AFDC PEACH Sanctions

PURPOSE
The purpose of this transmittal is to revise Section 1063, Procedures To Impose AFDC PEACH Sanctions.
DISCUSSION
The AFDC procedures to remove a PEACH sanction have been strengthened so as to require some action or activity on the part of the sanctioned individual before s/he can be added back to the AU. Current procedures only require the individual to sign Form 4, PEACH Referral Form and express a willingness to participate in order to remove the sanction. The revised policy states that an individual may not be added back to an AU until the PEACH case manager notifies the eligibility worker that the individual has met his/her PEACH requirements.
IMPLEMENTATION
This material is effective upon receipt.
INSTRUCTIONS FOR MANUAL MAINTENANCE
Remove Section 1063 in its entirety and replace with the revised Section 1063.
Insert Form 493, PEACH Compliance Form, and the accompanying instructions in Section 2800.

Make proper notation on the Record of Receipt of Manual Transmittals.

1063 - PROCEDURES TO IMPOSE AFDC PEACH SANCfIONS
Length of Sanctions Impose the AFDC PEACH sanction for the following time periods:
First failure to comply - the sanction lasts until the individual complies or becomes exempt.
NOTE: If the individual complies during the adverse action period, do not impose the sanction. However, it is still considered the "first failure to comply".
Second failure to comply - the sanction lasts until the individual complies, becomes exempt or for three months, whichever is longer.
Third or any subsequent failure to comply - the sanction lasts until the individual complies, becomes exempt or for six months, whichever is longer.
Notification For the first sanction, send a notice after three months into the Requirements sanction period explaining that the AU member can comply at
anytime in order to remove the sanction.
For the second, third or subsequent sanction, send a notice after the sanction period ends explaining that the AU member can comply at anytime in order to remove the sanction.
NOTE: To comply, the participant must successfully participate in an assigned PEACH activity for a period not to exceed 2 weeks. The PEACH activity is determined by the PEACH case manager (CM).
