Talmadge Amendment Helps Tobacco Bill

During the past two growing seasons, Georgia tobacco farmers have been faced with two severe cuts in tobacco acreage allotments, amounting to 29 1/2 percent.
As a result of these acreage cuts, effecting all tobacco, regardless of type, a group of Georgia farmers have taken the problem to court on the premise that tobacco was cut with no regard to type. The Agricultural Act states that the Secretary of Agriculture must consider each type of tobacco separately when regulating surpluses.
As type 14 tobacco, that primarily is grown in Georgia and Florida, has not been a surplus problem, the fanners who took their case to court have won on two separate trials.
During the present session of the U. S. Congress, a Poundage-Acreage bill was introduced by Congressman Harold Cooley of North Carolina. This is the bill recently voted on in referendum held May 4.
Many Georgians felt that this bill as

introduced was not acceptable to Georgia farmers.
In this regard, Senator Herman Talmadge introduced and successfully amended the bill to protect Georgia tobacco farmers.
Senator Talmadge's amendment protects the Georgia law suit concerning Type 14 tobacco and prevents Congress from legislating the Georgia farmers out of court.
If Georgia farmers win the court suit, the Secretary of Agriculture must set tobacco allotments according to type, supply, demand and market rather than on the basis of the entire tobacco crop; the amendment is, in effect, a restatement of that section of the Agricultural Adjustment Act of 1938 that was being contested in the courts.
Senator Talmadge is to be commended

for his efforts in protecting the tobacco
farmers of Georgia.
Should the Georgia farmers win their case now pending in Federal Court, all Georgia citizens and in particular Georgia tobacco farmers can be grateful for Talmadge's efforts in preserving the right to grow and market Georgia tobacco on a supply and demand basis.

below:
Sec. 4. Nothing in this Act shall be construed as affecting the authority or the responsibility of the Secretary of Agriculture under Section 301(b) (15) of the Agricultural Adjustment Act of 1938 with respect to providing that different types of tobacco shall be treated as different kinds of tobacco or with respect to increasing allotments or quotas for farms producing certain types of tobacco.
