WHEREAS:

The Workers' Compensation Medical Board was authorized by state law to hear and determine controversial medical questions in claims for compensation arising in cases of death or disability from occupational disease; and

WHEREAS: Section 8 of Act #790, Georgia Laws 1987, p. 1474 abolished the Workers' Compensation Medical Board; and

WHEREAS:

The Court of Appeals ruled on March 9, 1989 in the case of Nabisco Brands, Inc. v. Huggins, that the new law did not apply to cases prior to July 1, 1987, making it necessary to reconvene the Medical Board to hear cases which were filed prior to that date.

NOW, THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME AS GOVERNOR OF THE STATE OF GEORGIA, IT IS HEREBY

ORDERED:

That the Workers' Compensation Medical Board is hereby reestablished to resolve those claims for compensation arising in cases of death or disability from occupational disease before July 1, 1987.

WHEREAS: Said Act establishes a new Board of Community Affairs effective July 1, 1989.

Title I of the "Mental Retardation Facilities and Community Health Centers Act of 1963" as amended by Public Laws 90-170, 91-517, 94-103, 95-602 and 100-146 was enacted to assist states in assuring that persons with developmental disabilities receive the services and have the opportunities necessary to enable them to achieve their maximum potential; and

WHEREAS:

Said Act provides that any state desiring to take advantage of such federal assistance must have a state plan submitted to and approved by the Secretary of Health and Human Services and that such plan must provide for the establishment of a State Planning Council; and

WHEREAS:

By Executive Order dated December 10, 1971, the

State Planning and Advisory Council for

Developmental

Disabilities

Services

and

Construction was created and established.

NOW THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME AS GOVERNOR OF THE STATE OF GEORGIA, IT IS HEREBY

ORDERED:

That the State Planning Council for Developmental Disabilities shall henceforth be known as the Governor's Council on Developmental Disabilities and shall have the following primary functions and duties:

1. To develop jointly with the. appropriate state agencies the required state plan;

2. To monitor, review and evaluate the implementation of such state plan, at least annually;

3. To review and comment on all state plans which relate to programs affecting persons with developmental disabilities; and

4. To submit to the Secretary, through the Governor such periodic reports on its activities as the Secretary may reasonably request.

IT IS FURTHER

ORDERED: That the Council shall consist of 40 members as defined below.

1. Six members from the Department of Human Resources;

2. One member from the Department of Corrections;

3. One member from the Department of Medical Assistance;

4. One member from the Department of Education;

5. One member from the Department of Labor;

6. One member representing a university with training programs directed at individuals planning to work in the field of developmental disabilities;

7. One member representing the University Affiliated Program;

8. One member representing the Georgia Advocacy Office;

9. Seven members representing interests such as local agencies, non-state agencies, private non-profit groups, elected officials and individual citizens;

10. Nine members who are developmentally disabled;

11. Eleven members who are immediate relatives

or guardians of people with developmental

disabili ties, seven of whom represent people

with

mentally

disabilities, two representing people with

physical disabilities and one relative or

guardian of a person residing in an

Many important decisions impacting the financial and social welfare of the citizens of Georgia are based upon the results of the decennial census; and

WHEREAS:

Reapportionment of the U.S. Congress and the Georgia General Assembly is based on the census, and Georgia could gain a U.S. Congressional seat following such reapportionment; and

WHEREAS: Over 100 federal programs are based upon or distribute funds in whole or in part according to population counts; and
,
WHEREAS: Many private business investment decisions are predicated on data from the. census; and

WHEREAS: Population estimates and projections for the next decade and beyond will be based on the 1990 Census; and

WHEREAS: Even with the extensive actions of the U.S. Census Bureau, additional efforts are required to ensure an accurate count of all Georgians.

NOW, THEREFORE, PURSUANT TO THE AUTHORITY VESTED

IN HE AS GOVERNOR OF THE STATE OF GEORGIA, IT

ORDERED: That the Governor's 1990 Census Complete Count Task Force is hereby created and established; and

IT IS FURTHER

ORDERED: That the Task Force shall:

Provide general direction and assistance to the State I s efforts to ensure a complete count; and

Develop a plan to ensure the enumeration of groups unlikely to complete and return census questionnaire; and

Obtain the assistance of a public relations firm to prepare and coordinate a statewide publicity campaign; and

Coordinate with other federal and local organizations engaged in census complete count activities; and

Coordinate a census program with the Georgia Department of Education, the Board of Technical and Adult Education and the University System of Georgia to encourage them to conduct census related activities prior to Census Day; and
,
Obtain the assistance of other state agencies in posting census advertising in field offices and areas where the public has access, and in including census messages with clients' mailed benefits; and

Prepare correspondence for the Governor I s signature as necessary to obtain the assistance of local officials, influential citizens and religious leaders in communicating the importance of the census to their constituents and congregants prior to Census Day and to emphasize the importance of the Local Review Program; and

IT IS FURTHER

That members of the Task Force shall be paid reasonable travel expenses in accordance with state travel regulations when engaged in the business of the Task Force; and

IT IS FURTHER

ORDERED: That this Task Force shall complete its work by March 30, 1990, at which time it shall be abolished; and

By Executive Order dated May 20, 1985, the Martin Luther King, Jr. State Holiday Commission was created to provide advice and guidance to state and local governments and to private organizations that desire to hold ceremonies and other appropriate activities relating to the observance

Code Section 32-10-63(5) of the Official Code of Georgia Annotated, provides that the State Tollway Authority shall consider the possible economic, social and environmental effects of each project, and the Authority shall assure that possible adverse economic, social and environmental effects relating to any project have -been fully considered in developing such project and either eliminated or minimized; and

WHEREAS:

Section 32-l0-63(5)(A) of the Official Code of Georgia Annotated provides that the Authority shall assure that adequate consideration is given to these factors following the processes required for federal-aid highway projects, as determined by the National Environmental Policy Act of 1969, as amended, except the final approval of the adequacy of such consideration shall rest with the Governor, acting as the Chief Executive of the State, upon recommendation of the Commissioner, acting as Chief Administrative Officer of the Department of Transportation; and

WHEREAS:

Section 32-10-63(5)(C) of the Official Code of Georgia Annotated provides that said approval of the adequacy of the environmental considerations may come in the form of the Governor's acceptance of a federally approved environmental document; and

WHEREAS:

By Executive Order dated July 14, 1988, the Final Environmental Impact Statement for "The State Route 400
Extension Project" was accepted as the federally approved environmental document; and

WHEREAS:

Subsequent to said acceptance of the Final Environmental Impact Statement by the Governor, the Department of Transportation has proposed revisions to The State Route 400 Extension Project and has analyzed such proposed revisions; and

WHEREAS:

The Department of Transportation, by letter dated August 7, 1989 and October 5, 1989, requested that the Federal Highway Administration evaluate the impact of the proposed revisions to The State Route 400 Extension Project; and

WHEREAS:

The Federal Highway Administration, by letter dated August 22, 1989 and October 10, 1989, respectively, found that there has been no significant changes which would alter the social, economic and environmental impacts presented in the Final Environmental Impact Statement and that the Final Environmental Impact Statement remains valid; and

WHEREAS:

The Commissioner of the Georgia Department of Transportation has, by letter dated October 11, 1989, recommended that the Governor concur in the Federal Highway Administration's findings that the revisions made to The State Route 400 Extension Project, as set forth in the August 7, 1989 and October 5, 1989 correspondence to the Federal Highway Administration, does not evidence any significant alterations in the social, economic and environmental impacts presented in the Final Environmental Impact Statement.

WHEREAS: The safety and security of its citizens are among the first duties of government; and

WHEREAS:

By the Official Code of Georgia Annotated, Section 35-6A-l, the General Assembly has declared it to be the public policy of this State to provide the necessary leadership to coordinate the major components of the criminal justice system by establishing the Criminal Justice Coordinating Council as the statewide coordinating body representing all components and all levels of the criminal justice system; and has further ~uthorized the Council to serve as the statewide clearinghouse for criminal justice information and research; to prepare, publish and disseminate information of a descriptive and analytical nature to all components of the criminal justice system; and to encourage the cooperation of every department, agency or instrumentality in state government or its political subdivision; and

WHEREAS:

By the Official Code of Georgia Annotated, Section 35-3-33, the General Assembly has directed the Georgia Crime Information Center (G.C.I.C.) to compile statistics on the nature and extent of crime in the State; to compile other data related to planning for and operating criminal justice agencies; and to make available, upon request, to all ~ocal and state criminal justice agencies, all federal criminal justice agencies and criminal justice agencies in other states, any information in the files of the Center which will aid these agencies in the performance of their official
duties; and

WHEREAS:

The General Assembly has provided budgetary authorization for the establishment of statistical units within the Administra tive Off ice of the Courts, the Georgia Department of Corrections, the Board of Pardons and Paroles, the Division of Youth Services and

the Department of Public Safety, all of which collect, analyze and interpret criminal justice statistical data relative to their job specific applications; and

WHEREAS:

In order to promote efficiency and effectiveness in the criminal justice system of this State, there exists a need to systematically collect, analyze and interpret
statistical data retained by criminal justice agencies and to produce objective statistical reports on crime,
criminal offenders and the criminal justice system to assist the Executive, the Legislative and the Judicial Branches of government, as well as other criminal justice policy makers in their decision-making processes; and

WHEREAS:

The Governor of this State has determined a need to ensure the coordinated and systematic analysis, interpretation and use of criminal justice statistics by an independently created and non-affected agency of state government.

NOW, THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME AS GOVERNOR OF THE STATE OF GEORGIA, IT IS HEREBY

ORDERED: That a Criminal Justice Statistical Analysis Center is hereby created as a part of the Criminal Justice Coordinating Council; and

IT I S FURTHER

ORDERED:

That the Director of the Criminal Justice Coordinating Council may, by memorandum of agreement or contract, provide for the operation of a Criminal Justice Statistical Analysis Center at Georgia State University or any similar institution of higher education operated by the Board of Regents of the University System of Georgia. The Criminal Justice Statistical Analysis Center shall provide its reports and recommendations to the Governor through the Criminal Justice Coordinating Council; and

IT IS FURTHER

ORDERED:

That the Criminal Justice Statistical Analysis .Center shall improve the usefulness of criminal justice statistics through the conduct of statistical research and analysis, the result of which shall be disseminated to citizens, interested public agencies and elected public officials; and

IT IS FURTHER

ORDERED:

That the Criminal Justice Statistical Analysis Center shall conduct specialized studies, as determined by its Board of Directors, that use statistical data which are presently collected and maintained by state criminal justice agencies; and

IT IS FURTHER

ORDERED:

That the Criminal Justice Statistical Analysis Center shall identify and maintain selective data sets within the computers available to the statistical analysis center for ongoing analysis and dissemination; and

IT IS FURTHER

ORDERED:

That the Criminal Justice Statistical Analysis Center shall increase the ability of statistical users to translate data and research results into practice by publishing research results and conducting conferences and workshops relative thereto; and

IT IS FURTHER

ORDERED:

That the Criminal Justice Statistical Analysis Center shall strengthen the relationship between Georgia criminal justice agencies and the United States Department of Justice's Bureau of Justice Statistics (B.J .S.) by providing criminal justice statistics to the B. J . S . , as required and by serving as a clearinghouse for B.J.S. materials; and



IT IS FURTHER

ORDERED:

That the Criminal Justice Coordinating Council shall be authorized to expend any federal grants, other federal funds or private donations and grants which may be provided for carrying out the functions and authority as assigned in this Executive Order; and

IT IS FURTHER

ORDERED:

That nothing contained within this Executive Order shall be construed in such a manner as to conflict with state law relative to privacy and confidentiality protections established therein; and

IT IS FURTHER

ORDERED:

That the Official Opinion of the Attorney General of the State of Georgia shall serve as the determinate factor in any question which may arise concerning the release by any state agency to the center of criminal justice statistical data which may be protected by state law. It is the intent of this Executive Order that the Criminal Justice Statistical Analysis Center utilize aggregate data sets and data which has been coded in such a manner so as to prohibit the identification of private individuals within its data base and reports; and

The 1989 Georgia General Assembly created the Georgia State Games Commission pursuant to Senate Bill 194 (Act Number 697, Georgia Laws 1989, p . 1786 ); and

WHEREAS:

The purpose of said Commission is to promote the establishment of Olympic training centers within the state, to promote a statewide program of amateur athletic competition and to promote the health and fitness of Georgia's citizens.

WHEREAS:

The General Assembly of Georgia at the 1988. Regular Session enacted House Bill 1339 (Act Number 1248, Georgia Laws 1988, p. 717) creating and establishing the State Housing Trust Fundfor the Homeless Commission; and

WHEREAS:

The Governor is required by said Act to appoint seven public members of the nine member Commission who shall be knowledgeable in the area of housing and who shall represent diverse housing concerns; and

WHEREAS:

Said Commission shall be responsible for disbursements of available monies from the State Housing Trust Fund for the Homeless also created in said Act.

NOW, THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN ME AS GOVERNOR OF THE STATE OF GEORGIA, PARTICULARLY BY VIRTUE OF THE PROVISIONS OF THE AFORESAID ACT, IT IS HEREBY

WHEREAS:

Code Section 21-3-421 provides that when the aforementioned judge is unable to preside, the Governor may appoint a disinterested judge of the superior courts or senior judge of the superior courts to preside over such proceedings.
