Agencies Issue Final Rules on Identity Theft Red Flags and Notices of Address Discrepancy
On October 31, 2007, the federal financial institution regulatory agencies and the Federal Trade Commission announced that they have sent to the Federal Register for publication final rules on identity theft "red flags" and address discrepancies. The final rules implement sections 114 and 315 of the Fair and Accurate Credit Transactions Act of 2003.
The final rules require each financial institution and creditor that holds any consumer account, or other account for which there is a reasonably foreseeable risk of identity theft, to develop and implement an Identity Theft Prevention Program (Program) for combating identity theft in connection with new and existing accounts. The Program must include reasonable policies and procedures for detecting, preventing, and mitigating identity theft and enable a financial institution or creditor to:
Identify relevant patterns, practices, and specific forms of activity that are "red flags" signaling possible identity theft and incorporate those red flags into the Program; Detect red flags that have been incorporated into the Program; Respond appropriately to any red flags that are detected to prevent and mitigate identity theft; and Ensure the Program is updated periodically to reflect changes in risks from identity theft.
The agencies also issued guidelines to assist financial institutions and creditors in developing and implementing a Program, including a supplement that provides examples of red flags.
The final rules also require credit and debit card issuers to develop policies and procedures to assess the validity of a request for a change of address that is followed closely by a request for an additional or replacement card. In addition, the final rules require users of consumer reports to develop reasonable policies and procedures to apply when they receive a notice of address discrepancy from a consumer reporting agency.
The final rulemaking is issued by the Board of Governors of the Federal Reserve System, the Federal Deposit Insurance Corporation, the Federal Trade Commission, the National Credit Union Administration, the Office of the Comptroller of the Currency, and the Office of Thrift Supervision. The final rules are effective on January 1, 2008. Covered financial institutions and creditors must comply with the rules by November 1, 2008.

Agencies Issue Final Rules on Affiliate Marketing
The federal financial regulatory agencies have issued final rules that provide consumers with an opportunity to "opt out" before a financial institution uses information provided by an affiliated company to market its products and services to the consumer. The final rules on affiliate marketing implement section 214 of the Fair and Accurate Credit Transactions Act of 2003, which amends the Fair Credit Reporting Act (FCRA). These final rules generally prohibit a financial institution from using certain information received from an affiliate to make a solicitation to a consumer unless the consumer is given notice and a reasonable opportunity to opt out of such solicitations, and the consumer does not opt out. The final rules apply to information obtained from the consumer's transactions or account relationships with an affiliate, any application the consumer submitted to an affiliate, and third-party sources, such as credit reports, if the information is to be used to send marketing solicitations. Nothing in the final rules supersedes or amends a consumer's existing right to opt out of the sharing of non-transaction or experience information under section 603(d) of the FCRA.
The final rules also implement the statutory exceptions to the affiliate marketing notice and opt-out requirement. The appendix to the final rules contains model forms to facilitate compliance with the notice and opt-out requirement. The final rules are effective on January 1, 2008. All covered entities must comply with the rules no later than October 1, 2008.
Substantially similar rules will be issued separately by the Federal Trade Commission and the Securities and Exchange Commission. The Federal Register notice can be found at Fair Credit Reporting Affiliate Marketing Regulations.

Department Receives Work Away Program Champion Award

The Department was one of seventeen agencies awarded the "Work Away Program Champion Award." The award is presented by the State Personnel Administration to agencies that are consistent in achieving monthly goals and reliable in reporting on a timely basis.

Work Away is a statewide initiative that encourages telework and work scheduling options for eligible employees. Both telework and scheduling options have been shown to result in better job performance, improved job satisfaction and employee morale, and a reduction in absenteeism and sick leave usage. Work Away options also help retain valued employees and recruit top quality people while "Improving the Quality of Life for All Georgians."

Governor Honors State Employees for Excellence in Customer Service

On October 30, 2007, Governor Sonny Perdue announced the winners of state government's Excellence in Customer Service Awards for 2007. Six individuals and eight teams were recognized in a ceremony held at the Georgia World Congress Center.

First-year winners in the Team Georgia Customer Service Recognition Program were selected from among more than 400 nominations across Georgia. Individuals were to demonstrate helpful, courteous and knowledgeable service to citizens. Team winners dramatically shortened process time or responded quickly to customers. Awards were also given for Employee of the Year, Team of the Year, Call Center Excellence, Leadership and Agency of the Year. Nominees were judged by a blue ribbon panel of leaders from the business community and the public sector.

"The range of exceptional nominations from all state services and all parts of the state is impressive," said committee chair Carl E. Swearingen, Chairman, State Board, Technical College System of Georgia. Georgia is setting high benchmarks for customer satisfaction that mean better service, reduced costs and long term benefits for all."

The Department accepted two awards, one individual and one team:

Mark Simpson, Consumer Affairs Specialist in the Department's Legal and Consumer Affairs Division received an individual award for demonstrating outstanding service to the citizens of Georgia over the last year. His actions reflect all five of the state's customer service attributes: COURTEOUS, HELPFUL, ACCESSIBLE, RESPONSIVE, and KNOWLEDGEABLE.

The Legal and Consumer Affairs Division also received one of the Governor's Awards in Customer Service for Team Excellence. This is awarded to those teams who have demonstrated outstanding service to the customers of the state of Georgia over the last year.
"Part of making Georgia the best managed state is improving customer service and recognizing those employees who provide it," said Governor Sonny Perdue. "These awards highlight exemplary employees and their commitment to changing processes and attitudes to provide faster, friendlier, and easier service for the citizens of Georgia. Those recognized here represent scores of others who have found ways to produce and measure results."
