To Hon. N. E. Harris, Governor, and the Members of the General Assembly of Georgia.
Gentlemen : I have the honor to submit the following
report in connection with the operation of the Depart-
ment of Game and Fish for the past year.
The general conditions have shown improvement. A
large majority of the people respect and approve of the
laws for game and fish protection ; and the enforcement of these laws, as applied to those who do not willingly re-
spect them, is meeting with a large measure of success. Particularly is this true of that part of the law which prohibits the shooting of doves over baited fields. The wardens in quite a number of counties, complying with
my directions, have been specially diligent and active in
enforcing that part of the law, and as a result more than a hundred prosecutions on charges of violating Section
14 of the Game Law have resulted in convictions or pleas of guilty and the imposition of fines. And in each county
where such results have been obtained, the shooting of doves illegally has ceased.
The most difficult work of this department is in the
enforcement of the laws for the protection of fish. And in order that the law abiding citizens of Georgia may
have the benefit of these laws, and also those for the protection of game, it will be necessary to make some amendments to these laws and to provide better compensation for the county and deputy wardens. Under the present conditions, the pay to these of-
ficers is so small that it is difficult to obtain the
services of men who will devote any considerable

portion of their time to this work, nor can any other result be reasonably expected. The county wardens receive a commission on the sale of hunting licenses, and a part
of the fines imposed for the violations of the Game and Fish Laws in their counties. The deputy wardens re-
ceive as compensation only a portion of the fines imposed, in cases which they have been the cause of bringing about the conviction of the persons violating the law: and in a number of such cases the judges have imposed fines of no greater amount than to cover the court costs,
thereby leaving nothing to pay to the deputy wardens who have made the cases and furnished the evidence on which the convictions were obtained. But notwithstanding these drawbacks, a considerable number of the county wrardens and deputy wardens now in office are giving the
department active and faithful service, and the results of that activity are making conditions better in each county where the department is so fortunate as to have
as its officers men who show an interest in, and actually endeavor to enforce the laws for game and fish protection.
The work of this department being of recent establishment and the laws providing therefor, to a degree
experimental, naturally the experience acquired has led
to a better knowledge of the needs of game and fish protection, and of the necessity for some changes in our laws which should be made to give the people of Georgia the
best results in connection with this work, and to that end
I shall ask the Legislature to make some amendments to
both the Game and Fish Laws. It is my judgment that
the following amendments, if adopted by the Legislature,
will materially aid in the enforcement of game and fish
protection
The exemption of requiring persons to purchase licenses for hunting in the militia district in which they live has proved one of the greatest obstacles in the enforce-
ment of the Game Protection Law. Many persons take
advantage of this exemption, and also of the fact that comparatively few people know the location of the district lines, and the consequent difficulty of proving in court that a person lias hunted outside of the district in which

lie lives, without a license. Two good results would be
obtained from the striking out of this portion of the law. In the first place the revenue to the county wardens would be greater, which is a necessity for better enforcement of the law, not only through the increased sales of county li-
censes, but in making this change, it is also my recom-
mendation that the fees to the county wardens on. the sale of county licenses be increased from twenty-five cents (25c ) to fifty cents (50c), on each county license sold.
An additional benefit would arise in the protection of
game by the adoption of this amendment, as it would decrease the number of hunters among the negro population
who, under the present conditions, confine themselves almost entirely to hunting, as they claim, within the militia district in which they live. I also recommend that the same section be amended by adding after the word
"person," in line 22, the following: "and his wife and
children," so that the present defect in the law, which
does not provide that the family of a land owner may hunt on the owner's land without a license, may be remedied, and that a man's wife and children may have the
privilege of hunting on his land without purchasing a
license.
The present law states that the license season shall terminate on February 20th. This is clearly a mistake, as in another part of the same section it says that a per-
son purchasing a license prior to the opening of the season, or during the open season, shall have the privi-
lege of shooting game during the following, or then open season, and as the open season on quail and most of the other game birds in this State extends to March 1, the
license season should cover the period of that open season. However, I further suggest that the open season for
snipe shooting be made to end on the last day of March instead of the last day of April, and also that (he open season for shooting woodcock be extended to the last day of March, and as that date would then be the extreme limit of the open season on any of the game birds men-
tioned in this Act, I suggest thai the license season be extended to cover the period including flic last day of March,

instead of on the twentieth day of February as the law
now provides.
My reason for asking that the open season on woodcock be extended, is that I am convinced that they being
purely migratory birds, no shortening of the open season for shooting them in Georgia will in any degree increase
the quantity of those birds in this State. It is true that
occasionally we find a woodcock's nest in Georgia, and
a few young woodcocks, but I am quite sure that the
woodcocks who make nests in Georgia are birds which have been slightly injured or through some unusual
cause have been left behind in the regular flight of the woodcocks, and being separated from the regular flight have domiciled themselves temporarily here instead of proceeding to their natural nesting grounds further north. But the number of such woodcocks, so nesting in Georgia, is so small, that the absolute protection of woodcocks in
this State for a number of years would not in my opinion
cause any decided increase in that species of game birds. And consequently, I think it right and proper that the
sportsmen of Georgia be allowed to shoot these birds
whenever they appear during the season from November
twentieth to the last day of March. It is also my
belief, that the open season for snipe should be
changed, and commence on November twentieth and continue until the last day of March following.
It is rare that the sportsmen of this State have an opportunity to shoot snipe, and the same conditions apply to snipe as to woodcock. They are purely migratory
birds, and we rarely have an opportunity of shooting any
on the southward flight, but the best snipe shooting is in the latter part of February and March. So that in order
that the citizens of Georgia may have any snipe shooting,
it will be necessary that the open season for snipe shooting continue until the last day of March. I do not believe it is worth while to have the snipe shooting continue un-
til the last of April, as the law now provides, but that it
will be best to have the end of the open season on the last day of March for both snipe and woodcock, and at the same time for the license season to close.

I have had more requests asking that I recommend a change in the open season for shooting squirrels than on any other proposition regarding the changing of the dates for the open season. The original Act creating this department provided that the open season for shootinggray squirrels begin with October 1st and close on January 1st. The following year the Legislature amended the law and made the open season for squirrel shooting
begin on August 1st. But many reports have come to me
that the shooting of squirrels in August and September brings about not only the death of those which are shot,
but that in a majority of the cases the female squirrels
killed then have young in their nests; and when these mother squirrels are killed, the little one perish for the lack of food, and through this condition a greater destruction of squirrels takes place in August and September than at any other season of the year. So I believe it
will be best to set back the date for the opening of the
squirrel shooting season at least to the original date Oc-
tober 1st, and better still if the General Assembly wishes the best results in game protection, it will be best if the open season for shooting squirrels and practically all other kinds of game, except deer, be coincident with the opening of the quail shooting season. In addition to the loss of the young squirels above mentioned, persons' who do not respect this law take advantage of
the fact that they may obtain licenses and ostensibly be hunting squirrels in August and September, but in many
cases it is known that these supposed squirrel hunters go into the swamps and in many instances destroy entire broods of young wild turkeys, and the protection of wild turkeys at that season of the year is more important than at any other period. And if the Legislature in its wisdom
sees fit to set back the open season for shooting squirrels
as late as November 20th, it will be accomplishing the protection of wild turkey, quail and all other game, as well as the protection of squirrels in as much as there will then be practically no open season on any game in the
greater portion of the State which could be taken as an

excuse for being in the fields and woods with guns and dogs until the twentieth of November.
The penalty for shooting doves over baited fields by an amendment in 1912 was changed from a specific fine to the penalty imposed as for a misdemeanor. The department finds that the change in that clause has not worked advantageously for the enforcement of the laws for protecting doves in as much as in some instances the officers of the courts have under Section 1095 imposed fines to an amount only sufficient to cover the court costs, and in so doing have debarred the county wardens or the deputy wardens, who have in the performance of their
duties obtained the evidence to bring about the conviction
of persons violating this law, from any part of the pay which they are expected to receive for such work, through the participation in the fines imposed as provided in the
General Game Law. It is my impression that this change
was made at the suggestion of the former commissioner
with the idea that the shooting of doves over baited fields would be considered by the judiciary of this State so grave an offense that they would take advantage of the penalty provided by Section 1095 of the Code and impose fines of larger amounts than those provided for by Sec-
tion 12 of the General Game Law. But the department
lias not found that such a result has followed the adop-
tion of the amendment, and it is my judgment that it will be best for the enforcement of the Game Law that this
amendment be repealed and the same penalty imposed
for si looting doves over baited fields as is provided for in Section 12 of the General Act.
I am quite sure that no one will doubt the advisability of providing for the propagation of game in connection with the work of this department. Provision for the propagation of game birds and animals was omitted from the General Bill when enacted in 1911, but it should now
be added to the work of this department, and even though the department itself should not find it advantageous to undertake the propagation and raising of game to any
large extent for distribution in the State, it should at. least have the authority to issue permits to individuals

or associations, which may wish to engage in the raising and distribution of game birds and animals in Georgia, for the taking and transportation of game birds and ani-
mals from one section of the State to another, and from other States into Georgia. Under the present conditions there is no provision for the transportation of any game
birds or game animals for this purpose by any common
carrier, and the effect of this is to retard and discourage all movements in Georgia for the raising and distribution
of game for the purpose of propagation and the increasing
thereof.
It has come to the knowledge of the Commissioner that Black Beard Island, on the coast of this State, in Mcintosh County, which comprises an area of 9,000 acres of upland and probably an equal area of marsh land, now the property of the United States Government, is not now being utilized for any practical purpose, and it
is in my opinion more than likely that if a proper effort is
made by the people of Georgia or their representatives,
that the use of this island, and, possibly at a later date,
the ownership thereof can be secured for the State of Georgia, and if such purpose be accomplished, the island
can be made of practical use by the Department of Game
and Fish for the raising of deer and wild turkeys, and possibly other species of game. At small expense the entire island can be absolutely protected and in the course of a few years, can be made to supply large numbers of deer and wild turkey for distribution in other sections of the State, and at the same time afford protection and a harbor of refuge for migratory wild fowl, and other birds on their flights along the coast of this State, all of which would be very beneficial to the purpose for which this department is using its resources.
The most destructive and vicious act of violators of
the laws for the protection of fish is that of dynamiting. It is without any phase of sportsmanship and not only kills the fish which the lawbreakers are seeking, but all the fish, large and small, within the reach of the force
of the explosion.
At present this crime is punished as a misdemeanor,

and unfortunately where we have succeeded in obtaining
convictions for this villainous practice, in a majority of
such cases, the fines have been made very light, and to
such a degree that the punishment has not deterred persons from continuing to commit other violations of the same sort. I recommend that Section 604 of the Criminal Code be amended and that where any person is convicted of the use of dynamite for the purpose of killing fish in any of the waters in Georgia, that he be guilty of a misdemeanor and shall be fined not less than fifty dollars and all legal costs, nor more than five hundred dollars and all legal costs, or to serve on the chaingang not
less than thirty days nor more than six months, as may
be ordered in the discretion of the judge.
The smaller sales of hunting license for the last season as compared with those of 1913-14 is easily accounted for because of the great disturbance in business and financial conditions, brought on by the European war which commenced in August, 1914, and at once produced a stringency in finances, and to a more marked degree in Georgia because of the disastrous effect on the price of cotton,
our principal money-producing asset. This caused many persons who had before been accustomed to indulging in
hunting to forego that pleasure, not only because of the expense of the hunting license, but the additional cost of ammunition, traveling and hotel bills, all of which amount-
ed to quite a sum to the hunters, residents of cities, who in a large majority of cases have to travel some
distance to find attractive hunting grounds.
The saving in the expenses of the department has been obtained by practical economy and not by any attemx)t to curtail the efficiency of its work. But on the contrary, a larger amount by $1,115.93 has been expended, under the clause known as "Special directions," in the payment of county and deputy wardens when employed in special
work under the direction of the Commissioner. And I am sure that the results of that work are among the chief factors in bringing about the better protection of game
and fish. I have given special attention to the enforcement of

the laws pertaining to shad fishing during the past sea-
son, and as a result, more shad have gone higher up the streams of this State than in a number of years past ; and
as it is the habit of shad as well as other migratory fish to return in succeeding years to the places where
the spawn was hatched, we may expect a larger and in-
creasing numbers of shad in the interior waters of the State in the future, provided the practical enforcement
of these laws is continued.
In my previous report June 30, 1914, mention was made
of the lack of protection to the oyster beds of Georgia and the consequent depletion of same. During the past win-
ter and spring I have devoted much time to obtaining in-
formation about the oyster beds and of the legislation needed to bring about a revival of the oyster interest on
the Georgia coast. My efforts in this matter brought
about a meeting of the citizens of the coast counties at
Brunswick on May 25th to consider and perfect plans for
the betterment of the oyster, shrimp and other sea food interests; and a report on this subject with recommendations for amendments to the laws bearing thereon will be submitted by the committee appointed at the Brunswick meeting.
