EDITORIALBy TOM LINDER

The Milk Control Law now in effect in Georgia was passed

the Legislature in 1937 and reenacted in 1941.
- Section 1 declares in part as follows:

DECLARATION OF LEGISLATIVE POLICY. AS A MAT-

ER OF LEGISLATIVE DETERMINATION, IT IS HEREBY
HCLARED THAT MILK IS A NECESSARY ARTICLE OF

OD FOR HUMAN CONSUMPTION; THAT THE PRODUC-.
N AND MAINTENANCE OF AN ADEQUATE SUPPLY OF

ALTHFUL MILK IS VITAL TO THE PUBLIC HEALTH

_ A casual reading of the above makes it clear even to the
y mind that the Legislature intended to foster and encourage

dairy industry in Georgia for the noo of the health
the people.

With this in mind it is clear that the combined base of all
oducers should total enough milk to furnish the. reasonable
mand for milk within the state.

Section 19 of the law provides in part as follows:

IN DETERMINING WHAT IS A REASONABLE RETURN
O THE PRODUCER, THE BOARD SHALL TAKE INTO CON-
DERATION THAT NECESSARY COST INCURRED IN
AINTAINING DAIRY ANIMALS IN A HEALTHY CONDI-
ON, PAYING WAGES AND SUPPLYING WORKING CON-

DITIONS TO EMPLOYEES: SUFFICIENT FOR THEIR SUB-

The aie provision of the law clearly indicates that th
Legislature intended to encourage the keeping of enough da
cattle on the farms of Georgia to supply this milk. 2

It is also clear from the above that the base of the individu
producer should be based upon the number of dairy cattle tha
he keeps and the amount of milk that he produces. |

It should not be based upon the amount of milk that h
has delivered during a twelve months period. There are sot

* who purchase milk and who sell and deliver a great deal mor
milk than they produce.

The fixing of bases on the amount of milk deuverae has
a tendency to encourage the buying and selling of milk and to
discourage the keeping of cattle and producing the milk.

This clearly has the opposite affect from that the ae wa
intended to produce. .

Section 19, sub-section B, provides in part as follows:

eon the share you can see that the Le visldtare
e authority to the Milk Control Board to vary the
ice to be paid for different quotas of milk when
ed for different purposes,

f the Legislature had stopped with the above
sions of the law then it would be within their
ower to fix the price of milk for different purposes
price that the Board saw fit.

The Legislature did not stop, however, with the
ve provisions. In Section 19, sub-section D, the:
islature. wrote a provision as clear as the English
iguage can state it, which put a limit on the power
he M&k Control Board .and the Director in fix-
@ price of milk to be paid the producer as fol.

Phe paragraph just quoted says and I repeat:
IN NO CASE SHALL THE PRICE OF MILK
ID. THE PRODUCER BE LESS THAN ONE- HALF
THE PRICE BY THE ULTIMATE CONSUMER
: STANDARD FLUID-MILK.
The price paid by the ultimate consumers in At-
for standard fluid milk is now 16c per quart
per gallon. a
IN NO CASE SHALL THE PRICE OF MILK
'D THE PRODUCER BE LESS THAN ONE- HALF:
HE PRICE PAID BY THE ULTIMATE CON-
MER FOR STANDARD FLUID- MILK.
1 no case shall the price paid to the producer
g in he Atlanta milk shed be less than 32 per:

The, law does not fix this one-half as a ceiling,
es the fifty per cent as a floor, and no milk ean!
urchased from the producer at a lower price,
this floor clearly provided in the act.
If: the Board of Control and the Director
for the processor and distributor to pay 42e
ik that is distributed from door to door, and 32
No. 2 milk, and 22c for No. 3 milk, this would be
ible, provided that the producer received an
re of not less than 32 for all his milk.
Then the Board of Control and the Director set.
yer cent as the price to be paid on No. 1 milk, :
less price to be paid on other classes of milk,
are entirely without any legal authority to do so.

It is iipessible for the fas to maintain his
herd, to comply with the sanitary and health require-
ments of the state laws and to produce an adequate
supply of milk for the people of Georgia under the
present policy of the Board of Control and the Di-
rector in denying the producer a living price for his
milk.

It is the same old story of both the consumer and
the producer being gouged by an organized mid-
dle man.

_ At the hearing this week there were dairymen
who have been getting as low as 14c per gallon for
milk that was being sold to the consumer for 15c a
quart. f

I have numerous requests be permits to bring

they cannot buy the milk in Georgia, I have not is-
sued any permits for this purpose. The Milk Patrol of
this Department is making every effort to catch this
bootleg milk coming into the state and we are dis-
coloring it wherever it is found, in accordance with
the provisions of the law making it the duty of the
Commissioner of Agriculture to do this.

I AM ASKING THE MILK CONTROL BOARD
AND THE DIRECTOR TO IMMEDIATELY RAISE
THE PRICE OF MILK TO THE PRODUCERS TO
AN AVERAGE OF FIFTY PER CENT OF THE
PRICE PAID BY THE ULTIMATE CONSUMER IN
ACCORDANCE WITH THE PROVISIONS OF THE
LAW.

IF THE MILK GONTROL BOARD AND THE
