Y THE GOVERNOR:

GOVERNOR'S COMMISSION ON EFFECTIVENESS AND ECONOMY IN GOVERNMENT
WHEREAS, State Government aspires to provide necessary services to all Georgians as effectively and economically as possible; and
WHEREAS, the last comprehensive study and recommendation in Georgia on this issue was conducted during the administration of Governor Jimmy Carter in 1971-75; and
WHEREAS, since that time, Georgia's economy prospered in the 1980s, and State Government grew accordingly to manage this growth; and
WHEREAS, State Government enters the 1990s hopeful for continued and expanded economic development for Georgia, but mindful of the need to prepare for periodic economic slowdown and to again comprehensively review and ensure the effectiveness and economy of State Government; and
WHEREAS, it is desired that a commission comprised of Georgia's best and brightest business and academic leaders, working with State Government and a diverse range of citizen leaders, engage in a process of study and recommendations that is comprehensive in scope;
NOW, THEREFORE, BY THE POWER VESTED IN ME AS GOVERNOR OF THE STATE OF GEORGIA,
IT IS HEREBY ORDERED:
1. That the Governor's Commission on Effectiveness and Economy in Government be created (the "Commission"); and

That the Governor shall review and have final approval authority over the recommendations of the Commission; and

3.

That the Commission consist of forty-five members or such other number as determined by the Governor and who shall be and hereby are appointed by the Governor and shall serve at his pleasure as follows:

4. That the Commission be governed by an Executive Committee which shall direct certain aspects of the Commission's policy, and shall secure resources necessary to its operation; and
5. That the Executive Committee shall consist of the following members appointed by the Governor who shall serve at his pleasure:
Virgil Williams, Chairman Bennett Brown Ronald Hogan Douglas Ivester William McCoy Robert McCullough Patrick Thomas
6. That the Commission:
a. Work in a spirit of cooperation with state Government to help maintain and improve the effectiveness and economy of state government; and
b. Meet at such times and places as deemed necessary by the Chair; and
c. Engage in a comprehensive study process to identify issues, problems and opportunities, and identify alternative solutions, select and recommend the best solutions; and
d. Prepare interim and final reports and recommendations for the Governor; and
7. That all state departments, institutions, agencies, commissions, councils, authorities, boards, bureaus, or other entities orinstrumentalities of the state, by whatever name called, are authorized and required to provide all information and support as required by the Commission to perform its study and make its recommendations; and
8. That the Chairman is authorized and empowered to establish any advisory panels or other supporting entities that he may deem appropriate; and
9. That a Commission staff, comprised of paid and loaned executives from inside and outside government, support the Commission in all phases of its work, report to and serve at the pleasure of the Chairman; and

10. That this Commission, in the interest of economy in state Government, be funded without direct state appropriations. This the 15th day of January, 1991.

JUDICIAL NOMINATING COMMISSION

WHEREAS: The quality of justice in the State of Georgia is best maintained through the appointment and election of wellqualified persons to the jUdiciary; and

WHEREAS:

It is the responsibility and duty of the Governor under Article IV, section VII, Paragraph III, of the Georgia constitution to appoint duly qualified persons to fill vacancies in the courts arising during the Governor's term of office; and

WHEREAS:

In 1972, then Governor Jimmy Carter created a process whereby a nonpartisan nominating commission was created to assist in the appointment of jUdges based upon qualifications, merit and jUdicial ability; and

WHEREAS: Since said date, every Governor has utilized such a selection process; and

WHEREAS:

At this critical point in the administration of justice in this State, the appointment of jUdges based upon qualifications, merit and jUdicial ability is of the utmost importance and the establishment of a commission charged with that responsibility is vital.

NOW THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME AS GOVERNOR OF THE STATE OF GEORGIA,

IT IS HEREBY ORDERED:
That there is created the Judicial Nominating commission for the State of Georgia. The Commission shall make nominations to fill vacancies on all courts of record which involve executive appointment.

IT IS FURTHER ORDERED:
That said Commission shall consist of nine members. Two members shall be ex-officio as follows:
President of the State Bar of Georgia Evans J. Plowden, Jr.
Attorney General Michael Bowers
Three members shall be members of the State Bar of Georgia and shall be appointed by the Governor. The Governor's State Bar appointees are as follows: Norman Underwood, L. Clifford Adams, Jr., and Gary Parker. There shall be an additional four pUblic members who shall not be members of the State Bar of Georgia and who shall be appointed as follows: two members shall be appointed by the Governor, one member shall be appointed by the Lieutenant Governor, and one member shall be appointed by the Speaker of the House. The Governor's two public appointees are: Mary Long and Meryl Alalof. The Lieutenant Governor's pUblic appointee is Noble Benefield and the Speaker's pUblic appointee is Tom Triplett. All appointed members shall serve at the pleasure of the appointing authority. At all times, the Commission shall include at least one member who is either Black, Hispanic, Asian-Pacific American, Native American, or Asian-Indian American and one woman. The Governor shall designate the Chair of the Commission and herewith designates Norman Underwood as said Chair.

IT IS FURTHER ORDERED:

That a majority of the Commission shall constitute a

quorum.

The Commission may make such rules and

regulations as it deems necessary for the conduct of its

business.

IT IS FURTHER ORDERED:

That before designating nominees to fill any jUdicial vacancy, the Commission shall hold at least one meeting

to consider recommendations regarding such nominations.

The Commission shall recommend to the Governor five

individuals which it finds qualified for each jUdiciary vacancy. If less than five are found qualified, the Commission shall recommen~ a~ many as are qualified. IT IS FURTHER ORDERED: That the members of the Judicial Nominating Commission for the State of Georgia shall not be entitled to compensation for their services on the Commission, but shall be entitled to receive reimbursement for actual and necessary expenses incurred in the performance of their duties for the Commission. Such reimbursement shall be expended from funds appropriated to or otherwise available from the Office of the Governor of the State of Georgia. This the ~day of February 1991.

WHEREAS: One of the measures of the greatness of a State is its commitment to the advancement of higher education; and

WHEREAS:

The ever-growing complexity of the issues facing the State demand that the State's institutions of higher education produce students with vision, trained to meet the technical challenges of their chosen field and of society in general, and capable of leading this State into the twenty-first century, and

WHEREAS: To meet such a challenge, an alliance between the state's political leaders and educational leaders must be forged.

NOW, THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME AS GOVERNOR OF THE STATE OF GEORGIA,

IT IS HEREBY ORDERED:

That a Higher Education Roundtable be established to discuss the needs and goals of the university system and to receive input from the executive and legislative branches of the government as to the method of attaining such goals and meeting such needs as may be agreed upon by Higher Education Roundtable members.

IT IS FURTHER ORDERED:

That the Higher Education Roundtable shall be comprised of individuals serving in the following positions:

Governor of the State Lieutenant Governor Speaker of the House of Representatives Chancellor of the University System Chairman of the Board of Regents Presidents of the Universities of Georgia,
Georgia State, Georgia Southern, Georgia Tech, and the Medical College of Georgia

IT IS FURTHER ORDERED: That such meetings of th~ Higher Education Roundtable shall be held at least quarterly at the call of the Governor.

GOVERNOR'S TASK FORCE ON TEACHER PAY FOR PERFORMANCE

WHEREAS: The State of Georgia is committed to attracting and retaining experienced teaching professionals who excel in their respective fields; and

WHEREAS: Pay based on performance plays a critical role in the attraction and retention of such qualified teaching professionals; and

WHEREAS:

Pay for performance for teachers is properly the sUbject of an intensive study by a task force comprised of educators, legislators, businessmen, state officers and others.

NOW, THEREFO~E, PURSUANT TO THE AUTHORITY VESTED IN ME AS GOVERNOR OF THE STATE OF GEORGIA,

IT IS HEREBY ORDERED:

1. That the Governor's Task Force on Teacher Pay for Performance ("Task Force") be and hereby is established for the purposes of:

a. Developing and recommending a pay for performance program which would reward those teachers who have demonstrated excellence in their respective teaChing field; and

b. SUbmitting a written report to the Governor no later than December 31, 1991 summarizing their findings and recommendations and detailing any legislative action which might be required to implement such measures.

-IT IS FURTHER ORDERED:
1. That the Task Force shall be comprised of 13 members:
a. Appointees of the Governor:
1. Four members who shall be professional educators in the state including two classroom teachers and local school
administrators, as follows:

The Georgia Certified Public Manager (CPM) Program was established in 1976 by the State Personnel Board and the State Merit System as authorized under Code Section 45-20-12; and

WHEREAS:

The Georgia CPM Program has produced significant results and has been received very positively throughout the state government of Georgia, and the results produced have caused a number of states to implement programs modeled after Georgia's Program; and

WHEREAS: The Georgia CPM Program initially provided for an advisory CPM Board appointed by the Governor; and

WHEREAS:

On February 28, 1991, the State Personnel Board requested the Governor to assist in making current appointments to the Certified Public Manager Board which will act in an advisory capacity to the State Personnel Board and the State Merit System.

GOVERNOR'S LOCAL GOVERNANCE COMMISSION

WHEREAS: Local governments have been called upon to finance and deliver an increasing array of essential pUblic services; and

WHEREAS:

Population growth and decline and reductions in federal aid and dollars to local governments affect the fiscal capacity of local governments to provide essential pUblic services; and

WHEREAS:

Population growth and decline likewise affect the scope and type of essential public services provided as well as the economies and efficiencies of the delivery of such services; and

WHEREAS:

Essential pUblic services offered or required by general purpose local governments are at times duplicative, parallel and competitive due to overlapping geographical boundaries or overlapping statutory requirements.

NOW THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME AS GOVERNOR OF THE STATE OF GEORGIA, IT IS HEREBY ORDERED:

That the Governor I s Local Governance Commission is hereby created, and shall be comprised of 42 members, appointed as follows:



Twelve members shall be appointed by the President of the

Georgia Municipal Association;



Twelve members shall be appointed by the President of the

Association County Commissioners of Georgia;



Three members shall be appointed by the Lieutenant

Governor;



Three members shall be appointed by the Speaker; and



Twelve members shall be appointed by the Governor

All members shall serve at the pleasure of the appointing authority. The Governor shall designate the Chair of the Commission.

IT IS FURTHER ORDERED:
That the commission be and hereby is established to review, analyze, and make recommendations regarding specific issues affecting the delivery and financing of essential pUblic services as follows:
1. Existing local government service delivery arrangements and alternative service delivery arrangements, including contractual agreements with private service providers, intergovernmental agreements with other local governments, the transfer of functions from one government to another, the creation of special service districts, the merger of specific services, the merger of governments and other forms of intergovernmental cooperation; and
2. Changes in the current intergovernmental service delivery system to promote greater efficiency, effectiveness, and equity drawing on experiences in other states with specific delivery systems and forms of intergovernmental cooperation; and
3. The diversity between urban, suburban and rural areas of the state and the question of whether those communities experiencing either population growth or decline require a different delineation of roles between municipalities and counties; and,
4. Such other issues as the Governor deems in his discretion to be of significant importance in ensuring a local government structure and capacity that will efficiently, effectively, and equitably serve Georgia's citizens into the twenty-first century.

IT IS FURTHER ORDERED:

That Tommy Coleman be and hereby is appointed to serve as Chair of the Commission, and he is hereby authorized to appoint such other officers or advisory committees, task forces and other groups as are necessary to facilitate the work of the Commission.

IT IS FURTHER ORDERED:
That the Commission shall be attached to the Department of Community Affairs for administrative purposes only and that the Department of Community Affairs shall pay for reasonable and actual expenses incurred by the Commission.
IT IS FURTHER ORDERED: The Commission may contract with the Carl Vinson Institute of Government at the University of Georgia or with other units or subdivisions of the University System for such staffing and research support as may be deemed to be necessary to enable the Commission to carry out its functions, provided, however that no such contract may be entered into until and unless the Georgia Municipal Association and the Association of County Government Officials have agreed to bear all costs and expenses for such staffing and research support.
IT IS FURTHER ORDERED:
That the Commission shall make a final report to the Governor of its findings, conclusions, and recommendations no later than December 1, 1992, and shall stand abolished on such date.

WHEREAS: The Professional Standards Commission was created by the General Assembly in 1976 as part of the Georgia Professional Standards Act; and

WHEREAS: The act was renewed in 1979 for three additional years; and

The Carl D. Perkins Vocational Education Act (P.L. 98-524) and the Job Training Partnership Act (P.L. 97-300) authorize technical and financial assistance to the State for the purpose of developing and implementing a comprehensive occupational information system; and

WHEREAS:

The Carl D. Perkins Vocational Education Act provides that states desiring technical and financial assistance as authorized by said Act are required to establish a state occupational information coordinating committee and sets out certain membership requirements; and

WHEREAS:

The Governor's Employment and Training Council was created pursuant to P.L. 97-300 to have such powers and duties as provided by state and federal law (Code 1981, Section 34-14-2, enacted by Ga. L. 1989, p. 224, Section
5)

NOW, THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME AS GOVERNOR OF THE STATE OF GEORGIA, IT IS HEREBY

That the Governor's Employment and Training Council (hereinafter referred to as the Council) is designated as the organizational unit to be responsible for oversight and management of a statewide comprehensive labor market and occupational supply and demand information system. The Council shall advise the Governor, General Assembly, and appropriate State agencies of the funding and programmatic needs required to develop, coordinate, and implement a statewide comprehensive labor market and occupational supply and demand information system in. accordance with the provision of P. On July 3, 1991, Kirsten Louise Davis, age 21, 1061 Berry College, Mt. Berry, Floyd County, Georgia, was killed by a shotgun blast while driving down Georgia Highway 297, approximately five miles north of Vidalia, Toombs County, Georgia; and

WHEREAS:

Section 45-12-35 of the Official Code of Georgia Annotated provides that the Governor of the State of Georgia is authorized, in his discretion, to offer and cause to be paid a reward for information leading to the arrest and conviction of any person or persons who have committed a felony in the State of Georgia.

NOW, THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME AS GOVERNOR OF THE STATE OF GEORGIA, PARTICULARLY BY VIRTUE OF THE PROVISIONS OF THE ABOVE CODE SECTION, IT IS HEREBY

ORDERED:

That a reward in the amount of $2,000.00 is hereby offered for information leading to the arrest and conviction of the person or persons responsible for the death of Kirsten Louise Davis.
