INTRODUCTION
The purpose o f t h is annual rep ort i s to inform the reader about the P u b lic Se rv ice Ccnmission -- i t s background and h is to r y as w e ll as i t s 1987 workload. This rep ort e x p la in s the Ccnm ission' s reg u la to ry au th o rity and o u tlin e s i t s d u tie s and r e s p o n s ib ilit ie s , which have evolved over th e y e a r s , as documented in a section e n title d "H istory o f the Georgia P ublic Service Coirmission."
The Commission i s a sm all s ta te agency, bu t i t p la y s a very im portant r o le in G e o rg ia 's economy. By s u c c e s s fu lly b alan cin g the needs o f competing in te r e s ts -- o f consumers fo r a ffo rd a b le , r e lia b le s e r v ic e , w ith the in te r e s ts o f in v esto rs who req u ire a reasonable return on t h e ir investm ent in p u b lic s e rv ic e companies -- the Commission co n trib u te s s u b s ta n tia lly to G e o rg ia 's economic h e alth and growth.
Changes in techn ology, the world and n a tio n a l m arkets, on th e fe d e ra l le v e l and in Georgia have a l l combined to make th e r e g u la to r 's job more complex. The PSC i s committed to meeting a l l these ch a lle n g es as Georgia fa ce s a prem ising, though uncertain future.
The P u b lic S e rv ice Commission i s a c o n s titu tio n a l body e s ta b lis h e d by the L e g is la tu r e , and i t s powers and d u tie s are d escribed in th e Georgia Code, T i t l e 46.
The PSC c o n s is ts o f f iv e Commissioners e le c te d statew ide and a s t a f f o f approxim ately 157. The Commissioners serve staggered s ix -y e a r terms and may succeed them selves. They e le c t a chairman and v ic e chairman every two years from w ithin th e ir ran k s. The s t a f f i s headed by an ex ecu tiv e d ire c to r/ se c re ta ry and c o n s is ts o f en gin eers, a u d ito rs, a n a ly s ts , in sp e c to r s , enforcement o f f i c e r s , experts and various s t a f f support personnel.
The Commission has general supervision o f a l l common c a r r ie r s , express companies, ra ilro a d or s tr e e t ra ilro a d companies, dock or wharfage companies, term inal or term inal s ta tio n companies, telephone and telegrap h companies, and gas or e l e c t r ic l i g h t and power companies w ithin G eorgia.
The PSC does not s e t ra te s fo r :
-- p u b lic ly owned e le c t r ic and gas u t i l i t i e s , such as m unicipal systems and e l e c t r ic membership co rp o ratio n s;
-- water and/or sewerage s e rv ic e s ; and -- cable te le v isio n companies.
E le c t r ic Membership Corporations and m u n icip ally owned e l e c t r i c system s, w hile not under the ju r is d ic tio n o f the Commission, must come befo re the PSC fo r re so lu tio n o f t e r r i t o r i a l d isp u tes because th e Commission has resp o n sib ility for enforcing Georgia's T e rrito ria l E le ctric Service A ct.

The Commission has e x c lu s iv e pcwer to determine what are ju s t and reasonable ra te s and charges to be made by any person, firm or corporation su b je ct to i t s ju r is d ic t io n . The Commission must balance the needs o f consumers for adequate, r e lia b le service a t afford able rates with the needs o f u t i l i t i e s to r e a liz e an adequate return on investm ent th a t i s dedicated to servin g the p u b lic .
While the PSC has a d e fin ite stake in p ro tectin g the consumer's in te r e s t, i t must a lso abide by le g a l standards which c a l l fo r i t to allow u t i l i t i e s to operate norm ally and s e t ra te s th a t allow the company the opportunity to earn a return fo r i t s in v e sto rs th a t i s comparable to the return they could expect on an investment w ith s im ila r r i s k . The PSC does not guarantee p r o f i t s , however. I t i s the company's r e s p o n s ib ility to make prudent, sound business d e cisio n s th at w ill produce earnings.
The Commission, e ith e r by gen eral r u le s or by s p e c ia l orders in p a r tic u la r c a s e s , req u ire s a l l companies under i t s supervision to e s ta b lis h and m aintain such p u b lic se rv ice s and f a c i l i t i e s as may be reasonable, ju s t and necessary to f u l f i l l the company's serv ice o b lig a tio n s .
To f u l f i l l i t s r e s p o n s ib ilit ie s , the Commission i s empowered to make and en force r u le s and re g u la tio n s governing company operations fo r the p ro tectio n o f the p u b lic in t e r e s t . The Commissioners and s t a f f may conduct h e a rin g s, assemble evid en ce, make in v e s tig a tio n s , determine c o sts and v a lu a tio n s , in sp ect p ro p e rtie s , books and papers o f a l l regu lated companies, is su e orders g iv in g e f f e c t to Commission d e c is io n s , and when necessary, in s t it u t e j u d ic ia l proceedings to enforce o rd ers, r u le s and r e g u la tio n s .
The Commission's ta sk o f r e g u la tin g u t i l i t i e s i s n ' t over when i t decid es a ra te case, but rate cases -- because they a ffe c t people's pocketbooks -- get the lio n 's share o f attention.
Routine business in clu d es au d itin g company expenses r e g u la r ly , tra ck in g u t i l i t y estim ates and p r o je c tio n s , in v e s tig a tin g consumer com plaints and problems, sta y in g up to date on developments in the variou s regu lated in d u s tr ie s , and e v a lu a tin g u t i l i t i e s ' fin a n c in g p la n s . The Commission s t a f f i s responsible for a ll these a c tiv itie s .
During a r a te c a s e , the Commission s t a f f i s considered separate from the f iv e e le c te d Commissioners. The s t a f f puts on i t s own c a s e , u s u a lly opposing a company's req u e st, and the s t a f f ' s attorn ey (from the S ta te law Department) cross-exam ines company w itn esses.
During 1987, the Commission conducted 459 p u b lic h e arin g s. A l l m atters docketed fo r p u b lic hearing are heard by the e n tir e Commission o r an appointed hearing o f f i c e r in open s e ssio n . A m a jo rity o f the Commission c o n s titu te s a quorum. Regular a d m in istra tiv e sessio n s norm ally are held a t the Commission's A tla n ta o f f i c e , 244 Washington S tr e e t SW on th e f i r s t and th ir d Tuesdays o f each month. The G e n e r a l A ssem b ly ch an ged th e C o m m issio n 's name to th e
G eo rgia P u b lic S e r v ic e Com m ission. U t i l i t i e s under Com m ission r e g u la tio n were re q u ire d to pay a f i x e d f e e t o c o v e r t h e C o m m is s io n 's e x p e n s e s . T h is sum was s e t a t $7 0 ,0 0 0 p e r y e a r , d iv id e d among th e v a r io u s u t i l i t i e s s u b je c t to re g u la tio n in p ro p o rtio n to th e ir t o t a l ta x a b le v a lu e s ( a s s e ts ) . In p re v io u s y e a r s , th e C om m ission's expen ses were p a id from th e g e n e ra l tr e a s u r y .
The P S C 's ju r is d ic t io n was extended to in c lu d e m otor buses and tr a c k le s s t r o l l e y s .

The major focu s on energy a t th e P u b lic S e r v ic e Com m ission continued to in v o lv e th e A lvin W. Vogtle Nuclear G e n e r a tin g P la n t, a tw in-unit generating station being con tructed in Burke County, near Waynesboro. Georgia Power i s b u ild in g th e p la n t and s h a r e s ownership with O glethorpe Power C o rp o ra tio n , th e M u n ic ip a l E lectric Authority o f G eorgia, and the C ity o f D alton. Georgia Power owns 45.7 p e r c e n t o f th e p la n t , and th e f i r s t u n it began com m ercial o p era tio n in 1987.

A S tip u la tio n m s entered in to on Ju n e 17, 1987 by th e Com m ission, th e Company and th e In terven o rs to reduce th e Com pany's e x is t in g b ase r a t e s fo r g as s e r v ic e by $4.75 m illio n a n n u a lly .
The Commission continued to s tu d y p ro m o tio n a l p r a c t ic e s by e le ctric and natural gas u tilitie s , and to stu d y th e gas purchase p ractices o f A tlanta Gas L ig h t as well as to monitor th e s a fe ty o f A tlanta Gas L igh t's construction o f a L iq u e fie d N atu ral Gas sto rage f a c ilit y in Cherokee County.

Sin ce Ju n e 1, 1986, Southern B e ll had ch a rg e d th e d e v e lo p e r s o f r e s id e n t ia l s u b d iv is io n s and apartm ent com plexes $16 0 p e r se rv ice point fo r the in s ta lla tio n o f b u r ie d c a b le f a c i l i t i e s when such developers re q u e st b u rie d c a b le as opposed to a e r ia l f a c ilit ie s . Issu es in th is case cen tered around: (1) w h ether th e charge were already embedded in S o u th e rn B e ll's e x is t in g r a te s ; (2) w h ether th e r e w ere s u f f i c i e n t a d m is s ib l e , r e l i a b l e an d probative evidence th a t a $160 fix e d n o n -re c u rrin g c h a r g e i s j u s t and reasonable; and (3) w h eth er th e t a r i f f e x is t in g p r io r to th e February 2, 1987 f ilin g , authorized Southern B e ll t o im pose a f l a t $160 fe e .
Based upon th e fin d in g s o f fa c t a t p u b lic h e a r in g s , th e Commission ordered Southern B e ll to refu n d a l l am ounts p a id pursuant to the February 2, 1987 f i l i n g and t o c h a r g e o n ly th o s e am ounts a u th o riz e d by e x is t in g t a r i f f s .

Although a ll o f the major u t i l i t i e s were or w ill be a ffe c te d by TRA-86, SEPCO made a proposal during 1987 to s e t t l e th e is s u e fo r them selves. The Commission approved an ongoing ra te reduction o f $3 m illion e ffe c tiv e on Ja n u ry 1, 1988, and a r a t e r e fu n d o f $2 m illion o f th e revenues co lle cte d between Ju ly to December o f 1987. The refun d was to be a ffe c te d by c r e d itin g on th e F e b ru a ry 1988 b i l l an amount o f $0.0 01653 t im e s t h e n u m b er o f KWH's actually used by those customers during the Ju ly through December 1987 hi l l i n g months. Sales ta x e s co lle cte d on th o se r e v e n u e s were to also be refunded.
The refunds made by Georgia Power Company and A t la n t a Gas L ig h t Company were in c lu d e d in t h e i r r a t e c a s e s d u r in g 19 87, m entioned elsew h ere in th is re p o rt.
Southern B ell reduced t h e ir r a te s by $21.9 m illio n an n u a lly e ffe c tiv e on J u ly 1, 1987. T h is re d u c tio n d e c r e a s e d r e s id e n t ia l b i lls by approxim ately 50 c e n t s p e r month and b u s in e s s b i l l s by a p p r o x im a t e ly 75 c e n t s p e r m onth.
AT&T reduced th e r in t r a s t a t e m essage t o l l r a t e s by $2.7 m illio n a n n u a lly e ffe c t iv e Septem ber 4, 1987.

The U tility Finance Section was c r e a te d by th e G e n e ra l Assembly in 1981, and has been fu n c tio n in g s in c e Ja n u a r y 1982. T here are a ls o many such se c o n d a ry r e s p o n s i b i l i t i e s as finance proceedings fo r a ll in v e sto r u t ilit ie s as w ell as ru ra l e le c tr ic membership c o r p o r a tio n s , h e a r in g s on e l e c t r i c f u e l c o s t recovery rate adjustments, analysis o f purchased gas adjustm ents fo r regulated natural gas companies, and a myriad o f both ro u tin e and s p e c ia l rep o rts and stu d ie s. In ad d itio n to th ese re sp o n sib ilitie s, the U tility Finance Section has accepted th e r e s p o n s ib ility o f d evelop in g th e s t a ff's data p ro cessin g ca p a b ilitie s.

This section is also respon sible fo r d ep reciatio n and extended area se rv ice s tu d ie s, re g u la tio n o f telep h o n e s e rv ic e o b se rv in g equipm ent, c e r t ific a tio n and enforcement o f custo m er-ow n ed co in phones (COCOT) s e r v ic e and ru le s, c e r tific a tio n and enforcem ent o f Autom atic D ia lin g and Announcem ent D evices s e rv ic e (ADADs).

Four o ffic e in sp ectio n s were made to exam ine te le p h o n e s e r v ic e observing equipm ent and nine ap p lica tio n s were received fo r a license to use telephone s e rv ice ob servin g equipment. A ll nine a p p lic a tio n s were approved and lic e n s e s issu e d .
The Commission adapted new r e g u la t io n s c o n c e r n in g th e c e r tific a tio n o f COCOT providers in M arch o f t h i s y e a r . The new ce rtifica tio n procedures require th at a sin gle c e r t ific a te be issued fo r a company or in d iv id u a l and t h is c e r t ific a t e would authorize th a t c e r t ific a te holder to provide COCOTs th ro u g h o u t th e Sta te . The Commission's in vo lvem en t w ith p ip e lin e s a fe ty began in 1970 follow ing enactment by th e U .S. C o n g r e s s o f th e N a tu r a l Gas P ip e lin e S a fe ty A ct o f 1968. T his A ct e s ta b lis h e d s a fe ty stan d ard s fo r gas system s and allow ed s ta te agen cie s to p a rticip a te in s a fe ty e n fo rce m e n t by e n t e r in g in t o an agreem en t with the federal government to operate i t s Gas S a fe ty O ffic e . In 1987, th e PSC rece iv ed $110,852.32 in fe d e ra l matching fu n d s f o r g a s s a f e t y .
Systems under th e Commission's ju r is d ic tio n c o n s is t o f th r e e e x is t in g liq u e f ie d n a t u r a l g a s (LNG) f a c i l i t i e s and o n e u n d e r co n struction , more th an 500 m iles o f tr a n s m is s io n l i n e and o v e r 18,000 m iles o f d is tr ib u t io n lin e t r a n s p o r t i n g o n e - t h i r d o f G e o r g ia 's e n e r g y s u p p ly to 1.7 m illio n c u s to m e rs.
In 1987, th e Commission continued a c o n tr a c t w ith an o u ts id e consultant firm , Energy A nalysts, In c ., to work w ith th e gas s a fe ty s t a f f in monitoring th e co n struction o f th e new A t la n t a Gas L ig h t Company LNG in Cherokee County. The LNG f a c i l i t y lo c a te d north o f A tla n ta, w ill h a v e one s to r a g e ta n k w hich w ill h o ld 25 m illio n g a llo n g when co m p leted in 1988.

Since the Commission's s a fe ty program i s la r g e ly preventive, a ll safety aspects w ill co n tin u e to be review ed. The R a d io Common C a r r ie r S e c t io n i s r e s p o n s ib le f o r overseeing q u ality o f service, t e r r it o r ia l c e r tific a tio n and e n s u r in g t h a t ra d io common c a r r i e r u t i l i t i e s h a v e a d e q u a te planning, construction and equipment necessary to serve custom ers' needs. These ca rrie rs provide personal one-way radio p a gin g services and two-way mobile ra d io te le p h o n e s e r v ic e s th ro u g h o u t the state.

In 1987, th e Com m unications se ctio n perform ed s ix a u d its . Four audits were ro u tin e fin a n c ia l in v e s tig a tio n s and two were reactive to companies' r a te case f i l i n g s . A d d itio n a lly , r a te s o f return fo r a l l 34 telephone companies were com puted and r e p o r te d to th e Commission. The ra te o f retu rn s tu d y was s u b s t it u t e d f o r fie ld au d its because of lack o f tra v e l fun d s.

Prudence A udit
On J u l y 1, 1985, th e G e o r g ia P u b l i c S e r v i c e C o m m issio n o ffic ia lly established the Prudency A u d it Group. T his group was charged with auditing the prudence o f th e co n stru ctio n o f P la n t Vogtle Units 1 & 2 and Scherer U nits 3 & 4, th e d e cisio n to burn low su lfu r coal a t P la n t S ch e re r, th e co a l p u rch a sin g d e c is io n s concerning the volumes o f low s u lfu r c o a l p u rch ased by G e o rg ia Power Company and th e prudence o f G e o rg ia Power Com pany's d ecisio n s with resp e ct to th e re p a ir and re p la ce m e n t o f th e recircu latio n pipes on H atch U n its 1 & 2. The problem a t P la n t Hatch resu lted in outages connected with in te rg ra n u la r s tre s s corrosion cracking and other problem s th a t occu rred d u rin g t h is tim e.
The Commission selected O 'B rien -K rietzb erg & A sso ciates to b e the lead consultants for the audit of Plant Vogtle U nits 1 & 2 and Scherer Units 3 & 4. They were a ssiste d by T e ch n ical A n a ly sis Corporation. The Commission also selecte d Kennedy & A s s o c ia te s to examine th e generation expansion planning o f Georgia Power Company with respect to the basic d ecisio n -m ak in g p ro cess in v o lv e d with both plants Vogtle and Scherer. The audit was com pleted in 1987.

This division also issued a ll in tr a s ta te and in te r s ta te PSC motor v e h ic le r e g is t r a t io n s , r e s u l t i n g in th e c o lle c t io n o f a lm o s t $3 million in fe e s , which accru e to th e s ta te ' gen eral tre a s u ry . The Transportation D iv isio n co n tin u e s to fu n c tio n under cooperative agreements between th e PSC and th e Federal Departm ent o f Transportation regard ing motor c a r r ie r v e h ic le s a fe t y , and w ith th e In te r s ta te Commerce Commission reg ard in g econom ic en fo rce m e n t o f in terstate motor c a r r ie r o p eratio n s, to help elim in ate ille g a l transportation p ra c tic e s by ce rta in c a r r ie r s and sh ip p ers.
In addition to the P SC's r e s p o n s ib ility fo r motor c a r r ie r vehicle safety and fo r the transportation o f hazardous m ateria ls by fo r -h ir e " motor c a r r ie r s o p e r a tin g b o th i n t r a s t a t e and in t e r s t a t e in G eorgia, le g is la t io n was e n a c te d in 1984 em pow ering th e Commission w ith co rresp o n d in g a u th o rity over " p r iv a t e " m otor operations in Georgia. Also, th e Commission was named by G o v ern o r H am s as the lead agency fo r p a rtic ip a tio n in th e Federal Motor Carrier Safety Assistance Program (MCSAP), whereby fe d e ra l fun ds are made a v a ila b le to th e agency f o r t h e e n h a n ce m e n t o f th e Com m ission's m otor c a r r ie r s a fe ty program .
PSC o fficers are highly tra in ed and have developed exten sive e x p e rtise in perform ing motor c a r r i e r v e h ic le and h a zard o u s m aterials tran sp ortation safety in sp ectio n s. D uring 1987, th e enforcement u n it conducted approxim ately 20,285 d riv e r, v e h ic le and hazardous m aterials s a fe ty in sp e ctio n s r e s u lt in g in 24,375 "o u t o f s e r v ic e " v io la tio n s b e in g d e te c te d , o f w hich 14,366 v e h ic le s o r d riv e rs were placed "out o f se rv ice " u n til com pliance with our s a fe t y r e g u la tio n s was a c h ie v e d .
When v e h ic le s a re p la c e d o u t s e r v ic e , th e d e f e c t s m u st b e corrected before th e v e h icle is allowed to proceed. The person

responsible for rep airs must sign th e in sp e ctio n form c e r tify in g th a t rep airs were made. In a ll in stan ces, a copy o f th e in s p e c t io n report, signed by the d riv er is fu rn ish ed to th e d riv e r w ith instructions to turn i t over to th e resp o n sib le person with th e c a r r ie r firm . The form provides t h a t a l l d e f e c t s , o th e r th an "o u t o f service" d efects must be repaired and atte sted to th e Commission w ithin 15 days o f th e in sp ection . I f th e c a r r i e r f a i l s t o do t h i s , th e T ra n sp o rta tio n D iv is io n tr a n s m its an a d d itio n a l co p y o f th e report d ire ct to the company fo r i t s a c tio n . I f th e c a r r ie r f a i l s to comply, th e Commission is s u e s a Rule N isi fo r th e c a r r ie r to show cause why th e Commission sh o u ld n o t a s s e s s a c i v i l p e n a lty against i t for fa ilu r e to comply with th e Com m ission's ru le s and regu la tio n s.
The Com m ission's en forcem en t o f f i c e r s are a s s ig n e d s p e c if ic te rrito rie s in the state ran gin g from two co u n tie s in th e A tla n ta a re a to as many as 10 c o u n tie s in th e more s p a r s e ly p o p u la t e d southwest section of the state. In ad d ition to v e h ic le and d riv e r sa fe ty and hazardous m aterials in sp e c tio n s, th e o f f i c e r s make detailed inspections of the general op eration s o f companies under the PSC's jurisd iction to determ ine i f th ey are perform ing w ithin th e scope o f au th o rity granted by th e PSC and th e IC C , and in accordance with the Commission's rules and regu lation s and th e law s of Georgia relatin g to "fo r h ire " motor c a r r ie r o p era tio n s. The nature o f the ille g a l operator or one operating u n safe equipm ent precludes the establishm en t o f perm anent in s p e c tio n points since Georgia's maze o f highways enables th e i l l e g a l t r u c k e r to ea sily circumvent any such permanent check p o in t, alth o u g h PSC o ffic e r s work p e r io d ic a lly a t a l l p erm an en t w e ig h t s ta t io n s th ro u g h o u t G eo rgia, p erfo rm in g both s a fe ty and econom ic insp ection s. PSC o ffic e r s p a tro l th e h igh w ays, in v e s tig a te in d u s tr ia l s ite s , and examine a ll o th er lo ca tio n s where tr u c k s could be o p era tin g.

During 1987, in a d d itio n t o i t s s a f e t y in s p e c t io n s , th e P S C 's twenty-one enforcem ent-o ffic e r s perform ed thousands o f v e h icle inspections fo r op eratin g au th o rity , proper v e h icle re g istra tio n and id en tificatio n , r e s u ltin g in d e te c tio n o f 1,715 v io la tio n s and c o lle c tio n o f $28,625 in " la te " v e h ic le r e g is t r a t io n f e e s when vehicles had not been properly r e g is te r e d w ith th e Commission by carriers. PSC enforcem ent o ffic e r s were resp o n sib le fo r making 3,522 a r r e s ts th ro u g h o u t th e s ta t e stem m ing from in t r a s t a t e o r in te rstate "fo r -h ir e " o p eratio n s in G eorgia w ithout proper authority from either the PSC or ICC and cases against drivers w ith hours o f duty s ta tu s v io la tio n s . These cases re su lte d in bonds to ta lin g $523,942.40 b e in g p o sted in th e c o u n tie s where a r r e s ts w sre made. In a d d itio n , 616 w a rn in g s w ere is s u e d t o c a r r i e r s o p era tin g ille g a lly in G eorgia.
Through a cooperative agreement with the Georgia Department o f Revenue, PSC o ffic e r s reported in stan ces where G e o r g ia -b a s e s vehicles carried "private" ta g s, even though th ey were op eratin g fo r hire. As a re su lt o f the PSC's reports o f th e s e im proper ta g s , th e Departm ent o f Revenue assessed th ese c a r r ie r s $28,790.00
The Transportation Division added com puter te ch n o lo g y d u rin g 1984. During th e year 1987, th e Commission conducted fiv e hundred and twenty-nine public hearings involving the T ransportation D iv isio n . P u b lic hearings commence on th e second and fo u rth Tuesdays in each month and continue on su ccessive days th e r e a fte r u n t i l a l l c u r r e n t a p p lica tio n s and p e titio n s have been d isp osed o f.
