In compliance with the law of the State of Georgia I
have the honor to submit herewith the annual report of the
Insurance Department for the year ending December 31st
1923
The report given shows the results of the operations of
the several insurance companies associations and fratern
al societies licensed to transact business in this State and
their financial condition at the close of the year In the
preparation of this report I have followed the plan adopted
the last two years condensing the compilation as much as
possible and yet including all important data concerning
the business transacted and the financial condition of each
company The information is clearly set forth in a con
venient manner but if among those persons or insurance
companies finding use for the report there are some who
need more detailed information than is here given this
may be had very quickly by inquiry of the Department
VOLUME OF BUSINESS
In former reports attention has been called to the steady
growth of the insurance business in this State The year
1923 has surpassed all other records There is a steady and
remarkable development in the line of life insurance writ
ten upon citizens of Georgia the year 1923 showing about
2000000 more in premiums paid than in 1922 with over
75000000 additional insurance in force and with only
1500000 additional death and endowment claims paid
Special comment has been made in other years as to the
report of fire and marine insurance especially as to the
ratio of losses paid to premium income in the years of 1921
and 1922 A parallel was drawn between this showing andthe then existing business conditions which parallel point
ed out a decided improvement in 1922 over the conditions
of 1921 In 1921 the loss ratio on fire and marine insur
ance was 10853 of the total premium income In 1922
thru more care in the avoidance of risk and by reason of
better business conditions the ratio had been reduced to
6177 There is a still better condition in 1923 the losses
reported being 5285 of the total premium income on
this class of business
Fire losses throughout the country inevitably run paral
lel with business conditionsadversely affected by busi
ness depression and lessened by business prosperityand
the results here shown may very safely be taken as a sure
indication of decidedly better business conditions through
out the State There is still considerable room for im
provement however in the matter of prevention or lessen
ing of fire losses There is a tremendous waste of prop
erty that could otherwise be saved to the citizens of the
State and it would be well I believe to consider ways and
means of diminishing such waste
The tables following summarize the business of the three
larger groups of companies reporting to this Department
and make comparison of volume over a series of years No
comparative tables have been made up in connection with
the smaller groups of companies industrial life and health
assessment fire and and fraternal societies but the finan
cial statements submitted by these organizations and the
examinations made by this Department show fair develop
ment where the companies are properly managed

In compliance with the laws of the State which provide
that the Insurance Commissioner shall within any fiveyear
period examine or cause to be examined the affairs of the
several insurance companies organized under the laws of
Georgia special examiners appointed by the Department
and reporting under oath to the Insurance Commissionerthe financial condition of the companies examined with
recommendations for consideration have examined and re
ported upon the following companies during the year 1923

Your attention has been called heretofore to the valu
able and untiring work of the State Fire Inspector in con
nection with the investigation of suspicious fires A com
parative statement covering the past nine years will serve
to show somewhat the scope of his work and its increasing
importance as well as its enlarged volume

My dear Sir
I have the honor to submit to you condensed report of
my investigations as State Fire Inspector for the year 1923
During that year investigations were made in connec
tion with seventyeight fires reported to this Department
as being of suspicious origin Full reports of these inves
tigations are now in your hands and a brief summary
thereof is attached
The work of the office continues to increase The num
ber of investigations mentioned does not by any means rep
resent the number of calls received by the office but since
an assistant was given me in 1922 we have been able to
cover more fully the calls for investigations It is yet how
ever physically impossible to meet all demands Each in
vestigation consumes a great deal of time if it is to be made
worth while and the preparation of cases for court and
the attendance at court trials of the cases presented keep
this office very active
I append herewith a summary of the results of the in

All of the foregoing cases were brought to our atten
tion by reason of strong suspicion of arson directed against
some individual or individuals in each instance Thorough
investigation was made in each case in some instances as
much time as one to four weeks being devoted to run
ning down the various lines of evidence or suspicion
Where the facts warranted it each matter was laid before
the Solicitor General of the district and he advised as to
whether or not the evidence was of sufficient value to be
presented to the Grand Jury In many cases not sufficient
evidence to warrant prosecution could be found even where
there had been much cause for suspicion and these cases
together with other cases where suspicion had been mis
directed were dropped This particular condition existed
in connection with the fire occuring at Decatur Ga on
February 19 1923 in which two girls lost their lives and
three fires occurring at almost the same moment in the City
of Quitman on October 21 1923 In each case strong sus
picion was directed to certain individuals but it was abso
lutely impossible to obtain sufficient evidence to warrant
the presentation of any charges to the Grand Jury In the
former case confession has since been made but nothing
has developed in connection with the Quitman fire

In reports of preceding years mention has been made of
the difficulty of obtaining convictions in all cases brought
to trial by reason of the apparent disinclination of the
average jury to impose a sentence of five to twenty years
upon conviction of arson The report shown above indi
cates a somewhat different attitude at this time Some of
this may be due to a realization of the enormous fire losses
of the country in general and of this State in particular
much of which is preventable and a great deal of which is
due to incendiary acts The public is gradually becoming
educated to the importance of at least discouraging the lat
ter and with the other seems to be a developing sense of
obligation to prevent loss thru carelessness
In the furtherance of the work of this office by myself
and assistant we are meeting with more and heartier co
operation on the part of the officials in the various judicial
districts of the State and with this cooperation and a
more drastic attitude on the part of juries toward offend
ers against the arson law we look forward confidently to
a lessened number of fires whether due to carelessness or
incendiarism
It will be recalled that in 1922 we recommended the
adoption of the Model Arson Law of the Fire Marshals
Association of North America with such modification as
might fit the conditions of the State of Georgia Such a
bill was presented to the legislature in 1923 and at this
time stands as unfinished business having progressed
thru first and second readings and is ready for passage
in its order at the next session It is a most important law
in the estimation of all who have studied it It does not
seem proper that the State of Georgia should be without
a law on its statute books whereby a person can be pun
ished for setting fire to his own property of whatever nature
16outside of corporate limits Just now there is no such law
and provided a person does not damage or endanger the
property of others he cannot be prosecuted for setting fire
to his own property regardless of whether or not it is
done with intent to defraud the insurance companies car
rying the fire insurance upon such property The absence
of such a law makes it extremely difficult to follow up such
a case with the idea either of punishment or of deterring
others from similar acts and it is earnestly hoped that the
bill will have the support ofall members of the legisla
ture and other persons who are interested in bettering the
property conditions of this State and discouraging the enor
mous fire waste
The foregoing is presented for your information and the
suggestions for such action as you deem wise

As mentioned in previous reports the law providing for
the appointment of fire inspectors defines their duty to be
that of making investigation after a fire occurs I again
submit for consideration the suggestion that it would be
better for the State to enlarge those duties so as to encour
age fire prevention Both State and people would reap the
benefit of any lessening of the present enormous losses
just as both now pay the penalty incident to the present
experience I believe it would be well to grant the fire
inspector and any assistants he might be given authority to
so upon any premises for the purpose of examination to
see if local or State laws or ordinances or regulations for
the purpose of lessening or removing the fire hazard are
being strictly observed reporting to the proper authorities
and violation of such laws ordinances or regulations rec
ommending to the owners of properties examined the adop
tion of such precautionary measures as will diminish the
17risk of fire and thus better not only their own condition
but also decrease the hazard to adjoining property Meas
ures might also well be taken to compel the adoption of
such recommendations unless good and sufficient reason
could be presented to the contrary and where no local laws
or regulations exist the State should require the adoption
of some standard of safety and its enforcement The re
quired investigations of suspicious fires and the prosecu
tion of those guilty of arson are right and proper and
should be vigorously conducted but the prevention of fires
or the lessening of losses is far more important to the State
and its people and proper means taken to bring these
about will most certainly be worth while to all

The following statement is submitted showing the rev
enue collected thru the Insurance Department from com
panies licensed by the Department to transact business in
Georgia as well as the expense of maintenance of the De
partment for the year ending December 31 1923 This
amount of revenue shown does not include collections for
the fire inspectors fund provided by the statute for the
maintenance of that Division of the departmental activi
ties This fund is separately handled exclusively to main
tain the fire inspection service

The question of what deductions from premium receipts
were allowed by the law imposing a tax on insurance com
panies was raised in 1922 by several life insurance com
panies and it became necessary for this department to re
sort to the courts to enforce the collection of approximate
ly 20000 withheld by eleven companies The amount of
the tax held up for 1923 awaiting a decision was 27
44715 The decision was in favor of the State in both
the Superior Court and the Court of Appeals The case is
now pending in the Supreme Court of Georgia having been
recently certioraried from the Court of Appeals If the
Supreme Court affirms the decision of the Court of Ap
peals the taxes due the State for the years 1922 and 1923
with interest at 7 will amount to about 52000

2270305In the matter of revenue from insurance companies
there is approximately 40000 withheld by a number of
different companies pending decision of the Court in a
suit brought by one of them to determine the extent of the
exemption or reduction allowed by law If the State is
sustained this amount with accrued interest will of course
be collected
NB As this report is being prepared we have notice
of the decision of the Court of Appeals which is favorable
to the contention of the State Collection will be made in
due course and will be reported as a part of the income of
1924
21COMPANIES IN PROCESS OF LIQUIDATION
Last years report showed that the Empire Life Insur
ance Company formerly of Atlanta Ga was the only com
pany in the hands of the Insurance Department for liquida
tion Under the orders of the court all assets were to re
main in the hands of the Insurance Commissioner for a
period of seven years from March 16 1916 at which time
the affairs of the Empire Life were placed in his charge
During that period all assets have been liquidated and as
soon as possible after its expiration an order of court was
obtained permitting distribution Careful management in
the liquidation proceedings has brought about the accumu
lation of sufficient cash to enable the payment of 71628
of all policy and miscellaneous obligations Out of what
seemed to be an almost hopeless tangle in 1916 distribu
tion has now been made and the affairs of the company
finally closed in accordance with report made to and ap
proved by the Superior Court of Fulton County Georgia
Reference has been made in preceding years to the State
Mutual Life Insurance Co of Rome Georgia taken over
by this Department in 1915 and immediately placed by me
in charge of Colonel Hamilton Yancey as Special Deputy
I append herewith the report of Colonel Yancey covering
the business of this company for the year 1923

Dear Sir
As Special Deputy Insurance Commisisoner in charge of
and conducting the business of the State Mutual Life Insur
ance Company of Rome Georgia it becomes my duty at
this time to make formal report to you as to operations of
said Company for the year 1923
22Attached heretoand marked Exhibit Ayou will
find statement showing Income and Disbursements for the
calendar year also schedule of the assets and liabilities of
the Company as shown by its books at the close of business
on December 31 1923 The several items are I feel sure
selfexplanatory
Comparison of this statement with that for the year end
ing December 31 1922 shows an increase of 2369280 in
assets This notwithstanding payment of death claims
aggregating 11299392 and cancellation of policy loans to
taling 14832108 because of discontinuance of policies
Interest and rent realized on the Companys assets ex
ceeded by 874106 the receipts from that source for the
preceding year reflecting continued improvement in the
quality of assets and the income derived therefrom
In line with our fixed policy of liquidating the Companys
real estate holdings as fast as it is practicablt to do so at
reasonable prices we made a number of sales during the
year including disposition of the part remaining of the real
estate located at Bridgeport Alabama This was sold at a
price of 327437 in excess of the valuation at which it was
carried on the books of the Company As you will recall
this particular holding acquired before you took charge of
the Company under Orders of Court was for a long time a
burden on the Company
Notwithstanding some exceptionally heavy individual
death claims the mortality was within the expected accord
ing to the American Experience Table As heretofore since
you took charge of the Companys affairs death claims ac
cruing during the year were settled promptly and m full
upon receipt of proofs of death there being no due and un
paid claims outstanding
Analysis of results shows a substantial improvement in
the Companys condition The business in force at close of
the year was 675048375 The decrease from all causes

deaths lapses expirations cancellations etc was only
787 of the amount in force January 1st 1923

The report of this company shows a most remarkable
condition of affairs When this Department took charge
there was such an enormous inflation of asset values that it
seemed to be almost impossible to rearrange them in ac
cordance with reasonable market values and maintain the
solvency of the company This has been done however no
new insurance has been written in all these years most of
the effort having been put forth in conversation of assets
and of membership Equal success has been met with along
both lines and there has been a splendid demonstration of
the care given the interests of the policyholders
