FACT SHEET
FACT: Explosive materials (such as dynamite, blasting caps, and ANFO), and their components (such as ammonium nitrate and diesel fuel), are regulated as hazardous materials when transported for business or commercial purposes.
FACT: The Georgia Department of Public Safety, MCCD has adopted the Federal Hazardous Materials Regulations (HMR) and Federal Motor Carrier Safety Regulations (FMCSR) as state regulations; these regulations have the force and effect of law.
FACT: These regulations apply to anyone (including blasters) transporting for business purposes explosives and other hazardous materials on vehicles they own or use, regardless of size of the vehicle or quantity of the hazardous material.
FACT: In addition to state regulations, you may be subject to identical federal regulations and the jurisdiction of the U.S. Department of Transportation, depending upon the nature of your business.
FACT: These regulations are not new.
The hazardous materials regulations are contained in Title 49 of the United States Code of Federal Regulations, Parts 100 180 (49 CFR Parts 100 - 180). These regulations have many provisions which will apply in specific circumstances. These provisions may include:
U.S. DOT Hazardous Materials Registration (annual) Shipping papers, containing authorized descriptions for hazardous materials Emergency Response Information and emergency instructions Route plan and copy of 49 CFR Part 397 if applicable Marking of proper shipping names, identification numbers, and other information on packages Labeling of packages with required DOT warning labels Placarding of motor vehicles Commercial driver's license (CDL) with required endorsements Annual mechanical inspection of motor vehicles Hours-of-service limitations and record keeping requirements Training in DOT compliance for drivers and other personnel involved in the transportation process HM Safety Permit if transporting more than 55 pounds of a Division 1.1, 1.2, or 1.3 material or an amount of a
Division 1.5 material requiring placarding. 49CFR 385.403
