Report on the analy i of more than 5,000 amples of fer-

tilizer analyzed by the tate Chemi t prior to June 1st, 1928,

It has been the custom heretofore to issue one bulletin on fertilizers each year after the entire work of analyzing samples has been completed. For this reason consumers of fertilizer were not in possession of official analyses on the various brands until their fertilizer was paid for.
Under the law any analysis on record n the office of the

Commissioner of Agriculture is admissible as evidence in any case where the worth of the same brand of fertilizer is in question. The official analyses in this book repre ent the average of all

samples run on each brand and is intended by the law for the protection of those farmers who did not have their fertilizer ampled, since this can be used as evidence by any farmer u ing the particular brand of which the official analy is is sub ect to penalty.

Under the present law a fertilizer which hows a deficiency of more than 3% in commercial value is subject to a penalty oi 25%. It is impossible to determine accurately the commercial value of any fertilizer without knowing from what sources the

different plant foods are derived, and the relative amount of each source.

itrogen is the mo t expen ive plant food and the commercial value of itrogen per unit during the current season has varied from $2.80 on some inorganic itrogen to $7.00 per unit on some organic itrogen. Consequently a ton of 8-4-4 fertilizer where all the Nitrogen was derived from cheaper sources would have an actual commercial value of $16.80 less than a ton of 8-4-4 fertilizer where all the itrogen was derived from expensive organic sources. To illustrate more fully, the commercial value of an 8-4-4 with all itrogen derived from expen ive materials

would be $37.30 per ton, and would have to show a shortage of $1.12 per ton to be subject to a penalty under the law, while an 8-4-4 where all itrogen was derived from the cheapest sources

would have a commercial value of $~8.44 per ton and would

only have to show a shortage of lleventy cents per ton to be sub-

ject to penalty. Without a law requiring the manufacturer to

show the amounts of the different sources, the only way the

Commissioner of Agriculture can fix a commercial value i on an

average of the different materials. As a great majority of the

fertilizer old carry a high per cent of water soluble nitrogen

indicating that it came from inorganic sources it is evident that

in a great many instances the conSumer would be entitled to a

penalty for a smaller shortage in commercial value than on a

penalty determined on the average price for itrogen.

According to statistics of the Federal Department, five

Southeastern States, namely orth Carolina, South Carolina,

Georgia, Alabama and Florida use one-half of the commercial

fertilizer con umed in the entire nited States. Georgia is the

largest consumer with the single exception of orth Carolina.

Georgia uses more commercial fertilizer than 26 other States

combined including Texa. More than one-half of the cotton

produced in the United States is produced without the use of com-

mercial fertilizer. According to statistic , for the pa t two year it has required $~O.OO per bale for each bale of cotton produced

in Georgia to pay for the commercial fertilizer consumed in Geor-

gia. All of thi of course was not used for cotton but a very

large percent of it wa used in the production of cotton. It

is easy to see therefore the importance of the Georgia farmer re-

ceiving an honest deal in the purchase of fertilizer when we

understand the handicap that the purchase of fertilizer puts

on his products. It is equally true that those m.anufacturers

of fertilizer who are honestly seeking to build up a reputation

for honest goods are protected a much by enforcement of the

fertilizer laws as the farmers. Under the present law the farmer

who pays cash for his fertilizer and afterwards find that he is

entitled to a rebate on account of an under-run, has no recour e

should the company refuse to make settlement, except to bring

suit.

In the ca e of many smaller users of fertilizers where only

five to ten tons were purchased the amount of penalty involved

is not enough to authorize the trouble and expen e of a lawsuit.

For instance if the farmer bought five tons of fertilizer for $125.00

and finds he is entitled to a penalty of 25% this penalty would

amount to $31.25 but on account of the expense and trouble involved it would not be profitable to institute litigation to recover this penalty.
The Commissioner of Agriculture should have the authority to collect penalties for the ,consumer, the expense, if any, to be paid out of the fertilizer tag tax, all of which is collected from the comumer of fertilizer and should be used for his protection.
I also hand you herewith, under separate cover, a report on all those individual samples run during the current season to date which have shown an under-run sufficient to subject them to penalties.
