- Description:
- In this series of WSB newsfilm clips from Jefferson, Georgia on April 9, 1969, reporter Carolyn Linden gives details of the verdict in the second trial of A. C. "Cliff" Park and interviews defense attorney Wesley Asinoff and Imogene Hoard, the widow of Floyd G. Hoard.
The clips begin with a shot of Carolyn Linden holding a microphone. She says, "There was a different jury this time, and the judge allowed the defense a closing argument this time, but the verdict was the same: guilty. A. C. "Cliff" park showed not a trace of emotion as the verdict was read, but his wife and his daughter wept. For the second time in fifteen months, a Jackson County jury had found him guilty, without a recommendation of mercy, in masterminding the 1967 dynamite murder of solicitor Floyd Hoard. The verdict took only three and a half hours, and Judge Mark Donahoo immediately set May 15th as the execution date of this 77 year old man. There were two concepts of justice here last night, defense attorney Wesley Asinoff denounced the verdict, Mrs. Hoard gave thanks."
The clips cut to a shot of defense attorney Wesley Asinoff. He says, "I'm going to continue to fight to see that Mr. Park is exonerated from this terrible charge." The frame widens and Carolyn Linden is visible, holding a microphone. She asks, "Do you plan to seek a change of venue?" Asinoff says, "Yes, I stated to the judge that I am going to first seek a reversal, and if they desire to try the case again, I am certainly going to ask for a change of venue. We asked for a change of venue this time because we felt that the jurors were prejudiced. Furthermore, we were given a hanging jury, within the meaning of the case of Witherspoon v. the State of Illinois. All those persons who were conscientiously opposed to capital punishment were excluded from this jury. This is in direct violation of the case of Witherspoon v. Illinois, and another case that was just handed down by the Supreme Court of the United States on Tuesday of this week, and, for this reason, we feel that we have not had a fair trial."
The clips cut to a shot of Imogene Hoard, the wife of Floyd Hoard. From off camera, Carolyn Linden asks, "Now that this is over, could you tell us about your reaction to the verdict in this second trial?" Mrs. Hoard replies, "I'm still so pleased with the people in Jackson County. I know that they still want justice done here."
The clips cut again to a shot of reporter Carolyn Linden. She says, "Justice was done in Jackson County last night, but two trials may not be the end. This is Carolyn Linden, WSB News, reporting from the court house in Jefferson, Georgia."
