CHILD PROTECTIVE SERVICES INFORMATION SYSTEM

OVERVIEW
The Child Abuse Central Registry was established by law in 1990. Legislation passed in 1995 changed the name to the Child Protective Services Information System (CPSIS) and added a mandate requiring that alleged perpetrators of child abuse be notified of their due process rights prior to their names being placed in the Information System.
The purposes of this Information System, as defined by state statutes (OCGA 49-5-181, -182 and -183), and taking into account the 1995 revisions, are to:
(1) Receive all information regarding confirmed and unconfirmed cases of child abuse reported to the county departments of Family and Children Services.
(2) Allow child abuse investigators to identify and locate prior reports of child abuse.
(3) Maintain and produce aggregate statistical data of reported cases.
(4) Require that a person named as an alleged child abuser be mailed notice of this classification prior to the name being added to the Information System and be informed of the right to a hearing and the procedure for obtaining one.
(5) Provide for the Office of State Administrative Hearings to determine, based on acceptable evidence presented at an administrative hearing, whether there is sufficient credible evidence of abuse by the alleged maltreater to justify the investigator's classification of abuse as confirmed or unconfirmed.
(6) Entitle a person whose name already appears in the Information System to a hearing for an administrative determination on whether the name should be ordered removed.
(7) Provide an appeal process for people in both Numbers 4 and 5 above who are in disagreement with the decision of the Administrative Law Judge to request a review of the decision by the county Juvenile Court judge.
All 159 county Departments of Family and Children Services (DFCS) enter data onto the Information System, a process that began in July 1991. These collected data cover five types of maltreatment: neglect, physical abuse, sexual abuse, emotional abuse and other.
The Information System compiles data on:

(1) Information about the child alleged to have been abused.
(2) Information about the parents!caretakers of that child.
(3) Information about the alleged maltreater. (4) A classification of the incident(s).
Detailed information is collected about the family members and the type and location of abuse. The system also collects information on the number of reports that went to district attorneys and how many maltreaters are in active military service.
Because the CPSIS provides a common database for child maltreatment findings, it can alert abuse investigators to previous confirmed and unconfirmed reports made in Georgia (since July 1991), on named children and the parents!caretakers and/or maltreaters. In instances where names have been entered into the system more than once, only the most recent findings will be available.
A number of factors prevent the Information System from being a totally comprehensive database. For example, it includes few of the cases of child abuse that were reported to, and handled solely by, law enforcement. Also, when a case is classified as unconfirmed, the name of the alleged maltreater is removed from the Information System after two years. However, information on confirmed inciaents may remain in the System until the youngest child listed in the case is 23 years old.
CONFIDENTIALITY
Information about specific cases is confidential, and access is strictly limited by law (OCGA 49-5-185 and -186).
OCGA 49-5-185 (a) Except as otherwise provided in subsection (c) of
this Code section and subsection (b) of Code Section 49-5-186, only an abuse investigator, medical examiner, coroner, or out-of-state abuse investigator who has investigated, or is investigating, a case of possible child abuse shall be provided any information from the abuse registry and shall only be provided information relating to that case for purposes of using that information in such investigation. (b) The department shall provide the Governor's office, the General Assembly, district attorneys,

and law enforcement agencies with a statistical analysis of reported cases from the abuse registry at the end of each calendar year. This analysis shall not include the names of any children, parents, or people alleged to have committed child abuse. This analysis shall not be protected by any laws prohibiting the dissemination of confidential information. (c) A person may make a written request to any DFCS office to find out whether such person's name is included on the abuse registry. Upon presentation of a passport, military identification card, driver's license, or identification card authorized under Code Sections 40-5-100 through 405-104, the office receiving such request shall disclose to such person whether that person's name is included on the abuse registry and, if so, whether the report is classified as confirmed or unconfirmed, the date upon which the person's name was listed on the registry, and the county in which the investigation was conducted which resulted in such inclusion.
OCGA 49-5-186
(a) Information in the abuse registry shall be confidential and access thereto is prohibited except as provided in this article. Such information shall not be deemed to be a record of child abuse for purposes of Article 2 of this chapter.
(b) Information obtained from the abuse registry may not be made a part of any record which is open to the publ ic except that a district attorney may use in any court proceeding that information in the course of any criminal prosecution for any offense which constitutes or results from child abuse if such information is otherwise admissible.
(c) Any person who knowingly provides from the abuse registry any information to a person not authorized to be provided that information under this article shall be guilty of a misdemeanor.
(d) Any person who knowingly and under false pretense obtains or attempts to obtain information which was obtained from the abuse registry except as authorized in this article shall be guilty of a misdemeanor.
Only designated employees of the Division of Family and Children Services, law enforcement agencies or district attorneys are authorized access to the Child Protective Services Information System. A person wishing this access must fill out an application. The signed confidentiality agreement must be approved by the DFCS State Office.

HEARINGS FOR ALLEGED MALTREATERS

Effective July 1, 1995, legislation amending OCGA

49-5-181 and 182 requires that people who have

been reported for child mistreatment be notified and

given the opportunity to appeal prior to their name

being added to the Child Protective Services Informa-

tion System.

The DFCS office completing the investigation must

notify this person by letter of the case findings,

explain the right to a hearing before the Office of

State Administrative Hearings (OSAH) and instruct on

how to request a hearing. DFCS cannot place the

name of any alleged maltreater into the Information

System until all allowable time limitations for hearing

and appeal requests have been exhausted.

Because Georgia law does not recognize emotion-

al abuse as child abuse, many of the "withdrawns"

related to investigations where the only maltreatment

confirmed or unconfirmed was emotional abuse.

However, DFCS does investigate allegations of emo-

tional abuse, looking at risk factors for a child who is

in an emotionally abusive situation.

An OSAH decision determining whether a name

may be added to the Information System is based on

the credible evidence DFCS is allowed to present at

an administrative hearing. The evidence DFCS has is

not always acceptable, e.g. witnesses may not testify

to what a child has said if the child is not available

on the premises for cross-examination.

When an OSAH decision changes a DFCS determi-

nation of "confirmed" to "unconfirmed" or "unfound-

ed" and DFCS has reason to believe that a child is at

risk, the agency must then either convince the parent

or caretaker that a case needs to remain open for CPS

services or must petition Juvenile Court to protect the

child.

Names of maltreaters in confirmed cases remain in

the Information System until the youngest child listed

in the case is 23 years old. Names of maltreaters in

unconfirmed cases remain in the Information System

for two years.

DISPOSITION OF CASES
When DFCS receives a report, workers determine whether it meets the criteria for investigation: a child under age 18 alleged to have been abused or neglected by a parent or caretaker. In instances where the problems reported are not in the category of child maltreatment, DFCS makes referrals to other agencies such as the court system or mental health services. A copy of every report received must be given immediately to law enforcement.
If an investigation by a DFCS Child Protective Services (CPS) case manager finds that more than half of the evidence gathered indicates maltreatment (Le. that more than likely the child has been abused or neglected) the case is determined to be confirmed.
If an investigation shows some credible evidence that maltreatment occurred but not the required 50 percent (Le. the evidence does not weigh heavily in favor of a clear determination of maltreatment), the case is determined to be unconfirmed.
If no credible evidence of maltreatment is found, the case is determined to be unfounded (ruled out). Unfounded cases are entered into the Information System without identifying data. This information is gathered for statistical purposes only.

DEFINITIONS OF TERMS USED IN THIS REPORT
The information in this document will often address four sets of numbers: cases, reports, incidents and maltreaters.
A report count represents the number of allegations of abuse. Reports are made to DFCS by telephone, in writing or in person. One report may contain more than one alleged incident of maltreatment.
A case count represents the total number of families entered into the Information System. New
information is added any time a new investigation
is completed. A case may include several children and many incidents of maltreatment.
An incident count represents the number of maltreatment incidents that occurred to anyone child. For example, a child who was physically and emotionally abused accounts for two incidents of maltreatment in the Information System. The number of incidents in the Information System will be higher than the number of cases; it will equal or exceed the number of children.
A maltreater count represents the number of named maltreaters.
Following the determination as to whether maltreatment has occurred, DFCS decides whether a family needs services, and if so, what type. The case status categories, based on the above determinations, are: (1) Confirmed, Case Remains Open - The report is
substantiated based on the amount of credible evidence and the child needs further protection. (2) Confirmed, Case Closed - The report is substantiated based on the amount of credible evidence, but the incident is situational or caused by a third party perpetrator and the child is protected. (3) Unconfirmed, Case Remains Open - Although

there is some credible evidence, it is not enough to classify the case as confirmed. There is suspicion that maltreatment did occur and the family accepts DFCS services. (4) Unconfirmed, Case Closed - The report is unsubstantiated based on the amount of available credible evidence. There is suspicion that maltreatment occurred, but the incident is situational or caused by a third party perpetrator, the child is protected and/or the family is not willing to accept further intervention. (5) Unfounded, Case Closed - No credible evidence is found that maltreatment occurred. Of the 14,004 unconfirmed cases in 1997, 1,313 received CPS services. When an unconfirmed or unfounded case remains open, it means that a parent/caretaker admits there are problems that could result in future maltreatment of the children. The caseworker provides or arranges for help such as counseling, parenting skills training, referrals for substance abuse treatment or community worker services. These services are only provided when the family requests or accepts them.
