We are pleased to transmit to you the "Summary of General Statutes Enacted at the 1978 Session of the General Assembly of Georgia." This represents one of the services whic'1 the Legislative Services committee and the Office of Legislative Counsel perform for the Legislative Branch of Government. Other services include bill drafting, research, statutory and code revision, rendering of opinions, counseling, legislative reference, interim committee staffing and preparation of reports.

The Office of Legislative Counsel drafted a total of 3,559 bills, resolutions and amendments for the 1978 session. Of
this number, 836 had been prepared by the convening date of the session, leaving a total of 2,723 which were drafted during the session.

Lieutenant Governor Zell Miller, the other members of the Committee and the Office of Legislative Counsel join me in the sincere hope that this booklet will be of benefit to those who it. If we may be of service, please feel free to call upon us.

FOREWORD
This booklet contains a summary of the general
statutes of Statewide application which were enacted at the regular 1978 Session of the General Assembly of Georgia. No resolutions, "population" Acts, or Acts with special application have been included.
It would be impractical to minutely analyze each statute because to do so would defeat the main purpose which it is hoped this booklet accomplishes. It is intended that it be used as a convenient reference for persons desiring to know which laws were enacted or desiring to ascertain the main features of an Act without the necessity of reading it in its entirety. It should be pointed out that for specific, detailed information on any particular law, the Act itself should be examined. A notation of the effective date is listed after each Act.
I would like to give special credit to Terry McKenzie, Deputy Legislative Counsel, for the preparation of this booklet. The many long hours involved in this project are evidence of his outstanding work and his meticulous attention to detail.
This summary is not to be deemed in any manner as an opinion from the Office of Legislative Counsel, and the question of constitutionality has not been considered in any respect. It is hoped that this booklet will benefit all who have occasion to use it and comment and suggestions for improvement are invited.

The page numbers showing where the Acts may be found in the bound volumes of the Georgia Laws are omitted from the summary this year. This allows the summary to be distributed approximately a month earlier. Inasmuch as the Acts are published in the Georgia Laws in numerical order, it will be relatively easy to find the desired Act by checking the Act number at the beginning of each listed Act. All the Acts contained in this summary should be found in Volume I of the 1978 Georgia Laws. Once the bound volumes are distributed, there will be no problem in finding a particular Act because those volumes contain a listing of the Acts in numerical order with the page numbers on which they may be found.

AGRICULTURE
Act 1217; H.B. 1687
Adds a new Code Section 65-213.1, so as to provide that all associations hereafter incorporated and organized pursuant to the Cooperative Marketing Act (Code Chapter 65-2) shall have perpetual duration unless a limited period of duration is provided for and stated in its charter or articles of incorporation or in an amendment thereto; provides for similar perpetual duration for associations in existence on the effective date of this Section. Effective April 3, 1978.
Act 1230; H.B. 1342
Amends the 1956 Act providing for the licensing and bonding of dealers in agricultural products, so as to provide that holders of food sales establishment licenses shall be exempt from such Act; changes the definition of the term "dealer in agricultural products". Effective July 1, 1978.
Act 1256; H.B. 1755
Amends the "Georgia Liming Materials Act of 1976' ', so as to change the definition of the term "agricultural liming materials"; changes the requirements for ground limestone; changes the requirements for labeling; changes the provisions relating to penalties. Effective January 1, 1979.
Act 1436; S. B. 619
Amends the 1956 Act providing for the regulation of sale of livestock at auction, so as to provide that persons regulated by the Federal Packers and Stockyards Act of 1921 , as amended, may make payment for livestock purchased at auction by placing in the mail a check on the day following the date of purchase; provides for the transfer of funds by wire. Effective July 1, 1978.
Act 1240; H. B. 1370
Amends the 1956 Act regulating the sale of livestock at auction, so as to change the definition of the term "special sale" to include any livestock sale, except a regular sale at an establishment and any sale by a farmer of livestock owned by the farmer, with payment made

directly to the farmer; changes the provisions relating to bonds; exempts certain associations from procuring a bond. Effective July 1, 1978.
Act 1397; S. B. 447
Amends the 1961 Act regulating the sale, inspection, importation and distribution of fluid milk and milk products for human consumption, so as to provide that the cost of inspections shall be fixed by the Commissioner at a cost not to exceed the actual cost of the inspection; removes the current limitation on inspection cost of $25.00 per inspector per day. Effective July 1, 1978.
Act 770; H.B. 1150
Amends the "Georgia Plant Food Act of 1970", so as to provide that the term "specialty fertilizer" also includes any commercial fertilizer distributed in packages containing 16 ounces or less and designed primarily for use on household plants grown for noncommercial purposes; changes provisions relating to deficiencies in water insoluble nitrogen; provides that specialty fertilizers distributed in packages containing 16 ounces or less and designed primarily for use on household plants grown for noncommercial purposes shall not be subject to the provisions relating to minimum plant nutrient content. Effective July 1, 1978.
ALCOHOLIC BEVERAGES
Act 1297; H. B. 1046
Amends the 1938 "Revenue Tax Act to Legalize and Control Alcoholic Beverages and Liquors", so as to authorize the State Revenue Commissioner to issue refunds or credits for distilled spirits excise tax stamps purchased by a manufacturer, distiller or wholesaler under certain conditions. Effective April 3, 1978.
Act 1219; H.B. 1302
Amends the 1935 Act providing for license and excise taxes upon the business of dealing in malt beverages, so as to provide that any motor

vehicle, watercraft or aircraft used in transporting nontaxed malt beverages in excess of five cases is declared to be contraband; provides for the sale of motor vehicles, watercraft and aircraft declared to be contraband. Effective April 3, 1978.
Act 1195; H.B. 1304
Authorizes the Commissioner of Revenue to license and regulate the sale of alcoholic beverages in bona fide private clubs in any county or municipality within the State; provides for referendums to determine whether the sale of alcoholic beverages in private clubs shall be permitted in accordance with the provisions of this Act. Effective March 27, 1978.
Act 1208; H. 8. 1639
Amends the 1938 "Revenue Tax Act to Legalize and Control Alcoholic Beverages and Liquors", so as to provide that no person, firm, corporation or organization shall be issued more than two retailer licenses, nor shall any person, firm, corporation or organization be permitted to have an interest in more than two retailer licenses, regardless of the degree of such interest. Effective April 3, 1978.
Act 1220; H.B. 1303
Amends the 1938 "Revenue Tax Act to Legalize and Control Alcoholic Beverages and Liquors", so as to change provisions relating to surety bonds; authorizes the storage of alcoholic beverages in federally licensed and regulated foreign trade zones; provides for distribution of alcoholic beverages from foreign trade zones to destinations outside the State; prohibits sale at retail of alcoholic beverages within foreign trade zones if otherwise prohibited by Georgia law; amends the 1935 Act providing for license and excise taxes upon the business of dealing in malt beverages, so as to define the terms "broker" and "importer"; provides that importers shall be licensed and bonded in the same manner as wholesale dealers. Effective April 3, 1978.

Amends the 1969 "Development Authorities Law", so as to redefine the term "project". Effective March 27, 1978.

Amends the 1945 Act creating the Georgia Ports Authority, so as to increase the maximum number of days for which the chairman and other members of the Authority may receive compensation. Effective April 3, 1978.
Act 1268; H. B. 1840
Amends the 1974 Act creating the Georgia Residential Finance Authority, so as to change from one-third to 40 percent the proportion of units financed by the agency which must be located in the standard metropolitan statistical areas of this State and the proportion which must be outside the standard metropolitan statistical areas of this State. Effective July 1, 1978.
Act 1270; H. B. 1874
Amends the 1974 Act creating the Georgia Residential Finance Authority, so as to change the composition of the Authority; provides for public members and their terms of office; changes the provisions relating to vacancies. Effective July 1, 1978.
Act 1390; S. B. 423
Amends Code Section 88-1805, so as to authorize hospital authorities to contract for the management and operation of projects by a profession~! hospital or medical facilities consultant or management firm; provides for bonds. Effective April 5, 1978.
Act 1406; S. B. 421
Adds a new Code Section 88-1804.1 , so as to provide a procedure for removal of members of hospital authorities under certain circumstances. Effective July 1, 1978.

Amends Code Section 88-1803, so as to provide for the filling of vacancies on boards of hospital authorities activated on or after March 15, 1964. Effective July 1, 1978.

Amends the 1972 Act providing that meetings of State departments, agencies, boards, bureaus, commissions or political subdivisions shall be open to the public, so as to provide that said Act shall apply to all State or local housing authorities. Effective July 1, 1978.
Act 1426; S. B. 564
Amends the 1950 "Jekyll Island-State Park Authority Act", so as to change the composition of the Authority; provides that the chairman shall be selected from among the members appointed by the Governor; provides for delineation of authority. Effective July 1, 1978.
Act 1404; S. B. 1416
Amends Code Section 92-3701 (20), so as to provide that county taxes may be levied and collected to provide financial assistance to joint county and municipal development authorities for the purpose of developing trade, commerce, industry and employment opportunities. Effective April 5, 1978.
Act 1405; S. B. 417
Amends the 1977 Act authorizing municipal corporations to levy and collect taxes to provide financial assistance to development authorities, so as to authorize municipal corporations to levy and collect municipal taxes to provide financial assistance to a joint county and municipal development authority for the purpose of developing trade, commerce, industry and employment opportunities. Effective April 5, 1978.

The "Private Colleges and Universities Facilities Authority Act" creates a Private Colleges and Universities Facilities Authority and authorizes the Authority to acquire, construct and equip self-liquidating projects consisting of educational facilities for lease or sale to private institutions of higher education. Effective April 4, 1978.
Act 1364; H.B. 1811
Adds a new Code Chapter 69-15a, the Resource Recovery Development Authorities Law. Effective April 5, 1978.
Act 1425; S. B. 563
Amends the 1958 "Stone Mountain Memorial Association Act", so as to change the composition of the Association; provides that the chairman shall be elected from among the members appointed by the Governor. Effective July 1, 1978.
BANKING AND FINANCE
Act 1440; H. B. 1483
Amends Code Section 13-203.1, so as to provide that a parent bank or branch bank located in a county, or in a municipality of such county, either of which owns, operates, or both, an airport located within such county or municipality, or partly within such county or municipality, may, subject to certain conditions, establish and operate a bank office or offices, or a bank facility or facilities, within the confines of the primary airport terminal facilities. Effective July 1, 1978.
Act 1331; H.B. 1509
Adds a new Code Chapter 41 A-27, so as to authorize certain banks domiciled outside this State to maintain representative offices in this State; adds a new Code Section 41 A-3312, so as to authorize certain international bank agencies to maintain representative offices in this State. Effective July 1, 1978.

Amends Code Section 13-203(c), so as to provide for the establishment of branch banks through merger, consolidation or sale of assets; repeals subsection (f) of Code Section 13-203.1. Effective April 3, 1978.
Act 1332; H.B. 1510
Amends Code Chapter 41 A-5, so as to change the title of such Code Chapter to "Permissive Closing Days, Emergency Closings, Business Restrictions and Voluntary Liquidations"; amends Code Section 41 A-501, so as to provide that financial institutions may close one day each week in addition to Sundays and other legal holidays; renumbers Code Sections 41 A-502 through 41A-506 as Code Sections 41A-504 through 41 A-508, respectively; adds a new Code Section 41 A-502, so as to authorize the Governor to proclaim financial emergencies and subject financial institutions to special regulations; adds a new Code Section 41 A-503, so as to provide for business restrictions during financial emergencies; repeals Code Sections 14-1809a, 14-1811 and14-1812. Effective July 1, 1978.
Act 1035; H. B. 1369
Amends the 1955 "Georgia Industrial Loan Act", so as to provide that there shall be no forfeiture of the principal amount of the loan contract if the lender shows by a preponderance of the evidence that the violation is a result of a bona fide clerical or typographical error; provides that a claim of violation of the Act may be asserted in an individual action only and may not be the subject of a class action; provides that, if a contract is made in good faith in conformity with an interpretation of this Act by the appellate courts of this State or in a rule or regulation officially promulgated by the Commissioner after public hearings, no provisions of Section 20 imposing any penalty shall apply. Effective March 14, 1978.
Act 1333; H.B. 1511
Amends Code Title 41 A, so as to authorize the Department of Banking and Finance to determine for purposes of Chapters 41A-4, 41A-7,

41 A-8 and 41 A-9 that persons or corporations conducting business as financial institutions without authority are financial institutions; changes the provisions relating to reservation of names; redefines the term "trust company"; authorizes building and loan associations and savings and loan associations to execute safe deposit agreements; changes the provisions relating to financing involving directors or officers; changes the provisions relating to publishing of notices of proposed mergers or consolidations; changet provisions relating to bonds for licensees engaged in the business of selling or issuing checks; changes certain penalty provisions. Effective July 1, 1978.
Act 1229; H.B. 1338
Amends the 1937 Act to classify property for taxation, so as to provide that international banking corporations and international bank agencies authorized to conduct business in this State under the provisions of Georgia law, and their assets, shall be exempt from the tax imposed by such Act. Effective April 3, 1978.
Act 1233; H.B. 1351
Amends the 1967 Retail Installment and Home Solicitation Sales Act, so as to further define the terms "retail seller" and "seller" to include a person selling services to a retail buyer. Effective July 1, 1978.
Act 1437; S. B. 622
Amends the 1937 "Revenue Bond Law", so as to provide that the cost of any undertaking may include an amount equal to not more than 15 percent of the total principal amount of a bond issued for the purpose of establishing a debt service reserve with respect to the principal and interest requirements on such bonds; provides for statements as to validation of bonds. Effective April 5, 1978.

Revises Code Chapter 109A-9 (Article 9 of the Uniform Commercial Code) relating to secured transactions, sales of accounts and chattel paper. Effective July 1, 1978.
CIVIL PROCEDURE
Act 1396; S. 8. 444
Amends the 1965 Act revising appellate and other posttrial procedure, so as to provide that no appeal shall be dismissed for failure to pay costs if costs are paid within 20 days (exclusive of Saturdays, Sundays and legal holidays) of receipt by the appellant of notice, mailed by registered or certified mail, of the amount of costs. Effective April 5, 1978.
Act 1489; H. 8. 1427
Adds a new Code Chapter 7-3, the "Georgia Arbitration Code for Construction Contracts"; provides for the enforcement of written agreements or contracts to submit controversies to arbitration; provides for practices and procedures; adds a new Code Chapter 7-4, relating to arbitration of medical malpractice claims, so as to provide that the parties of a medical malpractice claim may submit such claim for arbitration in accordance with the provisions of such Chapter; provides for practices and procedures. Effective July 1, 1978.
Act 1200; H. 8. 1579
Amends the 1964 "Georgia Administrative Procedure Act", so as to provide that in contested cases involving a license to practice dentistry, a reviewing court may order a stay only if it makes a finding that the public health, safety and welfare will not be harmed by the issuance of the stay. Effective April 3, 1978.

Act 1005; H. B. 543
Amends Code Section 61-302(a), relating to the service of the summons on a defendant in a dispossessory proceeding, so as to provide that when the affidavit shall be made, the judge of the superior court or such other court with jurisdiction over the subject matter, including the judge of any State court where the action arises or justice of the peace before whom it was made, shall grant and issue a summons to the sheriff or his deputy, or any lawful constable of the county where the land lies, a copy of which, together with a copy of the affidavit, shall be personally served upon the defendant; provides that if the sheriff is unable to serve the defendant personally, service may be had by delivering said summons and affidavit to any person sui juris residing on the premises or, after reasonable effort if no such person is found residing on the premises, by tacking a copy of said summons and affidavit on the door of the premises and on the same day of such tacking enclosing, directing, stamping and mailing by first class mail a copy of said summons and affidavit to the defendant at his last known address, if any, and making an entry of this action on the affidavit filed in said case; adds a new Code Section 61-413, so as to provide that for the purposes of Code Chapter 61-4, the terms "goods" and "property" shall include a tenant's mobile home. Effective March 14, 1978.
Act 1485; S. B. 512
Amends Code Section 105-106, so as to provide that no product liability action shall be commenced with respect to an injury after 10 years from the date of the first sale for use or consumption of the personal property causing or otherwise bringing about the injury. Effective July 1, 1978.
Act 1464; S. B. 511
Amends Code Section 105-1 06, so as to provide that it shall be an affirmative defense for a manufacturer in any action of product liability that the personal property causing the injury was substantially altered, other than normal wear or tear, after sale from its condition when sold and

such alteration was the proximate cause of the injury sustained. Effective July 1, 1978.
Act 1471; H.B. 1327
Amends Code Title 105, so as to provide that the manufacturer of any personal property sold as new property, either directly or indirectly through a dealer or any other person, shall be liable in tort, irrespective of privity, to any natural person or the successor of his cause of action as designated in Code Sections 105-1302, 105-1303, 105-1306, 105-1307 or 105-1309, who may use, consume or reasonably be affected by the property and who suffers death or injury to his person or property because the property when sold by the manufacturer was not merchantable and reasonably suited to the use intended and its condition when sold is the proximate cause of the death or injury sustained; changes the definition of the term "homicide" as used in Chapter 105-13, so as to include cases where the death results from defectively manufactured property whether or not the result of negligence. Effective April 10, 1978.
Act 1371; S. B. 139
Amends Code Sections 76-1 01 and 76-201 , so as to require that in cases of peace warrants and behavior bonds, such bonds shall be returnable in the State court rather than in the superior court in counties in which a State court is established. Effective July 1, 1978.

Act 1439; H. B. 1585
Amends the 1970 Act implementing the requirements of the "Federal Intergovernmental Cooperation Act of 1968", so as to change the provisions relative to the membership of area planning and development commissions; provides for exceptions. Effective July 1, 1978.

Amends Code Section 23-1704, so as to provide that contractors who are awarded contracts with counties shall be required to give bond for the total amount of the bid, rather than the current double amount of the bid. Effective July 1, 1978.
COURTS
Act 1082; S. B. 517
Adds one additional judge of the superior courts of the Alcovy Judicial Circuit. Effective March 16, 1978.
Act 810; H. B. 1845
Fixes the terms of the Superior Courts of the Brunswick Judicial Circuit. Effective July 1, 1978.
Act 1013; S. B. 285
Provides for one additional judge of the superior courts of the Cherokee Judicial Circuit. Effective March 14, 1978.
Act 1327; H.B. 1504
Amends the 1970 Act authorizing superior court clerks to invest certain funds deposited in the registry of the court, so as to authorize each clerk of the superior courts to deposit funds paid into the court registry, when it is not contemplated that the funds will be held longer than 30 days, in an interest-bearing account in a bank or other financial institution authorized to do business in this State. Effective April 3, 1978.
Act 1358; H.B. 1848
Amends Code Chapter 24-27, so as to authorize clerks of superior courts to record criminal cases on microfilm; changes the location of the provisions relating to fees for recording proceedings in all cases of habeas corpus, by deleting such fees from the enumeration of fees for criminal cases and adding such provision to the enumeration of fees to civil cases. Effective April 4, 1978.

Adds one additional judge of the superior courts of the Cobb Judicial Circuit. Effective January 1, 1979, except for the purpose of the election of the additional judge.
Act 1245; H.B. 1429
Amends the 1923 Act creating the Griffin Judicial Circuit, so as to change the times for holding court in said circuit; provides for the calling of cases for trial or announcement; provides for arraignment days in criminal cases; provides for terms at which grand juries shall meet. Effective April 3, 1978.
Act 977; H.B. 113
The "Georgia Justice Courts Training Council Act" creates a six member Georgia Justice Courts Training Council and requires justices of the peace to complete annual training in order to be certified; provides that only certified justices of the peace shall charge or collect any fees, charges or costs. Effective July 1, 1978.
Act 1007; H.B. 1568

Amends Code Section 26-1601, so as to provide that upon a second conviction for burglary occurring after the first conviction, a person shall be punished by imprisonment for not less than two nor more than 20 years; provides that, upon a third conviction after the first conviction, a person shall be punished by imprisonment for not less than five nor more than 20 years; provides that adjudication of guilt or imposition of sentence shall not be suspended, probated or withheld for any offense punishable under this subsection. Amends the "Georgia Public Assistance Act of 1965", so as to provide that it shall be a fraudulent device within the meaning of subsection (a) of Section 13 for any person to (1) knowingly use, alter or transfer food stamp coupons or authorizations to purchase food stamp coupons in any manner not authorized by law, or (2) knowingly possess food stamp coupons or authorizations to purchase food stamp coupons when he is not authorized by law to possess them, or (3) knowingly redeem food stamp coupons when he is not authorized by law to redeem them, or (4) knowingly redeem food stamp coupons for purposes not authorized by law. Effective July 1, 1978.

Amends Code Section 26-2703, so as to provide that a person commits commercial gambling when he intentionally conducts, advertises, operates, sets up or promotes a bingo game without having a valid license to operate said bingo game as provided by law. Effective March 9, 1978.

Amends Code Section 26-2713, so as to provide that nothing in Code Chapter 26-27, relating to gambling, shall apply to a coin-operated game or device designed and manufactured for bona fide amusement purposes only which may by application of skill entitle the player to replay the game or device at an additional cost if the game or device can react to no more than 15 free replays or can be discharged of accumulated free replays only by reactivating the game or device for one additional play for each accumulated free replay; prohibits giving money or anything of value for free replays. Effective July 1, 1978.

Amends Code Section 26-2904, so as to provide that in cases of persons applying for licenses to carry pistols, two sets of fingerprints of the applicant shall be taken; provides for a fee of $5.00 for the services of the law enforcement agency; extends the time limits contained in subsection (b) from 20 days to 50 days and from thirty to 60 days. Effective July 1, 1978.

Amends the "Georgia Public Assistance Act of 1965", so as to provide that any person who intentionally, with knowledge of the fraud, aids or abets any recipient of public assistance in obtaining or attempting to obtain any payment of public assistance to which the recipient is not entitled, or a payment in excess of that to which he is entitled, shall also be liable to the State for the amount of such payment. Amends the 1968 Act providing that persons accused of a crime who have not been previously convicted of a felony, with their consent, be placed on probation after a finding but before adjudication of guilt, so as to provide for the forwarding of records of discharge and exoneration to the Georgia Crime Information Center rather than the Office of the State Probation System and to the Identification Division of the Federal Bureau of Investigation; provides that, except as otherwise provided, a discharge of such act is not a conviction of a crime under the laws of this State and may not be used to disqualify a person in any application for employment or appointment to office in either the public or private sector; provides for the release of records of discharge. Effective July 1, 1978.

Amends the 1966 Act providing procedures for searches and seizures and for suppression of evidence illegally seized, so as to provide that upon application by the State or civil claimants, the court may, upon written notice to a defendant and a hearing when so requested by the defendant, order returned to the rightful owners any stolen, embezzled or other unlawfully obtained property, not constituting contraband; provides for admissibility of photographs or other identification or analysis of the property involved in lieu of the original property; provides for appointment of guardians ad litem; provides that statements made by the defendant or a person representing the defendant shall not be admissible for use against the defendant at trial. Amends the 1974 "Adequate Program for Education in Georgia Act", so as to provide that individuals who are 16 or 17 years of age and who have withdrawn from school prior to graduation for a period of four or more months shall be eligible to enroll into adult education programs if they receive written approval for such enrollment from the superintendent of the local school system or the superintendent's designee. Effective March 14, 1978.

Amends the 1974 "Adequate Program for Education in Georgia Act", so as to provide that the State Board of Education shall provide funds to local units of administration for the purpose of employing classroom aides and paraprofessionals to assist classroom teachers in the instruction of assigned students; provides for the duties, authority and requirements for such aides and paraprofessionals. Effective April 5, 1978.

Amends the 1974 "Adequate Program for Education in Georgia Act", so as to provide that, except where prohibited by federal law, rules or regulations, local units of administration shall be authorized to utilize personnel funded under Section 8 of such Act to administer and coordinate community education programs and activities as well as to execute their assigned duties and responsibilities related to adult education. Authorizes the Board of Regents of the University System of Georgia to grant scholarships to certain qualified students as are necessary for citizens and bona fide residents of the State of Georgia who would not otherwise have available the funds necessary to obtain an education; provides for exceptions and conditions for such scholarships. Effective January 1, 1979, only if an amendment to the Constitution completely revising Article X is ratified at the 1978 general election.
Act 1228; H.B. 1335
Amends Code Section 32-904, so as to increase the per diem of members of county boards of education from $20 per diem to $50 per diem in those counties in which there is no local Act providing for the compensation of members of the county boards of education; adds a new Code Section 32-942.1, so as to provide that county and independent school systems may use school buses to provide transportation for the elderly and the handicapped if the cost is reimbursed in full from federal, State, local or other funds, other than school funds. Effective July 1, 1978.

Amends the 1975 Act providing for a health insurance plan for public school employees, so as to provide that the terms "public school teacher", "teacher" and "employee" shall also include librarians and other personnel employed by regional and county libraries; provides that the term "local employer" includes regional and county libraries. (Section 1 granting insurance for retired public school teachers shall become effective on January 1, 1979, in the event a constitutional amendment is ratified at the November 1978 general election authorizing the General Assembly to provide for a health insurance plan for retired public school teachers. Section 2, deleting certain language, becomes effective on April 3, 1978.)

The "Higher Education Assistance Act for Senior Citizens" directs the Board of Regents of the University System of Georgia to establish a program for elderly citizens of this State to attend units of the University System of Georgia without payment of fees; provides for exceptions. Amends the 1973 Act authorizing boards of education to purchase liability insurance or contracts of indemnity, so as to provide that in addition to other compensation paid to board members, officers, officials, administrators and other employees, the State Board of Education, local boards of education or boards of control of cooperative educational service agencies are authorized to make payment for the amount of deductible identified in the liability policy; provides that such payments shall be made only with respect to certain Acts or omissions. Adds a new Code Section 34-605.1 , so as to provide that no person who holds elective public office, including every municipal office to which persons can be elected by vote of the electors, shall be eligible to serve as a member of a board of elections during the term of such elective office; provides that the position of any board of elections member shall be deemed vacant upon such members qualifying as a candidate for elective public office. Effective July 1, 1978.

Effective January 1, 1979, only in the event an amendment to Article II, Section 111, Paragraph Ill of the Constitution requiring write-in candidates in special elections to file notices of intention to candidacy is ratified at the 1978 general election.

Effective July 1, 1978.

Adds a new Code Section 88-310, so as to provide that in any case in which an application for an individual sewage disposal system permit is denied, it shall be the duty of the Department or the county board of health denying such permit to notify the applicant, in writing, of such denial; provides that such notice shall include a notification that the applicant should contact the county board of tax assessors for ad valorem tax purposes; requires consideration of the denial of such permit in determining the fair market value of the property for ad valorem tax purposes. The "Georgia Child Custody Intrastate Jurisdiction Act of 1978" provides that, except as otherwise provided, after a court has determined who is to be the legal custodian of a child, any complaint seeking to obtain a change of legal custody of such child shall be brought as a separate action in the county of residence of the legal custodian of the child; provides that the use of a complaint in the nature of habeas corpus seeking a change of child custody is prohibited; provides that a physical custodian shall not be allowed to maintain against the legal custodian any action for divorce, alimony, child custody, change of alimony, change of child custody, change of visitation rights or application for contempt of court so long as custody of the child is withheld from the legal custodian in violation of the custody order. Effective January 1, 1979.

Amends the 1946 Act regulating employment of children, so as to provide that such Act shall not apply to any minor employed as an actor or performer in motion pictures or theatrical productions, in radio or television productions, in any other performance, concert or entertainment, or to any minor employed in the making of phonographic records or as an advertising or photographic model, provided that the written consent of the Commissioner of Labor must be first obtained; provides that it is unlawful for any person to knowingly employ any minor to engage in any sexually explicit conduct for the purpose of producing any visual or printed medium depicting such conduct; provides for felony punishment; provides for investigations. Amends the "Municipal Home Rule Act of 1965", so as to prohibit the General Assembly from enacting an Act to annex an area larger than forty acres or having more than 50 residents to any municipality lying wholly or partially within any county of this State having a population in excess of 600,000 unless such local Act calls for a referendum to ratify or reject the annexation. Effective January 1, 1979, only if an amendment to the Constitution authorizing the General Assembly to provide for financing service in counties having a population of 600,000 or more is ratified at the 1978 general election.

Amends Code Section 69-318, so as to authorize municipalities to sell lots from any municipal cemetery, regardless of value, without advertisement and the acceptance of bids; authorizes municipalities to sell real property in established municipal industrial parks or in municipally designated industrial development areas for industrial development purposes without bids. Amends Code Chapter 45-3, so as to provide that licenses for hunting and fishing, except for nonresident big game licenses, may be sold in each county by persons approved by the Department to be either bonded license agents or cash license agents; provides that nonresident big game licenses shall only be issued or sold by the Department and shall not be issued or sold except at one location in the State to be designated by the Department; provides for applications by mail; changes provisions relating to the hunting and possessing of big game licenses. Effective July 1, 1978, but shall only become effective as to nonresident big game licenses sold or issued for hunting seasons beginning on or after July 1, 1979.

The "Coastal Management Act of 1978" creates a Georgia Coastal Management Board with the power to designate geographic areas of particular concern and, when necessary, recommend legislation for special management of such areas; prohibits local governments from unreasonably restricting or excluding uses of regional benefit from the coastal zone when such uses cannot be feasibly sited outside the coastal zone. Effective March 3, 1978.

The "Georgia Safe Dams Act of 1978" requires any person constructing or operating a dam to obtain a permit from the Director of the Environmental Division of the Department of Natural Resources; prohibits the removal of any dam for which a permit is required without the approval of the Director; provides for inspection of dams. Amends Code Title 45, so as to provide for resident sport bait shrimping licenses and nonresident sport bait sh rim ping licenses; provides that commercial fishing boat licenses shall be effective from April 1 to March 31 of the following year; requires commercial fishing boats taking shrimp to have certain fluorescent orange numerals and letters affixed thereto; provides requirements for the use of power-drawn nets by persons having a sport bait shrimping license and the location where the taking of such shrimp may be made; provides for bait dealer licenses for the taking of shrimp for live bait, the sale of live shrimp for live bait or the sale of shrimp for dead bait; provides for records for the taking of shrimp. Amends Code Chapter 67-7, so as to provide that in a proceeding for a writ of possession, if the person holding the security interest is not a resident of the county where the debtor resides or where the secured property may be found, any oath required by Section 67-702 may be made before a judge of any court of record within this State and forwarded, with the petition, to the appropriate judge, justice of the peace or clerk in the county where the debtor may reside or where the secured property may be found; provides that if the defendant fails to answer on or before the date of the hearing, the defendant may reopen the default as a matter of right by making an answer within seven days after the date of the default; amends the 1958 Act delimiting the effect of "open-end" clauses appearing in mortgages or deeds conveying realty as security for a debt, so as to provide that the term "original party" shall include any bank, trust company or other corporation into which the grantee of any such real estate mortgage or deed conveying realty as security for a debt shall be merged or consolidated. Amends the 1954 "Uniform Act Regulating Traffic on Highways", so as to change the amount of property damage necessary to requi re an immediate report of a motor vehicle accident from $25 to $250 or more; amends Code Section 68C-101 (b)(1 ), so as to change the definition of the term "accident" by increasing the amount of property damage from $100 to $250; amends Code Section 68C-301 (a), so as to increase the amount of injury or property damage under which a motor vehicle accident report must be made within 10 days to the Commissioner of Public Safety from $100 to $250. Effective July 1, 1978.

Adds a new Code Section 95A-1307, so as to provide for the licensing of airports which are open to the public by the Department of Transportation; provides for minimum standards for licensing; provides that after September 30, 1979, it shall be unlawful to own or operate an airport without a valid license. Amends the ''Georgia Civil Defense Act of 1951 ", so as to provide that any marine rescue squadron sponsored by and operating under the direction and control of the sheriff of the superior court of the county of residence of said squadron and chartered as a Marine Rescue Squadron of America which was so chartered on January 1, 1960, or prior to that date, and which performs only water or boat safety rescue missions within the State of Georgia, shall be deemed to be a governmental rescue organization and need not be licensed by the State Director of Civil Defense. Effective April 3, 1978.
