 1027 Amends the "Executive Reorganization Act of 1972 11 (Ga. Laws 1972, p. 1015), so as to provide for transfer of functions of the Secretary of State relating to the inventory of real property and requirements for acquisition or disposition of real property (except the function of filing and retaining conveyances or plats) to the State Properties Commission. Effective April 16, 1979. Act 522; H. B. 496; p. 891 Amends Code Section 114-908, so as to provide that all officials, personnel, and employees of the workers' compensation Subsequent Injury Trust Fund are placed in the state merit system classified service unless otherwise excluded by law; provides that the administrator shall not be in the classified service except for determination of compensation. Effective April 13, 1979. Act 488; S. B. 242; p. 795 Amends the 1959 Act creating the Legislative Services Committee (Ga. Laws 1959, p. 152), so as to provide that the President of the Senate shall be allowed to designate, in writing, that the President Pro Tempore of the Senate shall serve on said committee in place of the President of the Senate. B. 10; p. 391 Amends the 1976 Act creating the Georgia Council for Energy Resources (Ga. Laws 1976, p. 1740), so as to change the membership of said council; establishes a termination or sunset date for said council of July l, 1980. Effective March 13, 1979. - 62 - STATE GOVERNMENT (continued) Act 497; H. B. 7; p. 821 Amends the 1969 Act creating the State Building Administrative Board (Ga. Laws 1969, p. 546), so as to establish a sunset or termination date for said board of July 1, 1980, and a date of repeal for said Act of July 1, 1981; repeals the 1978 resolution changing said termination date (Ga. Laws 1978, p. 2098). Effective April 13, 1979. Act 494; S. B. 277; p. 806 Amends the 1962 Act making the State of Georgia a party to the "Southern Interstate Nuclear Compact" (Ga. Laws 1962, p. 505), so as to change the name of said compact to the "Southern States Energy Compact"; provides that the purpose of the board shall relate to energy and the environment generally; changes membership of the Southern States Energy Board; authorizes Puerto Rico and the United States Virgin Islands to become parties to the compact. Effective when approved by nine member states and consented to by the United States Congress. Act 59; S. B. 66; p. 401 Amends the "Georgia State Financing and Investment Commission Act" (Ga. Laws 1973, p. 750), so as to change certain references to the Constitution by updating such references to the 1976 Constitution; deletes references to the "State Treasurer" and replaces them with the "director, Fiscal Di vision, Department of Administrative Services"; provides for agents of the fiscal officer of the state; changes provisions relative to certain prohibited contracts. Effective March 15, 1979. TRANSPORTATION Act 435; S. B. 38; p. 615 Amends Code Section 68-214, so as to extend the life of five-year motor vehicle license plates to seven years. Effective July 1, 1979. Act 520; H. B. 121; p. 887 The "Medal of Honor Winners' License Plates Act" provides for issuance of distinctive personalized license plates - 63 - TRANSPORTATION (continued) free of charge to persons who have been awarded the Medal of Honor. Effective April 13, 1979. Act 582; H. B. 356; p. 1038 Amends the 1937 Act relating to motor vehicle licenses (Ga. Laws 1937-38, Ex. Sess., p. 259) and Code Section 91A-5302 (effective January 1, 1980), so as to provide that there shall be no license fee for certain farm trailers. Effective as to the 1937 Act April 16, 1979; effective as to Code Section 91A-5302 January 1, 1980. Act 570; H. B. 291; p. 1015 Amends the 1941 Act relating to interstate reciprocal agreements on operation of motor vehicles (Ga. Laws 1941, p. 361), so as to authorize the Governor or his designees to enter into agreements or arrangements with other jurisdictions relating to the proportional registration of commercial vehicles in interstate commerce. Effective April 13, 1979. Act 611; H. B. 569; p. 1108 Amends the "Motor Vehicle Certificate of Title Act" (Ga. Laws 1961, p. 68), so as to require that certificates of title for vehicles which have been rebuilt, reconditioned, or remanufactured indicate such fact on the face of the certificate. Effective July 1, 1979. Act 454; S. B. 129; p. 651 Amends Code Section 68-502, so as to exempt from the definition of regulated "motor carriers" certain motor vehicles used for transportation of elderly and handicapped passengers and corporate sponsored van pool programs. Effective April 12, 1979. Act 527; H. B. 142; p. 906 Adds a new Code Title 68E to be known as the "Georgia Motor Vehicle Safety Inspection Act" which revises, codifies, and changes laws relating to motor vehicle safety inspections. Effective April 13, 1979. Act 622; H. B. 424; p. 1213 The "Georgia Motor Vehicle Emission Inspection and Maintenance Act" states - 64 - TRANSPORTATION (continued) legislative findings and policy; provides for establishment of motor vehicle emission standards by the Environmental Protection Division of the Department of Natural Resources; provides for implementation of inspection and certification procedures by the Department of Public Safety; provides a comprehensive system of inspection and certification of motor vehicles after April 1, 1981, in all counties where more than 200,000 motor vehicles are registered and pollutant levels exceed national standards. Effective April 16, 1979. Act 607; H.B. 541; p. 1086 Amends Code Chapter 95A-9, so as to provide for averting substantial economic hardship to private parties by the retention, in specific areas defined by the State Transportation Board and approTed by the United States Secretary of Transportation, of signs lawfully erected which do not currently conform to the requirements of Code Chapter 95A-9. Effective July 1, 1979. Act 492; S. B. 258; p. 803 Creates a new Code Section 95A-923.l which authorizes cities and counties to acquire by purchase, gift, or condemnation outdoor signs and displays which were lawfully erected but do not conform to local ordinances; requires payment of just compensation. Effective April 12, 1979. Act 487; S. B. 235; p. 789 The "Transportation of Hazardous Materials Act" states legislative findings; provides for administration by the Department of Transportation of a system of permits and regulations for transportation of hazardous materials within the state; provides for exemptions; defines "hazardous materials" to mean and include radioactive materials, liquified natural gas, and polychlorinated biphenal. Effective April 12, 1979. Act 84; H. B. 548; p. 439 Amends provisions of Code Chapter 95A-9, relating to oversized vehicles and loads, including the following: Code Section 95A-957, so as to authorize operation of buses which do not exceed a width of 102 inches upon all roads except interstate highways where traffic - 65 - TRANSPORTATION (continued) lanes are less than 12 feet wide; Code Section 95A-958, so as to provide that loads of poles and similar items may exceed the length of 55 feet without requiring a permit when such items are single length pieces and no pieces are loaded end to end; Code Section 95A-961, so as to provide that permits may be immediately declared null and void when the conditions of such permits are violated; and Code Section 95A-961, so as to provide that certain oversized vehicles may return unloaded to their point of origin and so as to provide for certain permit fees. The 1977 Act authorizing extra wide motor vehicles on highways (Ga. Laws 1977, p. 321) and the 1978 Act providing for permits for transporting mobile homes (Ga. Laws 1978, p. 1565) are repealed in their entirety. Effective April 1, 1979, except a provision for single trip permit fees for certain double wide trailers with a roof overhang which is effective July 1, 1979. Act 482; S. B. 222; p. 775 Amends the "Uniform Act Regulating Traffic on Highways" (Ga. Laws 1953, Nov.-Dec. Sess., p. 556), so as to exempt from safety requirements for school buses any motor vehicles operated by a local transit system which transports school children along with regular fare-paying passengers. Effective April 12, 1979. Act 557; H.B. 234; p. 973 Amends Code Title 95A, the "Georgia Code of Public Transportation," so as to define the term "other transportation purposes"; provides for widening, deepening, and improving the ports, seaports, or harbors of this state by the Department of Transportation by its own forces or by contract; provides for condemnation for transportation purposes other than public road purposes; provides for relocation assistance for persons displaced by federal-aid river and harbor improvement projects; authorizes the Department of Transportation to take necessary steps to secure federal funds for transportation facilities other than public roads. Effective April 13, 1979. Act 9; S. B. 13; p. 132 Amends the 1969 Act relating to highway welcome centers (Ga. Laws 1969, p. 610), the 1977 Act relating to - 66 - TRANSPORTATION (continued) tourist centers within the area of citizens of this state elected President of the United States (Ga. Laws 1977, p. 200), and Code Chapter 95A-9, so as to authorize the Department of Industry and Trade to install and operate vending machines at highway welcome centers and tourist centers and to allow the Department of Transportation to install and operate vending machines at highway safety rest areas; provides for use of net revenue. Effective February 23, 1979. Act 495; S. B. 294; p. 814 Amends Code Section 95A-962, so as to provide that enforcement officers of the Department of Transportation shall have authority to make arrests on certain property owned or controlled by the department; authorizes enforcement officers to carry firearms under certain conditions; gives to enforcement officers the full authority of peace officers in the performance of their duties. Effective April 12, 1979. Act 587; H. B. 381; p. 1049 Amends Code Section 68B-402, so as to change the additional period of time for which the Department of Public Safety shall extend the suspension of the driver's license of a person convicted under said Code section; amends Code Section 68B-316, so as to direct the Department of Public Safety to suspend the driver's license of any person who has failed to respond to a traffic citation (other than for a parking violation) to appear before any court of this state or another state. Effective April 16, 1979. Act 480; S. B. 207; p. 771 Amends the 1968 Act regulating the use of radar speed detection devices (Ga. Laws 1968, p. 425), so as to require that state law enforcement officers test radar detection devices for accuracy daily and maintain a record of test results. Effective July 1, 1979. Act 14; H. B. 352; p. 142 Amends Code Section 68B-215, so as to provide that the Department of Public Safety may issue abstracts of a driver's operating record to a person who has certified that he has on file an application for insurance or for the - 67 - TRANSPORTATION (continued) renewal or amendment thereof involving the driver. Effective February 23, 1979. Act 500; H.B. 18; p. 826 Amends Code Section 68C-301, so as to eliminate the requirement that the operator or owner of a motor vehicle involved in an accident report the accident to the commissioner of public safety; provides that such reports will be required only where requested in writing by the commissioner or where the accident is not investigated by a law enforcement officer. Effective April 13, 1979. WILLS, TRUSTS, AND ESTATES Act 662; H. B. 438; p. 1325 Creates a new Code Section 113-1001.1 which provides that any husband who becomes a widower after the effective date of the Act shall be entitled to year's support pursuant to the same provisions under which a widow is entitled to year's support; amends Code Section 113-1202, so as to provide that beneficiaries under a will shall be entitled, in lieu of other rules, to name an administrator with the will annexed; amends Code Section 113-1502, so as to provide that an administrator with the will annexed shall have all the powers and immunities of an executor, except such as manifestly arise from personal trust in the named executor; amends Code Section 113-1217, so as to reenact the requirement that administrators shall post bond in an amount equal to double the value of the estate, except administrators with the will annexed whose bond shall be governed by the rules of law governing the bond of an executor. Section 3A of the Act provides that the Act shall become effective July 1, 1979, except the provisions relating to year's support which shall become effective upon approval by the Governor, April 18, 1979. Section 4 of the Act provides that the entire Act shall become effective upon approval by the Governor, April 18, 1979. Act 649; H. B. 770; p. 1292 Amends Code Section 113-824, so as to change from six months to nine months the period of time within which a written instrument of renunciation of succession must be filed; provides for - 68 - WILLS, TRUSTS, AND ESTATES (continued) the effect of such changed time period on existing interests in property.
