To His Excellency, Governor John M. Slaton, and Members
of the General Assembly of Georgia:

I have the honor to make the following report of the opera-

tions of the Department of Game and Fish of the State of

Georgia for the period beginning November 1, 1913, and ending

June 30, 1914.

The results show that the observance of the laws for the pro-

tection of Game and Fish is becoming more general and that

the people of Georgia appreciate the benefits arising from the

work of this Department to a greater degree each year.

The provisions of the game law are more fully observed

Why than those for the protection of fish.

this is true I do not

know, but it is my opinion that those sections of the Code for

the protection of fish having existed for some years before the

establishment of a department for the active enforcement of

these laws, they did not become effective for the lack of active en-

forcement and on this account a feeling of indifference and

disregard of the fish laws arose in the minds of the people. On

the other hand, the establishment of this department, coincident

with the enactment of the laws for the protection of game, and

the immediate starting of the work of game protection having

brought that feature prominently to the attention of the

people, the results have been good and are, as before stated, im-

proving each succeeding year.

There are some changes which the Legislature should make

in these laws and which I will ask be made. Those in the
Game Law are of minor degree and are mainly to make the

meaning more direct and lucid and, in a few instances, to

remove contradictions. On the other hand, the practical pro-

tection of fish require some more radical changes.

I will suggest the following changes in the Game Law:

In Section 6, by striking out the wTord "first" in line 20

and inserting in lieu thereof the word "fifth." This to be

done in order that at the end of each month the County War-

dens may have reasonable time to make up monthly reports and

forward same to this office. Also by adding in line 21, after

the word "person," the words, "his wife and children." Also

by striking out the word "twentieth" in line 26 and in lieu

thereof inserting the word "last." These changes are sug-
gested because it is, in my opinion, right and proper that a

land owner's wife and children should have the legal right to
hunt on the lands of the husband and father, with his permis-
sion, without a license, which the law does not at present provide.
The substitution of the last day of February in line 26 for the
twentieth day should be made because in the same section it is
provided: "All licenses shall bear the date of issuance and, if
issued in the open season, shall authorize the person named there-
in to hunt during the next succeeding open season." Now, since
the open season on most of our game continues from November 20th to March 1st next, the licenses should continue of force
entirely through February.
Amend Section 14 by inserting in line 7, after the word " gobblers," the word "woodcock." By striking out "woodcock" in line 8. By striking out the word "May" in line 8
and inserting in lieu thereof the word "April." It has hereto-
fore been my opinion that a very short open season for wood-
cock would eventually promote an increase of these fine game
birds in our State, but having studied this subject carefully, I
now think, these birds being practically all migratory and
their flights irregular, the people of Georgia should be allowed
to shoot these birds as they do other migratory birds, during
the open season provided for quail.
A majority of the County "Wardens report that one of the
chief difficulties in enforcing the law is the provision allowing
persons to hunt in the militia district in which they live without
a license, the difficulty arising because of lack of definite in-
formation regarding the location of district lines. Inasmuch as a county license costs only $1, I think that it will( be well to require the purchase of such a license by any person who hunts in the county of his residence, except when hunting on his own land.
The exception in Section 18, which allows persons following hounds to pursue foxes or deer, or any other animals not mentioned in this act, should be changed and such exception should apply only to foxes and deer, as was originally intended.
This department is more than self-sustaining, and now that
this condition is proven, I believe that the scope of the depart-
ment's work should be enlarged and attention given to the propagation of game and fish, as well as to their protection. During the period before the protection of game and fish was made effective by the establishment of this department, the widespread destruction of game practically wiped it out in some sections of Georgia and there was not left in some localities enough to start a new supply. Such localities should be restocked, and the Commissioner given authority to permit the capturing and transportation of game for such purposes. This the law at present does not provide for. The same conditions exist regardmg fish.

My attention has been directed several times to the oyster
interests of the State and much stress has been laid on the large financial returns which might be obtained for the State by
the rigid patrolling of the State's public oyster beds. I have
made a fairly extensive investigation of this subject and have

reached the following conclusions:

The State's oyster beds have all been practically stripped of oysters by the continuous gathering of oysters from them for
many years past, which has been done without regard to any

restrictions prescribed by the laws for the protection of these

beds, until the establishment of this department. It is true

that there are provisions in our laws for the leasing of the State 's oyster beds to private persons, but the conditions, as above stated, are so lacking in promise of profit that very few leases

have been made and the returns to the office of the ComptrollerGeneral show that $65.00 is the total revenue which has come to

the State for such leases, and for the past three years no

revenue at all has come from this source to the State.

I have endeavored several times to arouse a spirit of active

interest among the people of the Coast counties of the State in

this matter, so that, with their co-operation, some plan might
be devised to develop and make available this now dormant interest of the State. But I must say, so far this movement has

met with no encouragement.

The oyster industry in Georgia is entirely carried on by

private parties, and they seem satisfied with the present con-

ditions, and prefer to patrol and protect their own oyster beds,

rather than be called on to pay a license tax on the products

of their business and depend on protection from the State.

Several of the States, including Virginia and South Carolina,

impose a license tax on the oyster industry, and in return un-

dertake to protect the oyster properties. In this way those

departments have an income which can be legitimately and

properly used for the promotion of the oyster interest.

At present there is no revenue accruing to the State from

the oyster industry, and has been none, except for the small

amount above mentioned, and there is not likely to be any from

the leases of oyster beds, owing to their present depleted state,

my until conditions are changed. It is

suggestion that the

Georgia law be changed so as to provide a license tax on the

products and the carrying on of the oyster industry, so that
revenue may be provided for the protection of the oyster beds,

both public and private, and thereby ultimately make valuable

the State's interest.

In this connection, I also wish to recommend a change in

the law which will provide specific penalties for the violations

of the fish and oyster laws and a distribution of the fines im-

posed, so that the officers of this department, or others, produc-

ing evidence causing convictions in these cases may participate
in these fines, as is provided in Section 5 of the Act of August
21st, 1911. Should this be done, this department could handle
this work on its own merits, and not be expected to use the fund
arising from the sale of hunting licenses, which, in my judg-
ment, should be devoted entirely to the protection and propagation of game birds and animals.
While on this subject, I wish to call your attention to the ineffectiveness of the laws providing for punishment of violators of the fish laws, particularly the horrible and outrageous practice of dynamiting and poisoning the waters of the State.
In such cases I believe there should be a minimum fine of $100 or work on the chain gang of not less than ninety days. At present the penalty is as for a misdemeanor and, in the discretion of the trial judge, can be, and usually is, made no
more than five or ten dollars, which merely amounts to a small license to commit a most destructive and inexcusable crime.
As to the matter of making changes in the personnel of the
County "Wardens, my only incentive has been to place in office
men who would be more active and attentive to their duties
than those in office, and I believe that such a result has been obtained in each instance where a change has been made. Wherever I have found in office a County Warden, or a Deputy Warden, who was giving the department proper service, it
has been a pleasure to me to have them remain in this service, and I am pleased to say that I have found many who are giving"
such satisfactory service.
In reverting to the finances of the department, on my taking
over this office, on November 1, 1913, I was given by the former Commissioner a memorandum showing unpaid accounts due the department by County Wardens amounting to $1,374.57. Of this amount, I have secured payments amounting to $781.74 cash and an accounting for licenses which had not been returned at the close of the season to the amount og $559.75, so that the amount shown on the memorandum has been reduced to $33.08. I doubt if this amount can be collected, as some of it is due by former wardens, who were not under bond. The indebtedness to the department for the season 1913-14 is $125.75, all of
which is owing by wardens who were not of my appointment
and who are no longer wardens and whose accounts are in the hands of the Solicitors-General for suit and prosecution for re-
taining funds belonging to the State.
As a part of the equipment of the department, I found in the ante-room of this office an aquarium, which necessarily, to perform its purpose of showing live fish and terrapin, had to be kept supplied with running water. Unfortunately, after repeated attempts to keep the water pipes in order, the damage from water leaking and running down on the records of the

Supreme Court became so serious that it was decided best to discontinue the use of this aquarium in the Capitol Building and, in order that the citizens might still derive some entertainment and information from the investment, it was, with the approval of the Governor, loaned to the Park Department
of this city.
With this report is submitted a sheet showing the income and disbursements of the department from June 10, 1913, to June 30, 1914. Also the receipts and expenditures of previous years, as shown by the auditor's reports. The period from June 10, 1913, to November 1, 1914, four months and twenty days, was under the administration of former Commissioner, Mr. J. B. Mercer, and the latter period, from November 1 to June 30, in-
clusive, while I have been commissioner. I am taking June
30 as the ending of the fiscal year, as that is the date used by
many public departments.
The revenues of the department have shown a decided increase during the season, the sale of licenses of all kinds being greater, showing a more general disposition to comply with the law, as well as indicating more attractive conditions for
hunting.
It has been my purpose to give the people of Georgia a prac-
tical and economical administration of the work of this department, as far as diligent and careful attention to its affairs would produce such a result, and I believe that an inspection of the financial report will show this.
