Recent cases have occurred under the act of the
23rd December 1822 authorizing the disposal of the [deleted text: the ] fractional lots of Land in the Territory lately acquired from the Creek & Cherokee Indians where the parties choosing to pay into the Treasury the whole amount of purchase money and fees have applied for Grants. I have directed them to be witheld [withheld], for the present, because it is not distinctly understood, what Fees the different officers of Government are entitled to receive in their transit through the different offices. The act before referred to (viz of the
23rd Decr. [December] 1822) is, taken singly, susceptible of but one construction, but taken in connection with other acts of the Legislature upon the same & similar subjects, it is doubtful what Fees were intended to be allowed, & so doubtful that this Department will not make any order on the subject until the Legislative will is clearly expressed.
