On Thursday, October 5, 1950, there
was a hearing before Judge Douglas
Thomas at Jesup, Georgia, on petition of
Creatwood Dairies attacking Senate Bill
185 known as the. Zellner Bill as uncon-
Creatwood Dairies had filed a : petition
seeking an injunction to prevent the
forcing rules and regulations made pur-
suant to the law on the ground that the
Act was unconstitutional. The Commis-
sioner of Agriculture filed a general
demurrer to the petition. Honorable M. H.
Blackshear, Jr., Assistant Attorney Gen-'
eral, made a splendid argument to sus-
tain the validity of the law and the rules
and regulations of the Commissioner of
Agriculture. Hon. Lamar W. Sizemore,
Blackshear in-the preparation and con-
duct of the case. Hon. John S. Candler,
II and Hon. Asa Candler, Decatur, Geor-
gia, represented Creatwood Dairies and
argued that the law was unconstitutional
and that the rules and regulations of the
Commissioner of Agriculture were in-

The parity which the Secretary of Ag-
riculture fixes is based on a formula pro- .
vided by Congress and does not in any
way. represent true parity to farmers to
grow cotton, The declared purpose of |
Congress in fixing parity was to give the
farmer as much purchasing power for his
crop as he had during the base period
1909 to 1914. Congress, however, failed
to provide a formula which would give
the farmer anything like as much pur-
chasing power as he had during the base
period.
As an illustration, the old rule during
the base period was that a pound of cot-
ton bought a yard of cotton cloth, A
pound of cotton bought an hour of labor.
A bushel of corn, a bushel of potatoes or
a gallon of syrup bought a days labor.
For the cotton farmer to have true
parity today he would have to get about
48c per pound for Middling Cotton with
7/8 staple. 80% of 48 is 38.40 so that if
the farmer received 80% of true parity

ing the constitutionality of the law and
sustained the validity of the rules and
regulations promulgated by the Commis-
sioner of Agriculture.
Judge Thomas very properly gave a
supersedeas to the plaintiff so that the
decision of Judge Thomas could be re
viewed and passed upon by the Appelate
Court. However, the Judge stipulated
that Creatwood Dairies were required te
abide by all of the laws and rules and
regulations of the Commissioner of Agri-
cultureand subject to the same inspec-
tion while the suit is pending as all other
distributors are.
This was a complete and full vindica-
tion of Georgia laws regulating the quali-
ty, the production, distribution, labeling
and selling of milk and milk products.
It was a great victory for the children,
housewives and general public, includ-
ing, of course, the farmers who produce
milk.
This decision will go a long way to en-
courage the dairymen of the State to
produce adequate supplies for our people
and will insure the consuming public of
wholesome, sanitary milk. It will also
go a long way towards insuring the gen-
eral public of the State against being de-
frauded by having inferior recombined
