DEAR SIR: In compliance with law I have the honor

to submit herewith the annual report of this department

showing the transactions of the State Treasury for the

fiscal year ending December 31, 1913.

At the close of business on December 31st, 1912, the

date of the last report from this office, the

balance in the Treasury was

$1,113,517.31

Since that date we have received and certi-

fied to the Comptroller-General, as shown

by table I. of this report, the sum of

of the State which have not yet matured, and shall be applied to no other purpose whatever."

TEMPORARY LOAN.
As you are aware, it became necessary during the present year, as it has for several years past, for the State to negotiate a temporary loan to meet the increased demand upon the Treasury caused by excess of appropriations over the annual revenue received.
The excess of appropriations has gradually grown larger each year, which, for lack of a corresponding increase in revenue, has so enlarged the annual deficit in the Treasury that it was deemed expedient to increase the borrowing power of the Governor so as to authorize a loan of $500,000, instead of $200,000, as heretofore, to meet the "casual" deficiency thus brought about. As there is nothing casual about the deficit in the Treasury, it being altogether foreseen and premeditated and to be expected as a natural result of spending more than we receive, the remedy adopted of increasing the temporary loan will only afford temporary relief, and the deficit will continue to occur, unless your earnest recommendations to the Legislature of confining appropriations strictly within the revenue received by the State, is adopted.
Under the law as amended we borrowed $475,000, which was immediately used, every dollar of it, in paying, as far as it would go, the appropriation to the public schools for the present year.
As soon as it was known that the State needed temporary assistance to meet her obligations, the following named National banks of this city immediately volunteered to furnish the necessary funds at the very low

At the beginning of the year there were 685 banks in active operation. During the year 19 banks have been chartered and 3 Branch banks have been opened by the parent banks, also one trust company that is now conducting a banking business has been added to our list of State banks during the year. Seven banks have liquidated, namely, Merchants & Farmers Bank, Claxton; Rabun County Bank, Clayton; Bank of Randolph, Cuthbert; Newton Banking Company, Griffin; Palmetto Banking Company, Palmetto; Citizens Bank, Union City, and the Exchange Bank, Waycross.
Citizens Bank and Planters Bank, Camilla, consolidated under the name of Planters & Citizens Bank, Camilla; Farmers State Bank, Dexter, consolidated with the Dexter Banking Company; Exchange Bank, Rome, merged or consolidated with the Exchange National Bank of Rome; American State Bank, Fitzgerald, merged or consolidated with National Bank of that place; Bank of Fairmount was sold to the Fairmount Bank, which began business under a new charter.
The First State Bank, Dawson, reopened for business September 15, 1913, under Legislative charter; Cordele Banking Company, Cordele, changed its name to Farmers State Bank, Cordele; American Bank & Trust Company of Rome changed its name to State Bank of Rome.
The Citizens Bank, Newington, branch of the Citizens' Bank of Sylvania, discontinued business and paid off all depositors through the parent bank.
A temporary receiver was appointed by the Court for the City Savings Bank, Atlanta. We are advised by Mr.

m the Fulton Superior Court, and that they agreed to pay all depositors dollar for dollar. We are further advised that depositors are receiving their money through the Empire State Bank of Atlanta.
Receivers were appointed for the Peoples Bank of Hartwell and the Bank of Senoia.
Our Examiner made an investigation of the Irish American Bank of Augusta, and found its affairs in such tangled and unsatisfactory condition, that its officers decided to place same in our hands, which was done and a skillful accountant placed in charge. His report was not completed in time to include in this report.
This leaves 693 banks in active operation, including 24 branches.

The law requires the State Bank Examiner to set iorth in his annual report any amendments to the banking laws, by which, in his judgment, the svstem may be improved and the security of depositors increased
It has been evident for several years that our bank aws were defective and inadequate to the proper protection of the depositing public.

have failed to. impress the Legislature as being of suf-

ficient importance to authorize any action, and we are

left with the present inadequate and defective laws as

the only means for the protection of the large and an-

nually increasing interest of the people against unsound

and hazardous banking methods indulged in by some banks in this State, which are permissible under present laws.
The State has held out for several years, that deposits in banks, chartered by the State, would be carefully looked after and safeguarded by good laws, which would afford the necessary protection of tbeir interests. Semi-annual examinations were required, and other means in the way of audits by the directors, and quarterly statements to be published were provided for that purpose. The authority was given to employ the necessary clerks and examiners to have the work properly done, who were to be paid by a system of fees authorized to be assessed against the banks, but which were so regulated and restricted by the Act that they have never afforded the means to employ the number of examiners and clerks, necessary to make the service efficient. With seven hundred banks to examine twice annually, which involves a great deal of office work in the way of continual daily correspondence, checking, filing, bookkeeping, etc., it can be readily seen that the five examiners and one clerk, permissible under the law, are entirely too few in number for the purpose intended. We need at least eight examiners and two office men to afford the service and protection which the depositing public have the right to expect.
In; addition to the inadequate provision made for efficient Nservice and thorough examinations, there are other and more serious defects in the laws. The most serious, and I might say the most disastrous, to banks and their creditors in this State is the right they have under the present law to concentrate their entire capital and surplus into single loans, which are generally made to bank officials, or a firm, or some outside enterprise in which they are interested. This defect, which permits

A small increase in the fees for examinations to enable the Department to employ more examiners and the clerks necessary to make the service more thorough.
Limit the amount of any loan to an individual, firm or corporation to ten per cent, of a bank's capital.
Limit the power of a bank to borrow money to an amount not to exceed its paid-in capital stock.
Require the reserve to be in cash and such State and municipal bonds of this State as may be worth not less than par.
Eequire bonds from all employees of the bank who handle the bank's funds.
Restrict directors and employees from overdrawing their accounts.

DEAR SIR : We acknowledge receipt of your favor of the 2nd, and complying with your request take pleasure in enclosing herewith statement of the Neal Bank, as under date of February 1st. Since filing our report a year ago, we wish to advise that depositors have been paid a dividend of 3y2 per cent., which was declared under date of November 20th, 1913.
With reference to the statement which we are sending you, we wish to say that item of loans and discounts, amounting to $628,986.24, covers very little collectible paper outside of paper held in connection with the Cuban property. At this time the Receiver sees no immediate prospects for disposing of this property, although continued efforts are being made to do so. The item of real

DEAR SIR : In accordance with your previous request, I enclose a statement of the defunct Athens Trust and Banking Company. This statement, however, conveys no real information as to the condition of this bank, because it shows the assets at their face value.
So far, I have been able to pay only a 15 per cent, dividend to depositors and creditors. I have paid preferred claims amounting to $15,000. Very little can be collected on the assets which I now have, and I doubt if I will be able to pay over a 5 per cent, or 10 per cent, dividend from these assets.
In the near future I will be compelled to file a bill against the stockholders in order to collect sufficient amount to pay the depositors.

5th. The Superior Court of Eichmond County, Georgia, heretofore directed the payment of a dividend equivalent to 20 per cent, of the liabilities and of the amount James P. Armstrong, as Eeceiver, disbursed $30,556".i4.
There remains still to be paid on account of the dividend the sum of $4,310.99. It is now impossible to pay the balance of said dividend so ordered by the Court, for the reason that the present Eeceiver has not sufficient funds so to do, and his predecessor, who was removed from his trust by the Court, has been adjudicated a bankrupt, and fails and refuses to pay over the amount in his hands as such Eeceiver as aforesaid.
Proceedings are now pending against the said Eeceiver and the surety on his bond to collect the amount due from him.
6th. The Eeceiver is of the opinion that he can effect a collection of the entire amount due from his predecessor. He can now give no accurate estimate of the value of the uncollected bills receivable, but is disposed to the opinion that he can and will collect about 10 per cent, of the face value of same. The amount so to be collected, together with the cash in his hands, "the real estate in possession of the Eeceiver and the funds to be recovered from his predecessor, should yield an aggregate sum for further distribution of $33,141.54, if estimate of collection of 10 per cent, on present bills receivable is accurate.
This amount is to be applied to the payments of the balance of indebtedness now outstanding, to wit, $156,228.31, or a further and final dividend of approximately 15 per cent., after allowance for administrative expenses and balance over owing on first dividend. The amount to

be derived from future collections is, however, a mattr of surmise. All of which is respectfully submitted.

_ DEAR SIR: AS Beceiver of the Bank of Senoia, Senoia, Ga., I beg to submit the enclosed report of condition of the bank on December 3rd, 1913:
I beg to call attention of differences in accounts of . $636.33, as shown in the statement. The various accounts
representing these differences were so shown on the books of the bank. i .^/tt0TM^ fees of $317.21 have all been paid on claims held by the Southern Securities and Financing Co of Monticello, Ga., as collateral security on their notes I beg to advise that the bills payable of the bank have been practically all paid. I have been unable to obtain a statement from the Southern Securities Co. showinbalance due. I will be in position to liquidate bills payable when I can secure this statement.
I feel confident that I will have sufficient funds to pay depositors in full in about thirty to sixty days.
There is a claim of about $12,000.00 against the Senoia Duck Mills, including the $600.00 paid by me for the property at Sheriff's sale. At a meeting of the stockholders recently it was agreed and signed by all stockholders present, and many since that time, that the stock holders would take over the property of the Senoia Duck Mills as a part payment on their stock. This payment will amount to 40 per cent, on each share of stock. I
feel that by proper management the stockholders should realize full returns on their investment in this property

and further that they should receive a substantial diyident from the remainder of the assets of the bank.
