GEORGIA LAW TO REGULATE THE REGISTRATION,
BRANDING. INSPECTION AND ANALYSIS OF
INSECTICIDES AND FUNGICIDES.
An Act to regulate registration, branding, inspection, analysis and sale of calcium arsenate, lead arsenate, and dust mixtures containing sulphur, lead arsenate and lime, and other insecticides and fungicides commonly used on cotton, field crops, and fruit; to provide for making rules for the enforcement of the provisions of this Act, and to fix a standard of calcium arsenate, lead arsenate, and dUI!!t mixtures containing sulphur, lead arsenate and lime, and other insecticides and fungicides commonly used on cotton, field crops, and fruit; to prescribe the punishment to be visited upon violators of the provisions of this Act, to appropriate a sum of money for the purpose of defraying expenses that may be incident to making the analyses of the preparations herein named, and for other purposes.
SECTION 1.
Be it enacted by the General Assembly of Georgia, and it is hereby enacted by the authority of the same, That from and after the passage of this Act, all manufacturers and jobbers of and dealers in calcium arsenate, lead arsenate; and dust mixtures containing sulphur, lead arsenate and lime, and other insecticides and fungicides commonly used on cotton, field crops, and fruit, in this State, who may desire to offer for sale and sell calcium arsenate, lead arsenate, and dust mixtures containing sulphur, lead arsenate and lime, and other insecticides and fungicides, commonly used on cotton, field crops and fruit, shall first file with the C0mmissioner of Agriculture the name of t!ach brand of said preparation, which they may wish to sell either directly or through agents, together with the name and business address of such manufacturers, jobbers or dealers as the case may be. ,

SECTION 2.
_Be it further enacted by the authority aforesaid, That it shall be the duty of all manufacturers, jobbers, dealers and agents in advance of offering ealcitim, lead arsenate, and dust mixtures containing sulphur, lead arsenate and lime, and other insecticides and fungicides, commonly used on cotton, field crops, and fruit, for sale in this State, to brand on each package, containing. the name, the words calcium arsenate, lead arsenate and dust mixtures containing sulphur, lead arsenate and lime, and other' insecti-cides and fungicides co~monly used on cotton, fie~d crops and fruit, the weight of the package in full, the name and address of the manufacturers, also the contents of goods, the guaianteed analysis, solubility, and density.
SECTION 3.
Be it further enacted by the authority aforesaid, That all manufacturers, or jobbers or agents representing them, who have registered their brands or preparations heretofore mentioned, shall apply to the Commissioner of Agriculture for tags to be attached to each package of the afore mentioned preparations and with such request, the sum of twenty-five ($.25) cents per ton, as an inspection fee.
Thereupon, the Commissioner of Agriculture shall supply all such applicants with the requisite number of tags which latter, attached to each package of calcium arsenate, lead arsenate, and dust mixtures containing sulphur, lead arsenate, and lime and other insecticides and fun-gicides commonly used on cotton, field crops, and fruit,' shall be prima fac ie evidence of compliance with the provisions of this Act. Tags left over from one season shall not be used next or SllCCeeding season Or be redeemed by the Commissioner of Agriculture.
SECTION 4.

tur$~ c;:pptaining sulphur, lead arsenate . and lime, and

other insecticides and fungicides commonly used on cotton, field crops, and fruit, shall be taken by fertilizer inspectors appointed by the Commissioner of Agricultur~, but they shall not be allowed additional compensation for such service; they shari h.owever, be r~imbursed in the matter of actual traveling expen.se~ now paid, under the rules of t h e Department of Agriculture, ~h en engaged in inspecting fertilizers. Samples of calcium arsenate, lead arsenate dust mixtures, containing sulphur, lead arsenate and lime, and other insecticides and fungicides commonly used on cotton, field crops, and fruit, shall be taken in the same manner now observed in taking samp les of fertil izers.
SECTION 5.
Be it further enacted by the authority aforesaid, That it shall be the duty of the State Chemist to make the necessary analysis of all samples of calcium arsenate, lead arsenate, and dust mixtures containing sulphur, lead arsenate and lime, and other insecticides and fungicides commonly used on cotton, field crops, and fruit, that may be turned over to him by the proper authorities. He shall keep a record of all such analyses and report on the same, as he now does in the case of fertilizer sampl es analyzed.
SECTION 6.
Be it further enacted by the authority aforesaid; That the Stafe Board of Entomology is hereby authorized and required to fix a standard for calcium a:rsenate, lead arsenate, and dust mixtures, containing sulphur, lear arsenate, and lime, and other insectic:ides and fungicides commonl y used on cotton, field crops, and fruit, and to make such rules and regul ations, as in t h e ~udgment of said Board, as shall be necessary for the protection of the people, and make thoroughly effective the provisions of this Act, and such regulations shall have the force of law.

SECTION 7.
Be it further enacted by the authority aforesaid, 'hat the sum of Five Thousand ($5,000) Dollars, or so much thereof as may be necessary, be, and the same is hereby appropriated to the Department of Agriculture for the purpose of defraying the expenses that may be incident to making the analyses hereinbefore required.
SECTION 8.
Be it further enacted by the authority aforesaid, That any person or persons, who shall violate any of the provisions of this Act, shall be deemed guilty of a misdemeanor, and on conviction shall be punished as prescribed in Section 1065, Volume 2, of the Code of Georga, 1910, all fines arising therefrom shall be paid into the State Treasury, and shall become a part of the State Educational Fund.
SECTION 9.
Be it further enacted by the authority aforesaid, That it shall be the duty of the Commissioner of Agriculture to prosecute each and every violator of any of the provisions of this Act.
SECTION 10.
Be it further enacted by the authority aforesaid, That
no provisions of the laws relating to the sale of Drugs and
poisons shall be construed to apply to the sale of the above
named insecticides and fungicides for use on cotton, field
crops and fruit.
SECTION 11 .
Be it further enacted by the authority aforesaid, That all laws and parts of laws in conflict with this Act, be, and th6 same are, hereby repealed. Approved August 17, 1920.

INSECTICIDE AND FUNGICIDE STANDARDS.
Adopted by the Georgia State Board of Entomology.
The following standards are adopted this 22nd day of October 1920, by the Georgia State Board of Entomology for the following insecticides and fungicides, in accordance with Section 6 of the foregoing Act, approved August 17, 1920.
CALCIUM ARSENATE.
Shall Contain:
Not less than 40 % arsenic pentoxide Not more than 0.75 % water soluble arsenic pentoxide Density not less than 80 or more than 100 cu. in. per pound.
LEAD ARSENATE (PASTE.)
Shall Contain.
Not less than 12.5% arsenate pentoxide.
Not more than 0.75 % water soluble arsenic pentoxide
Not more than 50 % water.
Provided, however, That extra ''Vater may be added to
lead arsenate (as describe~ in thi::; paragraph) if the re-
sulting mixture is labeled lead arsenate and water, the
percentage of extra water being plainly and correctiy

stated on the label.
LEAD ARSENATE (DRY POWDERED).
Shall Contain.
. Not less than 25 % arsenic pentoxide Not more. than 1.5'% water soluble arsenic pentoxide.
PARIS GREEN.
Shall Contain.
Not less than 50% arsenious oxide Not more than 3.5% water soluble arsenious oxide.

DUST MIXTURES .CONTAINING SUL?HUR, LEAD - ARSENATE AND LIME OR OTHER FILLER.
Shall Contain.
Not less than 10% pure sulphur Not-less than 5 % pure dry lead arsenate . Not less than 90 % of the mixture must be fine enough to pass through a wire screen of 200 meshes to the inch.
LIME SULPHUR SOLUTION.
Shall Contain:
Not less than 29 % calcium polyi; ulphide Not less than 1% calcium thiosulphate Inert ingredients not over 70 %. Test not less than 28 degrees on Baume spindle.
DRY LIME SULPHUR.
Shall Contain:
Not less than 63 % calcium polysulphide
Not less than 5% calcium thiosulphate
Not less than 12% sulphur
Inert ingredie~~i? not over 20 %.
ATOMIC SULPHUR.
Shall Contain:
Not less than 45 % sulphur. Inert ingredients not over 55 %. Any dust mixture or liquid spray that is recommended to be used on cotton, field crops or fruit, shall be deemed to be below the standard, if it fails to come up to the specifications on the label on the package, and the label must show the total percentage of the active ingredients. If arsenic in any form is contained in the dust mixture or liquid t he percentage of the water soluble arsenic pentoxide must be given. , In the case of any insecticides or fungicides, ,commonly used on cotton, field crops, or fruit. they will be deemed

to be below the standard, if they do not come up to the specifkations on the label on the package, and the label must be printed to conform with Section 2 of the aforesaid Act.

RULING OF THE GEORGIA STATE BOARD OF ENTOMOLOGY IN REGARD TO SIZE OF PACKAGES OF INSECTICIDES AND FUNGICIDES FOR USE ON COTTON, FIELD CROPS AND FRUIT.
Section 6 of an Act of the legislature approved August
17, 1920, (to regulate the registration, branding, inspec-
tion, analysis and sale of calcium arsenate, lead arsenate,
and dust mixtures containing sulphur, lead arsenate and
lime, and other insecticides and fungicides commonly
used on cotton, field crops and fruit,) reads as follows:
Be it further enacted by the authority aforesaid, That
the State Board of Entomology is hereby authorized and
required to fix a standard for calcium arsenate, lead arse-
nate, and dust mixtures containing sulphur, lead arse-
nate, and lime, other insecticides and fungicides common-
ly used on cotton, field crops, and fruit, and to make such
rules 1nd regulations, as in the judgment of said Board
as shail be necessary for the prote~tion of the people, and

make thoroughly effective the provision of this Act, and such rules and regulations shall have the force of law.
Now Therefore, the Board rules :
1. That Section 3 of this Act applies only to calcium
arsenate, lead arsenate, and dust mixtures containing sul-
phur, lead arsenate and lime, and other insecticides and
fungicides commonly used on cotton, field crops and fruit.
2. That all of the above named substances for use in
this State on cotton, field crops and fruit, shall be put up
in packages containing 25, 50, 100, 200 pounds or more.
3. That Section 10 of this Act applies to calcium arse-

nate, lead arsenate, and dust mixtures containing sulphur, lead arsenate and lime, and other insecticides and fungicides commonly used on cotton, field crops and fruit, when put up in packages as enumerated above, and officially tagged. Adopted November 17, 1920.
RULING OF THE COMMISSIONER OF AGRICULTURE ON TAGGING PACKAGES ACCORDING TO ACT APPROVED AUGUST 17, 1920.
The rulings of the Commissioner of Agriculture on Section 6 of an Act of the Georgia Legislature approved August 17, 1920, entitled An Act to Regulate the Registration, Branding, Inspection, Analysis, and Sale of Calcium Arsenate, Lead Arsenate, and Dust Mixtures Containing Sulphur, Lead Arsenate and Lime and Other Insecticides and Fungicides Commonly used on Cotton, Field Crops and Fruit.
FIRST: That section 3 of this Act applies only to calcium arsenate, lead arsenate, and dust mixtures containing sulphur, lead arsenate and lime and other insecticides and fungicid es commonly used on cotton, field crops and fruit.
SECOND: That all the above named substances for use in this State on cotton, field crops and fruits shall be put up in packages containing tw enty-five, fifty, o~e hundred and two hundred pounds or more and all packages of twenty-five pounds or more shall be subject to inspection as vrovided in th e above stated Act. No packages of less than tw enty-five pounds sh a ll be subject to inspection under the provisions of this law. Packages above twenty-five pounds and not exactly of the numbers given above, but under two hundred pounds, may bear the tag of denomination sufficiently la1ge to cover its weight. All packages of over two hundred pounds shall bear suffi cient stamps to cover weight of package.
THIRD: That the Department of Agriculture shall

sell for the use of those registering goods mentioned above
tax stamps at the rate of 25 cents per ton of the follow-
ing denominations: 2 1-2 cents _____________ 200 pound package. 1 1-4 cents ___ __________ 100 pound package.
5-8 cents - -- ---------- 50 pound package.
5-16 cents - ----------- 25 pound package.
