The Office of Leglslatlve Counsel drafted a total of 3,869 bllls, resolutions and amendments for the 1977 session. Of thls number, 983 had been prepared by the convening date of the session, leaving a total of 2,886 which were drafted during the sesslon.

FOREWORD
This booklet contains a summary of the general statutes of Statewide application which were enacted at the regular 1977 Session of the General Assembly of Georgia. No resolutions, "population" Acts, or Acts with special application have been included.
It would be impractical to minutely analyze each statute because to do so would defeat the main purpose which it is hoped this booklet accomplishes. It is intended that it be used as a convenient reference for persons desiring to know which laws were enacted or desiring to ascertain the main features of an Act without the necessity of reading it in its entirety. It should be pointed out that for specific, detailed information on any particular law, the Act itself should be examined. A notation of the effective date is listed after each Act.
This summary is not to be deemed in any manner as an opinion from the Office of Legislative Counsel, and the question of constitutionality has not been considered in any respect. It is hoped that this booklet will benefit all who have occasion to use it and comment and suggestions for improvement are invited.

The page numbers showing where the Acts may be found in the bound volumes of the Georgia Laws are omitted on the summary this year. This will enable us to distribute the summary approximately a month earlier than in previous years. Inasmuch as the Acts are published in the Georgia Laws in numerical order, it will be relatively easy to find the desired Act by checking the Act number at the beginning of each Act listed in this summary. All the Acts contained in this summary should be found in Volume I of the 1977 Georgia Laws. Once the bound volumes are distributed, there will be no problem in finding a particular Act because those volumes contain a listing of the Acts in numerical order with the page numbers on which they may be found.

AGRICULTURE
Act 103; H. 8 . 5 5
Amends the 1976 Act regulating grain dealers, so as to exempt from the licensing and bonding provisions those grain dealers who are licensed and bonded in accordance with the Georgia State Warehouse Act; requires surety bonding for each physical location of graindealing activity utilized by a grain dealer operating in multiple locations. Effective March 4, 1977.
Act 161; S. 8 . 4 2
Revises Code Chapter 62-12, relating to the suppression and prevention of hog cholera; provides that it shall be unlawful to use, possess, sell, offer or hold for sale, deliver, distribute or introduce or deliver for introduction into commerce hog cholera vaccine, serum or virus in this State; provides that the Commissioner of Agriculture shall seize and destroy any hog
1: cholera vaccine, serum or virus found in this State. Effective March 11,1977.
Act 87; S. B. 38
Amends the 1953 Act prohibiting the feeding of garbage to swine, so as to provide that persons, firms, partnerships, corporations, associations, agencies, departments or other political subdivisions of the State, or otQer entities negligently or intentionally providing garbage or sources of garbage to those found to be feeding garbage to swine in violation of such Act shall be deemed culpable and responsible for the violative acts of feeding just as are the actual feeders of the garbage. Effective February 25, 1977.
Act 360; S. B. 195
Amends the 1969 "Georgia Meat Inspection Act", so as to exempt from the requirements of said Act the slaughter and processing of rabbits by any person who raises rabbits for slaughter and processing for sale at wholesale and retail in numbers not to exceed 500 rabbits per year. Effective March 23. 1977.

Amends the 1960 Act regulating the sale of leaf tobacco, so as to provide that any person, firm or corporation purchasing flue-cured tobacco from producers other than at auction sales shall obtain from the Commissioner of Agriculture a nonauction tobacco dealer's license prior to engaging in such purchase operations. Effective February 18, 1977.
Act 164; H . 6 . 2
Amends the 1953 "Georgia State Warehouse Act", so as to provide a maximum surety bonding requirement of $100,000 for each warehouse licensed pursuant to the Act; limits coverage of the Act to warehouses storing agricultural products. Effective March 11, 1977.
ALCOHOLIC BEVERAGES
Act 726; S. B. 298
Amends Code Section 58-607, so as to change the provisions relating to the sale of alcoholic beverages near the Central State Hospital; repeals Act No. 30 (S. B. 106), passed at the regular 1977 session of the General Assembly, which Act amended Code Section 58-607. Effective July 1, 1977.
Act 30; S. 6. 106
Amends Code Section 58-607, so as to repeal the provisions prohibiting, exposing for sale, selling, bartering or giving away alcoholic, vinous, or fermented liquors within a distance of two miles from the Milledgeville State Hospital buildings. Effective July 1, 1977.

Amends Code Section 58-207, relating to contraband used in violation of liquor laws, so as to provide that the agency, State, county or munic-

ipality seizing any contraband article is authorized to use any vessel, vehicle, aircraft or other conveyance for covert police activity for a period up to 60 days prior to the sale of the vessel, vehicle, aircraft or other conveyance; provides that no vessel, vehicle, aircraft or other conveyance shall be utilized for covert police activity prior to final judicial adjudication of lawful seizure. Effective March 23, 1977.
Act 315; H. 6.725
Authorizes the governing authority of each municipality and each county in which the sale of distilled spirits or alcoholic beverages for beverage purposes by the drink is permitted to impose, levy and collect an excise tax upon the sale of such beverages, not exceeding 3% of the charge to the public for such beverages; provides for restrictions, practices and procedures; amends the 1951 "Georgia Retailers' and Consumers' Sales and Use Tax Act", so as to repeal 'the provisions prohibiting such taxes; provides :hat no ordinance or regulation imposing such tax shall become effective before May 1, 1977. Effective March 23, 1977.
Act 339; H. B. 1047
Amends the 1938 "Revenue Tax Act to Legalize and Control Alcoholic Beverages and Liquors", so as to provide that no initial license to sell distilled spirits or alcoholic beverages shall be granted by the State Revenue Commissioner until the applicant has exhibited a license granted by the municipality, if the place of business is within a municipality, or by the governing authority of the county if the place of business is outside a municipality; changes the provisions relating to annual renewal of licenses; provides for the refund of license fees oy municipalities or counties if the State Revenue Commissioner denies application for a license. Effective March 23, 1977.
Amends the 1935 Act providing for license ~ n edxcise taxes upon the business of dealing in nalt beverages, so as to authorize the State

Revenue Commissioner to issue refunds or credits for malt beverage taxes paid by or due from a wholesaler under certain circumstances; amends the 1937 Act relating to the manufacture, sale and taxation of wine, so as to authorize the State Revenue Commissioner to issue refunds or credits for wine taxes paid by wholesalers under certain circumstances; amends the 1938 "Revenue Tax Act to Legalize and Control Alcoholic Beverages and Liquors", so as to authorize the State Revenue Commissioner to issue refunds or credits for stamps purchased by a manufacturer, distiller, or wholesaler under certain circumstances. Effective March 30, 1977.
Act 723; H. B. 776
Provides that within all consolidated governments of this State within the limits of which the sale of alcoholic beverages, distilled spirits, malt beverages and wines is locally authorized, such sales for consumption on the premises shall be authorized, at the discretion of the governing body of such consolidated government, at any time from 11:55 o'clock p.m. on Saturdays and the two hours immediately following such time. Effective April 5, 1977.
Act 356; S. B. 127
Amends the 1938 "Revenue Tax Act to Legalize and Control Alcoholic Beverages and Liquors", so as to authorize the sale of distilled spirits, malt beverages and wine on Sunday between the hours of 12:30 p.m. and 12:OO midnight in public stadiums, coliseums and auditoriums having a seating capacity in excess of 12,000 persons and in certain eating establishments in counties having a population of 600,000 or more. Effective March 23, 1977.
Act 745; H . B. 746
Adds a new Code Chapter 58-8, known as the Wine Tax Law, so as to comprehensively and exhaustively revise, supersede and consolidate laws relating to the collection and administration of wine taxes. Effective April 8, 1977.

Amends the .I969 "Development Authorities Law", so as to change the definition of the word "project" to include sports facilities, convention or trade show facilities, airports, docks, wharves, mass commuting facilities, parking facilities, facilities for the local furnishing of electric energy or gas, facilities for the furnishing of water and facilities for lodging and for providing meals, and industrial programs. Effective March 23, 1977.

Provides a supplementary appr'opriation to the Georgia Building Authority, through the Department of Administrative Services, for the remainder of the fiscal year ending June 30, 1977. Effective January 18, 1977.
Act 110; H. B. 227
Amends the 1974 "Georgia Residential Finance Authority Act", so as to change the definition of "federally-aided mortgage" and I "lending institution"; defines "authorized officer"; changes the provisions relating to ex officio members; repeals certain provisions relating to State appropriations. Effective July 1, 1977.
Act 262; H . B. 228
Amends the 1974 "Georgia Residential Finance Authority Act", so as to change the powers of the Authority; provides for the certificate of validation on bonds of the Authority; authorizes the Authority to reimburse the district attorney for his actual costs associated with bond validation proceedings. Effective July 1, 1977.

The "lndian Housing Authority Law" creates, with respect to each lndian tribe in this State, a public body corporate and politic, to be known as the "lndian Housing Authority" of said lndian tribe with the same powers, rights and functions specified for housing authorities in the 1937 Housing Authority Law; provides that this Act shall stand repealed on July 1 , 1978. Effective March 23. 1977.

Amends the 1955 Act creating the Savannah Port Authority, so as to authorize the Authority to construct, acquire, own, repair, remodel, maintain, extend, improve and equip projects located on land owned or leased by persons, firms, or corporations or other entities other than the Authority. Effective February 18, 1977.
Act 380; S. B. 323
Amends the 1955 Act creating the Savannah Port Authority, so as to provide an alternative procedure for the Authority to stimulate industrial expansion and development; authorizes the Authority to construct, acquire, own, repair, remodel, maintain, extend, improve and equip property located on lands owned or leased by the Authority or on lands owned or leased by others. Effective March 23. 1977.
BANKING AND FINANCE
Act 311; H . B. 678
Amends Code Title 41A, so as to include national banks located in this State within the definition of the term "bank" for the purpose of applying Code Chapter 41A-38 relating to multiple deposits; provides that in the case of a credit union, adoption of a plan of dissolution may be made by the affirmative vote of at least twothirds of the members present and entitled to vote at a meeting duly called for that purpose; eliminates the rule that a bank may own shares of stock of a bank service corporation solely with one or more other banks; provides for the application of Code Chapter 41A-38 to minors' deposits; provides for the regulation and supervision of banks in formation. Effective July 1, 1977.

Amends Code Section 57-101. l , so as to change the maximum permissible rate of in-

terest on certain transactions involving real property from 9% to 10% per annum. Effective April 1, 1977.
Amends Code Section 57-116, so as to provide that such loans may be repaid in weekly, monthly, quarterly, semiannual or yearly installments; changes the provisions relating to the rate of interest and the calculation thereof; provides that such loans shall not be subject to the provisions of the Georgia Industrial Loan Act. Effective March 23, 1977.

Amends the 1955 "Georgia Industrial Loan Act", so as to increase the monthly maintenance charge from $1 to $2; repeals the provision which requires that any such monthly ' maintenance charge shall be clearly disclosed : in writing on said loan contract. i Effective July 1, 1977.

Act 323; H. B. 771
Amends Code Section 81-1402, so as to authorize continuance of cases in any trial court when any party or his attorney is absent by reason of his membership in the General Assembly during the first three weeks im, mediately following any session adjourned sine die. Effective March 23, 1977.
Act 3; H. B. 19
Amends Code Title 46 so as to revise the provisions relating to post-judgment garnishment; provides for affidavits, notices and tolling of time limits. Effective January 27, 1977.
Act 335; H. B. 973
Amends Code Section 46-509, so as to change the time within which motion must be

filed from one year from the date any judgment so obtained is entered on the General Execution Docket, to no later than sixty days from the date garnishee receives actual notice of the entry of such judgment against garnishee; provides that notice to the garnishee by certified mail shall be sufficient notice as required in this Section; provides that the amount of the judgment shall not be reduced below an amount equal to 15% of the principal amount of the judgment against the defendant or $200, whichever is greater. Effective July 1, 1977.

Amends the 1966 Act providing for personal

jurisdiction over any nonresident, or his ex-

ecutor or administrator, as to a cause of action

arising from the transaction of business within

this State, or the commission of a tortious act

within this State or owning, using or possessing

real property situated within this State, so as to

provide that the term "nonresident" shall also

include an individual, partnership, association or

other legal or commercial entities (other than a

corporation) who, at the time a claim or cause of

action arises, was residing, domiciled,

organized or existing in this State and subse-

quently becomes a resident, domiciled,

organized or existing outside of this State as of

the date of perfection of service of process; ap-

plicable to all act~onspending upon the effective

date and to all actions subsequently filed.

Amends Code Section 67-2002, so as to change the provisions relating to the filing for record of a claim of a mechanic's or materialman's lien; provides for notice of commencement of legal actions on claims of liens; provides that the provisions of this Act shall not be applicable to any obligation created prior to the effective date of this Act. Effective March 23, 1977.

Act 191; H . B. 321
Amends Code Title 22, so as to require that corporate names not contain any word or phrase which indicates or implies anything which is obscene; permits domestic corporations which are precluded from use of corporate names in another State because such names are the same as or confusingly similar to that of a corporation already authorized to transact business therein, or to a name already reserved or registered in such state, to amend its articles of incorporation to add to its corporate name, solely for use in such other state, a word, abbreviation, or other distinctive and distinguishing element; provides for written consents by registered agents; provides requirements for articles of incorporation; changes the provisions relating to plans of merger or consolidation; changes the fees paid to a publisher for advertising; changes the date for filing of annual reports by Secretary of State corporations from the first day of November to the first day of April. Effective March 11, 1977.

Adds a new Code Chapter 22-19, so as to provide for full and fair disclosure in connection with takeover bids made for securities of certain domestic and foreign corporations. Effective March 23, 1977.

Adds a new Code Section 108-610, so as to provide for the merger of a trust created under Code Chapter 108-6 into a domestic corporation for profit; provides for procedures; provides for the filing of articles of merger with the Secretary of State and the issuance of a certificate of merger. Effective March 23, 1977.

Amends Code Chapter 23-4, so as to change the procedures and proceedings for settling disputed county lines; provides for surveys by

land surveyors; changes the provisions relating to the compensation of land surveyors and their expenses. Effective March 4, 1977.
Act 357; S. B. 152
Amends Code Section 92-3701, so as to provide that county taxes may be levied and collected to provide for financial assistance to local county development authorities for the purpose of developing trade, commerce, industry and employment opportunities. Effective March 23, 1977.
COURTS
Act 249; H. B. 166
Adds a new Code Section 24-3902, so as to provide that the Supreme Court of this State may receive and answer certificates as to State law from federal appellate courts. Effective July 1, 1977.
Provides that, pursuant to Article VI, Section II, Paragraph IV of the Constitution, the Court of Appeals shall have jurisdiction of the trial and correction of errors of law in cases involving the crimes of armed robbery, rape and kidnapping wherein the death penalty has not been imposed; provides that the Supreme Court shall have jurisdiction of the trial and correction of errors of law in cases involving State revenue, contested elections and the validity of legislative enactments of municipalities. Effective July 1, 1977.

Provides that it shall be unlawful for any person to transmit, in any manner, a request for ambulance service to any person, firm or corporation furnishing such ambulance service, public or private, knowing at the time of making such request for ambulance service that there exists no reasonable need for such ambulance service; provides for misdemeanor penalties. Effective March 23, 1977.

Amends Code Section 26-1704, so as to provide what constitutes prima facie evidence of the criminal issuance of a bad check; provides for service charges, notices and immunity; provides what evidence constitutes prima facie evidence of identity of certain parties issuing instruments. Effective July 1, 1977.

Amends Code Section 26-1601, so as to provide that a person commits burglary when, without authority and with the intent to commit a felony or theft therein, he enters or remains within any railroad car or aircraft. Effective July 1, 1977.

Amends Code Section 26-2703, so as to provide that a person convicted of commercial gambling shall be punished as a felony, and shall be punished by imprisonment for not less than one nor more than five years, or by a fine not to exceed $20,000 or both. Effective July 1, 1977.

Adds a new Code Section 26-1710, so as to prohibit fraudulently obtaining or attempting to obtain public housing; provides for misdemeanor penalties; provides for notices. Effective July 1, 1977.

Adds a new Code Section 26-2022, so as to create the crime of necrophilia; provides that a

person commits necrophi'lia when said person performs any sexual act with a dead human body involving the sex organs of the one and the mouth, anus, penis, or vagina of the other; provides for imprisonment for not less than one nor more than 10 years. Effective March 11, 1977.

Adds a new Code Section 26-1710, so as to provide that it shall be a misdemeanor to make certain false statements in connection with telephone solicitations; amends Code Section 26-3201, so as to provide that a person convicted of criminal conspiracy to commit a felony shall be punished by imprisonment for not less than one year nor more than one-half the maximum period of time for which he could have been sentenced if he had been convicted of the crime conspired to have been committed, by one-half the maximum fine to which he could have been subjected if he had been convicted of such crime, or both; provides for punishment as a misdemeanor; provides that a person convicted of criminal conspiracy to commit a crime punishable by death or by life imprisonment shall be punished by imprisonment of not less than one year nor more than ten years. Effective March 23, 1977.

Adds a new Code Section 26-2909.1, so as to provide that it shall be unlawful for any person to fire or discharge a firearm on the property of another person, firm or corporation without having first obtained permission from the owner or lessee of such property; provides for exceptions; provides for misdemeanor penalties. Effective July 1, 1977.

Amends the 1967 Act providing for the confiscation and destruction of weapons used in the commission of a crime, so as to provide for the confiscation and destruction or sale or delivery of weapons used in the commission of the crime of carrying a concealed weapon. Effective July 1, 1977.

Act 381; S. 6.325
Adds a new Code Section 27-211. l , so as to provide for procedures subsequent to an arrest by a private person. Effective July 1, 1977.
Act 203; H. 6. 704
Amends Code Section 27-418, so as to provide that no person shall be imprisoned under a felony commitment when bail has been fixed if such person tenders and offers to give bail in the amount fixed with surety acceptable to the sheriff of the county in which the alleged offense occurred; requires sheriffs to publish and post written rules and regulations defining acceptable sureties; provides that sheriffs may not prohibit the posting of property bonds but may require a cash reserve and property for the operation of professional bondsmen. Effective March 11, 1977.

Amends Code Section 27-1402, so as to provide that upon failure of any principal in any bond or recognizance given by a person charged with a penal offense to appear before the court at the time fixed for his arraignment, the prosecuting attorney may proceed to forfeit such bond or recognizance. Effective July 1, 1977.

Effective July 1, 1977.
Provides that each person employed as a teacher in any public school shall be allowed a leave of absence without loss of pay, and without deduction of any amounts otherwise received as compensation for service as a teacher, for the purpose of attending upon any court as a juror; provides that jury leave shall not be deducted from sick, personal or professional leave. Effective July 1, 1977.

Amends the 1953 Act providing for sick leave for teachers in the public schools, so as to provide that unused sick leave shall be accumulated from one school year to the next up to a maximum of forty-five days; provides for the transfer of accumulated sick leave when a teacher changes employment to another local board of education; amends the 1974 "Adequate Program for Education in Georgia Act", so as to change the provisions relating to the amount of funds needed for the payment of sick and personal leave expenses. Amends Code Section 34-1405(a), so as to provide that the superintendent shall, as soon as practicable prior to each primary or election, prepare or obtain and deliver an adequate supply of official absentee ballots, envelopes and other supplies as required, to the board of registrars for use in the primary or election. Amends Code Section 34-1405, so as to provide that absentee electors whose names appear on the master list may be challenged by any elector prior to closing of the polls on the day of the primary or election; amends Code Section 34-1407(b), so as to delete certain provisions relating to the challenge of absentee ballots and provides that in those districts in which voter recorders are used, such absentee ballots shall be taken to the tabulation center or other place designated by the superintendent, and the official receiving such absentee ballots shall issue his receipt therefor. Amends Code Section 24A-301, so as to provide that the juvenile court shall have exclusive original jurisdiction over juvenile matters and shall be the sole court for initial action involving any proceeding for the termination of the legal parent-child relationship, except that in connection with adoption proceedings under Code Chapter 74-4 the superior courts shall have jurisdiction to terminate the legal parent-child relationship and the rights of the putative father; amends Code Section 24A-3201(a)(3), so as to provide that a juvenile court by order may terminate the parental rights of a parent with respect to his child if the written consent of the parent acknowledged before the court has been given: provided, however, that acknowledgement before the court is not necessary where the parent(s) voluntarily surrenders the child for adoption as provided by Sections 74-403 through 74-406. Effective July 1, 1977.

Amends the 1943 Act establishing the Teachers' Retirement System, so as to change the provisions relating to regional and county librarians and clerical personnel of such libraries; authorizes such librarians and personnel who were members of a local retirement system on January 1, 1977, to elect to remain members of such local retirement system. Amends Code Title 95A, the Georgia Code of Public Transportation, so as to repeal Code Section 95A-206, relating to financial assistance for mass transportation; adds a new Code Chapter 95A-13, relating to mass transportation; authorizes the Department of Transportation to provide assistance for mass transportation facilities; provides for the procedures for applications for financial support and project grants; provides for designation of travel lanes on State highway system roads for the exclusive or preferential use of buses or passenger vehicles occupied by two or more persons. Effective July 1, 1977.
