ADMINISTRATIVE OFFICE OF THE COURTS
The Research Review is designed to present the annual statistics and focus on specific areas of interest concerning the workload of the Georgia Courts. This year we are highlighting percentage change in superior court filings; selected state court case types; and juvenile court drug, unruly, and deprived charges. Also, municipal court data has been added this year. We hope this publication will enhance your understanding of the caseload data.
SUPREME Supreme Court Caseload
Case filings between 1999 and 2000 increased 3%.
Applications for Appeal increased 15% between 1999 (560) and 2000 (645).
Attorney Disciplinaries decreased 15% between 1999 and 2000.
As in 1999, Direct Appeals, Petitions for Certiorari, and Applications for Appeal, each, account for approximately 30% of Supreme Court filings in year 2000.

SUPREME Supreme Court Caseload
The court disposed of 107% of filings in 2000.
Discretionary Application dispositions show a 41% increase between 1999 (196) and 2000 (274).
Interim review and emergency motion dispositions held constant between 1999 and 2000.
Six percent of Petitions for Certiorari, two percent of Habeas Corpus, and eleven percent of Discretionary Applications were granted in 2000.

In 2000, there were 3,434 cases filed, compared to 3,359 in 1999, which represents a 2% increase.

Total dispositions increased 1% between 1999 and 2000.
Appeals filed increased from 2,521 in 1999 to 2,596 in 2000.
Dispositions by Non-Published Opinions increased 29% and dispositions By Order or Rule 36 increased 28% between 1999 and 2000.

SUPERIOR Superior Court Caseload
Of the 343,167 cases filed in 2000, 333,367, or 97%, were disposed. Cases disposed between 1999 & 2000 increased by 5%. Domestic relations filings comprised the largest percentage of 2000 filings (44%). Civil cases are 61% of filings and criminal cases are 39%. Dispositions increased 8% between 19962000, while filings increased 5%.

State Court reporting is dependent on voluntary submission of information by the clerk of court.
In 2000, 59 of the 68 counties with state courts reported (87%) compared to 78% in 1999.
Traffic cases represent almost two-thirds of state court filings.

JUVENILE Juvenile Court Caseload
Juvenile court reporting is voluntary, therefore, reporting is not complete. The number of courts and the specific ones reporting affects the data displayed each year.
In 2000, 128 of 159 courts reported caseload, compared to 146 of 159 courts reported in 1999.
Filings decreased from 125,234 (1999) to 118,765 (2000). This decrease is probably due to a smaller number of courts that reported.
Delinquent cases (49%) are the majority of juvenile court filings.

Nineteen counties provided more specific information about the charges filed in their courts in calendar year 2000: Bartow, Camden, Chatham, Cherokee, Clayton, Cobb, Coweta, Dawson, Dougherty, Fayette, Fulton, Hall, Henry Murray, Newton, Troup, Walton, Ware, and Whitfield.
These counties represent 37% of the state 2000 population and had 66,926 charges filed during the year. Delinquent drug related charges represented 3.9% of these charges, deprived 12.6%, and unruly 8.5%.

The type and number of charges making up these three categories is shown in the following charts and tables. In some instances, counties did not provide information about the subcategories so there is an "other" or "unspecified" category in the chart or table. For instance, one court did not provide information about truancy and three courts did not provide information about ungovernable charges, so these types of cases are included in the "other" or "unspecified" cases for those counties. For deprived cases, several courts did not separate abused, abandoned, and without parental or guardian's control charges. In drug cases, a large number of the cases were identified as VGCSA (violation of the Georgia Controlled Substances Act) without further detail as to the type of offense.

SELECTED COUNTY CHARGE DATA 2000
Charges of being without parental or guardian's control comprised the great majority of deprived charges (65%).
Specific charge descriptions were not provided for about 37% of the drug related charges, these were identified only as violations of the Georgia Controlled Substances Act. Marijuana possession charges were 32% of the drug charges specifically identified in detail.
Possession/sale of drugs near public parks, housing and schools were a significant number of the drug related charges reported (252 or 10%).

PROBATE Probate Court Caseload
Reporting is dependent on voluntary submission of information by the court.
Probate civil filings decreased from 32,159 (1999) to 31,936 (2000). This decrease is most likely due to a decrease in the percentage of counties reporting. Sixty percent of counties reported in 2000 compared to 62% in 1999.
Ninety-two probate courts have criminal case jurisdiction. In 2000, 52% of counties handling probate criminal cases reported filings compared to 47% in 1999.
In 2000, probate filings were 43% of all civil filings.

In 2000, probate court criminal dispositions increased 9% to 103,782 from 95,384.
In 2000, 97% of criminal filings were traffic filings; 3% were other misdemeanors.
Less than 1% of the criminal dispositions were bench trials dispositions; 64% were guilty pleas.

Between 1999 and 2000, warrants & filings increased 8%, while hearings and dispositions increased 3%.
As in 1999, warrants comprised the largest percentage (36%) of Magistrate Court filings in 2000.
As in 1999, foreclosures comprised the smallest percentage (2%) of Magistrate Court filings in 2000.
There were 228,027 criminal preliminary hearings held in Magistrate Court.
Civil filings were 46% of total filings and criminal 54%.

Municipal courts caseload data is from 187 surveys returned from municipal courts and special courts. Cases reported are cases heard (disposed).
Traffic cases represent the majority (68%) of municipal court cases.
Ordinance cases represent the smallest percentage (8%) of municipal court cases.
A number of court responses did not include caseload data categorized by Traffic -- 20; Ordinance -- 24; and Preliminary Hearing -- 27.
