a he Legal Status of the Georgia Cotton Growers Co-operative;
Association he

For the past few weeks I have received numerous alles
-iand telegrams asking me questions in reference to transac-

tions with the Georgia Cotton Growers Co-operative Associa-
tion.

I have answered all of these sie by wire or letter. Due
160. the faet that they are becoming more numerous, here is a
public answer for all parties interested to take due notice.

About three weeks ago, Ed Quillian of Gainesville, Geor-

gia, and Kelly and Kelly of Lawrenceville, Georgia, as attor-

neys representing 24 members of the Georgia Cotton Growers
Co- -operative Association, filed a petition for receivership in
the Superior Court of Fulton County, against the Association.

: A temporary receivership was not granted but it was set
for hearing on Saturday, November 9th. This hearing to de-

_ termine whether a permanent receivership should be appoint-

ed for the Georgia Cotton Growers Co-operative Association. :

: The case was called Saturday morning before Judge
_ Thomas and the firm of Bryan and Middlebrooks appeared as

_ Attorneys for the Georgia Cotton Growers Co-operative Asso-

ciation, The case is now set for December 10th.

The main allegation of the petitioners for the receiver-

:: ship is that the Georgia Cotton Growers Co-operative Associa-

tion owes to all of the members of the; Association, who were
~ members the first five years, the sum of $435,317.00. The pe-

ton Growers Co- operative Association for the first five years
have an interest in this amount and are entitled to their pro
rata part.

Paragraph 10 of the prayer of the petitioners makes the

following request of the Court:

Section 10. That all of the members under said five
years contract be required to intervene herein under said
terms and conditions as the Court may prescribe or be forever
barred.

In the original By-laws of the Georgia Cotton Beavers
Co-operative Axsociation, the President of the State College
of Agriculture, the Conimissioner of Agriculture, and the Di-
rector of the Bureau of Markets were each to appoint a pub-

lie welfare director of the Association to look out for the in-

terests of the public and members in all transactions of the
Association. I am informed that just before I went into office
as Commissioner of Agriculture, the By-laws were changed

and that-at present the Governor of the Federal Reserve Bank

of the Atlanta District appoints one public director.

The official connection of the Commissioner of Agricul-
ture having been terminated by the change in the By-laws just
before I went into office, I am not familiar with any of the
transactions or the present status of the Georgia Cotton
Growers Co-operative Association, and-I have no official way

of finding out. (

PHONY PEACH DISEASE QUARAN.

TINE REGULATIONS MODIFIED

An amendment to the phony peath disease quarantine was an-
nounced today by the Secretary of Agriculture, effective November
1, The principal modification is the addition of nineteen Georgia

counties and six Alabama counties to the area previously brought |

under regulation on account of this disease. The new infections in
northern Georgia and northeastern Alabama were found by inspect~-
ors of the Federal Bureau of Plant Industry engaged in the eradi-
cation of this disease. Hee Z ah

Intensive eradication work was started in the northern and _

northwestern part of Georgia with the intention of completely elim-

inating the phony peach disease from the outlying areas of infec-
tion at the earliest possible date and extending the eradication work :
eventually to the old centers of infection in the State in, and sur-
rounding Peach, Bibb, Macon and Houston Counties. -
The work thus far has included a substantially complete sur-
vey of the commercial \orchards in the counties named in todays
amendment and many adj i 5 a
number of recent infections in these districts. The infected trees
discovered have been or are being destroyed. The bureau plans to
continue the eradication work, first, by broadening the surveys to

cover dooryard and roadside peach trees, and second, by extending

the territory inward toward the center of infection as the work pro-

gresses. a Ge
The Federal Plant Quarantine and Control Administration ,in

cooperation with the Georgia and Alabama State Department of Ag- * P

riculture, is meanwhile undertaking to prevent the spread of the di-
sase to outside points by restrictions on the shipment of nursery
stock. In order to protect the zone in which the infection is slight
and where intensive eradication operations are in progress, the reg-
ulated areas will be divided into two sections known as the generally -
infected area and the light!y infected area, respectively.

~The movement of peach nursery stock and other restricted ar- _
ticles from either area to outside points and from the generally :
infected area to the lightly infected area will be prohibited ex-
cept under permit. It is the: expectation that as the surveys con- I
tinue and the intensive eradication operations are undertaken clos- _
er to the center of infection, the lightly infected area can gradually _

be expanded to include the countries in which substantial progress

is being made toward the eradication of the disease.

The generally infected area under the amendment consists of C
Lee and Chambers counties in Alabama, and a large district in. |

central Georgia extending from Fulton and Jackson counties on the
north to Quitman, Mitchell and Laurens counties on the south. |
Except for the addition of Chambers County, Alabama, and Warren

and McDuffie Counties, Georgia, it consists of the area which has
been under regulation heretofore. The lightly infected area un-
der the newly issued amendment includes the following counties:
Calhoun, Cherokee, Cleburne, DeKalb and Tuscaloosa, in Alabama,

and Banks, Bartow, Campbell, Carroll, Chattooga, Cherokee, Cobb, :
Dade, Douglas, Floyd, Habersham, Haralson, Heard, Milton, Pauld-

ing, Polk, Walker and Whitfield, in Georgia. All these counties,

except Chattooga, are now added to the regulated area for the first
