. We are pleased to transmit to you the "Summary ofGeneral Statutes Enacted at the 2001 Session ofthe General Assembly ofGeorgia." This represents one ofthe services which the Legislative Services Committee and the Office of Legislative Counsel perform for the legislative branch of government. Other services include bill drafting, research, statutory and Code revision, rendering of opinions, counseling, legislative reference, interim committee staffing, and preparation of reports. The Office ofLegislative Counsel drafted a total of 5,125 bills, resolutions, and amendments for the 2001 session. Ofthis number, 686 had been prepared by the convening date ofthe session, leaving a total of4,439 which were drafted during the session,

This booklet contains a summary of the general statutes of state-wide application which were enacted at the 2001 regular session ofthe General Assembly of Georgia. No resolutions, local Acts, or uncodified "population Acts" have been included. The booklet also includes a table of Code sections amended and enacted at the 2001 session..

It would be impractical to minutely analyze each statute because to do so would defeat the main purpose which it is hoped that this booklet accomplishes. It is intended to be used as a convenient reference for persons desiring to know which laws were enacted or desiring to ascertain the main features of each Act without the necessity of reading the Act in its entirety.

It should be pointed out that for specific, detailed information on any particular law, the Act itself should be examined. Acts may be readily located in the Georgia Laws by Act number, since the Acts are published in the Georgia Laws in numerical order by Act number. In addition, the Georgia Laws contain a table for converting Act numbers to Georgia Laws page numbers.

This summary is not to be deemed in any manner as an opinion from the Office of Legislative Counsel, and the question of constitutionality has not been considered in any respect.

It is hoped that this booklet will benefit all who have occasion to use it.

TITLE 1 GENERAL PROVISIONS
Act 2; HB 107
This Act makes extensive editorial amendments to the Official Code of Georgia Annotated to correct typographical, stylistic, and other errors and omissions and reenacts the statutory portion of the Code as so amended.
Effective February 12, 2001.
TITLE2 AGRICULTURE
Act 332, HB 645
This Act changes the maximum license fee required of grain dealers, commercial feed dealers, and grain warehousemen.
The Act amends O.C.G.A. Sections 2-1-5, 10-4-10, and 10-4-17. Effective July 1, 2001.
Act 290; HB 293
This Act provides that the Commissioner of Agriculture shall establish an application fee, not to exceed $100.00, for the registration of a pesticide. The Act provides that the Commissioner of Agriculture shall establish a license fee, not to exceed $100.00, for a nonauction tobacco dealer's license and increases a certain bond required of such persons. The Act provides that in the event federal graders are not available to grade tobacco, grading shall be done by graders approved by the Commissioner of Agriculture.
The Act amends O.C.G.A. Sections 2-7-55 and 10-4-115 and enacts O.C.G.A. Section 10-4-114.1.
Effective July l, 2001.
Act 388; HB 89
This Act provides for limited tort liability for owners and operators of farms providing pick-your-own agricultural products. The Act provides for the posting of warnings and notices.
The Act enacts Article 7 of O.C.G.A. Chapter 2-14. Effective April 28, 2001.
Act 174; HB 578
This Act changes the assignment for administrative purposes of the Georgia Tobacco Community Development Board from the Department of Agriculture to the Office of Planning and Budget.
The Act amends O.C.G.A. Section 2-18-4. Effective April 18, 2001.

Act 294; HB 361
This Act provides for payment from the Georgia Cotton Producers Indemnity Fund of 1999 for certain additional claims made by cotton producers and cotton ginners. The Act establishes and extends certain time limits.
The Act amends O.C.G.A. Sections 2-19-1, 2-19-5, 2-19-5.1, and 2-19-6. Effective April 27, 2001.
TITLE3 ALCOHOLIC BEVERAGES
Act 349; SB 99
This Act regulates the sale of malt beverages at retail by the keg. The Act requires each retail licensee selling kegs containing malt beverages to record for keg sales certain information identifying the purchaser and to affix to each keg a registration label or tag.
The Act enacts O.C.G.A. Section 3-5-5. Effective July 1, 2001.
Act 311; SB 155
This Act provides that in addition to the sale of its own wine, a farm winery licensee may sell the wine of any other Georgia farm winery licensee at retail for consumption on the premises and in closed packages for consumption off the premises. The Act directs the Department of Community Affairs and the Department of Transportation to collaborate to designate appropriate routes and signage for the Georgia Wine Highway.
The Act amends O.C.G.A. Sections3-6-2l. l through 3-6-2l.3andenactsO.C.G.A. Section 3-6-21.4.
Effective July 1, 2001.
TITLE4 ANIMALS
Act 286, HB 170
This Act adds crops to the "Georgia Farm Animal and Research Facilities Protection Act" and changes the name of such Act to the "Georgia Farm Animal, Crop, .and Research Facilities Protection Act." The Act provides penalties for destroying or interfering with a crop facility.
The Act amends O.C.G.A. Sections 4-11-30 through 4-11-33. Effective July 1, 2001.

TITLES APPEAL AND ERROR

Act 376; SB 269

This Act eliminates the magistrate court's monetary jurisdictional limit provided in

paragraph (5) of O.C.G.A. Section 15-10-2 when an appeal is filed.

The Act amends O.C.G.A. Section 5-3-30.

Effective July 1, 2001.

Act 17; HB 810

This Act allows direct appeal to the Supreme Court or Court of Appeals from any ruling on a motion, which would be dispositive if granted, with regard to a defense that the action is barred pursuant to O.C.G.A. Section 16-11-184. The Act also changes the time frame in which the Supreme Court or Court of Appeals must issue an order granting or denying an appeal pursuant to a certificate of immediate review.
The Act amends O.C.G.A. Section 5-6-34. Effective March 23, 2001. The Act applies to any case pending on or brought after March 23, 2001, and, for purposes of taking an appeal involving O.C.G.A. Section 16-11-184, applies to any ruling entered before March 23, 2001, which is still pending on March 23, 2001.

TITLE7 BANKING AND FINANCE
Act 299; SB 16
This Act revises numerous provisions relating to financial institutions and the Department of Banking and Finance. The Act changes the definition of "bank" to include a federal or state credit union, requires documentation in the file that documents a bank's primary reliance upon other factors for repayment of a loan even though the bank takes a real estate lien as security, allows a bank to acquire and hold for its own account interests in as well as shares of stock in various corporations, allows a bank to acquire unlimited investments in entities that only engage in activities the bank itself could conduct, allows a bank to invest as much as is necessary in the stock of the Federal Home Loan Bank to use the services of the Federal Home Loan Bank, requires prior approval by the Department of Banking and Finance for certain bank acquisitions, and authorizes the department to provide by regulations for expedited or notice only procedures and administrative fees. The Act changes the residency requirement for directors of a state bank to require 75 percent of the directors of a bank to be citizens of the United States. The Act further provides for review by the department of any plan of merger by a state bank with any other bank and a determination by the department whether the activity, power, asset, or line of business which may accrue to the resulting bank should be approved, denied, or phased out within a reasonable period of time, to be determined by the department. The Act provides that, subject to permission of the department, a resulting bank or trust company is authorized to engage in any business and exercise any right that any bank or trust company which is party to the merger plan could lawfully exercise or engage in immediately prior to the merger. The Act clarifies that a Georgia state bank may conduct any

activities at any branch outside Georgia that are authorized by Georgia law. The Act provides that a credit union meeting certain criteria specified by the department is not required to obtain prior approval from.the department to offer third-party payment services but must provide the department with prior notice of intent to offer such services. The Act requires mortgage brokers applying for licenses to show evidence of satisfaction of experience or education requirements as required by department regulations, to include with damages under a surety bond moneys owed to the department for fees, fines, or penalties, and to continuously maintain both the net worth requirement and the bond, wherever applicable, as a condition of licensure or registration. The Act clarifies that the department may not issue a mortgage lender or broker license to a person receiving first offender. treatment until probation, sentence, or both probation and sentence have been successfully completed and documented. The Act allows the department to deny or revoke a mortgage broker or lender license if the applicant has had a license denied, revoked, or suspended within three years of the date of the license application or if the applicant employs any other person against whom a final cease and desist order has been issued within the preceding three years or whose license has been revoked within three years of the date such person was hired. The Act requires that a proper application for a mortgage lender or broker license must include moneys owed to the department-The Act further requires the department to compile information on the-number of written complaints received on all licensees and beginning August 1, 2001, and at least annually thereafter, to disclose to the public those numbers and the number of Georgia residential mortgage loans made during the same period as reported to the department in license renewal applications, to prescribe. standards regarding the accuracy of required disclosures, and to set administrative or civil penalties or fines for failure to provide such disclosures or to meet the prescribed standards. The Act also makes conforming and technical changes throughout O.C.G.A. Chapter 7-1.
The Act amends O.C.G.A. Sections 7-1-4, 7-1-286, 7-1-288, 7-1-480, 7-1-530, 7-1-536, 7-1-555, 7-1-628.6, 7-1-670, 7-1-1003, 7-1-1003.2, 7-1-1004, 7-1-1005, 7-1-1009, 7-1-1012, and 7-1-1014.
Effective July 1, 2001.
Act 298; SB 11
This Act changes the powers of business development corporations to include limiting a corporation from incurring any secondary liability unless the corporation has a substantial interest in the performance of the transaction, providing for the purchase and sale of commercial or historical real and personal property and certain residential projects by the corporation, and authorizing a corporation to acquire or dispose ofa partnership interest in any partnership or other entity. The Act further increases the limitation on the sum of the amount outstanding of member loans to the corporation made by any member at any one time and the amount of the investment in the capital of the corporation then held by such member.
The Act amends O.C.G.A. Sections 7-1-745 and 7-1-747. Effective July 1, 2001.
Act 129; HB 152
This Act increases the amount of the loan balance from $200.00 to $300.00 on which an industrial loan licensee is prohibited from charging a loan fee when that part of the loan is

used to pay a prior loan from the same licensee to the same borrower within the immediately preceding two months. The Act also changes the amount that a licensee may charge and collect from a borrower as a late or delinquent charge to allow for alternative charges of $10.00 or an amount equal to 5C for. each $1.00 of any installment which is not paid within five days from the payment due date, whichever is greater. The Act further increases from $2.00 to $3.00 the amount that a licensee may charge and collect as a maintenance fee for each month in the term of the loan contract on each loan made.
The Act amends O.C.G.A. Section 7-3-14. Effective April 13, 2001.
TITLE9 CIVIL PRACTICE
Act 264; HB 569
This Act provides that when a party fails to file pleadings in an action such failure shall be deemed to be a waiver by that party of all notices including notices of entry of judgment. The Act further provides that notification of a decision to a losing party is not required if such notice has been waived by law for failure of a party to file pleadings in an action.
The Act amends O.C.G.A. Sections 9-11-5 and 15-6-21. Effective July 1, 2001, and applicable to judgments or decisions entered on and after that date.
Act 256; HB 435
This Act provides that the court may order a party to submit to a mental examination by a licensed psychologist, and the party against whom the order is made may request and shall receive a copy of the report of the licensed psychologist. The Act further provides that if a psychologist fails or refuses to make delivery of a report pursuant to a court order, the court may exclude the testimony of the psychologist at the trial. The Act does not preclude discovery of a report or the taking of a deposition of the psychologist.
The Act amends O.C.G.A. Section 9-11-35. Effective July 1, 2001.
Act 297; HB 737
This Act provides that attorney's fees and expenses of litigation assessed for a frivolous action or defense shall be treated as court costs in any subsequent action between the same parties.
The Act amends O.C.G.A. Section 9-15-14. Effective July 1, 2001.

TITLE 10 COMMERCE AND TRADE

Act 227; SB 198

This Act increases from $10.00 to $13.00 the delinquency charge for a retail installment

contract or revolving account payment that is not paid by the buyer within ten days from the

payment due date.



The Act amends O.C.G.A. Section 10-1-7.

Effective July 1, 2001.

Act 383; HB 701

This Act prohibits a career consulting firm from guaranteeing actual job placement as one of its services. The Act clarifies that the administrator is authorized to issue a cease and desist order or an order imposing a civil penalty or both. The Act further provides that the superior court may grant relief upon a showing by the administrator that a person has committed a violation or is about to commit such without regard as to whether the administrator has issued an order. The Act authorizes the administrator to initiate an action or intervene in an action in any federal court or administrative agency.
The Act amends O.C.G.A. Sections 10-1-392 and 10-1-397 and enacts O.C.G.A. Section 10-1-397.1.
Effective July 1, 2001.

Act 358; SB 53

This Act provides that consumers shall not be charged fees above and beyond those contracted for between their physicians and their health benefit plans, every contract between a physician and an insurer which offers a health benefit plan shall be in writing and state the fees and charges for services, neither the insurer nor the enrollee shall be liable for any amount which exceeds the obligations established in the contract, and no physician shall intentionally collect or attempt to collect charges and fees for which an enrollee is not liable; The Act authorizes the Composite State Board of Medical Examiners to discipline a physician who has failed to attempt to inform a patient, in a timely manner, of the results of a laboratory test. The Act provides that any physician who complies with the rules of the board regarding informing a patient of the results of any laboratory test shall be immune from civil or criminal liability for such disclosure.
The Act amends O.C.G.A. Sections 10-1-393 and 43-34-37. Effective July 1, 2001, except for the provisions relating to physician disciplinary actions and physician immunity which are effective January l, 2002.

Act 226; SB 188

This Act regulates the disposition of the inventory of a marine dealer following termination of a franchise, selling, or other contractual agreement.
The Act enacts O.C.G.A. Sections 10-1-675 through 10-1-678. Effective July 1, 2001, for any contract in effect which has no expiration date and is a continuing contract and any other contract entered into or renewed on or after July 1, 2001. Any contract in effect prior to July 1, 2001, which by its terms will terminate on a date

subsequent thereto shall be governed by the law as it existed prior to July 1, 2001.
Act 301; SB 24
This Act permits the use of electronic records and signatures unless the provisions of O.C.G.A. Chapter 10-12 are otherwise expressly referred to and limited.
The Act amends O.C.G.A. Sections 10-12-2 and 10-12-4. Effective July 1, 2001.
TITLE 11 COMMERCIAL CODE
Act 191; HB 191
This Act strikes existing provisions of O.C.G.A. Article 11-9, relating to transactions secured by personal property, and adopts Revised Article 11-9 (2000), as proposed by the Uniform Law Institute.and the National Conference of Commissioners on Uniform State Laws, with some Georgia variations. Georgia variations from the uniform official text include: a system allowing filing a financing statement in any county, with central indexing under the supervision of the Georgia Superior Court Clerks' Cooperative Authority; deletion of official text provisions relating to manufactured homes and transactions concerning manufactured homes; excluding some transactions regarding obligations secured by property ofgovernmental entities from the scope of Revised Article 11-9; excluding leases, usufructs, and rents from leases and usufructs from the scope of Revised Article 11-9; a provision that grant of a blanket security interest in inventory is not a bulk sale; certain provisions relating to the relative priority of a consensual security interest and the claim of a statutory lien creditor; priority over a perfected security interest for year's support and certain statutory liens; and special priority over prior security interests for certain financiers ofcrops. Significant changes from Georgia's previous version of Article 11-9 include: changed rules for determining where a financing statement must be filed and the form and content of the financing statement; expanding the scope of Article 11-9 to include agricultural liens, deposit accounts, payment intangibles, health care insurance receivables, letter of credit rights, and certain commercial tort claims; treatment of timber to be cut and embedded software as goods; changes in methods of perfection; and new obligations for secured parties. Transition provisions allow secured parties at least one year, and in many cases longer, to continue the perfection of security interests under Revised Article 11-9.
The Act repeals and reenacts O.C.G.A. Article 11-9 and amends O.C.G.A. Sections 1-3-3, 7-1-4, 9-9-2, 10-1-731, 11-1-105, 11-2-201, 11-2-103, 11-2-210, 11-2-326, 11-2-502, 11-2-716, ll-2A-103, 11-2A-303, ll-2A-307, ll-2A-309, 11-4-210, 11-5-118, 11-6-102, 11-7-503, 11-8-103, 11-8-106, 11-8-110, 11-8-301, 11-8-302, 11-8-510, 15-6-77, 15-6-77.3, 16-6-13.2, 16-13-49, 29-2-13, 40-3-50, 44-12-24, 44-14-36, 44-14-100, 44-4-101, and 49-4-146.3.

This Act limits an exception to a restriction on the talcing of artifacts. The Act specifies certain duties of the state archeologist relative to the finding of artifacts. The Act provides for evidence of the illegal talcing of artifacts.
The Act amends O.C.G.A. Section 12-3-621. Effective July 1, 2001.

Act 288; HB 235

This Act transfers the assignment for administrative purposes of the Georgia Agrirama Development Authority from the Department of Agriculture to the Department of Natural Resources. The Act changes the membership of such authority The Act repeals O.C.G.A. Chapter 2-3 and enacts Article 11 of O.C.G.A. Chapter 12-3.
Effective July I, 2001.

Act 287; HB 206

This Act provides that local water authorities shall have the authority to accept voluntary customer contributions for conservation and environmental projects. The Act provides that such authorities shall have the authority to establish and operate such programs. The Act provides that the Board of Natural Resources shall establish procedures for accepting water samples taken by any person for certain purposes and to account for transfers of water from one water basin to another or from one aquifer to another. The Act provides an exception froin the "Erosion and Sedimentation Act of 1975" for public water system reservoirs.
The Act amends O.C.G.A. Sections 12-5-5, 12-5-23, and 12-7-17. Effective July I, 2001.

Act 180; SB 139

This Act changes provisions relating to the State Water Well Standards Advisory Council.

The Act provides that a person may drill a water well on property used as his or her primary

residence, but only a licensee may drill a water well on property intended for sale. The Act

exempts such licensees from certain provisions relating to electrical and plumbing work done

in connection with the drilling of water wells. The Act changes provisions relating to

penalties.



The Act amends O.C.G.A. Sections 12-5-122, 12-5-123, 12-5-124, 12-5-127, 12-5-129,

12-5~130, 12-5-133, 12-5-134, and 12-5-135 and enacts O.C.G.A. Sections 12-5-131.1,

This Act enacts the "Metropolitan North Georgia Water Planning District Act." The Act establishes such planning district and the membership and duties of the district. The Act provides for the creation of advisory committees. The Act provides for the preparation of model ordinances relating to storm-water management and plans relating to watershed management, waste-water management, and water supply and conservation management. The Act provides for the adoption and implementation of such ordinances and plans by local governments within such district.
The Act enacts Article 10 of O.C.G.A. Chapter 12-5 and amends 0.C.G.A. Section 12-5-23.
Effective May 1, 2001.

TITLE 13 CONTRACTS

Act 261; HB 513

This Act revises the present provisions of law concerning bid bonds, performance bonds,

and security deposits required for state public works contracts and provides conditions for the

withdrawal of bids. The Act further provides for acceptable substitutes for performance bonds

and_ for actions on such bonds. The Act also provides for notices of commencement to be

posted at the construction site and placed on file with the clerk of the superior court of the

county in which the site is located and specifies the contents of such notices.

In addition, the Act exempts hospital authorities from the provisions of the "Georgia Local

Government Public Works Construction Law," 0.C.G.A. Chapter 36-91.

This Act enacts O.C.G.A. Chapter 13-10 and O.C.G.A. Section 36-91-2 and amends

This Act substitutes the Office of Treasury and Fiscal Services for the Department of Administrative Services as the recipient of the assets of creditors, claimants, members, or shareholders of dissolved corporations when such creditors, claimants, members, or shareholders cannot be found or are not competent to receive such assets.
This Act amends O.C.G.A. Sections 14-2-1408, 14-2-1433, 14-2-1440, 14-3-1409, 14-3-1433, and 14-3-1440.

Act 350; SB 96
This Act changes the formula to allow senior judge 'status when a judge has served a total of nine years in any combination as a Justice with the Supreme Court, Judge of the Court of Appeals, superior court judge, state court judge, magistrate court judge, or juvenile court judge and at least one year_ of service as the chairperson of the State Board of Workers' Compensation.
The Act amends O.C.G.A. Section 15-1-9.2. Effective April 27, 2001.
Act 328; HB 450
This Act provides for an additional judge of the superior court for each of the following judicial circuits: Atlanta Circuit, Augusta Circuit, Gwinnett Circuit, and Rome Circuit.
The Act amends O.C.G.A. Section 15-6-2. Effective January 1, 2002, for the Atlanta, Augusta, and Gwinnett judgeships; effective May 27, 2001, for the Rome judgeship; provisions relating to the initial appointment of the additional judges are effective April 27, 2001.
Act 305, SB 50
This Act changes the duties of superior court clerks and provides for electronic collection and transmission of data and use and access to the data. It requires transmission of the data to certain entities and authorizes maintenance of records in digital format, with back-up requirements. The Act also provides for record storage with the Georgia Department of Archives and History under certain circumstances and access to those records.
The Act amends O.C.G.A. Sections 15-6-61 and 15-6-62 and enacts O.C.G.A. Section 15-6-62.1.

This Act eliminates fees for costs from the clerk of superior court, magistrate court, and sheriff's office associated with filing criminal charges by an alleged victim of violations of O.C.G.A. Sections 16-5-90, 16-5-91, 16-6-1, 16-6-2, 16-6-3, 16-6-4, 16-6-5.1, 16-6-22.1, and 16-6-22.2 for the issuance or service of a warrant, protective ordeF, or witness subpoena.
The Act amends O.C.G.A. Sections 15-6-77, 15-10-82, and 15-16-21. Effective July 1, 2001.
Act 291; HB 302
This Act increases the minimum salary by approximately 21 percent for the office of clerk of superior court, probate judge, chief magistrate, magistrate, sheriff, chief registrar, tax collector, and tax commissioner. The Act also increases the compensation of these various officials when any such official serves in more than one capacity. The Act also enacts O.C.G.A. sections to allow these offices contingent expenses for the operation of the office

based on population size. The Act provides for compensation supplements for members of county governing authorities with respect to completion of certain training and provides for periodic cost-of-living or general performance increases. This Act provides an alternative to detention in a youth development center for a child who is found to have committed a delinquent act.

This Act provides guidelines when a child advocate subpoenas investigative records in an ongoing investigation, including a hearing on a motion to quash, and provides for compliance and confidentiality of certain information.

Act 196; HB 330
This Act extends the pilot project in the Family Court Division of the Superior Court of Fulton County until July 1, 2004. The Act provides for one or more judges to sit as judge of the family court division, instead of mandating two judges; provides for a comprehensive report; and changes the repeal date for the project.
The Act amends O.C.G.A. Sections 15-llA-2, 15-llA-3, 15-llA-7, and 15-llA-9. Effective July 1, 2001.

TITLE 16 CRIMES AND OFFENSES
Act 385; SB 160
This Act allows a person to use force which is intended or likely to cause death or great bodily harm against a person who is not a family or household member and who unlawfully and forcibly enters the person's residence.
The Act amends O.C.G.A. Sections 16-3-21 and 16-3-23. Effective July 1, 2001.
Act 19, SB 33
This Act, the "Child Sexual Commerce Prevention Act of 2001," changes the definition of prostitution to include the act of sodomy and sexual acts in exchange for items of value instead of only in exchange for money. The Act increases the penalty for pandering irivolving a person under the age of 18 to a minimum five-year sentence and adds pimping a child under the age of 18 as an offense, which is also punishable as a felony, with a minimum five-year sentence. It also increases the age limit for solicitation of sodomy from 17 to 18 and increases the misdemeanor punishment to a felony with a minimum five-year sentence and $2,500.00 fine. The Act makes pandering by compulsion gender neutral.
The Act amends O.C.G.A. Sections 16-6-9, 16-6-13, 16-6-14, and 16-6-15. Effective March 27, 2001.
Act 353; SB 207
This Act creates the additional offense of criminal trespass for defacing, mutilating, or defiling any military service person's grave marker. It also adds theft penalties for theft of a military grave marker: one to three years' imprisonment if the value of the property is $300.00 or less and three to five years if the value is greater than $300.00.
The Act amends O.C.G.A. Sections 16-7-21 and 16-8-12. Effective July 1, 2001.
Act 20, SB 34
This Act, the "2001 Crime Prevention Act," changes punishment for various offenses and modifies a court's authority over a sentence. The Act changes punishment for certain types of escape; provides for motor vehicle forfeiture when the offense involves pimping or pandering involving a person under the age of 18; and provides for forfeiture of money and proceeds for pimping a child under age 18.
The Act allows the sentencing court to revoke a probationary sentence before it begins and to continue to modify a sentence within one year from when it is imposed or within120 days of the remittitur. The Act also defines "special condition of probation."
The Act amends O.C.G.A. Sections 16-10-52, 16-6-13.2, 17-10-1, 42-8-34, and 42~8-34.1 and enacts O.C.G.A. Section 16-6-13.3.
Effective July 1, 2001, and applicable to escapes committed on or after July 1, 2001.

This Act make changes to the lists of Schedule I controlled substances and dangerous drugs and broadens the definition section. The Act also changes the penalties related to violations and restitution to the state for cleanup of environmental hai.ards. The Act amends the "Georgia Pharmacy Practice Act" to require certain wholesale distributors of controlled substances or dangerous drugs to provide certain information.
The Act amends O.C.G.A. Sections 16-13-25, 16-13-56, and 16-13-71 and enacts O.C.G.A. Sections 16-13-70.1 and 26-4-115.1.

Act 267; HB 657
This Act changes the definition of the term "pattern of racketeering activity" in the RICO Act and the applicability and effect of that Act.
The Act amends O.C.G.A. Section 16-14-3. Effective July 1, 2001, and applicable to racketeering activity occurring on or after that date.
TITLE 17 CRIMINAL PROCEDURE
Act 171; HB 292
This Act allows any judge who is authorized to issue a search warrant pursuant to O.C.G.A. Section 17-5-21 to hear a warrant application via video conference. The affiant and judge shall sign the appropriate documents by reasonable means, including by electronic stylus. A video

recording of the hearing and any documents submitted with the application must be maintained as part of the record.
The Act enacts O.C.G.A. Section 17-5-21.1. Effective July 1, 2001.
Act 312; SB 270
This Act allows state or magistrate court judges to set bond for a parolee or probationer charged with a misdemeanor involving physical injury, or an attempt to commit physical injury, or a new felony, except for persons charged with the offenses in subsection (a) of O.C.G.A. Section 17-6-1. It also allows the Department of Corrections to supervise a misdemeanor probationer whose sentence is transferred from out of state under the Interstate Supervision Compact.
The Act amends O.C.G.A. Sections 17-10-1 and 17-10-3. Effective July 1, 2001.

TITLE 19 DOMESTIC RELATIONS

Act 28; SB 118

This Act repeals the "Uniform Child Custody Jurisdiction Act" and enacts the "Uniform Child Custody Jurisdiction Enforcement Act." The Act provides comprehensive measures relating to child custody proceedings including enforcement of child custody determinations, provisions relating to how courts of this state shall treat Indian tribes and foreign countries in child custody proceedings, and provisions relating to which persons are bound by child custody determinations under the Act.
The Act repeals O.C.G.A. Sections 19-19-40through 19-9-64 and enacts O.C.G.A. Sections 19-9-40 through 19-9-51, 19-9-61 through 19-9-70, 19-9-81 through 19-9-97, and 19-9-101 through 19-9-104.
Effective July 1, 2001.

authorizes the creation of the Georgia Protective Order Registry to serve as a centralized data

base for state-wide protective orders issued pursuant to O.C.G.A. Sections 16-5-90 through

16-5-94 and O.C.G.A. Chapter 19-13. The registry provides law enforcement officers,

prosecuting attorneys, and the courts access to protective orders issued by the courts of this

state and foreign courts 24 hours of the day and seven days of the week to aid -in the

!!nforcement of such protective orders and the protection of victims of stalking and family

violence. The registry shall be maintained by the Georgia Crime Information Center.

The Act enacts O.C.G.A. Sections 19-13-50 through 19-13-56.

Effective July 1, 2001; however, the registry created by the Act shall become effective 180

days after the promulgation of the forms pursuant to O.C.G.A. Section 19-13-53.

Act 356; SB 60
This Act requires each county to establish a multidisciplinary, multiagency child abuse protocol committee which shall be charged with developing local protocols to investigate and pprosecute alleged cases of child abuse. The Act further requires each county to establish a local multidisciplinary, multiagency child fatality review committee which shall be charged with reviewing all eligible child deaths to determine manner and cause of death and if the death was preventable. The Act also establishes the Georgia Child Care Fatality Review Panel to oversee the local child fatality review process and to report to the Governor on the incidence of child deaths with recommendations for prevention.
The Act amends O.C.G.A. Sections 19-15-1 through 19-15-6. Effective July 1, 2001.
TITLE20 EDUCATION
Act 333; HB 724
This Act allows members of local boards of education to participate in the state health insurance plan and provides that the local board shall have the duty to make the employer contributions for such members. The Act deletes former provisions authorizing contracts with the Georgia School Boards Association, Inc., for such insurance.
The Act amends O.C.G.A. Sections 20-2-55, 45-18-5, and 45-18-50. Effective July 1, 2001.
Act 192; HB 176
This Act provides for issuance of high school diplomas to certain veterans who failed to receive diplomas due to an interruption of their education by service in World War II.
The Act enacts O.C.G.A. Section 20-2-69. Effective July 1, 2001.
Act 29; HB 656
This Act requires each local board of education to provide an early intervention program for kindergarten through grade five to serve students at risk of not reaching or maintaining academic grade level. The Act provides for identification of students for early intervention at the beginning of the school year and during the school year and for assignment to early intervention as soon as practicable. Students in grades four and five are no longer eligible for remedial education. The Act continues state funding of alternative education programs for the 2001-2002 school year based upon a full-time equivalent program count of 2.5 percent of the sum of the full-time equivalent program count for designated programs. The Act revises program weights; program weights now include funds for foreign language instruction in grades one through eight and instructional aides in kindergarten, but the Act prohibits using an aide to increase the maximum class size in kindergarten. The Act provides funding for 20 additional days of instruction for 10 percent of students in designated programs for addressing

the academic needs or'low-performing students. The Act provides for calculation ofallotments for the upper elementary grades early intervention program, the middle school program, and for the English for speakers of other languages program. With regard to equalization grants, the Act provides that school systems will report local tax revenues to the Department of Education; the Act provides for an adjustment to the effective millage rate if the amount of local tax revenues is subsequently adjusted after an audit of a local school system's annual financial report and application of any net change in the amount of equalization dollars earned to the local school system's equalization grant in a subsequent fiscal year. The Act revises expenditure controls for direct instructional costs with regard to counselors, technology specialists, and positions for foreign language. The Act provides for state payment of a portion of the national certification program participation fee prior to certification in specified circumstances. The Act deletes the requirement that local school systems pay the state supplement for principals in a separate payment.
With regard to capital outlay funds, the Act alters the method of calculating the required local participation, provides financial incentives for local school systems to use prototypical designs, increases the maximum authorization level for capital outlay, and revises the method of crediting local funds contributed in excess of required local participation toward earning entitlement for state eligible project costs. The Act defines a special appropriation for public school outlay and provides for rules and policies for disbursement and application of such a special appropriation. The Act extends the date for automatic repeal of the low-wealth capital outlay grants program to June 30, 2009; increases the percentage of the state eligible costs of the project funded by such grants; and provides a financial incentive for use of prototypical designs and project management under the direction of the Georgia State Financing and Investment Commission. Provisions for receipt of state capital outlay funds under the advance funding category and for construction projects needed because of exceptional growth were amended to provide for an automatic repeal on June 30, 2009.
The Georgia Academic Placement and Promotion Policy enacted by the Act provides that, with some exceptions, students would be promoted to grades four, six, and nine, respectively, only if students in grade three achieve grade level on the criterion-referenced reading assessment and students in grades five and eight achieve grade level on the reading and math assessments. The Act provides for notice to parents of a student's below-grade performance, retesting, and opportunity for accelerated, differentiated, or additional instruction. After below-grade performance on the second test and notice of intention to retain the student, if there is an appeal, the student may be promoted if the placement committee agrees unanimously. The policy is to become effective for the third grade beginning with the 2003-2004 school year; the fifth grade beginning with the 2004-2005 year; and the eighth grade beginning with the 2005-2006 year. The Act creates the Georgia Closing the Achievement Gap Commission to develop strategies, reports, and recommendations to assist in closing the student achievement gap for at-risk students, including groups disaggregated by ethnicity, sex, disability, language proficiency, and socioeconomic status. The commission's existence is automatically terminated on June 30, 2006.
The Act changes state requirements for middle school schedules to require a minimum of five hours academic instruction and to permit exploratory classes and a common planning period of 55 minutes for an interdisciplinary team of academic teachers. Sparsity grants to supplement funding for alternative education programs are added. The Act clarifies that charter schools are public schools.
The Act amends eligibility criteria for HOPE scholarships for students attending a private

postsecondary institution to allow students ineligible for HOPE for their junior year to requalify for their senior year. The Act changes eligibility criteria for PROMISE teachers' scholarships to a minimum overall cumulative 3.0 grade point average. The Act allows a PROMISE II teacher's scholarship to be applied to no more than 30 semester or 45 quarter hours, subject to appropriation.
The Act amends O.C.G.A. Sections 20-2-153, 20-2-154, 20-2-154.1, 20-2-160, 20-2-161, 20-2-165, 20-2-167, 20-2-181, 20-2-182, 20-2-212.2, 20-2-214, 20-2-260, 20-2-262, 20-2-290, 20-2-292, 20-2-2062, 20-3-519.3, 20-3-519.7, and 20-3-519.12 and enacts O.C.G.A. Sections 20-2-184.1 and 20-2-282 through 20-2-286.
Effective April 9, 2001, except that the Georgia Academic Placement and Promotion Policy is to be phased in as stated above.
Act 345; SB 274
This Act provides for payment of beginning classroom teachers for the first time at the end of the first month of the school year in which such teachers work.
The Act amends O.C.G.A. Section 20-2-212. Effective April 27, 2001.
Act 219; HB 372
This Act requires public schools to inform eligible students of their right to register and vote and to provide an opportunity to register at the students' schools.
The Act amends O.C.G.A. Section 20-2-310. Effective July 1, 2001.
Act 384; HB 651
This Act increases the maximum period for a lease of school property to 50 years. The Act amends O.C.G.A. Section 20-2-600. Effective July 1, 2001.
Act 169; HB 164
This Act provides that a teacher absent due to an injury caused by a physical assault in the performance of the teacher's duties shall not be charged with sick leave, be required to pay the cost of a substitute, or have his or her compensation reduced for the first seven workdays of absence. .
The Act amends O.C.G.A. Section 20-2-850. Effective July 1, 2001.
Act 344; HB 491
This Act reduces the minimum number of years of creditable service required for a former teacher or other public school employee not presently eligible to receive retirement benefits to receive continuing health insurance from 20 years to eight years. The Act provides that former state employees and certain former members of the General Assembly may continue

health insurance by paying monthly premiums. The Act amends O.C.G.A. Sections 20-2-888, 20-2-915.1, and 45-18-10. Effective July 1, 2001.
Act 321; HB 228
This Act requires publishers of textbooks recommended by the State Board of Education to provide such textbooks in electronic format.
The Act enacts O.C.G.A. Section 20-2-1015. Effective July 1, 2001.
Act 15; HB 417
This Act, the "Georgia Higher Education Savings Plan Act," creates the Georgia Higher Education Savings Plan to establish and maintain the Georgia Higher Education Savings Trust Fund. The Act provides that the plan, governed by a board of directors, shall make savings trust agreements available to the public, under which account contributors make contributions, which may be used, along with the investment earnings on such contributions, for qualified educational expenses of a designated beneficiary. The savings trust agreements and accounts will conform with the requirements of Section 529 of the Internal Revenue Code of 1986. The Act creates the Georgia Higher Education Savings Plan Trust Fund, to consist of deposits in accordance with savings trust agreements, earnings from the investment of such deposits, and any moneys acquired from other sources. An annual maximum of $2,000.00 per beneficiary in contributions by parents and guardians is deductible from taxable income for purposes of the Georgia income tax for years beginning on or after January 1, 2002. Qualified withdrawals from a savings trust account used solely for qualified higher education expenses are not subject to state income tax; unqualified withdrawals will be taxed as income of the contributor in proportion to the earnings in the account at the time of the withdrawal and the proportion of the contributions which previously have been used to reduce taxable income. The plan is not subject to the "Georgia Administrative Procedure Act" or the Office of State Administrative Hearings. The Act includes express disclaimers of any promise of admission to any or any particular institution of higher education, continuance of enrollment, or graduation and any promise that qualified higher educati~n expenses, in general or in particular, shall be fully covered by contributions or earnings on a savings trust account. The Act lists records of the plan which shall not constitute public records.
The Act enacts Article 11 of O.C.G.A. Chapter 20-3 and amends O.C.G.A. Sections 48-7-27 and 50-13-2.
Effective March 23, 2001.

This Act changes the composition ofthe members of the Georgia Public Telecommunications Commission to nine members appointed by the Governor from the general public.

Act 164; HB 110
This Act provides that candidates for county and municipal offices who pay their qualifying fee with a dishonored check are automatically disqualified and allows the State Elections Board to authorize the Secretary of State to investigate violations of the "Georgia Election Code." The Act further provides that qualifying periods may be extended and primaries and elections may be extended or postponed in the event the Governor declares a state of emergency, provides that municipal election superintendents be appointed in a public meeting and such appointment be recorded on the minutes of the governing authority, and changes the deadline for a municipal write-in candidate's notice of candidacy. The Act also changes requirements relating to municipal registrars, changes provisions,relating to a voter's change of address, provides for incumbency to be noted on the ballot in a nonpartisan election, and provides that candidates be listed alphabetically on the nonpartisan ballot. The Act additionally changes provisions relating to the number of ballots to be supplied, provides .that the addresses of candidates who have the same name be printed on the ballot, changes provisions relating to testing of tabulating machines, provides that the governing authority of the municipality shall appoint absentee ballot clerks, and provides that absentee voters voting in person shall show identification. The Act further provides that challenges to absentee electors must be made prior to 12:00 Noon on the day of a primary or election, eliminates a hunting or fishing license from the list of acceptable forms of identification, eliminates the requirement that one poll be open in a special election for a member of the General Assembly when there is only one candidate, provides that tampering with voting equipment is a felony, and changes provisions relating to recall elections. The Act also makes several clerical and conforming changes to the "Georgia Election Code."
The Act amends O.C.G.A. Sections 21-2-6, 21-2-31, 21-2-70.1, 21-2-133, 21-2-214, 21-2-218, 21-2-285.1, 21-2-290, 21-2-359, 21-2-380.1, 21-2-381, 21-2-417, 21.:2-544, 21-4-4, and 21-4-5 and enacts O.C.G.A. Sections 21-2-50.1, 21-2-325.1, and 21-2-582.1.

Act 165; HB 479
This Act provides that no person shall be eligible for party nomination or election to public office or to perform any official acts or duties in connection with an election if the person is illegally holding any public funds or if the person has been convicted of fraudulent violation of primary or election laws, malfeasance in office, or a felony involving moral turpitude unless the person's civil rights have been restored and ten years have elapsed from the date of the completion of the sentence without a subsequent conviction of another felony involving moral turpitude. The Act also prohibits the Secretary of State from serving in any fiduciary capacity in the campaign of any candidate whose election will be certified by the Secretary of State other than the Secretary of State's own campaign. The Act further provides that the appointment of the municipal election superintendent shall be made in a public meeting and recorded on the minutes of the governing authority, that the city clerk shall serve as election superintendent if the governing authority fails to appoint a municipal election superintendent, and that certain close relatives of candidates in municipal elections may not serve as municipal election superintendents. The Act requires election superintendents to provide adequate training to all poll officers and workers prior to the first election of the election cycle, to

provide certificates to those poll officers and workers who successfully complete the training, and to notify the Secretary of State of the completion of such training. The Act also requires county election superintendents and at least one county registrar to receive 12 hours of training annually and municipal election superintendents and at least one registrar in each municipality to receive 12 hours of training biennially. The Act requires political parties to file lists of their state and county executive committee members with the appropriate state or county election official. The Act provides that the municipal governing authority establish qualifying fees at least 35 days prior to a special primary or election, that county election superintendents who qualify candidates on behalf of political parties retain 75 percent of the qualifying fees and transmit 25 percent to the state executive committee of the party, that the county election superintendent shall qualify candidates ofpolitical parties that do not designate party qualifying officials at least 14 days before the opening of qualifying, and that the qualifying period for special elections shall not be less than two and one-half days. The Act requires that certifications of political party candidates include copies of the declaration of candidacy and affidavit of each candidate. The Act provides that persons who sign nominating petitions be urged to provide their date of birth for verification purposes. The Act authorizes the appointing authority to investigate the criminal history of applicants for the positions of registrar and deputy registrar and provides that registrars and deputy registrars cannot have been convicted of felonies or crimes involving fraud or moral turpitude and that deputy registrars at educational facilities receive annual training. The Act also provides that the forms for voter registration may be printed or available through electronic means, authorizes disabled and illiterate persons to receive assistance in completing a voter registration form, and requires that voter registration agencies and offices transmit completed voter registration cards to the Secretary of State weekly, except during the 15 days prior to a registration deadline when the cards shall be transmitted daily. The Act requires that municipalities reimburse the county registrars for postage when it becomes necessary for the county registrars to mail new voter identification cards as a result of municipal precinct or district changes. The Act provides that, when a voter's name is removed from the list of electors because the voter has furnished the registrars in writing a new residence address which is outside of the county, the registrars shall notify the voter in writing at the voter's new address that the voter's name has been deleted and shall provide the voter with a voter registration form to permit the voter to register in the new county of residence. The Act allows the establishment of polling places outside of the boundaries of a precinct if no suitable facility is available within the precinct and if the polling place outside of the precinct would better serve the needs of the voters and allows for the cancellation of an election in a precinct in which all of the candidates are unopposed and there are no issues to be submitted to the voters. The Act provides for the review of election equipment which has any problem concerning its ability to accurately record or tabulate votes, requires the testing of equipment by the election superintendent prior to each election, and prohibits the sale by vendors of voting equipment that has not been certified by the Secretary of State and provides for penalties for such sales. The Act provides for the printing on the ballot of the addresses of candidates with the same or similar naines, requires applications for absentee ballots that are distributed by persons, entities, or organizations to list all acceptable categories for absentee voting, authorizes registrars to approve absentee ballot applications by initialing the application, requires absentee electors to certify that they are citizens of the United States and are not currently serving a felony conviction, and authorizes registrars to make corrections to the list of electors on election day. The Act prohibits the use of photographic or electronic monitoring or recording devices and cellular telephones in the

enclosed space of a polling place, provides for assistance to voters in federal elections, eliminates the requirement for election officials to note on the electors list which voters received assistance in voting at the polls, allows children under the age of 18 to accompany parents in the enclosed space, and prohibits anyone except peace officers from carrying firearms within 150 feet of a polling place. The Act also provides that runoffs shall be held on the twenty-first day after a primary or election and provides that, unless otherwise provided for in the city charter, municipal officeholders will be sworn in at the first organizational meeting of the new year and will hold office until their successors are duly elected and qualified.

Act 166; SB 213
This Act eliminates nonpartisan primaries and requires that nonpartisan elections be held at the time of the general primary except for those offices which were covered by a local Act of the General Assembly on July 1, 2001, which provided for election in a nonpartisan election without a nonpartisan primary and provides that notices of intent for write-in candidates must be filed between January 1 and the Tuesday after the first Monday in June for nonpartisan elections held at the time of the general primary. The Act further-requires that the Secretary of State shall transmit the names of all persons convicted of felonies and who are declared mentally ~ncompetent to the registrars of the county in which such person resides, authorizes the Secretary of State to obtain lists of deceased Georgia residents from other states, and provides that the Secretary of State shall remove the names of deceased electors from the list of electors. The Act also provides that the Constitutional Amendments Publication Board shall provide a short title or heading for each constitutional amendment which shall be printed on the ballot. The Act requires the Secretary of State to provide uniform election equipment to the counties by the July, 2004, primary; requires counties to provide adequate arrangements at the polling places for such equipment; authorizes the Secretary of State to provide educational programs for election and poll officials and voters on the use of the equipment; authorizes the Secretary of State to test electronic voting equipment in pilot cities during the 2001 municipal elections; and creates the Twenty-first Century Voting Commission. The Act provides procedures for election superintendents to open absentee ballot envelopes prior to the close of the polls on election days, provides that recounts for offices elected by the voters in

more than one county be conducted in all such counties, and provides deadlines for the certification of election results by the election superintendents, the Secretary of State, and the Governor.

The Act amends O.C.G.A. Sections 27-1-2, 27-1-10, 27-1-13, 27-1-33, 27-1-39, 27-2-2, 27-2-3.1, 27-2-5, 27-3-1, 27-3-4, and 27-3-25.

This Act defines horseshoe crabs taken for bait as seafood. The Act provides for the opening and closing of waters for the taking of horseshoe crabs for bait. The Act limits such activity

This Act provides that hunting and fishing are rights in this state and that the Department of Natural Resources has the duty to encourage hunting and fishing. The Act provides that no political subdivision may regulate hunting, fishing, or trapping.

This Act provides that no licensed bait shrimp dealer and no employee of such licensee shall hold a commercial cast net license. The Act exempts certain bait shrimp dealers from a requirement to provide access to water. The Act provides for certain information in reports of bait shrimp dealers and repeals certain provisions relating to the number of boats engaged in bait shrimping.
The Act amends O.C.G.A. Section 27-4-171. Effective July 1, 2001.

This Act provides for the suspension of civil monetary penalties against nursing facilities, nursing homes, or intermediate care homes for certain violations if the facility is not resurveyed for compliance within a specified time and provides for the relation back of such penalties if such resurvey discloses continued violations.
The Act amends O.C.G.A. Section 31-2-6. Effective July 1, 2001.
Act 382; HB 470
This Act provides that the Department of Community Health may appoint advisory committees and accept gifts, provides for rules of that department, provides that such department may transfer to the Indigent Care Trust Fund certain penalties imposed and may use appropriations to match certain funds transferred to that trust fund, and provides that such department may employ and provide for compensation of staff of the Composite State Board of Medical Examiners. The Act also authorizes state employees' health insurance plan contracts with certain hospitals for their employees and dependents, authorizes such department to obtain interest on certain orders and judgments, requires insurers to take certain actions with regard to recipients of medical assistance, and authorizes such department to establish pilot projects to provide health care coverage to the uninsured and underinsured.

This Act provides for the confidentiality of health care licensing board reports and peer review organization reports and make requests for staff privileges subject to peer review. The Act also enacts the "Patient Right to Know Act of 2001" to require the Composite State Board of Medical Examiners to create physician profiles on physicians licensed in this state and to make such profiles available to the public, requires physicians to provide to patients estimated charges for services, and authorizes patients to file grievances with such board regarding treatment received.
The Act amends O.C.G.A. Sections 31-7-8, 31-7-131, 31-7-133, and 43-34-37 and enacts O.C.G.A. Chapter 43-34A.
Effective April 11, 2001, except that physician profiles do not need to be available until July 1, 2002.
Act 362; HB 158
This Act extends to certain nonprofit corporations operating certain medical facilities an exemption from open records and open meetings requirements. The Act also prohibits hospitals from releasing for public use certain autopsy photographs without permission of the family of the deceased.

This Act changes the criminal offenses for which criminal records checks must be made by nursing homes and prohibits them from employing persons with such criminal records.

Act 389, SB 134
This Act changes the name of the State Tollway Authority to the State Road and Tollway Authority and changes the membership of the authority. The Act further provides for the construction of the Developmental Highway System by the authority and for contracts between the authority and the Department of Transportation. The Act also provides for the disposition of federal funds to the authority and authorizes investments by the authority and the use of authority property to secure bonds and other instruments of debt. The Act provides for and authorizes the issuance of grant anticipation revenue bonds and specifies the manner in which the authority shall issue bonds.
The Act amends O.C.G.A. Sections 12-7-7.1, 12-7-17, 32-1-8, 32-2-2, 32-2-75, 32-2-61, 32-4-22, 32-5-1, 32-5-2, 32-10-60 through 32-10-64, 32-10-65.1, 32-10-69, 32-10-71, 32-10-72, 32-10-90, 32-10-92, 32-10-93, 32-10-99, 32-10-108, 36-60-21, 40-16-2, 45-15-13, 50-17-21, and 50-17-22 and enacts O.C.G.A. This Act provides that the POW-MIA flag shall fly year round at each of the interstate highway rest areas in Georgia and authorizes the Department of Transportation to place a plaque at each rest area to indicate Georgia's appreciation of the sacrifices of prisoners of war and those missing in action and their families . . The-Act enacts O.C.G.A. Section 32-2-8. Effective July 1, 2001.

This Act changes the descriptions of the road corridors included within the Developmental Highway System and provides that no state agency shall name or rename any state road, bridge, interchange, or any part of a road with the name of a person without approval by the General Assembly by Act or joint resolution.

This Act provides that the Department of Transportation may promote and solicit voluntary contributions, sale of license plates, and other fundraising or promotional activities for the Roadside Enhancement and Beautification Fund and shall provide accounting for such funds to the transportation committees of the General Assembly by February l of each year. The Act further changes the definition of "authentic historical Georgia license plate" and the provisions of law concerning which vehicles may display such plates. The Act provides for the issuance of wildflower license plates to benefit the fund and for the design of such plates.
The Act amends O.C.G.A. Sections 32-6-75.2 and 40-2-41.1 and enacts O.C.G.A. Section 40-2-49.2.
Effective July 1, 2001.
TITLE33 INSURANCE
Act 229; HB 478
This Act increases the penalties for failure of insurance companies to pay insureds for losses within 60 days after demand is made, requires that copies of all actions against insurers for failure to pay within 60 days after demand is made and copies of the demand shall be mailed to the Commissioner of Insurance and the Consumers' Insurance Advocate, and provides that insurers under motor vehicle liability insurance policies shall fairly and promptly adjust claims and provides for penalties and payment of attorney's fees for failure to do so.
The Act amends O.C.G.A. Section 33-4-6 and enacts O.C.G.A. Section 33-4-7. Effective July 1, 2001.

This Act comprehensively revises the provisions of law concerning the licensing of insurance agents, agencies, subagents, counselors, and adjusters.
The Act amends Article 1 of O.C.G.A. Chapter 33-23 and O.C.G.A. Sections 33-5-22, 33-11-66, 33-11-67, and 33-29A-8.
Effective July 1, 2002.
Act 379; HB 187
This Act provides for minimum amounts of uninsured motorist insurance coverage, provides that such coverage need not be increased on renewal for policies in existence on January 1, 2002, or on renewal once coverage is issued, and changes the dates until which a valid insurance card shall be sufficient proof of insurance.
The Act amends O.C.G.A. Sections 33-7-11 and 40-6-10.

This Act requires health benefit policy coverage for certain surveillance tests for women who are at risk for ovarian cancer and requires certain physicians to make information about such tests available to women who are at risk.
The Act enacts O.C.G.A. Section 33-24-56.2. Effective July 1, 2001.

This Act enacts the "Registered Nurse First Assistant Consumer Act" and provides that, under health insurance policies issued, executed, or renewed in Georgia on or after July 1, 2001, which provide that any of their benefits are payable to a surgical first assistant for services rendered, the insurer shall directly reimburse any registered nurse first assistant who rendered services at the request of a physician and within the scope of the registered nurse first assistant's professional license.
The Act enacts O.C.G.A. Section 33-24-59.9. Effective July 1, 2001.

This Act provides that insurance contracts which provide benefits for neurological disorders shall not deny benefits to covered insureds because of a diagnosis of autism.

Act 279; SB 72
This Act changes the provisions of law relating to the liability of reinsurers in the event of the rehabilitation of an insurer so as to provide that.reinsurance shall be payable under a contract reinsured by the assuming insurer on the basis of reported claims allowed by the liquidation court without diminution because of the insolvency of the ceding insurer and shall be paid directly to the ceding insurer or it domiciliary liquidator with certain exceptions.
The Act amends O.C.G.A. Section 33-37-31. Effective July 1, 2001.
TITLE34 LABOR AND INDUSTRIAL RELATIONS
Act 334; HB 730
This Act provides for the Department of Labor a supplemental appropriation for the purpose of providing for the payment of expenses of administration of O.C.G.A. Chapter 34-8, the

"Employment Security Law," including personal services and operating and other expenses incurred in the administration of said law, as well as for the procurement of offices, lands, buildings, fixtures, furnishings, equipment, technology, data, reports, and studies, supplies, and the construction of buildings or parts of buildings suitable for use in this state by the Department of Labor. The Act authorizes the Commissioner of Labor to direct the obligation and expenditure of said funds.
Effective April 27, 2001.
Act 32; SB 14
This Act increases the minimum wage in this state from $3.25 to $5.15 per hour. The Act provides an additional exception to the minimum wage requirement for certain individuals employed by a nonprofit child-caring facility serving children or mentally disabled adults.
The Act amends O.C.G.A. Section 34-4-3. Effective July 1, 2001.
Act 221; HB 497
This Act changes provisions relating to workers' compensation. The Act changes the rate of interest payable on final awards entered by the board; provides for the award of reasonable litigation expenses under certain conditions; increases the number of physicians on the posted panel from four to six; allows an injured employee the right to an independent medical examination within 120 days of receipt of income benefits, rather than the current 60 days; changes provisions relating to the penalty for nonpayment of medical charges by an employer or an insurer; increases the maximum temporary total disability benefits from $375.00 per week to $400.00 per week; increases the minimum temporary total disability and benefits from $37.50 per week to $40.00 per week; increases the maximum temporary partial disability benefits from $250.00 per week to $268.00 per week; and provides that impairment ratings shall be based on the fifth edition of Guides to the Evaluation of Permanent Impairment.
The Act amends O.C.G.A. Sections 34-9-107, 34-9-108, 34-9-201, 34-9-202, 34-9-203, 34-9-261, 34-9-262, and 34-9-263.
Effective July 1, 2001, except Section 3, relating to the panel of physicians, which shall become effective January 1, 2002.

This Act changes provisions relating to drug-free workplace programs, so as to recognize on-site testing at the employer's worksite as qualified testing; to reduce the number of hours of employee and supervisor training required after the first year of certification; to redefine the term "employee assistance program"; to change the provisions relating to the insurance premium discount; to change the provisions relating to the elements of a drug-free workplace program; and to change the provisions relating to conduct of testing, types of tests, and procedures.
The Act amends O.C.G.A. Sections 34-9-411, 34-9-412, 34-9-413, 34-9-415, 34-9-416, 34-9-417, and 34-9-418.

The Act provides that criminal justice agencies establishing such records shall bear all responsibilities for entry, update, and removal as dictated by actions of criminal justice employees and officials.
The Act amends O.C.G.A. Section 35-3-36. Effective July 1, 2001.

Act 175; HB 579

This Act provides that the superintendent of the Georgia Police Academy shall be a classified

employee under the Georgia Merit System. The Act changes the assignment of the Georgia

Police Academy for administrative purposes from the Office of Planning and Budget to the

Georgia Bureau of Investigation.



The Act amends O.C.G.A. Sections 35-4-6 and 35-6A-2.

TITLE36 LOCAL GOVERNMENT
Act 245; HB 399
This Act provides that unless otherwise provided by local law, the governing authority of each county is authorized to fix the salary, compensation, expenses, apd expenses in the nature of compensation of the members of governing authority subject to certain conditions. The Act provides that compensation in effect on January 1, 2001, shall continue in effect unless increased under the Act.
The Act amends O.C.G.A. Section 36-5-24. Effective April 27, 2001.
Act 313; HB 25
This Act changes a certain population reference to thereby update and specify the counties in which certain special provisions shall applr to the collection and use of certain court costs

Act 310; SB 147
This Act enacts O.C.G.A. Section 36-32-12 to allow sessions of municipal courts to be held outside the municipality for which the municipal court is established so long as they are held within a county in which the municipality is located or has its legal situs.

Act 258; HB 443
This Act changes certain provisions regarding the reporting ofannexations to the Department of Community Affairs. The Act also requires the governing authority of any municipality annexing property to add all annexed areas to maps provided by the United States Census Bureau during the next regularly scheduled boundary and annexation survey of the municipality, complete the survey and map as instructed, and return them to the United States Census Bureau within the time frame requested.
The Act amends O.C.G.A. Section 36-36-3. Effective July l, 2001.
Act 271; HB 115
This Act authorizes a municipal corporation to sell or grant any of its real or personal property to a bona fide nonprofit resource conservation and development council.
The Act amends O.C.G.A. Section 36-37-6. Effective April 27, 2001.
Act 324; HB 366
This Act amends O. C. G. A. Section 36-44-3, relating to definitions regarding redevelopment powers, to redefine the term "redevelopment" to include any project as well as any activity or service necessary or incidental to achieving the development or revitalization of a redevelopment area. The Act also changes certain provisions regarding finance costs which qualify as redevelopment costs.
Effective April 27, 2001.
Act 173; HB 409
This Act amends the "Redevelopment Powers Law" so as to change the legislative purpose to include encouraging the redevelopment of economically and socially depressed nonurban areas within counties and municipalities. The Act expands the meaning of redevelopment and changes the characteristics of areas eligible for designation as redevelopment areas. The Act further provides for findings by a local legislative body of a political subdivision that a redevelopment area includes one or more natural or historical assets which would not reasonably be anticipated to be adequately preserved or protected without the approval of the

redevelopment plan. The Act amends O.C.G.A. Sections 36-44-2, 36-44-3, and 36-44-8. Effective July 1, 2001.
Act23; HB 87
This Act expands the current power of a county or municipal governing authority to enter into one-year, or less, certain business, commerce, or tourism contracts with private nonprofit organizations which are exempt from federal income taxes pursuant to Section 501(c)(6) of the Internal Revenue Code to also include organizations which are similarly exempt under Section 50l(c)(3) of the Internal Revenue Code. The Act also provides an exception under certain circumstances.
The Act amends O.C.G.A. Section 36-60-14. Effective March 28, 2001.
Act 375; SB 239
This Act provides that a certified copy of a county or municipal ordinance or resolution included within a general codification shall be self-authenticating and shall be admissible as prima-facie proof of any such ordinance or resolution before any court or administrative body. The Act also changes certain definitions relative to transfer of development rights, changes certain provisions regarding transfer of development rights, revises requirements for procedures relative to the transfer of development rights within or between political subdivisions, authorizes intergovernmental transfers, changes certain provisions regarding codification of local government ordinances, and provides for the posting of codified ordinances and resolutions on the Internet.
The Act amends O.C.G.A. Sections 24-7-22, 36-66A-l, 36-66A-2, and 36-80-19. Effective April 28, 2001.
Act 370; SB 25
This Act amends numerous provisions in the O.C.G.A. so as to authorize delivery of notices previously required to be delivered by registered or certified mail to be provided by overnight or commercial delivery service.
The Act amends O.C.G.A. Sections 4-11-9.4, 10-4-107.1, 12-5-550, 33-58-5, 36-74-12, and 44-14-162.2.
Effective July 1, 2001, and shall apply with respect to notices delivered on or after that date.
Act 327; HB 400
This Act provides an exemption for vehicles owned or leased by a county, municipal, or public housing authority from the provisions of O.C.G.A. Section 36-80-20 requiring certain
public vehicles to display a decal identifying the governmental entity to which h belongs.

This Act provides that no political subdivision shall issue any pension obligation bond unless the state auditor has certified that such bonds comply fully with the provisions of O.C.G.A. Section 36-82-9. The Act further provides that neither the political subdivision issuing pension obligation bonds nor any department, agency, authority, retirement system, or pension fund of such political subdivision shall purchase the pension obligation bonds so issued.
The Act enacts O.C.G.A. Section 36-82-9. Effective April 27, 2001.
Act 315; HB 75
This Act requires each political subdivision of this state which issues general obligation bonds, revenue bonds, or any other bonds, notes, certificates of participation, or other such obligations of that political subdivision in an amount exceeding $1 million to file a report with the Department of Community Affairs containing certain information.
The Act enacts O.C.G.A. Section 36-82-9 and repeals O.C.G.A. Section 36-82-160. Effective April 27, 2001.
TITLE38 MILITARY, EMERGENCY MANAGEMENT,
AND VETERANS AFFAIRS
Act 8; HB 242
This Act provides for the rank and the pay and allowances of the adjutant general and the assistant adjutant general of the Department of Defense.
The Act amends O.C.G.A. Sections 38-2-150 and 38-2-152. Effective March 9, 2001.
TITLE40 MOTOR VEHICLES AND TRAFFIC
Act 364, HB 253
This Act authorizes the use of a three letter abbreviation for a month on temporary license plates and the extension of the expiration of such temporary plates under certain circumstances. The Act also revises the provisions for registering commercial vehicles on an apportionment basis and provides that commercial vehicles which are prohibited by a federal agency from operating in interstate commerce shall not be eligible for registration. The Act defines natural person with regard to certificates of title, security interests, and liens and provides that certain motor vehicle records may be released to the public individually or in bulk. The Act also changes the time for county tag agents to submit reports and fees to the Department of Revenue and changes the form of the license plates issued to vehicles of state and political subdivisions.

This Act authorizes the issuance of special license plates for retired members of the armed forces and to recognize Trout Unlimited and provides that certain amounts raised from the issuance of the license plates recognizing Trout Unlimited may be made available to supplement trout restoration and management programs of the Wildlife Resources Division of the Department of Natural Resources.
The Act amends O.C.G.A. Section 40-2-85.1, enacts O.C.G.A. Section 4{}.;2-86.6, and amends and redesignates O.C.G.A. Section 40-2-81 as O.C.G.A. Section 40-2-9..

Act 161; HB 385
This Act promotes safe operation of motor vehicles on public roads. The Act lowers the blood alcohol concentration level to 0.08 grams or more for a per se offense of driving under the influence of alcohol. The Act prohibits possession of an open alcoholic beverage container or consumption of an alcoholic beverage by any person in the passenger area of a motor vehicle on the roadway or shoulder of a public highway, with exceptions for certain vehicles such as taxis or limousines. The Act provides for more severe consequences for persons convicted of driving under the influence two or more times within a five-year period by: increasing the minimum "hard suspension" period (no driving whatsoever) to 12 months for the second conviction and requiring the surrender of license plates of all vehicles registered in the offender's name during such hard suspension period; requiring, as a condition of mandatory probation, installation of ignition interlock devices on all vehicles registered in the name of the offender and use of such devices in any vehicles driven by the offender under a limited driving permit during a six-month period after conclusion of the hard suspension period; and increasing the criminal punishments to include mandatory minimums of 72 hours of actual incarceration and 30 days of community service for the second such offense within five years and 15 days of actual incarceration and 30 days of community service for the third such offense within five years. The Act changes certain provisions relating to revocation of drivers' licenses of persons under age 21 to conform to the foregoing. The Act provides for establishing the qualifications of persons who draw blood for purposes of testing drivers' alcohol concentration levels. The Act defines and provides punishment for the offense of aggressive driving. The Act expressly provides that secondary schools may conduct driver training courses subject to certain requirements. The Act provides for a Blue Ribbon Young Driver and DUI Study Commission.
The Act amends O.C.G.A. Sections 40-2-136, 40-5-55, 40-5-57, 40-5-57.1, 40-5-63, 40-5-67.1, 40-5-67.2, 40-6-253, 40-6-391, 40-6-392, 42-8-111, 42-8-112, and 43-13-10 and enacts O.C.G.A. Sections 40-5-7 and 40-6-397.

This Act requires that certain males under the age of 26 must be registered in compliance with the Military Seh;ctive Service Act before obtaining a driver's license and provides that making an application for a driver's license or an identification card shall constitute.consent for the necessary information to be sent to the United States Selective Service System for registration if the applicant is not registered.
The Act amends O.C.G.A. Section 40-5-2 and enacts O.C.G.A. Section 40-5-7. Effective July 1, 2001.
Act 30; SB 1
This Act promotes safe operation of motor vehicles on public roads by young or inexperienced drivers. The Act requires a form of driver training, consisting of either 40 hours of supervised experience or driver education plus 20 hours of supervised experience, as a prerequisite for issuance of an initial Clas~ D license (or an initial Class C license if the person has never been issued a Class D license). The Act prohibits Class D licensees from driving at any time between 12:00 Midnight and 6:00 A.M., with no exceptions. The Act prohibits Class D licensees from driving with any passenger in the vehicle who is not a member of the driver's immediate family during the first six months after license issuance; after that initial period, the Class D licensee is prohibited from driving when more than three other passengers in.the vehicle who are not members of the driver's immediate family are less than 21 years old. The Act requires a comprehensive on-the-road driving test for driver's license applicants. The Act deletes an obsolete reference to the Department of Education in regard to approval .of driving instructors and vehicles. The Act also changes certain provisions relating to revocation of drivers' licenses of persons under age 21 so as to conform with provisions of HB 385 and provides for suspension of the driver's license ~f any person under 18 years of age who has accumulated a violation point count' of four or more points in any consecutive 12 month period.
The Act amends O.C.G.A. Sections 40-5-21, 40-5-22, 40-5-24, 40-5-27, and 40-5-57.1. Effective January 1, 2002; except that provisions relating to on-the-road driving test requirements become effective six months after the effective date of sufficient appropriations for such purposes; and except that the Act becomes effective July 1, 2001, for purposes of promulgating rules and regulations relating to driver training requirements.
Act 223; HB 678
This Act establishes maximum fines for the first offense of speeding, provides that the failure of drivers to obey official traffic-control devices shall be a misdemeanor, and provides for the implementation and manner of use of traffic-control signal monitoring devices and procedures for imposition of civil penalties in connection with such devices.
The Act amends O.C.G.A. Sections 40-6-1, 40-6-20, and 40-6-371 and enacts O.C.G.A. Sections 40-14-20 through 40-14-24.

Act 217; HB 248

This Act provides an exception to the requirement that children four years of age and younger be seated in approved child passenger restraining systems while in vehicles for any children whose physician has provided a written statement to the child's parent or guardian that the physical or medical condition of the child prevents the use of such child passenger restraining system. The Act also removes the option of using seat belts for children who are three or four years of age.
The Act amends O.C.G.A. Section 40-8-76. Effective July 1, 2001.

TITLE41 NUISANCES

Act 368; SB 162

This Act provides that counties and municipalities may require repair, closing, or demolition

of buildings which do not comply with state minimum standard codes or which constitute a

nuisance; authorizes local ordinances with regard to such buildings or those which endanger

public health or safety or which are vacant and being used in connection with drug crimes; and

provides for notices and hearings regarding such buildings and compliance orders and

demolition in connection therewith and liens for such demolition.

The Act amends O.C.G.A. Sections 41-2-7, 41-2-8, 41-2-9, 41-2-12, and 41-2-17 and

enacts O.C.G.A. Section 41-1-10.

Act 306; SB 66
This Act changes the sex offender registration requirements by adding first offenders and people who plead nolo contendere as persons who must register; requires a school address to be provided, if applicable; and provides for registration of certain sex offenders convicted in a tribal court. The Act also changes the definition of "criminal offense against a victim who is a minor" for convictions after June 30, 2001.

TITLE43 PROFESSIONS AND BUSINESSES
Act 329; HB 532
This Act enacts 0. C. G.A. Section 43-1-29 to provide mandatory suspension of professional lice~ses for default or breach of a repayment or service obligation under any federal educational loan or service conditional scholarship program. Prior to suspension, the licensee shall be entitled to notice of the board's intended action and an opportunity to appear before the board. A license suspended under the provision shall not be reinstated or reissued until the

person provides the licensing board a written release issued by the reporting agency stating that the person is making payments on the loan or satisfying the service requirement.

Act 218; HB 297
This Act changes the types of structures which do not require the seal of a registered architect so as to include certain single story buildings not exceeding 5,000 square feet in area and certain one story preengineered buildings. The Act provides that construction contract administration services are not required to be performed exclusively by architects and clarifies the provisions relating to architect seals and documents required to be sealed.
The Act amends O.C.G.A. Sections 43-4-14 and 43-4-16. Effective July 1, 2001.

Act 222; HB 538

This Act revises and moves the provisions relating to the Georgia Boxing Commission from

O.C.G.A. Chapter 43-8A to O.C.G.A. Chapter 43-4B and changes the name of the Georgia

Boxing Commission to the Georgia Athletic and Entertainment Commission. The Act provides

for definitions; provides for the commission membership and its appointment, terms, officers;

vacancies, and reimbursement; provides for the membership of a medical advisory panel and

its qualifications, functions, meetings, and reimbursement; provides for identification cards

and a boxing registry; prohibits certain relationships with or compensation from promoters;

prohibits holding a professional match by unlicensed persons or persons without a match

permit; prohibits participation in professional matches by persons under 18; prohibits persons

other than ticket brokers from reselling a ticket for an athletic contest for a price exceeding

the face value of the ticket and for certain exceptions; provides for requirements for ticket

brokers and prohibits convicted felons from engaging in the business of a ticket broker;

prohibits certain practices by ticket brokers; provides that the original purchaser for personal

use of one or more tickets may sell or offer for resale such tickets at any price under certain

conditions; and provides for rules and regulations, fQr enforcement by the commission, and

for relief by order of the superior court.

The Act repeals O.C.G.A. Sections 10-1-310 and 10-1-311, repeals O.C.G.A. Chapter

43-8A, and enacts O.C.G.A. Chapter 43-4B.

Act 366; HB 641

This Act authorizes the State Board ofCosmetology to waive certain education requirements in cases of hardship, disability, or illness or under such other circumstances as the board deems appropriate .with respect to applicants who were enrolled in a board approved school or had completed a board approved study course as ofJune 30, 2000. The Act changes certain provisions relating to reciprocity; provisions relating to application to practice cosmetology; certain qualifications of cosmetologists, estheticians, and nail technicians; and the qualifications of instructors and teachers.
The Act amends O.C.G.A. Sections 43-10-9, 43-10-12, and 43-10-14. Effective July '1, 2001.

This Act contains the same provisions as HB 641 relative to the practice of cosmetology. In addition, this Act changes the definition of certain terms to reflect the general law change from technical institutes to technical colleges and provides that all such colleges and their programs shall be considered to be board approved.
The Act amends O.C.G.A. Sections 43-10-1, 43-10-9, 43-10-12, and 43-10-14. Effective July 1, 2001.
Act 188; HB 241
ThisActenactsO.C.G.A. Section43-ll-52, known as the "Georgia Volunteers in Dentistry Act." The Act authorizes the Georgia Board of Dentistry to issue a special license to practice dentistry only in the noncompensated employ of public agencies or institutions, not for profit agencies, institutions, corporations, or associations which provide dentistry services only to indigent patients in areas which are underserved by dentists or are determined by the board to be critical need areas. The Act provides for waiving examinations and certain license and renewal fees, issuance of a nonrenewable temporary license, and the waiving of liability for services rendered.
Effective July 1, 2001. The Act shall be automatically repealed July 1, 2004.
Act 242; HB 223
This Act amends O.C.G.A. Section 43-11-74, relating to direct supervision of dental hygienists, and authorizes them to perform dental screenings in settings which include schools, hospitals, clinics, state, county, local, and federal public health programs and other health fair settings preapproved by the Georgia Board of Dentistry. The Act requires that certain information be provided and no foes be charged except as provided.
Effective July 1, 2001.
Act 281; SB 254.
This Act prohibits a person who is not licensed as a conditioned air contractor from advertising in any manner that such person is in the business or profession of a conditioned air contractor unless the work is performed by a person licensed as a conditioned air contractor
under O.C.G.A. Chapter 43-14. The Act changes the provisions for certain cease an!,i desist
orders and provides that proof of unlawful practice shall not require an investigator to observe or witness the unlicensed person engaged illegally in the process of work or to show work in progress or work completed. Advertising is prima-facie evidence of a violation of the chapter and penalties are provided.
The Act amends O.C.G.A. Sections 43-14-8, 43-14-12.1, and 43-14-14. Effective July 1, 2001.

This Act authorizes the State Board of Registration for Professional Engineers and Land Surveyors to exempt certain engineers and land surveyors who are over the age of 65 frCJm

Act 272; HB 388
This Act authorizes the State Board for the Certification of Librarians'to require continuing education as a condition of renewal of a librarian's certificate; to waive the requirement in conditions of hardship, disability, or illness or under other circumstances deemed appropriate; and to adopt rules and regulations and appoint committees to administer and implement the continuing education requirement.
The Act enacts O.C.G.A. Section 43-24-7. Effective July 1, 2001.
Act 247; SB 75
This Act authorizes the issuance of a temporary license to practice acupuncture to an applicant who has completed the licensure requirements except certification until the applicant takes the appropriate examination and the Composite State Board of Medical Examiners is notified of the results.
The Act amends O.C.G.A. Section 43-34-64 and repeals subsection (b) thereof on July 15, 2002.
Effective April 27, 2001.
Act 243; HB 383
This Act increases the number of physician's assistants who may be licensed to an individual physician at any one time from two assistants to four assistants and provides that no physician may supervise more than two assistants at any one time except as provided.
The Act amends O.C.G.A. Section 43-34-103. Effective July 1, 2001.
Act 335; HB 736
This Act authorizes the Georgia Board of Private Detective and Security Agencies to enter into limited license recognition agreements with any other state or the District of Columbia having requirements substantially equal to Georgia's such that a person licensed in.such state may conduct an investigation in this state directly related to an investigation initiated outside the state for a period of 30 days.
The Act amends O.C.G.A. Section 43-38-6. Effective July 1, 2001.

TITLE44 PROPERTY
Act 354; SB 108
This Act provides that a cause of action shall not arise against property owners or real estate brokers or affiliated licensees thereof for failure to disclose in real estate transactions that certain property was the site of a person's death or that the property was occupied by a diseased person, requires truthful answers regarding such matters, and provides immunity for certain disclosures regarding such matters.
The Act amends O.C.G.A. Section 44-1-16. Effective July 1, 2001.
Act 220; HB 373
This Act increases the value of a debtor's interest in residential real property, motor vehicles, household goods and apparel, other property, tools, insurance cash value, and personal injury payments which are exempt for purposes of bankruptcy and intestate insolvent estates.
The Act amends O.C.G.A. Section 44-13-100. Effective July 1, 2001.
Act 266; HB 648
This Act provides that the advertisements of sales under power shall include recitals of certain conveyances and the names of the new owners after such conveyances and must include certain information in boldface type.
The Act amends O.C.G.A. Section 44-14-162. Effective July 1, 2001, and applicable to sales under power which are first advertised on or after that date.
TITLE45 PUBLIC OFFICERS AND EMPLOYEES
Act 197; HB 367
This Act, the "Corruption Prevention Act," authorizes suspension of an appointed member of a governing body of a local authority upon indictment of such a member for a felony offense and reinstatement in the case of a nolle prosequi, acquittal, or if a conviction is overturned. The Act provides for charging public officers with a misdemeanor offense for malpractice, misfeasance, or malfeasance in office or other misuse of public office and provides for removal from office upon conviction. The Act authorizes the grand jury to amend the indictment or instruct the district attorney to cause a new indictment to be drawn and provides for giving a copy of the amendment or new indictment to the accused public official. The Act extends to former peace officers charged with a crime which allegedly occurred during the performance of official duties the rights formerly accorded to present peace officers: notice of the contemplated indictment and the right to be present during the presentation of evidence to the grand jury and to make a sworn statement to the grand jury.

This Act deletes a provision setting out a specific salary for the state auditor and amends an existing provision to allow the Governor to recommend and the Legislative Services Committee to fix the compensation of the state auditor. The Act provides that the compensation of the state auditor shall remain unchanged until the first action of the Legislative Services Committee to fix it.
The Act amends O.C.G.A. Sections 45-7-4 and 50-6-20. Effective April 26, 2001.
Act 292, HB 303
This Act raises to $105.00 the daily expense allowance for members of any board, commission, or other body which by law receive the same daily expense allowance as members of the General Assembly.

This Act increases the maximum percentage of the net revenue collections of the fiscal year which may be reserved from the state surplus as the revenue shortfall reserve from 4 percent to 5 percent. The Act authorizes the director of the budget to direct the return of all or any part of the fourth or fifth percentile reserved to the general fund for appropriation.

This Act creates the Commission for the Celebration of 250 Years of Representative Government in Georgia to carry out plans recommended by the Committee for the Celebration of 250 Years of Representative Government in Georgia, coordinate appropriate observances, and recommend actions or legislation. Incentive compensation p_lans will authorize or direct one-time bonuses for employment, learning new skills, surpassing performance expectations, and incentive pay based on objectively measurable criteria. The Act also authorizes awarding certificates of merit, certificates acknowledging period of service, and pins, buttons, or other emblems. The Act indicates which incentive payments will be included for purposes of determining retirement benefits.

TITLE SO STATE GOVERNMENT
Act 1; HB 16
This Act changes the design of the state flag and makes it a misdemeanor to deface or prevent the visible display of a monument, plaque, marker, or memorial dedicated to past or present military personnel of the state, the United States, or the Confederate States of America. The Act also prohibits publicly owned monuments located on state property in honor of military persoMel, including the Stone Mountain memorial, from being relocated, removed, concealed, obscured, or altered. The Act further requires any agency that is eligible to receive appropriated state funds to display the new state flag. The Act makes technical changes in the description of the great seal of the state.
The Act amends 0.C.G.A. Sections 50-3-1 and 50-3-30 and enacts 0.C.G.A. Section 45-12-83.1.

This Act temporarily authorizes the Department of Administrative Services to use reverse auctions as an alternative to sealed bidding, to promulgate rules and regulations to govern such auctions, and to receive bids and proposals by way of the Internet or other electronic means. The Act increases from $2,500.00 to $5,000.00 the dollar limit for noncompetitive purchases.
The Act amends O.C.G.A. Sections 50-5-67 and 50-5-69. Effective July 1, 2001.

This Act increases the amount of certain dues to be paid by counties and municipalities to metropolitan area planning and development commissions and provides for future increases in such dues.

Act 378; HB 71
This Act authorizes the Georgia Development Authority to borrow money, from funds granted to the state by the administrator of the federal Environmental Protection Agency for purposes of financing water pollution control projects designed to mitigate pollution from agricultural operations. The Act further authorizes the Georgia Environmental Facilities Authority to receive all assets of the Georgia Development Authority held immediately prior to the creation of the Georgia Environmental Facilities Authority with certain exceptions and to administer the funds granted to the state by the administrator of the federal Environmental Protection Agency for the purpose of providing financial assistance for any eligible water pollution control project.
The Act amends O.C.G.A. Sections 50-10-5, 50-23-2, and 50-23-5. Effective July l, 2001.

This Act authorizes the Georgia Commission on the Holocaust to solicit and accept donations to enable it to carry out.its functions and purpose. The Act further prohibits the commission from paying any-member of the General Assembly any amount in excess of expenses.

This Act requires the state when engaging in certain development activities to minimize the loss of trees on the construction site and to provide for landscape plans to retain or replace trees on the development site.

Act 211; HB 695
This Act makes the State Financing and Investment Commission responsible for the proper application of an appropriation for capital outlay and for the proper disbursement of an appropriation to it for public school capital outlay. The Act makes the State Financing and Investment Commission and the State Board of F.ducation concurrently responsible for the proper application of an appropriation to the commission for public school capital outlay. The Act requires the construction division of the commission to perform grant administration services for state agencies and for local governments, instrumentalities of local governments, and other political subdivisions. The Act authorizes the commission to agree by contract or grant agreement with county and independent school systems that income earned during grant administration will be applied to the capital outlay purposes of the appropriation or, if there is no agreement, the interest on direct appropriations to the commission shall be deposited into the treasury.
The Act amends O.C.G.A. Sections 50-17-22 and 50-17-27. Effective July 1, 2001.
Act 250; SB 114
This Act repeals "The Georgia Government Documents Act." The Act repeals O.C.G.A. Sections 50-18-50 through 50-18-55. Effective July 1, 2001.
Act 189, SB 205
This Act provides that public disclosure shall not be required for certain personal information contained in public records with the exception that news media organizations may obtain access to social security numbers and day and month of birth for persons other than teachers and employees of a public school when gathering information in connection with a news report. The Act further provides that the prohibition against disclosure of certain personal information does not apply when the disclosure is sought for certain specified situations. The Act makes the obtaining of records and the knowing and willful disclosure or selling of such records to unauthorized persons for an unauthorized purpose a misdemeanor of a high and aggravated nature and authorizes any person injured as a result to bring a cause of action for invasion of privacy. The Act requires a custodian of public records who has good faith reason to believe a request for records has been made fraudulently to apply to the superior court for a protective order. The Act clarifies that it shall supplement but not supersede any other state or federal law or regulation requiring or prohibiting access to the personal information covered by the Act.
The Act amends O.C.G.A. Section 50-18-72. Effective July 1, 2001.

This Act authorizes a county, municipality, regional development center, or local authority that has created or maintains a geographic information system in electronic form to contract to distribute or sell records or information maintained in such system and to license or establish fees for providing such records or access to such system. The Act provides that any fees established shall be based upon the recovery of the actual development cost of creating or providing the system and upon the recovery of a reasonable portion of the costs associated with building and maintaining the system. The Act further provides that public entities that maintain geographic information systems may contract with a private person or corporation to provide the system's information to members of the public.
