As required by O.C.G.A. 43-45-8 (3), the Georgia Structural Pest Control Commission submits the following annual report.
The Georgia Structural Pest Control Commission met monthly during Fiscal Year 2016 on the following dates:

All meetings began at 9:30am in Room 201 of the Agriculture Building with the exception of the July 14th meeting held at 10am in the barn of Jaemor Farms in Lula, the October 13th meeting held at 8:33am in the Port Auditorium of the Georgia Ports Authority in Garden City, the January 12th meeting held at 10am at the Lucy Cobb Chapel in Athens, the February 9th meeting held at the Post 50 Auditorium in Atlanta, and the June 14th meeting held in the H.M. Stewait Center for Continuing Education of the University of
N01th Georgia.
Expenditures for the Commission and records of attendance for each member are included.

July 14th, 2015
A. The Georgia Structural Pest Control Commission conv.ened at 10:00 a.m. in the barn of Jaemor Farms in Lula, Georgia on July 14th, 2015. The following commission members were
present: Derrick Lastinger, Vice-chair, l<im Bragg, Dr. Brian Forschler, Bodine Sinyard and
Greg Holley.
B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA
and CPCO representatives, registrants and other members of the pest management
industry.
C. Motion was made by Mr. Sinyard to approve the minutes of the June meeting. Mr. Holley
seconded the motion and motion passed.
D. The Commission welcomed Mrs. l<im Bragg to the meeting. Mrs. Bragg was recently
appointed by Commissioner Black to serve as the Consumer Affairs and Protection member.
Mr. Lastinger administered the oath of public office to Mrs. Bragg.
E. Motion made by Mr. Sinyard nominated Mr. Chris Gorecki as Commission chairman and
motion made by Mr. Holley nominated Mr. Lastinger as vice-chairmen for the new state

fiscal year. Dr. Forschler seconded motion and motion passed. F. The Commission approved company license applications (see Attachment 2).
G. Dr. Forschler provided the UGA update. He discussed Department of Entomology' s
Department Head, Dr. Ray Noblet's recent retirement announcement. Dean Scott Angle is
assembling a search committee to find a replacement and hopes to find a replacement by
the end of the year. Mr. Sinyard suggested that we recognize Dr. Noblet's tenure at the
Athens Commission meeting in January 2016.
H. Mr. Lastinger discussed the final draft of the state pollinator protection plan. He shared a
copy _of the final draft and a request from the authors of the committee to submit a letter of
support. Mr. Sinyard motioned that the Commission subm it the letter stating the
Commission's involvement and support of the June 4th published Protecting Georgia's
Pollinators: A state plan for promoting a large, healthy and diverse pollinator workforce. Mr.
Holley seconded motion and motion passed. The supporting letter and the pollinator
protection plan will be posted on the Commission website. Mr. Lastinger briefly discussed
the Federal and U.S. EPA pollinator protection strategy; the EPA strategy is currently
proposed and open for public comment. Mr. Lastinger also mentioned that ASPCRO is
drafting comments on the U.S. EPA strat~gy. He will share the comments once they are
finalized and submitted to the agency.
I. Mr. Lastinger provided the Department update. He mentioned the Georgia Clean Day which will be held on July 22nd at the Gwinnett County Fairground s. There continues to be
registration space available for those who would like to participate.
J. Ms. Jenny Wren _discussed the Department's preparation and response for the expected
outbreak of the highly pathogenic influenza in Georgia poultry. She highlighted concerns

that an outbreak could possibly wipe out a large portion of Georgia poultry. A group of department employees had the opportunity to travel to Minnesota to assist with the turkey
depopulation efforts in response to a recent outbreak. For potential outbreaks, Georgia has
put into place a response plan to detect, control, quarantine, and properly dispose the
affected poultry. The Department has started training employees representin_g all Divisions
and the first training was recently held in North Georgia and another one scheduled for
South Georgia.
I<. Mr. Lastinger provided the program update. He noted that the Commission has finalized
plans to hold the October Commission meeting at the Port of Savannah. He also discussed
program staff involvement in several new workshops at the University of Georgia Training
Center in Griffin. Lastly, Mr. Lastinger discussed a U.S. EPAfunded bed bug outreach project
for Georgia consumers. The department is working with the Georgia Department of Public
Health on the project.
L. Ms. Christy l<uriatnyk discussed a new grant application through HUD that she is currently
working with that will research how educating residences in multi-family housing would
affect their understanding of controlling bed bugs. M. Mr. Taylor provided the licensing update. He noted that by the deadline of June 30th, 1,023
companies and 4,244 registered employees were renewed. Licensees can be renewed until September 30th by paying a late fee. Late fees include an additional $10.00 for registered
employees, $100.00 for certified operators, and $100.00 for companies. Lastly, the
Licensing Division will be distributing late notices.

N. Mr. Burton requested the Commission review three GDA cases involving a termite
treatment failure and make a recommendation for corrective action under rule 620-6-
.07{5}. Mr. Wesley Burton provided details regarding the case. After discussion, the
Commission made a motion to recommend that GDA require a comprehensive soil applied
termite treatment and for GDA to complete re-inspections to verify compliance.

August 11, 2015
A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the
Agriculture Building on August 11, 2015. The following commission members were present:
Chris Gorecki, Chair, l<im Bragg, Dr. Brian Forschler, Bodine Sinyard, Christy l<uriatnyk, and
Greg Holley.
B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA
and CPCO representatives, registrants and other members of the pest management
industry.
C. Motion was made by Mr. Sinyard to approve the minutes of the July meeting. Mr. Holley
secon ded the motion and motion passed.
D. The Commission approved company license applications (see Attachment 2).

E. Dr. forschler provided the UGA .update. He mentioned that classes will begin on August
17th Professor ana Dean of .the coilege of Agricultural and Environmental Sciences, Dean
Angle announced his retirement starting September 2015. Commissioner Black has been
appointed to serve on the search committee to find a replacement. Dr. Forschler also
mentioned that Dr. Ray Noblet, the current Department Head of Entomology for the
University of Georgia, announced his retirement a few months ago.
F. Mr. Taylor provided the program update. He discussed the US EPA proposed changes to the
commercial pesticide applicator rule. The rule change has the possibility of affecting the
structural pest control industry. He discussed some of the proposed rules.
G. Mr. Taylor announced the October Commission meeting location and details which will be
held at the Port of Savannah and provided a copy of Public Notice 15-04. Lastly, he provided
a renewal update. As of August 7, 2015, 1,067 company, 1,936 certified operator and 4,776
registered employee licenses have been renewed.
H. Mr. Gorecki discussed a recent letter sent to the Commission regarding Charles Guy with
Good Guys Pest Control. The letter addressed continued concerris and rule proposal
regarding advertising on the internet. Mr. Gorecki stated that this was discussed at an
earlier meeting including the Structural Pest Control Commission's limited authority in such
matters. Mr. Gorecki stated that he plans to discuss the letter with Mr. Lastinger. I. Mrs. Lauren Fraulick provided the legislative update. On August 18th the house will be
meeting to discuss Representative John Carson's proposed tax reform. Also, this fall there
will be a number of committees that will be studying the use of drones. She stated that pest
control operators could be looking to use them in the future. Lastly, Senator Henson
proposed a bill regarding how and when pestiddes are applied within certain structures.
The bill was later dropped.
J. Mr. Bell provided the NPMA update. He discussed a meeting that he had with NPMA
leadership. At the meeting, a recently released HUD map was discussed. The revised map

consists of a listing of termite pressures in the United States. FHA and HUD are also making

rev1s1ons to their documentation in reference. NPMA seeks to get an interpretation
concerning th_e changes with the hope of HUD referencing the importance of the Wood ( Infestation Report on letterhead. Lastly, he mentioned the 59th annual ASPCRO meeting that will be held in Ft. Lauderdale, Florida from August 23 rd-August 25th_

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the
Agriculture Building on September 8, 2015. The following commission members were

E. Mr. Tommy Gray provided the Department update. He noted the Department's current
priority in preparing for potential highly pathogenic avian influenza. The Animal Protection
Division has been closely monitoring for detections in Georgia. Accordingly, many of the
department employees have been trained to respond if needed. The comment period for
)
EPA's strategy on pollinator protecti~n closed last week, the Department submitted comments to the docket. Lastly, the Agriculture Inputs section recently received a new
grant from FDA to assist wit~ the feed inspection program. Particularly to help with BSC and
mad cow disease. Coming up this fall, the Department will be hosting several events
including the Georgia Grown Showcase on September 1ih in Moultrie, the Georgia National
Fair and the Sunbelt Expo in October.
F. Mr. Taylor provided the renewal update. He noted that the license renewal period will end September 30th. As of today 1,103 companies, 1, 952 certified operators, 5,043 registered
employee licenses have been renewed. Currently there are about 140 companies, 200
certified operators, and 2,000 registered employees have.expired licenses.
G. Mr. Lastinger mentioned a few UGA related activities. He mentioned that UGA's Structural
training center in Griffin held the first school 1PM workshop. There will also be the termite
workshop later this week and again in two weeks. The search committee for the Chair
position of the UGA Entomology Department had their first meeting last Friday. Mr.
Lastinger announced that the field staff will be working with the industry on a field strategy
to work with expired licensees to get renewed and assist with applications as needed. He
also provided highlights from the ASPCRO conference, which occurred last month. The
highlights include the US EPA proposed certification and training regulations, a study
predicting a 20% increase in PMP jobs over the next 10 years, special sessions on Sulfuryl
Fluoride and recent incidents.
H. Mr. Lastinger mentioned details for next Commission meeting to be held at the Port of
)
Savannah on October 13th at 8:30 AM. The meeting will be held at the Conference Room Port Auditorium of the Georgia Port Authority Annex #2 Building located at 100 Main Street

I. Mrs. Lauren Fraulick discussed the legislative update. She noted that the study committees
are currently meeting this month including a study committee for the Hope Scholarship.
John Carson presented his tax reform package to the House Ways and Means Committee
last month. Lastly, there are two more open seats that will be up for special election in
November.
J. Mr. Bell with NPMA provided an update. He noted that HUD and EPA are eight days away
from their revision to the termite map. He also noted a concern within the industry
regarding environmental groups and neonicotinoids. It seems that focus has been moved
from neonicotinoids and pollinators to a broadened category of herbicides.

A. The Georgia Structural Pest Control Commission convened at 8 :33 a.m. in the Port Auditorium of the Georgia Ports Authority in Garden City on October 13th, 2015. The following commission members
were present: Chris Gorecki, Chair; Derrick Lastinger, Vice-Chair; Kim Bragg; Dr. Brian Forschler;
Bodine Sinyard; and Greg Holley.
B. Also in attendance were representatives with the Georgia Department of Agriculture, Georgia Ports
Authority, Pest Risk Committee, GPCA, and CPCO, and other members of the pest management
industry.
C. Motion was made by Mr. Sinyard to approve the minutes of the September meeting. Ms. Bragg
seconded the motion, and motion passed.
D. The Commission approved compa ny license applications (see Attachment 2).
E. Dr. Forschler provided the UGA update. He discussed the search for a new Department Head of the
Department of Entomology. The position has been advertised, with a closing date of December
2015. Comments to the search comm ittee are welcomed. The search for anew Dean of the College
of Agricultural and Environmental Sciences is ongoing.
F. Dr. Forschler explained that many states, including Georgia, do not mandate school integrated pest
management {SIPM), but university extension services frequently offer assistance for schools
interested in 1PM. He discussed a recent call received by the National Pesticide Information Center
)
from an anonymous school employee in Georgia who was concerned about pesticide safety. Mr.
Sinyard suggested dr<;1fting a letter to the Georgia Superintendent of Schools in regards to this issue.
Dr. Forschler will review and present options for contacting the Georgia Department of Education at'
the Commission meeting in November 2015.
G. Mr. Tommy Gray provided the Department update. He discussed the Department's multi-level
preparation for incidence of Highly Pathogenic Avian Influenza (HPAI) in Georgia. The likelihood of
HPAI cases in Georgia will decrease after November, but will rise again in early spring. Mr. Gray also
discussed the Georgia National Fair being held in Perry from October 8-18t\ 2015, and the Sunbelt
Expo
in
Moultrie
from
October
20-22

2015.
H. Mr. Gray mentioned that the proposed revisions to the U.S. EPA Certification of Pesticide Applicator Rule (40 CFR 171) are currently in the comment period, which ends November 28th, 2015.
Commissioner Gary Black has expressed his concerns over the proposed changes to the Georgia
Congressiona l Delegation. The Commission will prepare and submit comments to the agency.
I. Mr. Lastinger provided the .program update. He discussed a statewide field operation targeting
expired licenses. Department inspectors completed 87 license renewal inspections in two weeks. He
also mentioned the U.S. EPA's focus on regulatory oversight of structural fumigation, due in part to
the recent incidents in the U.S. Virgin Islands and Florida. Mr. Lastinger will report the number of
structural fumigations in Georgia at the November Commission meeting. He also shared that the
Department met with representatives of the Georgia Department of Natural Resources (DNR)
regarding licensing regulations for wildlife control in and around structures. He provided the
language to be placed on DNR'.s licensing website to inform permit holders that they will need to
obtain a license with the Department if they provide structural pest control inspection and/or
control of pests such as mice, rats or insects. DNR plans to host booths at the upcoming GPCA and
CPCO conferences.

J. Mr. Rick Bell provided an NPMA update. He stated that the Vice President of Operations of NPMA
(
plans to communicate with ASPCRO to discuss the impact of the proposed revisions to the U.S. EPA
Certification of Pesticide Applicator Rule if finalized. He also mentioned that OSHA is reconsidering
the definition of "confined space," and may classify crawlspaces as confined spaces. This would
necessitate the presence of two people when entering a crawlspace.
I<. Mr. Gorecki proposed sending-the Commission's comments to U.S. EPA on the proposed revisions to
the Certification of Pesticide Applicator Rule. Mr. Lastinger and Mr. Gorecki will work on compiling
comments and contacting UGA Extension for their input.
L. Mr. Lastinger discussed potential locations for Commis'sion meetings in the upcoming calendar year.
The January 2016 Commission meeting will take place in Athens, Georgia.
M. Mr. Lastinger suggested revising the Commission's Underfloor Ventilation Fact Sheet to reference
the Georgia State Minimum Standard Energy Code (402.2.9) regarding insulation of per,imeter walls.
He also proposed the inclusion of diagrams that illustrate the requirements. The Commission will
compose and review the fact sheet before the next Commission meeting.

November 10, 2015
A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the
Agriculture Building on November 10, 2015. The following commission members were
present: Chris Gorecki Chair; Derrick Lastinger Vice-chair; Kim Bragg; Dr. Brian Forschler;
Bodine Sinyard; Christy l<uriatnyk; and Greg Holley.
B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA
and CPCO representatives, registrants and other members of the pest management
industry.
C. Motion was made by Bodine Sinyard to approve the minutes of the October meeting. Dr.
Forschler seconded the motion and motion passed.
D. The Commission approved company license applications (see Attachment 2).
E. Mr. Doug Barnes introduced the GPCA 2015 Leadership Class. GPCA conducts the leadersh ip
program every other year. Currently, the class has nineteen members who have completed
the final session.
F. Mr. Lastinger discussed a start-up company that plans to provide testing and management
for dust mite allergens. The company described a dust mite allergen reduction service that
)
includes vacuuming and heat treatment services. The information provided did not make any mite management claims. An inquiry was made regard ing licensing requirements and
the Department requested input from the Commission.
G. Dr. Forschler provided the UGA update. He noted that the search for the Department head
is still moving forward. He reminded the Commission of Dr. Ray Noblet's upcoming
retirement.
H. Dr. Forschler announced the January Commission meeting location that will be hosted by
the Department of Entomology. The meeting will be held at the Lucy Cobb Chapel located at
the University of Georgia Carl Vinson Institute of Government in Athens, Georgia.
I. Mr. Gray provided the Department update. He discussed the Department's efforts to
prepare for potential Avian Influenza detections. He mentioned that US EPA has proposed
to revoke the remaining chloropyrifos product uses.
J. Mr. Lastinger provided the program update. He discussed a recent announcement regarding
the US EPA Office of Inspector General to conduct an evaluation of US EPA's regulatory
oversight of structural fumigants. The evaluation will _include state oversight of structural
fumigations. Mr. Lastinger noted that over the past five years, the Department has received
an average of 50 fumigation notifications per year. Lastly, he mentioned that Mr. Mike
Evans, Program Director for the Plant Protection Section, will be serving as the Department
representative on the Brown Marmorated Stink Bug Southern Region Work Group.
I<. Mr. Taylor discussed recertification course renewal for 2016. He mentioned that a
notification will be sent by email to instructors and sponsors as a reminder to renew
courses for 2016.

L. Mr. Lastinger discussed proposed changes to the under-floor space fact sheet. The changes

included updating the energy code reference, clarification for conditioned air supply in unvented spaces and diagrams for unvented space options. Motion was made by Mr.
Sinyard to approve changes to the fact sheet. Ms. Bragg seconded the motion and motion
passed. M. Lauren Fraulick provided the legislative update. The Session for the upcoming year will
begin on January 11th. N. Mr. Rick Bell provided the NPMA update. He noted that OSHA may change the construction
specific standard, which could possibly affect the pest control industry. He also noted that
US EPA granted a 30 day extension for the comment period on the proposed certification
and training regulations. 0. Mr. Lastinger mentioned the posting of two public notices on the website including Public
Notice 15-05 which references a change in the December Commission meeting date and
Public notice 15-06 which references the 2016 meeting schedule.

E. Dr. Forschler provided the UGA update. He reminded everyone that the location for next

He discussed a student research project that compares pest management in school
cafeterias and county health scores. Dr. Forschler has been working with GDA to make
some minor edits to the Employee Registration Manual. The revised manual should be

complete and submitted to the Commission prior to the January meeting.
.F. DL Dan Suiter discussed the selection process of the candidates for the Entomology
Department Head position. He noted that next year will be a full year of training workshops
including several new workshops, the 10-week certificate program and webinars. Mr.
Lastinger noted that several officials from the Governor's Office of Planning and Budget are
planning to attend a workshop to learn about the Department's role in regulatory education
and outreach.
G. Mr. Lastinger provided the program update. He discussed the regulatory fumigation
evaluation that is being conducted by the US EPA Inspector General's office. US EPA Region
4, Georgia and Florida were selected for evaluation. Once the evaluation is complete, a
report will be issued that will likely include recommendations for the US EPA Pesticide
Programs. H. Mr. Taylor announced the 2016 recertification course renewal information. He reminded all
sponsors that current courses must be submitted for renewal for approval in 2016. 700
course renewal applications have been received. Course approval notifications will be
processed and notifications will be sent out by the end of the year.
I. Mrs. Ashley Sellers provided and overview of the Georgia rule change process. The Georgia
Structural Pest Control Act explicitly gives the Georgia Structural Pest Control Commission
and the Commissioner the authority to adopt and amend the rules and regulations. Specific
procedures for adoptio'n, amendment, and repeal <?f a rule and regulation are in the
Administrative Procedures Act. She discussed the rule making process and responded to

questions.

J. Mr. Gorecki discussed the proposed US EPA certification and training rules. He suggested that the Commission consider supporting the comments that will be submitted by the ( Department and the national pesticide regulatory and industry associations. Mr. Lastinger mentioned that at a recent full SFIREG meeting, US EPA seemed to be listening to state concerns regarding the proposed rules and may consider allowing a state equivalency provision to allow variations in state certification and recertification standards.
I<. Mrs. Lauren Fraulick provided the legislative update. She noted that the session starts on January 11th.

A. The Georgia Structural Pest Control Commission convened at 10:00 AM at the Lucy Cobb
Chapel in Athens, Georgia on January 12, 2016. The following commission members were
present: Chris Gorecki, Chair; Derrick Lastinger, Vice-chair; Christy Kuriatnyk; Dr. Brian
Forschler; Bodine Sinyard; Kim Bragg; and Greg Holley.
B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA
and CPCO representatives, registrants and other members of the pest management
industry.
C. Motion was made by Mr. Sinyard to approve the minutes of the December meeting. Kim
Bragg seconded the motion and motion passed.
D. The Commission approved company license applications (see Attachment 2).
E. Dr. Ray Noblet was recognized for his service to the Department and Commission. Mr.
Gorecki presented the Distinguished Agriculture Steward on behalf of Commissioner Black.
He also read a letter from Commissioner Black inviting Dr. Noblet to attend a future
Commission meeting.
F. Dr. Forschler provided the UGA update. He thanked everyone for attending the meeting. He
)
announced that Samuel Pardue was named as the new dean and director of the UGA's
College of Agriculture and Environmental Sciences and his appointment will is effective on
March 14th. The search for the head of the Entomology Department continues and he
introduced and thanked Dr. Nancy Hinkle for se rving on the search committee. She
discussed the search committee activities and noted that interviews will begin next week.
Dr. Forschler discussed Dr. Dan Suiter's upcoming workshops and webinar series. He also
noted that the Entomological Society of America recently published an ACE 1PM certification
program training manual and recognized similarities with the 1PM chapter in the Georgia
Employee Registration Manual.
G. As requested by the Commission, Mr. Tim Taylor provided an update on the pass and fail
rates of the employee registration exams for 2014 and 2015. Overall the percentage of
passing exam scores increased in 2015 from 2014. This was unexpected since the updated
manual and exam questions were implemented in 2015. Mr. Lastinger mention ed that
2015 was a renewal year so the percentage of first time examinees may have decreased.
Since the revised manual was published in January 2015, several suggest ions and edits were
received and considered. Mr. Taylor and Dr. Forschler reviewed the suggestions and
incorporated many of them in the revised manual which was previously distributed to the
Commission. Motion was made by Mr. Sinyard to approve the revised employee
registration manual. Mr. Holley seconded the motion, and motion passed.
H. Dr. Forschler provided the UGA Urban Entomology Research Report. He provided an
overview of ongoing and new resea rch projects. After introducing his students, each
student provided a brief summary of th eir research project (see attachment 3).

I. Mr. Gray provided the Department update. He noted that the General Assembly started this
week and that the budget continues to look good for this year. Lastly, he thanked the
Commission for their hard work and successful meetings.
J. Mr. Lastinger provided the program update. He mentioned that Protecting Georgia's
Pollinators Publication had been published to the UGA and GDA websites. He also
mentioned that the US EPA released preliminary risk assessments for insecticides that are
found to be potentially harmful to bees. The first assessment is open for a 60 day comment
period. Mr. Lastinger also announced that Mrs. Ashley Sellers with the GDA Legal Services
office was promoted to the Director of Lega l Services. Lastly, he recognized Ms. Lillian
Santiago for her service to the Department and wished her well on her recent retirement.
K. Mr. Burton discussed 2015 compliance activities with the new rules that were published in
2014. He noted that most compliance issues were with the new pesticide use record
keeping requirements for technician license numbers and US EPA Pesticide Registration
Numbers. He also reminded attendees to confirm the use of the cu rrent Official Wood
Infestation Inspection Reports.
L. Dr. Jim Fredericks w ith NPMA discussed his role at NPMA including his recent activities that
involved working closely with state regulatory officials. He also provided an overview of
NPMA and highlighted current regulatory related activities.
M. Mr. Lastinger discussed a proposal that was received from Dr. Suiter regarding distance
learning recertification credit s. He will follow-up with Dr. Suiter for additional information.
N. Mr. Lastinger mentioned a meeting space change for the February Commission Meeting and
the date change for the March meeting which is now scheduled for March ih. A public

notice will be issued with the new meeting information.

A. The Georgia Structural Pest Control Commission convened at the Post 50 Auditorium in Atlanta, Georgia on February 9, 2016. The following commission members were present: Chris Gorecki, Chair; Derrick Lastinger, Vice-chair; l<im Bragg; Greg Holley; and Christy l<uriatnyk.
B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA and CPCO representatives, registrants and other members of the pest management industry.
C. Motion was made by Mr. Holley to approve the minutes of the January meeting. Ms. Bragg seconded the motion and motion passed.
D. The Commission approved company license applications (see Attachment 2). E. Mr. Lastinger discussed a few activities from UGA. He noted that the University of Georgia
has printed the Georgia Pollinator Protection booklets. The search committee for the Department of Entomology head will complete their work next week after the last scheduled interview. F. Mr. Lastinger provided the Department update. He mentioned a detection of HPAI in Indiana poultry that has led to a state response. The Department is following this incident closely. He is now serving as the deputy planning section chief for the Incident Command System. G. Mr. Lastinger provided the program update. He mentioned that the company license application for new online applications is under development. Following up with last month's request by Dr. Suiter to archive distance learning webinars, a meeting has been scheduled to meet with Dr. Suiter at the training center to review and discuss. H. Mr. Lastinger provided an update on the proposed US EPA Certification and Training regulations. The Department, ASPCRO, AAPCO, and NPMA submitted comments to the federal docket. I. Mr. Lastinger discussed termite retreatment case reviews. He proposed that the Commission consider implementing a policy that would provide guidance on the termite retreatment rule. The Commission discussed that the policy would require a retreatment plan be submitted to GDA when a retreatment is required by corrective action. J. Mrs. Lauren Fraulick provided the legislative update. She noted the recent GPCA Legislative Luncheon held at the state capitol. K. Mr. Gorecki provided th e NPMA update. He mentioned that NPMA released talking points to provide the industry with information regarding the Zika virus. Legislative day is scheduled for the 1lh of March in Washington, DC. L. E. Dr. Suiter met with the Commission to discuss his proposal on recertification credit for
archived webinars. He noted that the archived webinars would have a facilitator at a
specific training site to ensure that attendees are attentive and complete the training
verification records. At the end of the presentation, the instructor from the archived
sessio n would be available for any questions by teleconference at the end session for 15

minutes. Mr. Lastinger proposed that Dr. Suiter provide the details in a written document for the Commission to review and consider at the next Commission meeting.
F. Dr. Forschler provided the UGA update. He discussed the UGA research project looking at
the health score for school cafeterias and correlating this information with the school's pest
management program. He also mentioned that Samuel Pardue will be the new Dean of the College of Agriculture and Environmental Sciences starting on March 14th .
G. Mr. Gray provided the Department update. He provided copies of the new employee
newsletter which highlights work in each division. He stated that the Licensing Division has
moved under Operations at the Department and that the Chief Operation Officer, Dan
Brown, has transferred to the Department of Corrections. Lastly, the highly pathogenic
avian influenza training continues to be a top priority among the Department.
H. Mr. Lastinger provided the program update. He mentioned that the revised Employee
Registration Manual has been published on the website. Following up with issues of federal
trademark names, the pending request has now been sent to the Attorney General's office
to review the current rule regarding the approval of company names. Lastly, he mentioned
a recent incident involving the impersonation of state inspectors by licensed pest control
technicians. The GDA Inspector General investigated the incident and found that the
incident did occur as reported qnd it addressed accordingly.
I. Mr. Lastinger mentioned a letter from Marcy Raich regarqit){5 her business, K9 Bed Bug
Detection and her concern with Georgia's licensing requirements. In her letter, she
requested an exemption from the current requirement and the creation of a new license
category for inspections only. Mr. Lastinger also mentioned that he spoke to Ms. Raich to

discuss the current requirements and the options for getting certified and licensed. The

Commission discussed her requests and agreed that the current requirements are
appropriate and asked Mr. Lastinger to respond to Ms. Raich.
J. Mr. Lastinger discussed the termite retreatment rule and the draft policy. He mentioned
that the Commission requested that the Department draft policy to address the current
rule. The Commission discussed the current process and the need for some basic
interpretation of the rule to address the variety of situations. Motion was made by Mr.
Gorecki to remove the last sentence and accept the policy. Mr. Sinyard seconded the
motion and motion passed.
K. Mr. Lastinger announced that the June Commission meeting will be held at the University of
North Georgia in Dahlonega.
L. Mr. Rick Bell provided the legislation and NPMA updates. He discussed NPMA's Legislation Days coming up on March 13-lSth. Efforts will focus on Department of Labor overtime
proposed changes, NPDES permitting issues, mosquitos, pollinators and US EPA proposed
certification rules.

April 12, 2016
A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the
Agriculture Building on April 12, 2016. The following commission members were present:
Chris Gorecki Chair; Derrick Lastinger Vice-chair (by telephone); Laurie Padgett; Dr. Brian
Forschler; Bodine Sinyard; and Greg Holley.
B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA
and CPCO representatives, registrants and other members of the pest management
industry.
C. Motion was made by Mr. Sinyard to approve the minutes of the March meeting. Mr. Holley
seconded the motion and motion passed.
D. The Commission approved company license applications (see Attachment 2).
E. Dr. Forschler provided the UGA update. He noted that Dr. Kris Braman has been appointed
as Department Head of Entomology beginning in June. She has worked at the Georgia
Experiment Station in Griffin for the past 27 years.
F. Mr. Lastinger provided the Department and program updates. He mentioned that the
Department has a new Chief Information Officer, William Rutherford. Mr. Lastinger also
)
noted his attendance at the current SFIREG committee meeting in Denver. During the
meeting, EPA has announced that they plan to finalize the proposed certification and
training rules and pollinator protection strategy by the end of the year. For program
activity, he noted that the field staff will be participating in a st atewide meeting in Macon
next month. Field staff have been involved in several pest management workshops at the
UGA Structural Pest Training Center.
G. Mr. Lastinger stated that the Department was contacted by Stego Industries regarding their
new product called PANGO Termite Defense System. The product is a pre-construction
termite control device that is installed prior to the pour of a slab foundation. EPA doesn't
consider it a pesticide or a pesticide device. However, the Georgia rule definition for device
does include the product since the product claims to provide termite protection.
Considering this information, the product would have to be installed by a Georgia licensed
pest control operator in the category of wood-destroying organisms.
H. Mr. Gorecki discussed a demand letter received from Barton Black Law, LLC on behalf of
Hankey Pest Control to approve their name change request. The company originally
requested a company name change to The Green Queen and the Commission did not
approve the request on November 10, 2015 due to a similar licensed company name. In
January, the company requested the Commission to reconsider and approve the requested
name. In January the Commission decided to hold the request si nce there is a current
request at the Attorney General's office to review the rule. Motion was made by Mr. Gorecki to maintain the November 10th decision. Ms. Bragg seconded the motion and

I. Mr. Lastinger discussed an issue with the Profume label placarding requirement and conflict
(
with the Georgia sign posting fumigation rule. He provided an issue paper and the following
position:
The Georgia Rule 620-8-.04 for posting a sign is to provide a warning to all
persons to keep away. The warning sign specifications were designed to best
communicate this information by requiring the sign be in insoluble ink and
contrasting colors. When a rule or label requirement is found to be more
restrictive, the more restrictive requirement applies to the applicator. Since
the Georgia rule requires the print to be red with the exception of the words
"DANGER" and "DEADLY POISON" to be in black letters, the Enforcement
Agency considers the Georgia rule to be more restrictive compared to the
Profume label placarding requirement.
Motion was made by Mr. Gorecki to accept the issue paper for guidance policy and for the
Department to do outreach to licensed fumigators. Ms. Bragg seconded the motion and
motion passed. The guidance document will be posted on the website.
J. Mrs. Lauren Fralick provided the legislative update. She noted that the legislative session
finished up two weeks ago. The Governor is in the bill signing and review period. The Governor has until May 3rd to sign or veto a bill. Lastly, nothing passed in the session
regarding tax reform.
I<. Mr. Rick Bell provided the NPMA update. Legislative Day was a success in Washington D.C.
with efforts focusing on two main issues. Legislative meetings focused on concerns with the
Department of Labor's increase in overtime pay. The other issue that has increasingly been

in the news is the Zll<A virus. Funds from the government have been requested for the CDC
to increase research related to the virus. He also noted that ASPCRO's mid-year meeting will
be held next week in Burlington, Vermont.
L. Mr. Lastinger mentioned that Laura Edison from the Georgia Department of Public Health
contacted the Department regarding a project on pesticide exposure surveillance. She
would like to attend a future Commission meeting to discuss her project.

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in Room 201 of the Agriculture Building on May 10, 2016. C. Motion was made by Mr. Sinyard to approve the minutes of the April meeting. Mr. Holley seconded the motion and motion passed.
D. The Commission approve.d company license applications (see attachment 2). E. Ms. Jenny Wren provided a report of administrative actions. Ms. Wren discussed an
overview of violations for administrative orders issued since January 2016 (see attachment 3). F. Mr. Eric Olsen, program manager in Ag Inputs, provided the background which prompted the development of the new category 41 (Mosquito Control) commercial pesticide applicator license under the Georgia Pesticide Use and Application Act. To obtain a category 41 license, an applicant must pass the general standards and category 41 examinations. All contractors must have one full time pesticide applicator category 41 license, in addition to a business contractor license for each operating location . Mr. Olsen also noted an increase in applicator and contractor licenses. Lastly, he clarified that lawn care operators that hold a Turf and Ornamental licenses must also hold a Mosquito category to provide these types of services. It was suggested that the Department focus outreach on the Mosquito licensing requirement to lawn care operators. G. Mr. Lastinger provided the Department and Program updates. He mentioned an upcoming Georgia Clean Day scheduled for this summer in Laurens County. He noted that due to a policy change in the finance division, there will be some changes to Commission daily travel expense allowances. The Profume guidance notice that was approved last month has been posted on the Commission website. The Department published a Protecting Georgia pollinator's webpage. The webpage is found under the Plant Protection Section. Lastly, he noted that next week, the Plant Industry Division field operations staff will be meeting at Macon Farmers Market. The two day meeting will include a session on urban mosquito pressures and management by Elmer Gray with UGA and a session on Zika virus outreach and surveillance efforts by the Georgia Department of Public Health. H. Dr. Forschler provided the UGA update. The new Departm ent Head, Dr. Kris Braman, begins
on June 1st_ He discussed the results of a mosquito control research project by one of his
students. Lastly, he mentioned the collaborative project between the Department and the

University to control a drywood termite infestation at the Thomasville Farmers Market. The

project included efforts by a local pest management company and Nisus Corporation.
I. Dr. Suiter discussed his proposal regarding recertification _credit for archived presentations.
He noted that after the Department has reviewed the proposal, he would be more than
agreeable to come back and answer any questions regarding his proposal.
J. Mrs. Lauren Fralick provided the legislative update. Two weeks from today will be the
primary election in Georgia.
I<. Mr. Lastinger highlighted a few discussions from the ASPCRO midyear meeting that was
held last month in Burlington, Vermont. US EPA reached out to ASPCRO to finalize model
contract elements for school 1PM contracts. Additionally, the number of employee
retirements at the agency has created a knowledge gap. This issue is a concern which is
leading to further discussions of how best to address the issue.
L. Mr. Gorecki discussed the rule making document that was distributed to Commission
members. The document will be used to review draft rules and track discussions. Dr.
Forschler recognized the Department effort to develop a tool for rulemaking. Mr. Gorecki
suggested that after rulemaking that the Commission develops outreach materials for new
rule compliance assistance.
M. Mr. Alex Conti, discussed details of the June meeting. The meeting will be held at 9:30 in
University of North Georgia's H.M. Stewart Center for Continuing Education. The center is
located at 25 Schultz Avenue Dahlonega, Georgia 30533.
N. Mr. Lastinger discussed possible dates for the July meeting.

A. The Georgia Structural Pest Control Commission convened at 9:30 a.m. in the H.M. Stewart
Center for Continuing Education of the University of North Georgia on June 14, 2016. The
following commission members were present: Chris Gorecki, Chair; Derrick Lastinger, Vice-
chair; l<im Bragg; Dr. Brian Forschler; and Greg Holley.
B. Also in attendance were representatives with the Georgia Department of Agriculture, GPCA
and CPCO representatives, registrants and other members of the pest management
industry.
C. Motion was made by Mr. Holley to approve the m inutes of the May meeting. Dr. Forsch Ier
seconded the motion and motion passed.
D. The Commission approved company license applications (see Attachment 2).
E. Ms. Debo.rah Adams, the director of continuing education at the University of North
Georgia, welcomed the Commission to the University and Dahlonega. She also provided
some interesting history and facts about Dahlonega and the University of North Georgia.
F. Mr. Lastinger discussed the changes with daily allowance reimbursements for Commission
members.

G. Dr. Forschler provided the UGA update. He stated that Dr. Braman has started with the Entomology Department and he hopes to have her attend a commission meeting in the
future.
H. Mr. Allen Beiriger with Active Pest Control met with the Commission regarding a letter that
he had submitted regarding some concerns with the marketing and advertising by Aptive
Environmental. He specifically expressed concerns with their forceful marketing efforts and
advertising materials only using the name "Aptive" and sometimes "Aptive Pest Control"
and not the licensed name. He further stated that Active Pest Control custome'rs are
confused as the name is similar when approached by Aptive representatives. Mr. Gorecki
suggested that a -letter be sent to Aptive addressing the issue. Mr. Lastinger offered for
GOA to do a review of the sa les and marketing efforts including the information received
from Active Pest Control for compliance and respond according to enforcement response
policy.
I. Mr. Lastinger provid ed the Department update. He mentioned an article in the April issue of
the Market Bulletin that discussed the Zika virus and the Department of Public Health's "Tip 'n Toss" campaign. A Georgia Clean Day is scheduled for June 29th at Southern Pines Ag
Expo in Dublin, Georgia. Registration is required to participate. He announced the Southern
meeting of the Association of America Pesticide Safety Educators (AAPSE) is being held in
Savannah, Georgia this week. An intern for the Plant Indu stry Division, Rachel Wel ch, has
been assisting with current research on rule changes for severa l non-structural pesticide
regulations.

J. Mr. Lastinger provided the program update. Mr. Lastinger noted that when the Department
(
issues WDO corrective action reports to companies, a change has been recently made to
issue warning letters in addition to the WDO corrective action reports if other violations are
discovered that don't require a corrective action such as a record keeping violation. The
warning letters are issued to notify the company about non-compliance. He also mentioned
that the National Pesticide Information Center (NPIC) published new guidelines and helpful
tips for cleaning up pesticides misapplied indoors. Travis Whitley of the field inspection staff
has now taken on the role of field supervisor. A compliance specialist has been hired and
will start on July 151. July 15th has been selected as the date for the next Commission
meeting. A public notice will be posted with the new meeting date. Lastly, Jenny Wren will
provide a compliance summary of violations at the next meeting in July.
K. Dr. Forschler requested that the Commission work with the GDA to do some outreach to
Georgia Consumers regarding Mosquito Control Operators and urging consumers to verify
that their contractor is licensed to do mosquito control by GDA. Mr. Lastinger will work on
coordinating an effort at GDA with the Communications Office.
L. Mr. Gorecki discussed the rulemaking document. The . Commission discussed 10
housekeeping related proposed rule changes. Most of these changes were to correct errors
or add clarification to a current rule. Four additional issues were briefly mentioned and will
be discussed at the August meeting. Dr. Forschler requested that the first ten draft rules be
accepted as currently written in the current rulemaking document . Air membered agreed to
the request.

M. Mr. Rick Bell provided the NPMA report. There has been an outreach effort by NPMA to the

CDC regarding mosquito control needs and how the pest control industry can assist with
mosquito management needs. Arnold Layne has been named the new Deputy Director of
the US EPA Pesticide Division and is expected to be a great resource in bridging the gap
between the industry and EPA.
