_ CASE IN POINT.
WHAT BECAME OF THE ~
_ BILL OF RIGHTS?

In the Summer of 1951, according to

- information on my desk, President Tru-
man and Secretary of State Acheson -

made a secret agreement with a number

_ of foreign nation members of NATO giv-

ing them authority to arrest, try and
punish members of the American armed

_ forces who might be accused of violating

the laws in those countries.. Up to that
time every American service man, wher-
ever he might be in the world, could be
tried and punished only by the army,
courts and officers of the United States

He was still protected by the Bill of
- Rights. He could still appeal his case to

higher courts in this country. This se-
cret agreement was ratified in 1953 by

- the United States Senate. As of now, it

is the Supreme Law of the Land notwith-
standing the provisions. of our National
Constitution. This un-American treaty
was put: through the United States Sen-
ate by President Eisenhower and Secre-

_ tary of State Dulles. You will remember
that it was entered into secretly in the

first place by President Truman and Sec-

reyary Acheson.

According to- this same information,
an American soldier in France was ar-
rested by French authorities and charg-
ed with driving off in a parked taxicab.
Until this secret treaty was entered into,

been turned over to the American forces

- for trial and punishment. But, with this

secret. treaty, this soldier was thrown in-

to a French jail, tried and convicted in a

: French. court, sentenced to five years at
__ hard labor in a French prison.

taken away from him without any action
to amend the Constitution.

Under that secret agreement every
WAC, WAVE, Army. Nurse, as well as
other military personnel, can be taken up

and thrown into foreign convict camps

and confined under such conditions and
for such length of time as those foreign-
ers may determine.

A number of other cases could be cit-
ed but space, at this time, does not
permit.

Your United States Constitution is
the heritage coming down to you. Every
word inf it represents principles of lib-
erty, sanctified by the blood of thousands
of martyrs on the battle field, at the
stake, on the guillotine and in miserable
prisons. Do you love it enough to raise
your voice in its defense?

The chief executive of the nation and
of each state rightfully has authority to
use military force when necessary to de-
fend and protect lives and property of
the people. This is no reason why the
Governor of a state or the President of
the United States should-have the power

to change the Constitution or the Laws.

The Bricker Amendment does not de-
prive the President of any rightful au-
thority. It in no wise interferes with him
in entering into any agreement with any
foreign: nation if that agreement is con-
sistent with the Constitution of the Unit-
ed States. More power than that will

~ never be asked by a patriotic. President.

Any President who wants more power
than that.is dangerous to the safety of
this nation.

The adoption of the original Ten
Amendments to the Constitution known
as the Bill of Rights was not considered
by George Washington as any reflection

-on him and there is no good reason why

the adoption of the Bricker Amendment
should be considered a reflection on Hi-
senhower or any other President.
