Remanded by court of appeals to U.S. District Judge William O'Kelley; Whether the City of Atlanta had the right to transfer about nine acres of park property to the DOT for the road project. Currently pending in the Georgia Supreme Court; Whether the State Department of Transportation has the power of eminent domain to condemn the nine acres of park property for the road project without the City of Atlanta's consent. Pending in the Georgia Supreme Court; Whether the federal funding of the $22 million parkway should be withdrawn because the project does not have the unconditional support of the Atlanta City Council.
