The Research Review is designed to present the annual statistics and focus on specific areas of interest concerning the workload of the Georgia Courts. This year we are highlighting tort and juvenile delinquency cases. We hope this publication will enhance your understanding of the caseload data.
SECTION I: SUMMARY DA TA
SUPREME COURT CASELOAD
There were 1,828 cases filed in the Supreme Court in 1999. Direct Appeals increased by 2% from 500 in 1998 to 509 in 1999. Attorney Disciplinaries and Bar Admissions increased 11% and 63% respectively. Petitions for Certiorari, Direct Appeals, and Applications for Appeal each comprise almost a third of the court filings.

SUPREME COURT CASELOAD
Total dispositions decreased from 2,185 in 1995 to 1,858 in 1999, representing a 15% decline. Major contributions to the decline in dispositions included a 19% decrease in Petitions for Certiorari and a 36% decrease in Habeas Corpus. Appeals dismissed increased by 11% from 1998 to 1999.

In 1999, there were 3,359 cases filed, compared to 3,366 cases filed in 1998.
In 1999, there were 3,331 disposed, compared to 3,314 disposed cases in 1998, resulting in a 1% increase.
The total number of appeals increased from 2,424 in 1998 to 2,521 in 1999.
Both interlocutory applications granted and transferred to Supreme Court increased 10% and 46% respectively.
Over the past five years, dispositions have been very consistent with an average of 3,465.

SUPERIOR COURT CASELOAD
Of the 334,311 cases filed in 1999, 317,062, or 95%, were disposed.
Domestic relations were 43% of all cases filed, comprising the largest percentage of the filings followed by felony and general civil cases.
Over the past five years (1995-1999), total filings in the criminal and civil cases averaged 328,813.
For the past five years, misdemeanors have comprised the smallest percentage of the filings averaging at 25,218 cases filed per year.
In 1995 the courts disposed of 290,709 cases compared to 317,062 cases in 1999. Dispositions increased by 9% over the five year period.
Open cases decreased from 174,444 in 1998 to 169,293 in 1999, representing a 3% decline.

Tort Litigation Information Extracted from Another Brick in the Wall: An Empirical Look at Georgia Tort Litigation in the 1990's

Another Brick in the Wall: An Empirical Look at Georgia Tort Litigation in the 1990's, written by Eaton, Talarico, and Dunn, explores tort litigation trends in superior and state courts. Data was collected in the superior courts between 1994 and 1997 in Bibb, Cobb, Fulton, Gwinnett, Irwin, and Oconee Counties. Additionally, data was collected from Cobb and Gwinnett County State Courts. Fulton County State Court data was obtained for 1995-1997 only.
The final data set included 25,561 tort cases filed in the state and superior courts of the six counties between 1994 and 1997. Of the 25,561 cases filed, 7,881 were filed in the six superior courts and 17,680 were filed in the three state courts.
Tort cases accounted for 5.1% of the civil filings in the six superior courts studied. Tort cases were 7.2% of civil filings in the three urban state courts.
Automobile accidents accounted for more than twothirds of all tort claims filed. They were 55.8% of tort claims filed in the six superior courts followed by: premises liability (14%), intentional torts (10.9%), professional malpractice (6.4%), products liability (3.4%), and other (9.5%). In state courts, automobile accidents were 71.9% followed by premises liability (9.2%), intentional torts (8.6%), professional malpractice (2.8%), products liability (2.4%), and other (5.1%). Automobile accident filings were a larger percentage of tort filings in the rural courts than in the urban courts sampled.
Jury trials resolved 4.3% of the tort cases disposed in superior courts and 3.6% of state court torts.
An average of 55.5% of the tort cases filed in the six superior courts in 1994-1996 were disposed within two years of filing. The three state courts had an average of 78.3% of tort cases being disposed within two years.
Compensatory awards were usually modest, although the awards ranged from $1 to $14,915,670. Punitive damages awards ranged from $100 to $750,000, and were awarded by judges more frequently than by jurors in both state and superior courts. Plaintiffs prevailed in over 50% of the tort jury trials in both superior and state courts and in over 70% of the bench trials.
Eaton, Talarico, and Dunn found the results of this study to be consistent with those of their first study. Over the eight years of the data collected, tort claims account for less than ten percent of total civil filings. Automobile accident claims were the most prevalent type of tort, and awards were usually modest. The addition of state court filings in the second study increased previous estimates of tort filings per 100,000 persons in the Atlanta metropolitan area. Additionally in the urban counties, a greater number of tort cases were brought in the state courts than in the superior courts.

State Court reporting is dependent on voluntary submission of information by the clerk of court.
In 1999, 53 of the 68 counties reported (78%) compared to 58 of the 68 counties (85%) in 1998.
Traffic cases were 68% of all reported cases, compared to 60% of the cases reported in 1998.
In 1999, courts disposed of 552,435 of the 622,150 (89%) filed cases, compared to 553,140 of the 712,029 (78%) of disposed cases in 1998.
The decrease in open cases from 131,984 in 1998, to 87,002 in 1999, represents a decrease of nearly 34%. This decrease may be the result of some of the larger counties not reporting open caseloads.

JUVENILE COURT CASELOAD
Juvenile court reporting is not mandatory, therefore, reporting is not complete. The number of courts and the specific ones reporting affect the data displayed each year.
In 1999, 146 of 159 courts reported caseload, compared to 149 of 159 courts reported in 1998.
The caseload of superior court judges sitting as juvenile court judges was collected by the District Court Administrators, and for this number of courts the reporting is complete.
For the first time, termination of parental rights was segregated as a separate case type. Although not all counties reported terminations separately, 1,487 were reported.
Filings decreased from 129,423 in 1998 to 125,777 in 1999. This decrease may be due to a slightly smaller number of courts that reported.
Delinquent cases are 50% of all the cases filed. In 1998, delinquent cases were 51% of all cases filed. This represents an 1% decrease.
In 1999, courts disposed of 111,839 of the 125,234 cases filed. Eighty-nine percent of the cases were disposed.
The increase of open cases from 23,613 in 1998, to 25,773 in 1999, represents an increase of 9%.

DELINQUENCY OFFENSE DATA FROM SELECTED COUNTIES
This information was compiled from the data of the following eight counties: Chatham, Cherokee, Camden, Fayette, Fulton, Hall, Walton, and Whitfield.
The total estimated population of these eight counties in 1999 was 1,516,593. The total estimated population of Georgia in 1999 was 7,788,240. The eight counties represent 19% of Georgia's total estimated population in 1999.
There were 23,166 delinquency charges filed in the eight counties in 1999.
Traffic violations comprised the largest percentage of the filings (27%) with 6,313 of the 23,166 cases, followed by theft offenses (18%) with 4,079 charges filed.
Of the traffic charges filed, speeding and driving without a license were 17% and 10%, respectively.
Thirty-six percent of the theft offenses (1,461 of the 4,079 charges) were shoplifting.
Criminal trespass charges were 1,201 of the 2,493, or 48%, of property damage and intrusion charges.
Disorderly conduct (26% or 759 charges) and terroristic threats (22% or 633 charges) comprise the largest percentage of the public order and safety charges (2,901) filed in the eight counties in 1999.

Reporting is dependent on voluntary submission of information by the court.
Approximately 62% of counties reported civil filings in 1999.
Ninety-one of the 159 probate courts handle misdemeanor and traffic cases.
In 1999, 47% of counties handling criminal cases reported filings compared to 57% in 1998. The caseload reports from the Probate Courts that handle traffic and misdemeanor offenses varied significantly both in the number of courts who reported and number of quarters per year they reported.
Over the past five years, civil filings (without Marriage and Pistol Licenses) averaged 35,215 cases.
In 1999, 42% of the cases concerned Probate of Wills and 29% of the cases concerned Guardianship.

MAGISTRATE COURTS CASELOAD
The Magistrate Courts are required by Uniform Court Rule 12 to report caseload to the Administrative Office of the Courts.
In both 1998 and 1999, approximately 84% of the courts reported.
Total warrants and filings have decreased from 783,121 in 1998 to 707,595 in 1999.
Warrants were 37% of all filed cases.
Additionally, dispositions decreased from 611,189 in 1998 to 559,570 in 1999.

RESEARCH & COURT SERVICES
The Research and Court Services Division of the Administrative Office of the Courts compiles and maintains caseload and demographic data for the court system. Reports of caseload statistics and trends are available. It also prepares memoranda, surveys, assessments and evaluations either routinely or upon request. Examples are the judgeship study for superior courts, circuit boundary studies, creation of state courts, pilot court evaluations for the Judicial Council and compensation comparisons for each level of court. Other areas of expertise include case, records and jury management issues.
