Pursuant to the call of his Excellency, Governor Sonny Purdue, the House met in special session at 1:00 o'clock, P.M., this day and was called to order by the Honorable Glenn Richardson, Speaker of the House of Representatives.

The following proclamation was read:

BY THE GOVERNOR OF THE STATE OF GEORGIA

A PROCLAMATION CONVENING THE GENERAL ASSEMBLY OF GEORGIA IN SPECIAL SESSION

WHEREAS:

Article V, Section II, Paragraph VII of the Constitution of the State of Georgia grants to the Governor the power to convene a special session of the General Assembly, stating and thereby limiting its purposes; and

WHEREAS:

The Regular Session of the 2005 General Assembly adjourned sine die on March 31, 2005; and

WHEREAS:

Motor fuel prices have risen substantially since the adjournment of the 2005 General Assembly; and

WHEREAS:

Hurricane Katrina has caused major destruction and damage to properties in the states of Alabama, Mississippi, and Louisiana, adversely affecting the motor fuel supply to the State of Georgia, which has had the effect of further increasing gas prices in the State of Georgia; and

WHEREAS:

The Governor has determined that certain purposes warrant the convocation of a special session; now

THEREFORE:

By virtue of the power and authority that the Constitution of the State of Georgia confers upon me, I, Sonny Perdue, Governor of the State of Georgia, do hereby convene the General Assembly of this State in Special Session at 1:00 p.m. on September 6, 2005, for the purposes and only the purposes stated as follows:

1. To ratify the Executive Order dated September 2, 2005, and numbered 09.02.05.01 in the official records of the Office of the Governor, which suspended the collection of all state sales and use taxation, state excise taxation, and the second motor fuel tax as those taxes apply to aviation gasoline, and motor fuel used to propel motor vehicles for use on or off public highways including gasoline, dyed fuel oils, liquid propane gas, and other special fuels including but not limited to gasohol, ethanol, liquefied natural gas, or compressed natural gas, and excluding jet fuel, commencing with all deliveries occurring immediately following the last moment of September 2, 2005, until the General Assembly acts upon this Order;

2. To enact general law providing a temporary exemption on motor fuel tax due to the state commencing with all deliveries occurring immediately following the last moment of September 2, 2005, and ending midnight September 30, 2005, and other related purposes;

3. To amend Code Section 50-19-7 of the Official Code of Georgia Annotated to change provisions relating to the mileage reimbursement rate for traveling expenses for officers, officials, and employees of the executive, legislative, and judicial branches of state government.

VETO NUMBER 1
HB 264 HB 264 significantly expands the authority of the Georgia Commission on Interstate Cooperation to include all interstate and international relations and expands the type and number of organizations that are considered joint governmental agencies. This new authority is vague and overbroad; I therefore veto HB 264.
VETO NUMBER 2
HB 367 HB 367 includes many unrelated provisions including regulation of ignition interlock device providers, re-plating of license plates, changes for hazardous material transport and requirements for driver training schools. The fatal flaw in this bill, however, is the provision that prohibits the operation of public driver improvement clinics in any county in which a private clinic is located. This provision would even require a public clinic to shut down whenever a private clinic begins operating in the same county. This provision is inconsistent with free market competition. I therefore VETO HB 367.
VETO NUMBER 3
HB 444 HB 444 changes the educational and professional requirements for engineers and land surveyors, essentially phasing-out the acceptability of apprenticeship

experience and requiring a bachelor's degree. This legislation would ultimately, unnecessarily and inappropriately shut out many individuals from land surveying and likely result in increased costs to consumers. I believe that the underlying purpose of this bill can be better addressed through considering scope of practice as opposed to educational requirements. Therefore, I VETO HB 444.

VETO NUMBER 4

SB 68

Among other things, SB 68 expands the authority of the Georgia Board of

Real Estate Appraisers and the Georgia Real Estate Commission to regulate continuing

education instructors and the schools offering continuing education courses. These are

privileges not given to similar professional boards and I see no demonstrated need for

such expanded authority or regulation; I therefore VETO SB 68.

VETO NUMBER 5

SB 98

SB 98 authorizes local boards of education to provide life, disability,

liability insurance, retirement or pension coverage, social security and employment

security coverage for local board members. Such benefits would inevitably expand

service on local school boards to full-time engagements. These wide-ranging benefits are

beyond the scope of what is appropriate. I therefore VETO SB 98.

VETO NUMBER 6

SB 254 SB 254, among other things, relaxes the standards for the annual audit of legislative funds and expenditures by removing the requirement for detail. Because such relaxation is inappropriate, I VETO SB 254.

VETO NUMBER 7

SB 328 SB 328 is local legislation applicable to Dekalb County. This bill, among other things, would impose a $5.00 surcharge to fines levied by the State Court or Recorders Court in DeKalb County for the purpose of creating a technology fund for use in the offices of the clerk of the Superior Court, State Court, Magistrate Court and other courts in DeKalb County. In recent years, there has become an over-proliferation of court fines and fees as a means of funding various services at the state and local levels. The proliferation has occurred without a concurrent ability to track, account for and manage receipts to ensure efficiencies. I am unwilling to expand court fines for technology funds for the State and Superior Courts which have greater access to resources than other local courts. I therefore VETO SB 328.

SB 338 SB 338 is local legislation applicable to Clayton County. The Clayton County Board of Commissioners has requested that it be vetoed. Local legislation should be a partnership between local officials and their legislative delegation. This bill will have a significant budgetary impact on the county for which the county commission is unprepared to bear the financial burden. I therefore VETO SB 338.

SB 339 SB 339 is local legislation applicable to Clayton County. The Clayton County Board of Commissioners has requested that it be vetoed. Local legislation should be a partnership between local officials and their legislative delegation. System shall not exceed $23.35 per member for State Fiscal Year 2005." The appropriations in HB 85 increased the benefit accrual rate per member by $0.50, from $13.00 to $13.50. Therefore, this language (page 28 of 85) in the provisions relative to Section 23, Employees' Retirement System of Georgia is incorrect and must be vetoed.
Section 33, pertaining to the Department of Motor Vehicle Safety, page 50 of 85, lines 1265 through 1267: In the appropriations for the Department of Motor Vehicle Safety, the Motorcycle Safety Program is to be appropriated $100,000. This program is currently funded through fees paid by applicants. The department did not request these funds. Therefore, the $100,000 for this program (page 50 of 85, lines 1265 through 1267) in the provisions relative to Section 33, Department of Motor Vehicle Safety is vetoed.
Section 48, pertaining to the General Obligation Debt Sinking Fund, page 74 of 85, BOND #12: This language authorizes the appropriation of $192,360 to finance projects and facilities of the Board of Regents of the University System of Georgia, specifically for library and classrooms expansion to Building A at Waycross College, through the issuance of not more than $2,290,000 in principal amount of General Obligation Debt for 20 years. This project is one of several minor projects on the Fiscal Year 2006 capital budget list of the Board of Regents of the University System of Georgia. A more thorough process needs to be developed to evaluate and prioritize projects of this type. Section 48, pertaining to the General Obligation Debt Sinking Fund, page 76 of 85, BOND #33: This language authorizes the appropriation of $15,960 to finance projects and facilities for the Department of Technical and Adult Education, specifically for design of the West Central Technical College, Douglas Campus, through the issuance of not more than $190,000 in principal amount of General Obligation Debt for 20 years. This project does not appear on any priority list for the Department of Technical and Adult Education. Therefore, this language (page 76 of 85, BOND #33) in the provisions relative to Section 48, General Obligation Debt Sinking Fund is vetoed.
Section 48, pertaining to the General Obligation Debt Sinking Fund, page 80 of 85, BOND #77: This language authorizes the appropriation of $168,000 to finance projects and facilities for the Department of Agriculture, specifically for renovations to State Farmers' Markets, through the issuance of not more than $2,000,000 in principal amount of General Obligation Debt for 20 years. Currently, there are $2 million of yet unsold bonds specifically for the State Farmers' Markets renovations. Therefore, this language (page 80 of 85, BOND #77) in the provisions relative to Section 48, General Obligation Debt Sinking Fund is vetoed.

To amend Title 48 of the Official Code of Georgia Annotated, relating to revenue and taxation, so as to provide for an exemption for a limited period of time with respect to state taxes applicable to certain motor fuels; to provide for procedures, conditions, and limitations; to provide for powers, duties, and authority of the administrator of Part 2 of Article 15 of Chapter 10 of Title 10 of the Official Code of Georgia Annotated, the "Fair Business Practices Act," as amended; to provide for powers, duties, and authority of the state revenue commissioner with respect to the foregoing; to ratify an executive order of the Governor suspending the collection of such taxes; to provide an effective date; to repeal conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1. The Executive Order of the Governor dated September 2, 2005, and filed in the official records of the Office of the Governor as Executive Order 09.02.05.01 which suspended the collection of state sales and use taxation, state excise taxation, and the second motor fuel tax, as those taxes apply to gasoline, dyed fuel oils, aviation gasoline, liquid propane gas, and other special fuels, including, but not limited to, gasohol, ethanol, liquified natural gas, or compressed natural gas, and excluding jet fuel, is ratified by the General Assembly of Georgia.
SECTION 2. Title 48 of the Official Code of Georgia Annotated, relating to revenue and taxation, is amended by adding a new Code section immediately following Code Section 48-9-19, to

be designated Code Section 48-9-20, to read as follows: "48-9-20. (a) For the time period commencing as specified in the Executive Order of the Governor dated September 2, 2005, and filed in the official records of the Office of the Governor as Executive Order 09.02.05.01 and the time period concluding at the last moment of September 30, 2005, state sales and use taxation pursuant to Code Section 48-8-3.1, state excise taxation pursuant to Code Section 48-9-3, and the second motor fuel tax pursuant to Code Section 48-9-14, as those taxes apply to aviation gasoline and to motor fuel used to propel motor vehicles for use on or off public highways including gasoline, clear fuel oils, dyed fuel oils, liquid propane gas, and other special fuels, including, but not limited to, gasohol, ethanol, liquified natural gas, or compressed natural gas, and excluding jet fuel, shall be governed by the provisions of this Code section notwithstanding any provisions of Code Sections 48-8-3.1, 48-9-3, and 48-9-14, or any other law, to the contrary. (b) Sales or use of fuels described in subsection (a) of this Code section shall be fully exempt from the 4 percent state sales and use tax levied and imposed under Chapter 8 of this title. The temporary sales and use tax exemption provided for in this subsection shall not apply to local sales and use taxes levied and imposed in an area consisting of less than the entire state, however authorized, including, but not limited to, such taxes authorized by or pursuant to constitutional amendment; by or pursuant to Section 25 of an Act approved March 10, 1965 (Ga. L. 1965, p. 2243), as amended, known as the 'Metropolitan Atlanta Rapid Transit Authority Act of 1965'; or by or pursuant to Article 2, 2A, 3, or 4 of Chapter 8 of this title. Such local taxes shall remain applicable to sales of such fuels. (c) Distributors who sell or use fuels described in subsection (a) of this Code section within this state shall be exempt from the 7 1/2 per gallon excise tax levied and imposed under Code Section 48-9-3. (d) Sales or use of fuels described in subsection (a) of this Code section shall be exempt from the 3 percent second motor fuel tax levied and imposed under Code Section 48-9-14. (e) The failure of the distributor or the seller to pass through to the purchaser of any of the fuels described in subsection (a) of this Code section the amount of the tax exemptions, decreases, or reduction under this Code section shall constitute an unfair or deceptive act or practice under Part 2 of Article 15 of Chapter 10 of Title 10, the 'Fair Business Practices Act,' as amended, and shall be subject to enforcement by the administrator of said Part 2 in the same manner as any other act or practice constituting a violation of said Part 2 and subject to the same remedies and penalties as any other act or practice constituting a violation of said Part 2. (f) The commissioner is authorized to prescribe forms and promulgate rules and regulations deemed necessary in order to administer and effectuate this Code section. (g) This Code section shall stand repealed in its entirety on October 1, 2005."
SECTION 3.
