- This damaged document concerns a treaty (Treaty of Coweta, August 21, 1739) between James Oglethorpe, founder of the Georgia colony, and the Creek Indians, which stated in part that no nation except England had a right to receive or settle any lands that had not yet been granted by the Indians. The document refers to a portion of the treaty that attempts to prevent English intrusion on lands not yet granted. This document also mentions the possibility that the Indians could sell or give away parts of their land to individual English settlers, but due to the condition of the document it is unclear exactly what other restraints are placed on the Indians with regard to the transference of their lands.

it is said That the Spaniards nor no other nation have a right to any of the said Lands. -- & that they will not suffer them or any other persons (except the Trustees of Georgia) to settle upon [unclear text: ye ] said Land.
The first part of the above declaration must be understood to relate to the Lands not granted to the Trustees or is [illegible text] [document damaged] had granted part of [document damaged: the sd Lands ] to the Trustees in
1733, & therefore they could not say then in
1739 [document damaged] that no other Nation have a right to any of the said land, it must therefore mean the lands they had not granted to the Trustees & the Subsequent or last part of the declaration that they will not suffer them or any other persons excepting [unclear text: ye ] Trustees [document damaged] the said Land must necessarily [document damaged]
