In compliance with the law of the State of Georgia I have the
honor to submit herewith the annual report of the Insurance De
partment for the year ending December 31st 1926
The report given shows the results of the operation of the several
insurance companies associations and fraternal societies licensed
to transact business in this State and their financial condition ax
the close of the year The information is clearly set forth in a
convenient manner but if among those persons or insurance com
panies finding use for the report there are some who need moie
detailed information than is here given this may be had very
quickly by inquiry of the Department

the Insurance Commissioner shall within any fiveyear period
examine or cause to be examined the affairs of the several insur
ance companies organized under the laws of Georgia special ex

untiring work of the State Fire Inspector and his assistant in con
nection with the investigation of suspicious fires A comparatve
statement covering the past twelve years will serve to show some
what the scope of his work and its increasing importance

I have the honor to submit to you condensed report of the investi
gations made by the office of Fire Inspector during the year 1926
During the year 1926 investigations were made in connection
with fiftyeight fires reported to this office as being of suspicious
origin Pull reports of these investigations arc now in your hands
and T am including in this report a brief summary
The volume of work that this office is called upon to do has been
somewhat decreased in the last two years owincr to the constant and
rigid investigations conducted through this officeINSURANCE DEPARTMENT OF GEORGIA 9
Although with the appointment of an assistant in 1923 it is still
impossible for this office to answer all the calls for investigations
within a period of twelve months naturally it has been possible to
accomplish more than heretofore but due to the fact that each
investigation consumes a great deal of time it is yet impossible io
complete all of those called to our attention if each is to be given
the consideration it deserves

All of the following cases were called to our attention because
of strong suspicion of arson against a certain individual or indi
viduals A complete investigation was made in each case some of
these investigations requiring as much as one to four weeks to
determine the various lines of evidence or suspicion In cases where
the facts warranted the evidence was laid before the Solicitor Gen
eral of the district and upon his advice the case was either dropped
or presented to the Grand Jury

The following cases were reported to the office and investigatioii
started during 1925 but results were not obtained until 1926
Beach Three indictments cases were nolprossed witnesses
leaving state
Extreme difficulty has been encountered in the past year on
account of the fact that the average Jury has proved unwilling to
convict a person of the crime of arson on circumstantial evidence
due to the provisions of our laws carrying a straight sentence This
condition was greatly improved by the passage at the 1924 session
of the legislature of the socalled Model Arson Law This law
modified to fit conditions in Georgia is in general use throughout
the country having been drafted and endorsed by the Fire Marshal
Association of North America
Prior to the passage of the Model Arson Law for Georgia it
was impossible to convict a man of arson for the burning of chattel
property The Model Arson Law providing for the conviction of
persons burning their own property and also providing a sentence

of from two to twenty years naturally makes it much easier for
this office to secure conviction
The results of practically all of our investigations indicate cir
cumstantial evidence rather than direct evidence and juries are
disinclined to convict a man and sentence him for a minimum
term of two years solely upon the strength of circumstantial
evidence
I am pleased to report that the public is becoming more and more
awake to a realization of the enormous fire loss suffered annually
throughout the entire country and particularly by the State of
Georgia This realization has tended toward greater cooperation
on the part the public with this office This is also true in the case
of the officials of the various judicial districts of the State
In view of the above outlined improved conditions it is con
fidently boped that the result will be a greatly lessened number of
fires both from carelessness and incendiarism
At this point I would like to recommend what appeals to me as a
very strong aid and further improvement on the above conditions
towit the passage of a bill by the 1927 session of the legislaiure en
titled An Act to amend Section 1062 Volume 6 so as to strike
the word arson from the third line thereof The present law
provides that it is impossible for a jury to recommend the punish
ment in any case convicted of arson While it is by no means felt
that the Model Arson Law provides too drastic punishment for con
viction of arson it is felt that if the law was so changed as to per
mit recommendation by the jury for punishment in arson cases
as a misdemeanor a great many more convictions would be obtained
and the ultimate result would be a material reduction in fire loss
throughout the state Our investigations indicate very conclusively
that the motive back of approximately 90 of incendiary fires is the
amount of insurance carried on property
By eliminating the tendency of juries to acquit a person rather
than convict them on circumstantial evidence by allowing said
juries to recommend the punishment as a misdemeanor wherever
warranted the net result would naturally be a lessening in the ten
dency to commit incendiarism By way of explanation any pun
ishment meted out to a person convicted of the crime of arson would
naturally tend to discourage the motive as explained above or the
possibility of collecting the insurance money

gestions for such action as you deem wise

The State Mutual Life insurance Company of Rome Ga which
is being operated by this Department under order of Court is the
only company now in the bands of the Insurance Commissioner Ref
erence has been made m preceding reports to tins Company which
under direction of the Court was taken oven by the Department
1915 and mediately placed by me in charge of Colonel Hamilto
Yancey as Special Deputy I append below the reports of Colonel
Yaneey covering the business of the State Mutual for the years 1925

This Exhibit being a part of the report should be taken and con
sidered m connection with same The 8everal items shown in Exhibit

ment for their full understanding Except for substantial improve
ment in the financial condition of the Company there was no
marked change in the status of the State Mutuals affairs
Operations still show a saving from mortality and a continuing
increase of contingency reserve or unassigned funds
Owing to depressed cotton prices during the past season we have
not deemed it desirable to press liquidation of properties that have
been added to the assets of the Company following the general
price deflation of 192021 in farm lands except where same could
be sold without loss to the Company though a few of our holdings
have been disposed of at a profit over the values at which they have
been carried in the Companys assets
At time of our last report there was pending in the Courts a case
from Bartow County in an effort to enforce a junior judgment
lien on certain farm lands to which the State Mutual held Security
Deeds
This effort was of a purely technical nature On trial in the U
S District Court Judge Sibley on hearing the case dismissed
plaintiffs bill sustaining the priority of the State Mutuals title
Subsequently another claimant undertook to assert a similar
effort in the State Courts before Judge Irwin of the Tallapooa
Judicial Circuit and appealing from his adverse decision the
Supreme Court of Georgia recently affirmed Judge Irwins decree
finally settling the question and upholding State Mutuals title to
these properties
The case brought before Judge Thomas by certain certificate
holders has not been advanced to a final hearing from causes seem
ingly beyond the control of the Company or our Counsel It will be
our purpose to press the issue in this case to a final determination
as soon as practicable
In any event the rights and privileges of our polieyholders are
and will be fully protected
Taken as a whole the polieyholders seem to be satisfied with your
direction and the handling of the Companys affairs and with what
we have been enabled to do for them
Following our uniform practice all death claims have been paid
promptly and in full polieyholders allowed the options of paidup
and extended insurance under their policies also the right to have
premiums charged against their policies instead of paying same in
cash if they desire to arrange premiums in that way where policy
loan values June not been consumed16

In investing the Companys funds we have adhered to the
policy of seeking high class real estate loans giving the best return
consistent with safety Such loans have proved eminently satis
factoryand interest income received from that source durine
1926 was 708394 more than in 1925
The usual annual volume of Insurance Reports for 1925 not hav
ing been printed because of direction of the Governor we are asking
reference to our report covering the calendar year 1925 making
same as Exhibit B a part of this report same being more com
prehensive and reviewing operations of the Company during the
several years during which the State Mutual lias been under vour
control and direction

Dear Sir
As Special Deputy Insurance Commissioner in charge of the
properties and conducting the business of the State Mutual Life
Insurance Company under your administration I submit report
of operations of the Company for the year ending December 31
1925 together with statement of Income and Disbursements for
the calendar year also schedule of Assets and Liabilities as shown
by the books at the close of business December 31 1925 Exhibit
A attached is to be considered in connection with and as a part of
this report
All death claims accruing during the year were settled promptly
and paid in full on receipt of approved proofs Net results for the
year again show a substantial improvement in the Companys
financial condition After setting up the legal reserve for outstand
ing policies and making provision for liabilities as listed in ex
hibit schedule the contingency reserve or unassigned funds in
creased during the past year by the sum of 5798858 Mortgage
Loan investments were increased by the sum of 13492615 and
bond investments were increased by 1850330
The Companys invested funds yielded an income in interest and
rents substantially in excess of the amount required to maintain
reserves and pay taxes and other investment expensesthereby
improving the companys financial condition There was also a
saving from mortality the losses reported being less than the ex
pected under the American Experience Table for ihe amount at
risk and gains or profits from other accounts
At this particular time I deem it proper to call attention to a
brief comparison of the Companys financial condition as reflected
in the attached statement with its condition when under Order of
Court you assumed administration of its affairs At that time
report of the Auditor and Consulting Actuary following examina
tion made under your direction showed a large impairment of
reserve Further after such examination sundry items of un
known and unrecognized liabilities developed for which provision
had not been made by the previous management of the Company
making a still greater impairment than was at first indicated20

The report ofConsulting Actuary following examination as of
December 31st 1915 showed disbursements aggregating 960
96380 that year for items accruing prior to the date you took
charge of the Company and assets as of December 31st 1915
totaling 281888993
Since that date Notwithstanding the fact that no new business
has been solicited or issued hence no additions to premium income
to offset decreases due to deaths expiry etc death claims aggre
gating 12002965 have been paid and interest bearing policy
loans and lien notes aggregating 165361794 have been cancelled
when the respective policies against which the loans were made dis
continued by the insured
During the same period assets have been increased from 2 818
88993 to 304067151 and the quality of the invested assefa is
reflected by the income realized thereon In 1915 the total income
from interest and rents was 13034017 in 1925 17754029
During the period of your administration mortgage loans have
been made aggregating the sum of 232681292 the net increase
in mortgage loan investments after deducting repavments etc
being 78277810 Mortgage Loans as to date December 31 1925
as shown by exhibit attached totalled 132692547
As of December 31st 1925 the reserve and contingency reserve
aggregated 51365 for each 1000 of insurance in force This 1

The report of this company shows a most remarkable condition
of affairs When this Department took charge there was such an
enormous inflation of asset values that it seemed to be almost im
possible to rearrange them in accordance with reasonable market
values and maintain the solvency of the company This has been
done however no new insurance has been written in all these years
most of the effort having been put forth in conversion of assets and
af membership Equal success has been met with along both lines
and there has been a splendid demonstration of the care given the
interest of the policyholders
