- This is a letter dated December 31, 1835 from Robert S. Hardaway in Columbus, Georgia regarding the sale of his interest in some former Indian land to John Fontaine, a Columbus merchant, and his business partner. The land is in Russell County, Alabama, and Hardaway sold it for six hundred dollars. Hardaway states that he will sign over the contracts made with the Indians (probably Creek Indians) for the land as soon as the federal government approves the sale; he agrees that, should the government not approve the transaction, he will refund the amount of the sale. It is not clear to whom the letter was directed.

Decr [December] 31st 1835
I have sold to Stewart and Fontaine my Interest in the South half [added text: of Section ] thirty one eighteen Township and [unclear text: thirtieth ] range the S/2. 19. 18.30 and the S/2 20. 18. 30 it being the half of the above named half sections of Land lying in Russell County Alabama for Six hundred dollars the other half belonging to said S. [Stewart] & F [Fontaine] in a joint purchase and certified in my name Now I [unclear text: gree [agree] ] that I will assign over the contracts with the Indians for the above Land so soon as the assent of the President of the United States is obtained with the Indians but in case the assent of the President is withheld I agree to refund the above amt [amount] of six hundred dollars with Interest thereon Given under under my hand And seal the day and date above written
